My Bio Notice showed up today. Post Office managed to cut the lower right corner off. Fortunately it didn't hit either of the bar codes or any important info. And the appointment is at 8am. Yuck. Seriously tempted to try a walk-in.

"Priority Date" is the date they use to determine what order to process applications in to maintain a "first come, first served" order, and also the filing date they use when determining if an application has gone over it's processing deadline and should be moved to the front of the line (for example in response to an inquiry from a Congressman's or Senator's office).

It's not terribly relevant in N-400 applications, but they're very important in others, like I-130 family petitions that have enormous waiting periods and don't typically get handled for years after the initial filing.

I received my NOA1 today as well. Biometrics notices, just as with AOS and RoC, are sent separately, though my coworker who is doing this too says he got his bio notice very soon after the NOA1, significantly sooner than how long it took during AOS and RoC. So I think we can probably expect to start seeing bio notices within the next week or so.

I'm assuming we're posting the NOA1 issue date, as opposed to the arrival date.

HM: Good to see you too.

My package has arrived at the Phoenix Lockbox. Delivery confirmation shows it arrived yesterday, October 16, at 10:43 am. Which is a day later than UPSP estimated it would get there. Ah well. The check hasn't been cashed yet, though. I imagine that's another day or 5.

The ball is back in their court now. Next steps: Confirmation email, check cashed, NOA1 and bio notice.

A coworker of mine is doing his N-400 right now too. He sent in his a couple of weeks ago. He said his NOA1 and bio notice came within 2-3 days of each other. He just did his biometrics yesterday - said it went very smoothly, which it should, after all the experience we've had doing them. :)

I just had my citizenship oath on Wednesday, and went to register to vote today.

 

It is not that much of a stretch to walk out of the IO's office from the N-400 interview thinking you're a citizen. The IO sometimes won't make the distinction between N-400 approval and citizenship [and the necessity of swearing an oath before you're actually a citizen] all that clear. It's quite possible to miss it, particularly if your English literacy is very weak (just this side of what's needed to pass the interview).

 

It is harder to see how he got out of the IO's office not knowing there would be an oath ceremony. My IO made it very clear that there was an oath ceremony and when I could expect to get the notice. He even told me that the answer to all the questions on the oath ceremony notice questionnaire were "No". smile.png

 

In Utah, registering to vote requires no ID. You fill out a form and mail or deliver it to an office at the county. The form asks you straight up to check "Yes" if you are a citizen, directs you not to fill out the rest of the form if the answer is "No", and has warnings of fines and jail time if you register to vote knowing you aren't eligible (in English and Spanish). They give you enough rope to hang yourself, but appear to place no real boundaries to prevent fraudulent registrations.

 

Apparently they do check everyone's ID at the polling place. Looking at the list of documents they'll accept, it may be theoretically possible for PRs to slip through and vote. [They're primarily looking at driver licenses, which are available to PRs.]

 

I don't know when or how ID is checked if you request absentee or mail in ballots.

 

I strongly suspect "I wasn't told I needed an oath ceremony, or that such a thing existed" will not wash, particularly given how the M-476 Guide to Naturalization describes the process in detail.

 

TL;DR: Lawyer up!

The passport card is the cheapest and easiest-to-replace proof of US citizenship available to the naturalized US citizen - that's why you want one.

 

If my wife or daughter ever need to replace their proofs of US citizenship, they can go to the county health office, drop less than $50, and get birth certificates. We can't do that. The passport card is significantly cheaper to replace than a lost passport book, and both are far faster and cheaper to replace than a naturalization certificate.

 

[The card is also much more durable than either the passport book or certificate as well. It can survive a fluid spill that will positively destroy the other two.]

Depends if applying for the 3 or 5 year, 3 year can take an hour.  Want all that proof you are living and paying taxes and bills together.

 

Ha, the USCIS states the most important issue about becoming a US citizen is the right to vote.  But the two parties have this situation well in hand with ID's, redistricting, and that outdated electorial college.  If you live in a state with just a handful of electorial votes, don't even care how you vote.  Wife's first experience in voting was for a local election where 95% of the candidates ran unopposed!  Why am I even wasting my time voting was her comment.

 

Greatest motivation for gaining US citizenship is to finally become free of the USCIS that has been dictating your life for the last 4-6 years.

