wow.. I called DoS and immediately got a visa specialist. She talked so fast I didn't catch her name. No interview scheduled yet,but she was the first one to tell me "You can call back tomorrow"

That's awesome! I had a couple last week encourage me to call often. Then yesterday, Anna decided to get snippy. Sigh. Seems even with DoS, it's the luck of the draw on whether or not you talk to a nice op.

But what if there is something wrong and then you can't get RFE. You have to wait till after the interview? If I have everything ready, it should be quick right? I am sure getting a quicker interview date would be better but it adds one more thing to worry about at the interview. I am so nervous already.

DON'T scare me any more than I already am about this gong show process!!! Lol! I have documents to back up most pieces that I figured I might need - and I may go get two more documents that will be absolutely everything covered (NVC told me I didn't need them, but peace of mind is key). I'm still worried, and still concerned that my file's in the ocean instead of in Montreal. So in truth, there are pros and cons to either side.

Well Kerry and Carl has the same NOA2 date as me and had the case arrive at NVC yesterday. Sugarz has NOA2 few days before me and had the case arrive yesterday. so I assume mine should be there by tomorrow or so.

I have everything ready to go so I don't know how much help an expediate is going to be. Does an expediate mean that you don't submit the forms now but later during the interview?

By all rights, yours should be there. I would hope they'd have record of it by tomorrow, yes. That's the hope anyway...And what I'm learning about the expedite means that apparently all forms either go to the embassy before the interview, or else they'll ask for it at the interview. I was able to submit my DS-260, but on my forms page it says that payment is "not applicable" even though it's clearly unpaid. Once I submitted the DS-260, the status changed to "On File at Post", which tells me that I think everything just goes to Montreal from here on in. Theoretically it's supposed to be faster, but we'll see!

I am trying to determine on what grounds. I mean NVC has said that they have not received it. They askd me after the 15 business days were up to send the approval notice to them and then they replied within a day to let me know that they will contact USCIS. While contacting USCIS, they said that it takes up to 90 days to send the case and on the approval notice itself it says allow 60 days for the NVC to receive your case. So I guess everything is still under normal processing times. I would love to say that someone has made an error but right now, I have no idea who or what the error was. So what do I write?

Ugh. Well, on one hand - at least they're contacting USCIS. My thoughts are, sit tight. Every time they contact you, every time you get mail - keep it. Start a file, with EVERYTHING they do. Sounding like they're lining up to make an error (which isn't surprising lately), but you're right - technically at this point there's no "error" (although your case being in a black hole sounds like it could be a good one).

I'd also like to add - if you know of anyone else with an identical NOA2 date, you may then be eligible based on NVC error. Get in touch with your spouse's congressman. Let them know it seems NVC misplaced your file and you need help.

Ok so I filed the DS-260 last week and the lawyer sent the rest of the documents and I got this letter this morning

Dear Sir/Madam:

All documentation necessary to complete the National Visa Center's processing of your case has been received. As soon as an interview date has been scheduled, the applicant, petitioner and attorney (if applicable) will be notified.
The applicant should NOT make any travel arrangements, sell property, or give up employment until the US Embassy or Consulate General has issued a visa.
The US Embassy or Consulate General may require additional documentation at the time of the interview.

Do I just wait now?

Sure, I wouldn't mind the expediate. But on what basis?

Well, what I used was "NVC error." I sent a strongly worded letter, along with the documentation that I could gather (my passport, my marriage certificate, the original page from the I-130 with the CORRECT information, correspondence between NVC and the congressman where they actually communicated the errors to the congressman). I indicated that, had I not found the error myself - I'd still be waiting. I also indicated that every time I phoned, NVC indicated there was no error and they could not understand why my invoices weren't generating. I ALSO indicated that people who received case numbers/NOA2s on the same day as me had their cases complete and mine was still stalled - and the only way I got movement was by throwing papers at NVC until something stuck, and I was on my own to find the problem. I sent my request to Supervisor Sue, and copied our congressman as well as Travis. I'd also like to note - I got the expedite and I'm the alien non-resident spouse (I've also been the main one talking to Congress and they've been busting their butts to help - he and his family have only now started to get mad at Congress too, which is really helping). So...how can I best help you? I'd love to try - you CERTAINLY deserve it and have grounds for it!

I am honored to join VJ crowed. Just wanted to also put my piece of information. I am in the same boat with everyone else who are waiting for the IV bill to be generated. I called them on number of occasions and they told me that it should be up sometime before Friday. My husband also received an email from NVC saying that IV bill will be sent shortly. I hope they will do it very soon.

And we need to find a half decent Poutine restaurant - actually, I think we have a restaurant that specializes in poutine LOL. And I work 7 to 3:30 now, right on Broadway! Close to most buses and stuff for getting places too :)

Well, congrats on that :dance: how about buying a matching plate set? :yes: Of course you keeping yourself busy in that way has a potential of leaving you without any money for the case processing once NVC is all straighten up :D I am trying really hard to concentrate on passing my finals to keep me from calling NVC again this week...... :huh: the activities we have taken upon are trully challanging :yes:

Just stick with visiting family and friends. If they further inquire, then tell them. As I learned, don't offer anything unless they ask. Stick to the point.

I think I'm done with calling DoS - at least for a couple days. Apparently now they haven't received my case at the consulate. The operator that told me this is one of the operators who LAST WEEK told me the consulate has it and is working on it. Yep...just reached my limit. I'm calm, but so need a break.

Nope. I've heard pretty much...oh yeah, NOTHING. DoS also keeps asking me if I've received my non-existent packet 3 yet. I keep telling them I won't get it. Frustrating! To take my mind off it, I've taken to trying to win EBay auctions for a rare set of salt and pepper shakers. It's not working...lol.

I just got an email from the IV Unit at the Santiago Embassy saying they received our case this morning and asked that my wife go to the Embassy tomorrow morning so they can give her the remaining documents and schedule the interview appointment. She had scheduled her medical for Thursday so this should work out perfectly. :dance:

By this time tomorrow we should know our interview date.

Yeah...I don't want to but maybe should. Also thinking of going to get just police name checks done on my former surnames because I have a sinking feeling someone's going to ding me for those too (the former surnames didn't show up on my criminal record checks, so even though I got fingerprinted and all my names were searched, I just don't know - and the mistakes are starting to make me second guess everything)... :whistle:

The Canadian Government is strict about photos for their passport and have to be stamped on the back as to who took them and the date. Fills up the back of the photo. I've found that when our family has photos taken for US purposes, sometimes they stamp the back and sometimes they don't.

So - think it might be wise to go in and get a new set done, requesting that they not be stamped as they are for us purposes?

Nothing scheduled that DoS can see yet. Geneva (the operator) still seems to think I should get packet 3. When I said "I was informed that spousal visas are not sent packet 3 by the embassy," she got kind of quiet, told me nothing's been scheduled yet, and told me to keep calling. Guess packet 3 is now code for "confused operator." :wacko:
