I should add that, while the IO at the consulate was slightly concerned about how I would arrange medical insurance with an unemployed spouse (I have diabetes, but it's very mild, and under very tight control), we were approved at both the consulate interview and later at AOS with no problems.

My g/f had completed the consular interview for the Uzbekistan diversity lottery about 2 weeks ago and she wasn't able to receive the original I-134 forms through the mail (FEDEX got there a few hours after her interview and US Airmail got there 2 days after) so I had e-mailed her the I-134 as a jpg for her and the lawyer to print them out.

She told them about her situation and had brought the printed out I-134 forms to the interview. They took that and when she asked the consulate, they told her that she didn't need to bring in the original I-134 forms at all which is puzzling. She has retained the originals and I told her to drop them off at the embassy information window.

It's also strange that the customer service when she calls about the case, they tell her that she doesn't have bring in this original I-134 form. I am puzzled at the response.

She is currently on administrative processing and I am wondering whether that has any connection to her case. Why would an embassy not want to take the original I-134 forms when I thought that was required?

I got a reply from the embassy regarding the case and they told me about:

"section 222 (F) of Immigration and Nationality Act, which states that the visa records are considered confidential and can be used only for the formulation, amendment, administration, or enforcement of the immigration, nationality, and other laws of the United States"

I am trying to understand the implications of what this means. I supposed that only the visa applicant can inquire accordingly and not the sponsor?

I think that they would be running the AP on it right now. Sometimes they seem to pre-approve stuff but they run it through the security checks afterwards...

Actually only the I-134 form is required for DV applicants who cannot provides the savings. It's rather unusual because it is an immigrant visa application with some rather taken criteria from the non-immigrant visa stuff. They don't even need a I-864 form for the DV application.

I would have loved to figure out the DV process as the person in interest is undergoing her administrative processing (3 months less 3 weeks) so basically it's hard to figure things out....

Sponsorship for K visas is quite flexible, as it is for all of the non-immigrant visas. It's the immigrant visas that have the strict requirements, embodied in I-864.

The possibility of marriage fraud is not the issue here. The issue is will the visa applicant become a public charge once they enter the USA.

Again, I don't know whether or not a sponsor is required for the DIV program. My guess would be not.

I'm not intimately familiar with the Diversity Immigrant Visa Lottery program, but I don't find any mention of sponsorship in the instructions on the DoS web site.

Being an immigrant visa program, and the instructions do say that applicants must meet all of the INA requirements for an immigrant visa (or for adjustment of status, if appropriate), then I guess that the I-864 affidavit of support would apply.

So yes the DIVL is different from the non-immigrant K visas, one way or the other, with respect to sponsorship .

I was wondering whether the embassy cares about who the I-134 sponsor is for a K-1 or diversity visa applicant. I got into some argument with a friend that if a "complete stranger" does fill out the I-134 form for an applicant then that would be a red flag. However, I did mention that non-profits do fill out I-134 forms for applicants and there doesn't have to be an explicit relationship between the I-134 sponsor and the applicant directly.

I wonder what the embassy's take is on this?

I can't speak for Montreal par se but my girlfriend's interview with the consulate in Tashkent was very rough and rather "ruthless". I am grateful that she made it out alright at least.

They will be following the law of letter and they pretty much the right to ask anything they want. It's like your private life under scrutiny.

The consulate will be tough and just pray that you can get through it all.

THat would be very rare. Often the AR process is extremely secretive so you wouldn't know anything about what goes on.

Your comment about Russia being blacklisted was the first I had heard anything about that. Can you tell me more about what you mean?

I am giving them 6 more days on mine then I am going to try to follow up a bit. I am going to call again Tuesday night of next week and check on the statis. If it is still in A/R I am going to start trying to contact my congressman next Wednesday. If it does any good I will let everyone know.