At my naturalization interview for the 3-year rule I was in and out in 15 minutes. I was let in 15-20 minutes early and was actually out of the building with a recommendation for approval a few minutes before my "official" interview time even hit. smile.png

 

The N-400 interview is really just the bureaucratic necessity of an actual human being checking your reading, writing, speaking, and civics test results, as required by the wording of the naturalization laws as written by Congress. If USCIS could figure out how to put those on a form while complying with federal naturalization law there would be as relatively few naturalization interviews as there are AOS and RoC interviews. I've never seen a reference on here to anyone failing a naturalization interview who had followed the N-400 instructions properly in the first place. It's really not something to stress about. [Generally speaking, the USCIS interviews (AOS, RoC, Naturalization) are not much to worry about if you have a "normal" case. DoS deny visa applications all the time, sometimes for arbitrary reasons, depending on your country of origin, and that can reasonably make us feel skittish right through the rest of the immigration process, but USCIS will usually only deny something if your case is way out there and/or you completely failed to read their instructions.]

 

Amen and +1 to getting free of USCIS. We were cleaning out my wife's purse and she had a bunch of old roadside assistance cards from our insurance company, and we were going to throw them out. A tiny part of my brain objected for a split second, worrying about "USCIS relationship evidence" until the rest of my brain remembered "Oh, yeah... we don't actually have to do that EVER AGAIN... thank you God!" smile.png

 

In the solidly red or solidly blue states the real power isn't voting to determine which party gets elected - that's a foregone conclusion. But you can still wield a significant amount of voter power - just register for the dominant party, whether you generally agree with them or not. Doing so does not obligate you in any way to vote for them, but does gain you access to their primaries or caucases - voting on who they put up. That's where the voter's real power is in deeply red or blue states.

US Citizenship General DiscussionCan you change your full name to whatever you want at the interview?

One of the purposes of the interview is to check and, if necessary, revise any aspect of the N-400 form that needs modification before the adjudicating immigration officer signs off on it. So yeah, I don't think it will cause any problems if you let the IO at the interview know that you do, in fact, want to do a legal name change as part of your naturalization.

 

FYI: the name change officially takes place during the oath ceremony, not at the interview. Name changes in the US are technically done as motions to a court, as are [technically] the naturalizations. USCIS is not legally empowered to make anybody a citizen, or change anybody's name. Only a judge can do that, by approving a motion during a session of court. So every oath ceremony is actually a session of court - USCIS formally submits a set of motions to have the approved immigrants be naturalized, an officer of the court administers the oath, and the judge approves the motions. Your name change, if you choose to have one, is one of the motions in the big bundle of motions USCIS submits to the court, in addition to your naturalization, and it is approved by the judge with the rest of the naturalization motions.

You will get a booklet at your biometrics appointment which will have all the 100 questions you need to study. My husband just used that booklet and an app he downloaded onto his tablet (don't remember what the app is at this moment). There really was no need to take a class. They ask you 10 questions out of those 100, and once you answer 6 correctly, you have passed the test.

 

+1 above. As well, the study booklet USCIS give you at your biometrics appointment, which includes all of the questions (with answers) and all of the words used in the reading and writing tests, ALSO includes an audio CD with a track for each of the 100 questions and answers. Just pop it in your car's CD player and listen through it 2-3 times a week (it's about 35 minutes long altogether) while commuting, and you'll be able to answer the questions in your sleep by the time the interview rolls around!

 

The class might be fun and interesting for its own sake, and would definitely be a good way to meet fellow immigrants going through the same process, but isn't really necessary just to pass the test. USCIS give you enough free material to do that on your own.

I must disagree emphatically with the above post. China, Germany, Denmark and India, and many other countries, take the renunciation clause of the US citizenship oath very seriously. Upon discovering that you have taken the oath, they consider you a non-citizen retroactive to the instant you repeated those words at the oath ceremony. People are actually in jail right now in Germany for having "fraudulently" used a German passport after having thereby renounced their German citizenship. [There is a way for a German citizen to not lose their German citizenship when taking the US citizenship oath, but that's a separate issue.]

 

It sounds like Croatia is more like Canada - they don't take the renunciation clause seriously and consider you to still be a citizen unless you do specific denaturalization paperwork in front of a consular officer at their embassy.

