Hello!!!
My fiancé and I filed our k1 in jan and just got the notice that it is in Tx (where I live) waiting to be approved. The next step is our NOA2 and I'm about to hyperventilate. First ....should I be making wedding plans? Idk how anyone can do that not having the slightest idea when they are going to get here. I don't want his visa to be denied because of something like this. Also I was told by someone that I also had to go through an interview and would be asked very personal questions about our intimate life...I can't find any evidence of that in any website I have found . He is coming from Iraq. Can someone help???!!

First, you filed in January and JUST now got your NOA1? Or got a notice saying it got transfered to TCS?

Yes, make wedding plans (start looking at what dress, flowers, photographer, etc...you want), but do not pay for anything yet, I'd say don't pay for any wedding stuff until you are in the US and are 100% sure of your wedding date, but that's just my advice and what I plan on doing.

After the NOA2 the benefiaciary will have to go to an interview in the consulate in Iraq, they will ask questions about your relationship but nothing out of the ordinary and nothing too intimate. Here's more about that http://www.visajourn...rview_Questions

Both you and the OP's spouse should simply answer the question "NO". Neither attempted fraud. To say yes would be to admit to attempting fraud, which admission WOULD make you ineligible for visas.

Somebody not being convinced of your positive motives in applying for a visa or judging you don't have sufficient ties to your home country is not either fraud or an accusation of fraud. Answer NO.



Really? Should I attach an explanation to "No" too?

Did anyone in VJ was denied for a visa and answered "No" to the question and had no problem during the interview? I am really worry she could get denied again!

I broke the whole question into relevant sub question:

An alien who failed to attend a hearing on deportation or inadmissibility within the last 5 years; Thie "NO" for you
who seeks or has sought a visa, entry into the US or any immigration benefit by fraud or misrepresentation;
who knowingly assisted any other alien to enter or try to to enter the US in voilation of law - Thie "NO" for you
who after November 30, 1996, attended in student (F) visa status a US Public elementary school or who attended a US public secondary school without reimbursing the school - Thie "NO" for you
or who is subject to a civil penalty under INA 274C - Thie "NO" for you

Remember it is for the foreign spouse to answer, so answer to all sub questions except 2 are a big NO. Now let's review sub question 2. The CO didn't beleive that you were friends and denied visitor visa. Now this is definitely not a fraud but let's see if is a misrepresentation. Does this come under misrepresentation just because CO denied her visitor visa?

As far as the visiting spouse is concern it is not misrepresentation, as you were friends but it was just that the CO didn't beleive you were friends. I think the answer to this sub question can be a "NO" from the spouse point of view. But NVC may view it differently.

I think it is immaterial whether you answer "NO" or "YES" but an explanation letter with DS-230 explaining the sub question 2 in detail must be done, so that NVC will not take it as hiding facts.

The bottom line is that NVC does want any lies or hiding facts. So it may be best to answer "YES" and attach an explanation letter.

I've filed I-130 for my wife and am in waiting mode. In the meantime, I figured I'd take a look at DS-230 and try to get prepared for that.

My wife applied for visitor visa around June 2010 and was denied because the CO didn't believe we were just friends (we were still friends at that time). How do I answer the question? If I select "Yes", does my wife automatically ineligible to receive a visa?

I made 3 trips (stayed one month each time). I went to meet him and his family. and travel to 3 cities to see little of Morocco. Went back for long process of marriage and paperwork. Went back 6 months later for visit, their holiday and our honeymoon period. USCIS likes a honeymoon and photos so go, and consider this that time. The more time you spend as a couple, the better it is. I am going back now for his interview. That is also important to show support. Hope this helps. Jeanne

If he still reside in Australia, he can file for DCF with the consular/embassy. The process will only take few months.

However if he is in the States now, then he has to apply the I-130 with USCIS. It takes about 5 to 6 months to approve and USCIS will forward the petition to the NVC. Once he submitted all the required documents and fees to NVC, then NVC will send the case to the consular/embassy to setup for an interview. The whole process will take about 9 to 12 months.

Also, it is not easy for a spouse of US citizen to get a visitor visa unless you have strong ties to your country.

The embassy is using the Aramex courier service to return your passport. There are no extra fees associated with this service. The cost for Aramex to return your visa and passport to you is included in the visa application fee.

yes. already paid the AOS and IV fee. I am not sure if another fee needed to pay during interview so that i can prepare for it. My interview will be next week.


I would suggest you to bring some cash (Ringgit Malaysia) for your interview. They do accept cash! I don't know if they accept any credit card.

If you are approved for a visa, you can pick it up the next day. I heard that the embassy doesn't use courier service to return your passport.

I have a question about the police certificate. We are still waiting for the police certificate back. If we don't receive it before we send out those supporting documents to NVC, can we bring it to the interview in embassy?

That would be true, but I found out that once your case is expedited, NVC ships off what they have and it's up to the Embassy to schedule your interview. I am grateful our package has been expedidted but I hate not being able to know when she can get her interview date, from what I have heard, you have to be dying to call them.