Ironically enough the VJ'r with the closest time line to mine as well as the same regional center and Embassy will have his interview two days after that. I never got jealous over someone with more money than me, a fancier car or a prettier woman, but I am very jealous of that lucky dude.


Russia is on the political outs with American in general particularly since Russia has some connections with Iran especially with the nuclear crisis. I was talking with some of my Russian friends and it seems like that they are conducting more security reviews on everyone coming from there.

Honestly, the same problems are occurring in other FSU countries too. Even Uzbekistan seems to have AP quite a bit on their lists, esp. for visa lottery winners. Honestly, being jealous of someone with quick approval is understandable. But patience is the key.

I found that rushing the whole process is a red flag for the embassy. They seem to like to feel that they are in control. :(

I am just curious how many others find themselves in that big black hole called Administrative Review, how long you have been sitting there and what courses of action you have been taking?

Mine has been there for 6 weeks. I am giving it 4 more and then going to contact my congresman's immigration specialist to see if they can help. I know of no reason for it. It is the second K-1 for both me and my fiancee (not to the same person). I am guessing they are checking to see what happened on her last K-1 which she stayed here for 30 days and returned home well ahead of the 90 day period she was allowed. Other than that we have a clean slate.


My friend, IF YOU HAVE BEEN WAITING AT LEAST 3 months since you mailed in I-129F, CALL your US REP local office and also call both your US Senators offices, and tell them your situation and you need help, they should either have you come to local office and fill out a "Congressional Inquiry" form or mail one to you or have you write a letter and mail or preferrably fax it back in to them. This Congressional will get you an answer within 48 hours and get USCIS off their ### and moving. Sorry to say it but sadly the only way to speed up this process and get what you want is to demand and complain to politicians, believe me it works. I know from experience, I found out hard way, I believed that if I followed rules and did what instructions said everything would go fast and well, and I have learned from reading what others have done on here, if you notice there are some people on here that will apply at same time as you and will be approved within like 3 to 4 months and have k1 interview and visa approved, it is no luck thing or accident, they had some help or contacted those politician offices within 2 to 3 months of applying to move and speed up the process. I know it is not right and a person should not have to do it, but hopefully by now you will have learned this by reading other posts, if not call them now. Also a potential problem with Russia women is fact of where they come from, things are still icy cold with their government and ours behind the scenes more so than we know. Thus it slows down the visa process. :D

Honestly, immigration is becoming tougher and tougher. And sadly enough, AP will become a longer and longer process....

alright, updates from me, they told me that It is now going through Administrative processing , I asked them that last time I was told it's under administrative review. she replied:" it is the same thing" ......... she said it's out our nvc's control and she doesn't even know which agency is involved in this. 55555555555555555 damn

Strangely enough I am disliking administrative processing due to the lack of transparency. It's one of the few things I find a lot more mysterious than say the 1040A!

Hopefully the 2.25 months will be over soon and the DV visa will be issued. But it's a matter of time :)

A Wang, What is a 222-F? I know from first hand experience what a 221-G is but have not heard of a 222-F. I am guessing it is a denial and it leaves you up the creek without a paddle but that is just a guess.


222F is a provision under the Immigration Act that does not allow a person who isn't the applicant him/herself to inquire into the status of an pending case due to privacy issues. In fact, this is invoked if a person such as a sponsor tried to ask about the status of administrative processing via e-mail, etc.

NY Girl, an administrative review as near as I can tell is when something signals them that they need to look at an application closer. It may be the name is the same as someone who has created a problem or something to do with a prior problem such as wanting to check on a previous visa. I don't think anyone knows all the answers. It seems like it can come at any stage, whenever they find somethng that they think might be a red flag. Mine & Bins came at NVC. Omoba's came after the interview.

After you get your NOA-2 the regional center sends it to NVC. There it is assigned a case number based on the Embassy you will be using and the date it was processed. They then forward all the files for each embassy directly to the Embassy. The Embassy then of course arranges the interviews.