 

When I took the oath I felt it to mean that, if there was ever a situation where I would have to choose between loyalty to Canada or loyalty to the US, I was promising to be loyal to the US. I feel attached enough to the US, and detached enough from Canada, that I can swear that sincerely. But as they say, taking US citizenship is a very important, far-reaching, intensely personal life choice, and part of that life choice is deciding if one can sincerely and honestly swear the renunciation clause, along with the rest of the oath. I would say that if you sincerely can't reconcile yourself to a reasonable interpretation of that oath, then you have no business becoming a US citizen. It's not like you're forced to, after all.

 

Thankfully, there is very little likelihood of America and Canada ever having seriously divergent national interests, so I don't anticipate ever having my loyalties tested to that extent. But I would be prepared to prefer the US to Canada if it came to it. If I wasn't, then I would have had no business taking the oath, in my humble opinion.

 

P.S. I think the likelihood of Croatia and the US ever having seriously divergent interests is pretty low too, if not quite as low as for Canada. smile.png

 

In specific answer to your question, the renunciation clause is absolutely NOT optional. If you tell the immigration officer at your interview you can't take that part of the oath, they will be forced to declare that you are not legally qualified to become a US citizen.

If you go to USCIS's website, in the Citizenship section, they have a downloadable booklet called Guide to Naturalization. In this book there is a flowchart you can work through that will explain, step by step, how do do all of the in-country/out-of-country calculations to determine whether she is elegible to apply for naturalization.

 

I strongly recommend you read that book several times, and work through the flow chart with her. The rules that determine whether a person qualifies to apply for citizenship are much more complex than those for any other USCIS process, and some of them are a little confusing. It depends on a lot more than just the 2-3 facts you given us about her, and working through the flowchart is the only way to know for sure.

I think, generally speaking, that needing a passport of country <X> to enter country <X> if you are [still] a citizen of country <X> is pretty normal, if not universal. I don't know for sure if Canada has this requirement, but all of their online material that I've seen recommends in the strongest possible terms that Canadians use their Canadian passports whenever they would need to use a passport.

 

I would personally love to know, from some authoritative source, if a Canada-US dual citizen is in violation of Canadian law or regulation if they enter Canada with a US passport and do not disclose or mention their Canadian citizenship to the border officers. I may try hitting up the Denver consulate or Canadian Border Services to find out. It'd be nice to know if I'll need to update my newish Canadian passport a few years from now, or if they'll accept just a US passport (perhaps in conjunction with an expired Canadian passport, which as I understand it still proves Canadian citizenship in some contexts).

 

The complication where retention of Columbian citizenship is required to maintain ownership of Columbian property and Columbian financial accounts is not as widespread, thankfully, and a culture of [apparently] widespread minor corruption in the Columbian government minor officials certainly isn't going to help things either. Oh well, not much that can be done there.

You submit 2 with the application, as the requirements state. At the biometrics appointment they will take your picture. The biometrics picture is the one that will be printed on your Naturalization Certificate, so you'll probably want to try to look nice for it. :)

 

The interview notice documents checklist, as well, will recommend, but not require, yet another pair of passport photos. I didn't bother, and the IO never even mentioned them. So I wouldn't worry about those.

Be aware, when filing based on 3 years of marriage, you can send the packet 90 days before you have been a PR for 3 years, but you must have been actually married for 3 full years at the time of filing. In other words, you can't file under after your third wedding anniversary.

 

I have never done tabs, hole punching, page numbers, or any such thing for any of my USCIS filings, and everything has always gone perfectly smoothly. I typically just have everything neatly ordered in a file folder, in the order listed in my cover letter, multipage documents or forms stapled together but everything else just lose in the folder, and slide that right into a UPSP cardboard mailer. Remember, whatever you do to package it, they'll just have to undo it to get it into their binders and clips the way they like it. Don't worry too much about it.

I filed based on three years. I filed in mid-October last year (a few weeks after I became eligible), my interview was at the end of April, and my oath ceremony was June 12. It had always been our intention, right from when we filed the initial fiance petition, for me to apply for citizenship as soon as I became legally eligible to do so. The biggest reasons for me were being able to vote and, even perhaps more importantly, setting my wife and mother-in-law free from their affidavits of support and the associated requirement to do change of address notification to USCIS.

