I am filing from Ireland where I have been living with my fiance for 3 years. On the I-129f form I used my Irish address and today received all the documents back we sent in with a I-797c form stating:

I DID put my address so I am confused why I got this rejection letter if you are allowed to file from abroad? Anyone that can help??

We went to the AOS interview. The officer took us back to her office and swore us in. Then she reviewed all of the information in our file. She approved the case. We had our "sealed envelope" from the doctor, all the documentation, photos etc etc etc and she didn't ask to see anything. She let us keep the EAD card, and took the I-94 card out of the passport. She said that we will receive the permanent resident card within two weeks and sent us on our way. WE totally forgot about the medical envelope until we were home. WE have no idea why she didn't ask for anything, or look at photos etc. We were shocked that it went so fast and so easy. We thank our God for helping and protecting us!! Shokran Allah!

One last question. How important is the suffix on the CENOMAR and/or marriage contract? My fiancee found out that on both documents this person or her fake husband put his first name middle initial and last name but no Jr. There is same name with Sr and there is the same name with Jr but no name without the suffix. When the NSO did a search for the name without the suffix it came out blank. Does this mean we still pursue an annulment? or is there something easier and quicker we can do to throw out this marriage contract?

Hi guys, thank you for your responses. Is a update and more clear information. I didn't really understood what CENOMAR is but after speaking to my fiancee now I understand it better. My fiancee went to get her CENOMAR and on there it said that she was married, dated Aug 2004. But the CENOMAR was registered Nov. 30 2010, 6 years after she was suppose to be married. She never got her Certificate of Marriage. After 9 months and breaking up with her fake husband she went to NSO(I think) to check to see if she was registered as married and the lady said no, there is no record. So she went to see a lawyer he said that she should go back to the NSO and get an CENOMAR on the husband and the Certificate of Marriage and bring it back to his office. Also note when she got married her family took pictures at the City Hall where she got married and show those pictures to the employees there the lawyer who married them and the employees said that guy is no lawyer in this City Hall.
I think what is happening is that this guy is trying to get back at her because she broke up with him, and he said he would get revenge and make sure she would not have a happy life. Is it possible this guy got the original papers and filed them just before Nov. 30, 2010? Could this happened to a guy who is still married? Any answers OR supported would be appreciated. Hello everyone.
Has anyone had this problems with your fiancee getting her CENOMAR(certificate of No Marriage) in the Philippines. My fiancee was denied for a Cenomar. Here is my story(or at least what I know so far): Back in 2005 she thought she was getting married to this guy so he set it up with a lawyer and couple of witnesses. This guy was already married but told my fiancee that his wife had died. So she thought she got married to him, legal and free. But later she found out that he was still living with his wife and kids and so she check with marriage records and found no certificate of marriage to this guy so she figured it was fake. So after three months in 2005 she left him and didn't need to file annulment. Now today she went to get the Cenomar and found out certificate of marriage was dated November 30, 2010. How could this happen? Did anyone run into this problem? What did you do? What can I do? I planning to get a lawyer, but is there anything else I can do? I feel very hopeless and powerless.

Thank you for your responses so far. As for how she got married to this guy without a marriage license, no cenomar, no approval from parents since at that time she was only 23, no body knows. As far as we know is that the marriage certificate was registered without those other documents. We assumed that all the other documents were forged. We have an attorney working on this and he tells us we have grounds for void of marriage because there is no marriage license. But my real question is not how they got marriage but what to do with the K-1 visa? Last week I just got a letter from the US embassy stating that they ready to set up an interview. I have been told that because of her cenomar showing that she is married, we have to re-apply the K-1 visa because the petition assumes that you are both single and free to marry. So this K-1 petition is now invalid.

We got our petition approved but when she got her cenomar(in the Philippines that means certificate of no marriage) it shows that my fiancee is married. 6 years ago she had a BF and thought she got married to him but then found out that he was already married. So she broke off the relationship. She checked with the Local Registry Center after a few months and was told there was no record of her being married. So she assumed she was still single the last 6 years. After we found about the cenomar we got a copy of the marriage certificate and that certificate was full of flaws. First and most important there is no marriage license, then other problems like bad birth dates, forge signatures, wrong addresses, etc. Anyway, we are petitioning for a nullity of marriage where the marriage is void. My question is this-the US embassy is waiting for her physical and interview but we can't go forward because of the cenomar. Do I need to re-apply a fiancee visa after we finally get this annulment? Or can I wait for the nullity of marriage is to be finalized? I was told that you can't re-apply to the same person. I was also told that getting married in the Philippines and then apply for a spouse visa will be better. Does anyone know what are my best options and what can I do? And do you know what huddles I will have go through with those options?

My petition was approved and sent to the US embassy in the Philippines and they are waiting for my fiancee's physical and appointment for an interview. But because she has a "slight" problem with her cenomar, like she is married (I have a post from a earlier topic about this and got my answers) so we can't move forward until we can fix her problem(like get an annulment), my question is this: Who and where do I ask for an extension on my petition? I still have until April 20 before it expires but this annulment process will take many months but I hope before a year is up. Thank you for any help.

Thank you for all of your answers. If my residency in the US is in question, is it possible that I visit the Philippines for a year since I do own a house in the US? My plan is to visit the Philippines 3 1/2 months at a time and then go back home for a month and then visit the Philippines again with the same amount of time and then back home. Would this keep my residency in the US? Or will this put a "red flag" on my I-129F petition.

