All Canadian international airports with commercial flights to the US have US Customs and Immigration Pre-clearance facilities. If you change planes in Canada, you will go through US Customs and Immigration at the Canadian airport. No choice in the matter. You will find it actually structurally impossible to get from the International Arrivals section to the US Departures section without going through the US Customs and Immigration booths.

You may need a special visa from Canada to transit through a Canadian airport, and if you are entering the US with any kind of visa, you will show it to US Customs and Immigration at the Canadian airport, and they will process you there. Allow a significant amount of time (3-4 hours minimum) for your layover in Canada if you are entering the US with any kind of visa.

Sorry but no. Mine didn't. I'm also pretty sure none of the other Aussies that I've spoken with had theirs with cuts either. Mine was 100% sealed and undamaged with a huge "DO NOT OPEN" sticker" Sounds like the "cut" is a country specific thing or perhaps a new measure.

I crossed at a land crossing, so fortunately I didn't have to deal with any intrusive airport personnel.

My "Do not open" K-1 envelope, issued at Vancouver Canada, didn't have a cut corner either. It was actually two envelopes, both white, one quite a bit thicker than the other, both marked "Do not open". There was an elastic holding the two together, with a cover letter on the outside. They may or may not have been stapled together, I don't recall. The thinner envelope contained the three copies of my medical, and the thicker one was the rest of my immigration file up to that point. The cover letter just described that I had been issued a nonimmigrant fiance visa, repeated the instruction not to open these envelopes, and reiterated the time limit for PoEing and marrying, and repeated the eventual necessity to AOS.

The consular officer must be convinced that the beneficiary will not become a public charge. A perceived lack by the consular officer lack of formal education or equivalent experience sufficient to plausibly support oneself in the United States would be a serious problem. There are no formal minimum requirements, but the beneficiary is going to have to convince the CO that they will be capable of functioning in North American society. A Grade 3 education and complete lack of functional literacy would clearly be a serious problem.

We filed our I-129F in late October 2009, and got approved in early January 2009. It's still a little early to expect to hear from them. 2.5 - 3.5 months would be more normal. 2 months would be unusually fast.

The vast majority of people on this website are doing this without a lawyer, and the vast majority of cases do not need a lawyer the vast majority of the time.

Lawyers excel when there is advocacy to be made, when arguments need to be made in some kind of court or tribunal to establish particular facts and debate how the laws apply to those facts. They are also necessary for consultation when the decision of a course of action hinges on subtle interpretations of law and precedent that are not common knowledge.

But for the vast majority of normal employment- or family-based- visa applications, there is no debating, no courts, and no advocacy of any kind. The process is a simple matter of filling out forms correctly, mailing them to the right addresses, and waiting patiently. The correct course of action is almost always obvious from a a brief perusal of the Guides here and on the USCIS website, and no esoteric legal analysis is required. Anybody who can graduate college, and I daresay the vast majority of literate high school students, can do this. It just isn't that hard.

In situations where there are complications, like previous criminal activity or immigration violations, the correct course of action can come to hinge on the application of specific legal precedents, and in those situations I'm the first person to advise someone to "lawyer up". But normal cases consist primarily of filling out and mailing forms, and do not normally need a lawyer, the vast majority of the time.

If the USC has no domicile, and isn't going to be able or doesn't want to get any, that might be a situation where they would want to file an I-129F from outside the US.

When approved, the petition would be sent to the NVC, then to the beneficiary's local consulate, where they would get a normal K-1. The USC and the beneficiary could then enter the US together, the USC as a returning citizen, and the beneficiary as a K-1 entrant, with no preexisting US domicile strictly required, I think.

I know the I-129F and the DS-15x consulate forms ask for the location the beneficiary intends to live at, but I can't think of anything offhand that would prevent this from being a workable path to a K-1 visa, in the case where the petitioner is living with or near the beneficiary outside the US. It would clearly be an unusual case [since normally, reestablishing domicile and going for DCF is so much quicker and cheaper than the I-129F->K-1 path], but it seems doable to me.

I wonder if the question is implying that the USC petitioner is currently living in Toronto? A USC can file an I-129F while living abroad, according the the I-129F instructions.

If this is the case, it's a much more interesting question, though I don't know the answer.

They are *only* estimates. If you wait until the last minute to sent or gather documents for an interview, then it might take longer. Other times it'll take longer no matter what - things in the mail, many cases at the embassy etc.

Don't let the length of the K-1 flowchart frighten you. The process is long, but it is very linear. At any given point you only need to worry about the next one or two steps. Concentrate on those, and you'll be through before you know it!

The other main things you can gather right away are pictures, plane tickets, motel receipts, and other documentary proof of this most recent visit. You will need to include proof that you two have visited within the last two years with your I-129F, and any other evidence of your relationship (within reason) you include with the I-129F won't hurt either.

Have you looked at the requirements for the I-134 and I-864 Affidavits of Support yet? As the US citizen petitioner, you will need to be able to show an annual income of $17000-$18000 per year, or find a cosponsor who can show sufficient income and is willing to sponsor your fiance.

For us, the cosponsor was my mother-in-law, since my wife wasn't working when she filed the I-128F petition.
The cosponsor is going to need to provide 3 years of tax returns, and some fairly personal information about their bank balances. It's fairly invasive, so even though you won't need this stuff until the consulate interview, if you know you'll need a cosponsor, you should start diplomatically feeling out family or friends now.

Wire transfers from the USC to the beneficiary are probably unnecessary. They definitely shouldn't hurt and they might help. It's up to you whether you want to include them or not, but they are fairly personal financial information that isn't directly asked for - I would probably exclude them just on general principle, but YMMV.