Sorry but after consulting with a few immigration lawyers, I found that the congressman can't influence the administrative processing much at all since it's an out of country issue. Pretty much the consulate has the final say and they seem to take however long they want to with AP process.

Sadly enough, there's no real way that you can speed up AP process especially with CP (AOS is different but I think that it can be more influenced). Found that out the hard way.

I can see if the ap is at the foreign embassy but in my case and Bins case we were early in the procedure and ours went from the regional center where it was approved to NVC where they put it in A/R and sent it to Washington? Just curious if you have any thoughts.


That is correct. If your A/P moves to the NVC within the States, then the congressman approach may help although this isn't too surefire. The toughest thing is trying to track down where the application is. For example, the diversity lottery case I'm working with is at the embassy itself so no US legal method can be useful here. It's a wait and see. However, if it got sent to Washington then it would be a better shot.

Of course, the worst thing is when you call up and get a 222(F) which is bad! They can be rather private on a ton of things! :(

AP or AR is administrative processing or administrative review... that's like a FBI name check and background type of search to ensure that your documents aren't fraudulent. Right now my girlfriend in Tashkent and goodness only knows how long that it will take.

Hers need to be moving fast because the deadline of Sept. 30 for DV winners is coming up quickly.

Quelques nouvelles... Mon histoire avec la paperasse avance doucement, tres doucement, mais surement... J'ai eu mon EAD courant Mars et je suis toujours en attente de nouvelles a propos de ma GC.

Mon dossier avait été transmis en Californie début décembre et j'ai recú ma GC... aujourd'hui :D

J'ai juste du refaire ma visite médicale ($300 de perdu et je n'ai toujours pas compris pourquoi :wacko: )


J'ai tout envoye fin octobre, eu un RFE le 30 janvier (pour un papier deja present dans le dossier) et mon dossier a ete aussi transfere en Californie. J'attends toujours des news. Merci pour ton 'update', je dois encore etre patient.

Cela dit, je n'ai pas perdu mon temps. Prof de CP en France, je suis sur le point de retrouver le meme job ici... Enseigner le Francais a des eleves de Grande Section ou en elementaire. J'ai du passer des exams en Francais (Praxis sur ordinateur et un test oral a venir pour obtenir une 'teaching certification', pour verifier le niveau de mon francais :whistle: ), une interview telephonique, tout un tas de papier a reunir (dont l'equivalence de diplomes, qui est toujours en cours, qui coute la peau des fesses, et dont la traduction prend un temps fou...). Bref, ca devrait etre bon pour la prochaine rentree !

J'avais moi aussi demande des infos avant mon mariage donc je me suis senti oblige de remplir la paperasse une fois leur reponse obtenue.
J'avais tout rempli en temps et en heure (30 jours avant la date de mariage je crois), mais n'ai jamais recu de certificat de capacite de mariage parce qu'il n'avait pas eu le temps de traiter mon cas...et ca n'a pose aucun probleme.
En gros, tu peux zapper : gain de temps (ca m'a fait perdre un mois dans l'envoi de ma paperasse pour l'AOS et l'EAD) et moins de prise de tete.
La transcription et la production du livret de famille ont elles etaient plutot rapides !

Perso, je pense la prendre. Avec tout ce que j'ai pu entendre lors de la campagne republicaine, ca donne envie de voter et d'exprimer son opinion dans le pays dans lequel on vit. Et en cas de deces d'un des conjoints, ca facilite le transfert des biens. Ce sera un souci de moins dans des moments pas faciles ! Je ne suis pas de nature pessimiste non plus mais bon !

Ben franchement, nous si on avait pu éviter de se marier on l'aurait pas fait, mais vu les circonstances on avait pas le choix.
On te force un peu la main, en France par exemple, le PACS suffit pour une demande de carte de résidence.
Après tout çà, c'est un truc subjectif hein... Mais clairement nous, si on avait été tous les deux de la même nationalité on ne se serait pas mariés.