I plan to retire and move to the Philippines while my fiancee processes her annulment. Once she gets her annulment then I plan to apply for a I-129F. I have been told by others that by moving and living in the Philippines would send red flags for my petition. Does anyone here my any experience in living in one's fiancee country and having problem processing the I-129F? Would it be better to get married first and then apply for the I-130 instead? DONT WORRY....i know how frustating is during this process....you just have to wait patienly...i went thru the same thing in utah...i went to mi interview for my citizenship in august 21 2012 and i was told the same.....i had to turn more RFE like they call it....but since oct 2012 when they asked me for more rfe i did not hear anything until december 26 when they placed my application on the oath ceremony que and then finally on march 3 my status change to oath ceremony schedulle and now i have a date and place for my ceremony in utah......but this is all i can advise you....WAIT PATIENLY AND DO NOT GO CRAZY LOL......everything will be okay...good luck my friend

Given the vast quantity of personal and financial data that seems to be expected for I-751 filings, I'm wondering if I'm the only one feeling a bit queasy about submitting all those documents "in the clear" with account numbers, SS numbers, etc.

 

Questions for those who have already filed:

 

Did you redact your evidentiary documentation in any way to avoid exposing the keys to your financial kingdoms?

 

Are personally-identifiable things like account numbers necessary to establish "happy marriage" bona fides?

 

Do you trust the government to keep your personal information safe?

 

Did you ever lose any sleep worrying about identify theft?

re: picking up CFO stickers at NAIA after obtaining the counseling certificate and visa

My resourceful fiance :lol: sent an inquiry to the CFO staff on their facebook page. They replied quickly as follows:


When u complete the counseling at PRISM, u need to go to the CFO office afterwards to get ur certificate. If u don't have ur visa yet by that time, u can register (and get ur sticker) at our NAIA extension desk (all 3 terminals). They are open Sunday to Saturday from 5:00am to 12:00 midnight. You can also call the CFO-NAIA at 8795685.

Unfortunately, the CFO facebook information may not be as accurate as we'd all like.

Having read the quoted CFO facebook stuff before going to Manila for my finacee's interview, I looked up the CFO desk in NAIA T3 while I there awaiting her plane (this was on July 30, 2011). The CFO desk was empty. No one anywhere in sight. I walked around a bit and went back to the CFO desk again. It was still unoccupied.

On Wednesday, August 3, 2011, we went to the CFO office on Quirino Avenue (after the PRISM counseling session) to get the CFO completion certificate so we could, in theory, get a CFO sticker at NAIA after she receives her visa. When we asked the CFO office personnel about the CFO desks at NAIA, we were informed that it is hit and miss at the airport because there is *one* staff member who handles the CFO desks in all three terminals. In other words, depending on when you go there, you might find someone at the CFO desk in any given terminal, or you might find the desk to be rather empty, like I did.

Armed with this feet-on-the-ground surveillance data, we are no longer counting on sticker availability at the CFO desk at NAIA. We'll check the NAIA CFO desk when we arrive there enroute to the USA, but we're also planning plenty of time in our schedule to allow a round-trip to the more heavily staffed Quirino Avenue CFO office.

I was wondering if a keychain light would be (or not be) allowed to the US embassy interview?


I always carry an LED keychain light in my pocket and it wasn't a problem for me when I attended my fiancee's USEM interview. Upon entry into the embassy I didn't even have to empty my pockets. The guard just asked me pointedly (and smilingly) if I was carrying any cell phone, ipod, or other electronic gadgets, to which I calmly and repeatedly replied "no", and that was the end of it.

Good thing when I filed for my NBI clearance last month, the NBI agent advised me to get 3 original copies if I'd be using it to travel to the US.


Please forgive my ignorance, but for what purpose(s) does one need multiple original copies of the NBI clearance?

In August 2011 I booked tickets online (from USA) and then flew as follows:

1. One-way for me only: Las Vegas to Manila via Vancouver (cheap fare on PAL).

2. One-way for me & my fiancee: Manila to Salt Lake City via Tokyo Narita (Delta airlines).

We had no trouble at all with either the booking or flying with e-tickets purchased online. There was one odd thing about the online booking of the flights from MNL to SLC: my credit card company charged a foreign transaction fee because Delta apparently "originated" the booking in Manila. I thought this was strange, but didn't bother to find out exactly why it was done that way.

(POE in SLC was easy as could be. Whole process was probably less than a minute. Too bad Delta no longer flies direct from Narita to SLC--we got lucky.)

This was a couple of years ago, but I bought for my then-fiancee a short duration "inbound immigrant" medical policy from sevencorners.com.  The coverage period started on the day we traveled from Phils. to USA and ended a couple of months after that.  Not knowing how long it'd take to get things all squared away with my employer's insurance, I probably overspent on a too-long coverage period.  I had guessed  that it might take a month or two to get things settled, but it turned out to be a lot quicker than that.  Anyway, the sevencorners policy worked out fine.  It was easy to buy online, provided the desired peace of mind, and we were glad not to have needed to use it.

US Embassy and Consulate DiscussionEmbassy sent Packet with proof of approval

Hi all,

 

I am a newbie to all this, so this may be common knowledge, but for others like me who were not in the know, here is a bit of info. After we had our approval, I contacted the embassy in Hungary to see what I needed to do to keep the process moving forward. They said if I sent them proof of approval, they would sent my fiancee the packet, no need to wait for NVC. I sent them a screenshot of our approval from USCIS and just got a confirmation email from them that the packet went out. We got approved on May 15th and they sent it on the 17th. Like I said, this may be common knowledge, but maybe other embassies will do this as well. I just haven't seen this in anything I have read so far during the process....so, sorry if this redundant, but thought I would put it out there anyway. Cheers!!
