Has anyone not gone with their fiance? I've been there 5 times I think since january. I've been working like crazy so we can buy a new house when she shows up and I'm really not keen on another trip this year. But if it will make a big difference for me to be there I will be there.

Almost home... I think.

Ok well ,we have our interview date of September 18th and we as of today have every last peice of paperwork and then some. I have been feeling confident about everything as we have sped through the process pretty well with no problems. But today I spoke with a friend who scared me. HIs brother had some big problems getting his wife from Brazil a visa. He was telling me to be ready for the interview process because its very indepth and we should rehearse our answers and be ready for anything.
I know I've read that each embassy is different and their requirements are different but still this has me spooked.
Am I being paranoid now or should I really prepare for disapproval?

She received packet 3 in the mail last week she then went to the embassy and they took her DS-230. Her was done yesterday and her police record will be finished August 25th..

Now what? she thinks we have to wait for more mail from the embassy. Do we just wait or do we have to turn in packet 3?

I already planed on this once we get the interview. date. I planed on taking a trip back to the Philippines.

my problem is this though.. her parents are very adement about her finishing school before she gets married. They are wanting us to wait for 4 years.

A 4 year wait would be ok if i lived there. but living in the states and never really getting to be with my love is very hard. I have only been away from her for just over a month now but it really has been the longest month i have ever had in my life.

She is wanting to just leave there as soon as possible and does not care what her parents think about it. We both however do not want it to come to her running away to be with me but we will do that if needs be. We have known eachother a while as i lived there for 5 months. I was with her ever day and met her my 3rd day there.

My question is this though.. what information will the consulate require from her to prove parents consent so they will be able to approve her visa? if any. we both do not want to wait the 4 years to be with eachother but will if we absolutly have to.

When i do go back i planed on bringing some school info and also my financial statments to her parents to help prove to them that my intentions are good and that i want her to finish her schooling as they do. but i want it to be here with me.

Any advice on our situation would be greatly appreciated.

I know that in the Philippines you need to have parents written consent to marry untill you are 22. If her parents are not too happy about us being together is there anything that they can do to make it so that she is not able to get her visa? i do know about the exit counsiling and we have that taken care of already.

is she going to need anything for her interview to prove that her parents give consent to marry? she is leagly an adult

I called NVC yesterday morning, and was told they'd just received my file from CSC that day.

Today I got an email from NVC, answering my email of last week:

Good Afternoon,

Your inquiry has been received at the National Visa Center (NVC).

As part of the aftermath of the events of September 11, 2001, there are additional security check requirements for visa applicants. While it is not possible to predict when the clearances for this case will be finished by all involved Washington agencies, please be assured that as soon as the results are received the NVC will be able to schedule this case for an interview at the assigned US Embassy or Consulate General. As soon as an interview is scheduled notification will be sent to the designated agent by mail.

I then called NVC. They said our file is undergoing additional administrative review.

Questions:
1. Is the GUZ number what people refer to as the "NVC number"?
2. If so, does that mean we're done with NVC?? The email sure doesn't sound like it.
3. What is "additional administrative review"? Any idea how long it takes?

Hi, everyone. Congratulations to those who have been surprised by fast I-129F approvals lately. It's energizing to see so many people moving forward!

I have a question about e-mail notifications. I have seen posts where VJers say they have recieved e-mails about their cases. I didn't see a place on the I-130 form where I could write in my e-mail address, though I did on the I-129F. So for the K-3, there are apparently some things that I will in fact be informed of via e-mail.

1. What exactly will those things be, and who will they be from?

2. Are e-mails always followed up by paper notices, or will there be some things that will only be communicated electronically?

They will tell you every time they touch your file, or when they send things to you. AFTER you get your NOA1 (receipt), then you can go their web site and sign up for email notification, using your receipt number. Until then, just sit tight. Minor actions (touches) do not result in snail mail. Major actions that require response result in snail mail. But sometimes one can respond to the email and get things done faster.

Earlier you asked about what time of year is best. NOW! NOW! NOW! The process takes so long that sooner is always better. I'm kicking myself now for not filing sooner. In the statistics section there is a graph of how long things take. There does not seem to be a consistent seasonal pattern.

Consider yourself VERY lucky that you are dealing with Vermont!! I waited 25 days from my submitting my I-129F to Nebraska until the date for my receipt from California.

That said, I share your concern with the long delay from NVC to Guangzhou Packet 3. I will be enduring that wait. But if it is by October, I will consider us lucky.

We can easily wait 3-4 weeks for NVC to send things to the embassy/consulate. Check immigration timelines for the time the remaining steps take. For Russia, NOA2 to Interview seems to be taking 2 1/2 to 3 1/2 months. You're lucky. For China, we're looking at 5 1/2 to 7 months.

But it nice to see a P2-Interview in just over 4 months,(All K1 I was looking at only), probably because they had no other K1's since the IMBRA stoppage and cranked out the interviews as fast as they could.