Nous, on aurait surement attendu plus de temps egalement... C'est vrai qu'on te force la main...
Une autre personne parlait du fosse culturel pas si important entre francais et americains... Je le trouve deja bien assez large, et meme si nous partageons les memes valeurs, la culture et la vie quotidienne sont tres differents selon moi !
Apres, ca depend surtout de la volonte des personnes d'en faire un atout ou un handicap !

Pour le coiffeur, c'est vrai ! Ma coiffeuse me disait qu'elle n'avait pas de diplomes, et qu'elle n'en avait pas eu besoin pour etre embauchee !


Sinon, petite question.
On va faire un trip a NY dans un mois : n'ayant pas encore de GC, mon passeport, mon visa (expire) et mon EAD sont-ils suffisants pour voyager sereinement ?

Je viens aux nouvelles.

Il y a plus de 3 mois, j'avais envoyé mon AOS. J'ai passé mes biometrics 2 semaines plus tard à Idaho Falls (très sympas d'ailleurs) attendant impatiemment mon permis de travail...(j'ai déjà trouvé un employeur...).
Aujourd'hui, j'ai reçu un RFE me disant qu'ils n'avaient pas reçu de birth certificate traduit en anglais alors que j'en avais fourni un plurilingue... Bleeeeeeeeh ! Ils n'ont pas dû prendre la peine de retourner ledit certificate pour y trouver la traduction.
Je vais renvoyer le certificat plurilingue + un original en français avec la traduction pour les 2, faites par moi-même...d'après vos différents témoignages, ça passe...

Bref que de temps perdu, que du bonheur...

2 jours de neige en Idaho seulement, méga les boules : pas assez de neige pour skier...
Mais le temps passe vite malgré tout !

Je viens aux nouvelles, déjà 3 mois aux US...le temps file!

Marié le 24 septembre par un juge, dans la salle d'une église lol... Pas de salle des fêtes comme en France, la location d'une salle dans une église s'est révélé le meilleur rapport qualité/prix/côté pratique (avec la cuisine à dispo)... Simple et efficace comme on le voulait (trop risqué de le faire dehors à cette date dans l'Idaho même si, au final, il a fait 25°....). Et il a neigé 2 semaines plus tard...

Petits détails.

1) Le Consulat de San Francisco m'avait tanné pour publier les bans... Ma demande effectuée dans les délais, ils n'ont pas eu le temps d'envoyer un certificat de mariage... Merci !
2) Pour avoir la marriage license dans l'Idaho, il a fallu que j'aille au bureau de la sécurité sociale pour qu'il me produise un papier comme quoi je n'ai pas de SSN... Sympa l'attente avec la musique d'ascenseur...
3) Vous pouvez avoir votre SSN dès votre arrivée, jusqu'à 15 jours avant expiration du visa, sinon il faut attendre l'EAD. Allez au bureau de la SSN avec ce papier au cas où l'employé ignore ce droit.
Les K1 sont des 'Legal alien allowed to work'!

Toutefois, la bonne foi des usagers ignorant cette procédure autorise en pratique la transcription de l'acte de mariage étranger établi dans les formes usitées dans le pays de célébration."

Bouh, j'croyais que tu avais lu tout l'ancien post....



Ben j'ai tout lu une fois...
Mais quand on est entrain d'obtenir son visa, toute la procédure à réaliser une fois aux US reste floue et ne me parle pas forcément, n'a pas trop de sens.

Maintenant, je commence à mettre tout ça en ordre et j'essaie de retrouver toutes les infos.
J'avais aussi lu dans l'ancien forum que le Consulat de San Francisco était plus à cheval sur la paperasse. Apparemment, ça a l'air d'être aussi le cas à Chicago :P .

Avoir un résumé de la procédure en un post = plutôt cool pour les nouveaux ;)