Wire transfers from the beneficiary to the USC, on the other hand, will definitely look iffy at best (even if there were and are completely legitimate reasons for them) and should almost certainly not be included. Don't lie about them if you're asked directly about them at an interview, but don't volunteer anything about them if the subject doesn't otherwise come up.

My name is very unique so there shouldn't be a question that it's the same person, but of course that is not proof in itself. :whistle:

Instead of submitting my old marriage certificate, could I send copies of my old passports or my old social security cards (which are dated) that show the progression of my name change??

My old marriage certificate is actually in Mexico (and I don't speak very good Spanish!) so that's why I'm hesitant to bother getting another one and having to get it translated.

What if the divorce decree officially states that my name is changed back to my maiden name? None of my other documents or pieces of evidence use my old married name, so is the divorce decree enough in this case? Or would I still need the first marriage certificate? I have a photocopy, but I definitely don't have any originals/certified copies. Thanks for any help!

hi there! no need to wait for packet! they dot send any packet anymore.. infact i did not receive mine but i got my visa approved last week.. all you need to do is wait for one week and call nvc then ask for case number then you can book for interview and have medical as long as you got all the requirements like fiancee's birth certificate, cenomar, police clearances here in philippines or any country you lives or stayed morethan 6 months.. in my case i stayed in hongkong for two years so i need hongkong police clearance.. if your fiancee needs help on how to process everything as her to text me this is my number 09076133809, i am willing to give advice as i survived this whole process with help of my visajourney friends.. PhilippinesHong Kong Police Certificate Needed for DCF K3 Visa Manila

I need to get a police clearance from Hong Kong for my wife who is pursuing and Immigrant visa as spouse of a US citizen. Has anyone done this? Where can I get a bank draft in Hong Kong dollars in Manila to send to them? You can do this out of Hong Kong, but you need the back draft in Hong Kong dollars. Also, she needs to get finger printed from a police authority and it has to be certified. Where can we do that? I hope someone reading this has been through it.

my situation is same, but i got my hongkong police clearance arrived at us embassy last friday.. all you need to do and tell your wife to go to camp crame and have her finger prints taken then send to hongkong police through mail. my case, i got my mom living in hongkong so she helped me for payment. it took 3 weeks form my clearance to arrived and if you got question just message me i am happy to help and entertain your question. An expedite -- as soon as there is reasonable evidence/reason that one should be requested. This could be two weeks into it, or a month out...

Contacting congressmen/senators -- after you've hit your five month mark. The service centers won't even look at something, even if they've been contacted by a congressman, if it's less than 5 months old.

Hey guys Im kind of worried. I started a post about this somewhere else but I figure I would run it by my fellow Novemberites. My fiance has a son who we did not add to the org ap because we do not plan to have him come to the US initially. How should I move forward with this? I know my embassy asks for the names of all children even if they do not wish to travel. Does anyone have a similar situation?


I've never heard of this before, sorry. I think you'll need to find out how you can get that information on the application; otherwise, it could be considered fraud (in my opinion, and knowing how much of a stickler immigration is). You might want to call your service center and see what they would recommend. It could be as simple as just sending an updated form.

We actually filed and recieved everything the same day! Hopefully we'll get the NOA2 the same day, too... and SOON.


Nice to have someone with the same situation! ;) Good luck to you, and hopefully when we either of us hear good news we'll know it's 2x for the other of us! I just realized we have the same touch date of 12/29 as well! I guess we're in the same pile. :)

Just go up to Immigration Timelines in the navigation bar, then click 'View My Timeline' on the left-hand side of the page. You'll have to scroll down a little, but it should tell you then (assuming you've entered in your I129F info).

Mine says this: Based on timeline data, your I129f may be adjudicated between April 27, 2011 and May 2, 2011*. It's actually moved forward a couple of days. :) Yay!

Just based off of looking at the timeline and the person's profile, they were at the CSC and had applied for an expedite due to the beneficiary receiving an offer to go to a school. The beneficiary would've come in on another visa, but not left, which had turned into some sort of dual intent/lying on an application form.

Should've got mine to apply for school here... ;)

Ahh, well two months isn't SO bad. I read somewhere on the forums that it took 4-6 months, so I was freaking out trying to plan things. I'm guessing that this process improved since we're able to register for our interviews online. Is anyone starting to work on getting packet 3 together yet?

Also -- how do you know that CSC is flying through the approvals right now? I just saw the post above mine but have no idea where to look.

Thanks for the welcome. :) I'm getting a little antsy trying to plan out the ETA of when we'll actually have the Visa (who knows how long it'll take for the interview @ Montreal), but oh well. Can't do much about it but plan out. :)

As far as the August ones, I don't think it should. The people that were delayed were only by 2 or 3 days or so... and I only saw that one person was having problems. Seems to be right about the 5 month mark.

I just got a NOA in the mail from the California Service Center regarding an I-129F. It says Notice Type: Receipt Notice. The Received Date is July 9, and the Notice Date is July 13. It also has my case number on it. I thought that you get the NOA1 when they actually open your petition, not just receive it, so I'm wondering if this is the actual NOA1. Any thoughts from past filers?

I just got an e-mail stating that my I129f application was approved and the NOA2 is being sent. My NOA1 was dated the middle of July and it has been a tedious 5 and 1/2 months, but I'm so relieved that it's almost over. I'm a huge pessimist and was expecting lots of RFEs, but a straight up approval just made my day.

We received our acceptance letter on 2/7/2013 (dated 2/5/2013), and the new green card arrived on 2/8/2013. (I was surprised these were so close together.)