It will be very interesting to see what happens to processing times with the flood of late July, Aug. and Sept. approvals. I hope it doesn't jam up the system. But the fact that CSC files now often take 2-3 weeks to get to NVC is not a good sign for the rest of the process.

I hope I'm being too conservative.

I combined them into one spreadsheet. While 4 1/2 months is possible, 6 months seems more likely. And with the longer delay (CSC to NVC) and the upcoming holidays, I fear it could stretch out a bit.

The health issues might also play into the financial support issue. Can you show that he would be put on your medical insurance, with pre-existing conditions covered? If not, then I'd research to find out if this could impact the financial support question. This could be another reason that treatment first would be good - to show that it is unlikely to become a financial drain.

In my case, the lag from NVC approval to receipt of P3 can be 45-150+ days (for China). I doubt too many people on VJ would be confortable not checking their case for 5 months!

How consistent is your bonus and overtime? If it is consistent, I'd show 2-3 years of tax returns. I'd also say something like $xx salary plus $yy bonus and overtime (3 year average). That way you get to give a more complete and more favorable picture.

I sent our 129F on July 6, with tracking. It was delivered July 8. The check has not been cashed. We still do not have our NOA1. How do we contact Nebraska and find out if it's lost.

On the other hand, since several people are noting slow response by Nebraska, maybe this is just sad but normal. But I do note that many people have gotten responses from Nebraska in a week or two.

Hi, I am just starting to get my paper work together to bring my fiance to the states. I have been trying to get as much information as possible before I start the process next month. I wanted to know if anyone had any advice on getting an immigration lawyer. If so, is it better to get a lawyer to help you with the process or do it yourself, or is it about the same? If anyone has any information it would be greatly appreciated.

I did a mix/blend. We prepared all the materials ourselves, then showed them to an immigration lawyer. We then filed them. He said there was no benefit to him sending them in. This kept the cost low, but made sure there were no obvious errors.

Vartan: I can relate completely, $4.00 a minute to Taichung, yikes that was a bad bill.


I suggest you and Vartan check out phone cards at the local Chinese grocery store. A Chinese grocery store here sells phone cards that allow me to call China for about 1.4 CENTS a minute. The same card is good to Taiwan at about 17 cents a minute (vague recollection). I suspect that there are Taiwan-specific cards that may be significantly less.

Unfricking believable. I about lost my mind when I saw they are now processing OLDER petitions than the March 6th (which was the IMBRA effective date, even though it was signed January 5th!)

I honestly can't believe the incompetence with USCIS. I had a friend who had to get a handwritten (no letterhead) letter to work. It looks like that place is run by a bunch of three year olds, and even then I think it migth be better. What annoys me EVEN more is the fact that files just sit there literally for months and no processing takes place on them. Oh, ya and the fact the imbra form COULD have been posted back in january or february so they didn't have to send out 10,000 letters for those waiting.

How the hell will we ever legalize 15 million+ people when they can't get SIMPLE forms right. Good Lord! We are now going to file for me in her home country as well, and we will see how fast their process goes (usually less than 1 month).

I honestly give up. No more waiting for this person, this is complete incompetence.


There is another thread that the USCIS recently CHANGED the way they report. They are now reporting the LONGER of their actual processing time or their "standard" for processing time. In other words, they have given themselves a 6 MONTH "standard" to process I-129F applications.

I suggest we contact ALL our members of congress and suggest a 30 day standard. After all, that's what Vermont has been caple of within the last year. Even if USCIS and Congress negotiate to a 60 day standard, it might (if we're very lucky) light a fire under the director at California.

The stats are a bit shaky, in that someone may have stopped posting on VJ, and thus be listed as waiting, when in fact, they are just gone.

It appears that whether you applied in late Feb. or late May, that your chance of having approval are about the same - maybe 50/50.

We MAY still have a big backlog. Or we MAY be almost done processing the March/April backlog. CA/NE/TX had 30 approvals listed in the last two weeks. If the backlog is small, then by the end of Sept. we should see the March/April ones done, and a big chunk of May and early June processed. I will update this table in a couple of weeks.

Thank you guys so much for your replies, it's easing my mind more than I can say! :) I feel kinda silly asking about the affidavit of support with $300,000 in assets, but I didn't know if they looked at the assets themselves or just the income I live off of, which isn't much per month. From "Fiance & Marirage Visas, 3rd ed.", Nolo Press, "Assets (such as savings, houses or cars) are only counted at one fifth of their current market value after subtraction of debt liabilities, mortgages and liens. Assets must also be readily convertible into cash (within one year)." That means your $300,000 of net worth is viewed as similar to $ 60,000 of annual income.

You should be fine.

Welcome to the club. I hope things go rapidly. But given that you're with me in CSC purgatory, I suggest you find a new hobby that will take LOTS of time. For instance, you could pick a Russian novel you've always wanted to read. And then start learning Russian, so you can read it in the original. By the time you're done with the book, you MIGHT have your visa. :-)