 

As besaangle said above, I sent only the documents specifically required by the N-400 for relationship evidence: the tax transcripts. I gathered some slightly updated material from the RoC filing to fulfill the relationship evidence line item on the interview notice, but the IO never even looked at any of it. 

 

It's a really good feeling not having to worry about keeping relationship evidence anymore. smile.png

 

Omeka: Both. In order to file for naturalization, it has to have been at least three full years since your wedding day, and at least two years and nine months since the "Resident Since" date on your green card.

If you ever, for any reason, show USCIS a tax return in which you indicate that you were or are a non-resident of the US, they will agree emphatically, keep your GC, and send you back to wherever you claim to be a resident.

Since your son is a minor, he does not fill out his own N-400 - he will obtain US citizenship automatically at the instant you do, assuming he is still living in your custody and currently has a green card, as a consequence of the Child Citizenship Act of 2000. You have to include him on your N-400 anyways, as it asks for information about all of your children, including adopted children and stepchildren, regardless of their current immigration status or citizenship. It is my understanding that you will need to include a biometrics fee for him, but not a separate application fee.

 

I don't know if children receiving derivative citizenship through a naturalizing parent can have their names changed at the oath ceremony. I suspect not. Not only does the N-400 form lack a place to record such a preference, but there appears to be no procedural way for a child's name change to happen during the oath ceremony.

 

The name change is accomplished by USCIS presenting a motion to the court for the name change as part of the collection of motions for naturalization that they present during the oath ceremony (which is a session of law court, technically). You become naturalized when the judge approves the motion to naturalize that the USCIS representative presents on your behalf, and your name changes when the judge approves the motion of name change that USCIS presents on your behalf. USCIS presents these motions, and the judge approves them, as part of the oath ceremony.

 

The derivative naturalization conferred on the child by the Child Citizenship Act does not appear to be directly conferred by the judge approving a motion for naturalization, the way it is with the primary applicant. Since the judge does not, as part of the ceremony, approve any motions directly relating to the child at all, the child's name can't change, since there is no motion before the judge asking for it to change. I could be wrong though about this though, I only play a lawyer on TV :)

 

The N-600 Application for Certificate of Citizenship can only be filled out for your minor son once he is actually a US citizen, which only happens when you become one at your oath ceremony, at the end of your N-400 process. So no, you don't fill it out yet.

 

It is very arguable that you don't really want to do an N-600 for your son at all. It is quite expensive and only gets him a certificate that he doesn't really need. About the only thing a certificate of citizenship is good for is getting your first US passport. After that, the US passport and/or passport card will be a perfectly good proof of US citizenship, and he won't need the citizenship certificate for anything else. It is my understanding that you can order him a US passport and passport card using your certificate of naturalization, since his citizenship will be a direct result of your citizenship. One of the Yes/No questions asks if you have been cited, among things. A traffic violation is a citation. If you've ever received a ticket, you have been cited. So you have to answer yes there.

 

The instructional text surrounding that section says if you answer yes to one of those questions, provide an extended explanation on a separate piece of paper. Your cover letter is a good place for this.

 

None of this is optional, for traffic tickets or anything else. You have to report it and explain it.

 

What you do not have to do, if the only penalty was a small fine and/or license points (a set of conditions obviously intended to capture minor traffic violations and not much else) is provide documentation (certified copies of the citation, related court documents, etc) relating to the incident. That doesn't mean you don't have to report it. Reporting citations, even minor traffic citations, is not, by my read of the N-400 instructions, optional.

Since the transition from whatever status you were filing as before to Single happened after your last immigration filing, it does not imply any misrepresentation in your last immigration filing. And since your current filing has nothing to do with your current martial status at all, I think you're in the clear.

Since you're applying based on 5+ years of PR status, your marriage is completely irrelevant to whether you are qualified for naturalization or not. It shouldn't make a difference to this application.

 

In the worst case scenario, this could introduce doubt into the IOs mind as to the validity of your marriage. I don't know if you obtained your PR status through marriage, or if you had a Removal of Conditions. You obviously got through those, if you had them, so your evidence of relationship, including tax returns, must have been acceptable then.