Have you tracked your case to check if it is in the embassy in Kuala Lumpur? If they have it now, email or call them!

DS-3032 is required only for DS-230 fee bill to appear and not for AOS. They go parallel till case at NVC is completed.

From the time you get IIN, it used to take around 2 days for the AOS fee bill to appear. I hope it is still 2 days now.

The beneficiary not the USCIS will receive an e-mail form NVC stating that this case is eligible for further processing and will give instructions how to access the payment portal to pay the AOS fee of $ 88

Once your receive the e-mail from NVC you can send your DS-3032 from the beneficiaries e-mail.We jumped the gun and did it as soon as we received the case number but it was rejected.We were instructed to send it again once we were sent the NVC e-mails. Pay the AOS bill and in a couple of days you will be able to print the bar coded cover sheet and send the I-864. DS-3032 will take about the same amount of time to be accepted. Than a second e-mail will be sent again to the beneficiary saying that the Petitioner will be contacted how to further proceed with the IV fee.
And the ball is on the petitioners court from this point on with the exception that all the signed docs and police certificates have to be provided by the beneficiary

Are you saying that to email the DS3032 after I paid for the AOS bill to avoid rejected? I just received my NVC and IIN numbers yesterday, I tried to pay for the AOS bill online but it is still not in the system yet. How long do I need to wait to be able to make the payment? Thanks!

Besides the visa officer asked about how you know your spouse, when you met her, etc, is there anything need to be concerned? Did the officer ask to see any supporting evidence or pics? Was the officer nice? I heard that one Caucasian female officer is very unfriendly!

You must enter United States with your immigrant visa and your visitor visa is eventually canceled! Did the visa officer cross out your visitor visa during the interview?

When you pass through the POE, your passport will be stamped with I-551 and you can leave and return again within 6 months. If you need to stay out of the United States for more than 6 months, then you have to apply for a reentry permit.

I don't receive any email that my case is completed and I am still able to log in to the invoice payment portal.

Yes, because my first wife deserted me while I was stationed overseas and she went back to Europe I had to get a Mexican Divorce. Good thing I paid extra for the Apostille and had the government stamp on it.

The interview was crappy because a couple of months prior she filed for a tourist visa to come visit and she was turned down by the CO. Bad thing was, the CO was the same guy who interviewed her for the I-130. So I can see why he was looking at my case funny. Once he saw the decree the red flag went up and we were put in AP. So they went and got an Advisory Opinion from DOS, after that she came back for a 3rd interview and was approved. But honestly, only a week and a half of AP isn't bad compared to most of the cases I see on here so I cant even complain.

I wasn't very clear, but it was the doctor that originally told us no. It contradicted with the State Department website and I couldn't find any information other than posts about Manilla, which is what prompted this thread.

The consulate replied to my email, disregarded my question (period-ok or period-not-ok?), and said they'd be happy to postpone the interview if necessary. Well thanks, but that wasn't what I asked!

However, my wife has managed to find some time to get to KL this weekend. So either she'll complete the exam this weekend or have to cancel and complete it two weekends from now when she has another schedule availability. The doctor's office said it takes them 4 days to get the results to the consulate.

Still, an official answer to the question would be nice for future VJ searchers.

As the consular isn't a medical profession, they can't provide any medical advice. It's true that they would suggest you to reschedule the interview than you aren't following the requirement of the doctor office. This is the only panel doctor (West Malaysia) that they trust for the medical check-up and I don't think you want to take a risk on your visa decision.

BTW, does the doctor office open on weekend?

We got got two I-797C NOA's...the first was the receipt notice showing they had received the package from the POE, the second was the welcome notice.

As to the SS number, we just filed a new application just like anyone can do at any time ... no muss, no fuss

Just received both notice letters today! At least we know USCIS is working on that!

It seems like far too many people fret over what happens after POE, somehow thinking that if things don't happen immediately, there is a problem--just for the record, it is rare to have problems, but the odds are not zero. Far too many people want to know what the "average time is to get the green card and SS#, so let me say there are no averages, and plenty of myths promulgated right here at VJ.

So, let me tell you our experience--it is neither normal nor abnormal--it is what it is.

POE at Newark airport November 3. The entire process from the time Emma got off the plane until she was with me in the waiting area was about 40 minutes.

We go to SS office to get card November 23. There is NO REASON to wait three weeks like so many folks here suggest. We would have done it sooner, but needed an originan copy of our marriage license, so had to wait for it in the mail.

SS card arrived November 28.

USCIS got the package from Newark Novemebr 28.

USCIS "officially" recognized Emma's CR-1 status December 6.

Green card arrived December 27.

And we are finished for now--hope this helps allay so many fears that I ahve read here over the last couple of years.


How do you know/check that the USCIS got your package from Newark on Nov 28th and "officially" recognized Emma's CR-1 status?

Our PoE was on Dec 4th and we went to the SSA office on Dec 26th and was told that no SSN record in the system and we have to submit a new application.