 

The worst possible scenario is that your tax returns, as they stand now, prompt the IO to wonder if you materially misrepresented yourself in a prior filing. If you are found to have misrepresented the state of your marraige at a previous RoC or AOS filing, that could result in the denial of this application, and the retroactive denial of your PR status. But if you tell the truth, that this is mere tax preparer error (How many years returns are incorrect anyways? If it's just one that's almost certainly no problem. If you've been filing as single for the last decade, that's a much bigger problem) you should be fine.

Particularly the eligibility worksheet in the last section.

 

That section includes a detailed flowchart that lists all of the requirements to file for US citizenship. One of the requirements is having lived in the US for a certain minimum of time, which it sounds like they haven't.

 

On that basis alone, any application for citizenship they make will probably be denied. USCIS will also need proof that they're paid US taxes for the last 3-5 years. If they can't show tax transcripts for the last 3-5 years, that would probably cause a denial as well.

With USCIS, you only ever send photocopies. If they feel a deep and pressing need to see the original, they will send you an interview notice and tell you to bring the original there.

 

Through the entire process, from I-129f through citizenship and passport, only two offices have wanted an original document from me:

  • The US Consulate in Vancouver state in their Packet 3 that they will keep your long form birth certificate unless you bring in a photocopy to your interview.
  • The passport folks need to borrow your original Certificate of Naturalization to issue you your first US passport and passport card.

Every single other form, process, petition, or application has only needed photocopies of documents.

This would seem to state very clearly that actually cohabitating is required. If you follow the footnotes, you will see

Under very limited circumstances and where there is no indication of marital disunity, an applicant may be able to establish that he or she is living in marital union with his or her U.S. citizen spouse even though the applicant does not actually reside with citizen spouse. An applicant is not made ineligible for naturalization for not living in marital union if the separation is due to circumstances beyond his or her control, such as:[30]

 

  • Service in the U.S. armed forces; or

  • Required travel or relocation for employment.

 

USCIS does not consider incarceration during the time of required living in marital union to be an involuntary separation.


Footnote 30 links to the actual immigration law, which states:

 

(b) Marital union.
 

(1) General. An applicant lives in marital union with a citizen spouse if the applicant actually resides with his or her current spouse. The burden is on the applicant to establish, in each individual case, that a particular marital union satisfies the requirements of this part. and

 

© Involuntary separation. In the event that the applicant and spouse live apart because of circumstances beyond their control, such as military service in the Armed Forces of the United States or essential business or occupational demands, rather than because of voluntary legal or informal separation, the resulting separation, even if prolonged, will not preclude naturalization under this part. 

So there you have it. You will need to prove to the immigration officer that the reason you are not cohabitating is adequately described by the language written in the law. It's pretty much up to the discretion of the immigration officer whether or not you succeed.

 

I recommend reading all of the relevant sections of both the Field Adjudicator's Guide and the CFR. Doing so will give you a much better idea of what specific words and phrases to use in your N-400 cover letter to convince the adjudicating IO that you are in compliance with the laws and regulations as written.

So you may be ok, but the onus will be on you to prove to the immigration officer at the interview that your separation is "beyond your control", and due to "essential business or occupational demands, rather than voluntary legal or informal separation". 

 

Interestingly, the next section of law specifically excludes incarceration as counting as "involuntary separation".

A quick scan of the M-476 Guide to Naturalization seems to say yes... and no. The text in the main body of the document says that you must be living with your USC spouse petitioner, and that you must have been living with your USC spouse petitioner for the last three years.

 

The flowchart at the end, on the other hand, states only that you must be living with your spouse at the time of filing, but does not mention the requirement of having lived with your spouse for the last 3 years.

 

Either way, you definitely need to be living together at the time of filing, so that may disqualify you right there.

 

The flowchart is, by design, a summary rather than an exhaustive reference, so on that basis I suspect that you do need to have been actually living together for 3 years. But I seem to recall reading recently that they may not hold separate living arrangements against you if you have a really good work-or-eduction-related reason. Search the citizenship forum for "Field Adjudicator's Manual". It has more detailed information than the more basic material intended for the general public, and a few of the members in here are reasonably familiar with it and quote from it from time to time.

 

At any rate, all of this only applies to naturalizing after 3 years. If you wait until the 5 year mark, your living arrangements with your spouse will be completely irrelevant. It may be worth waiting rather than risking the [substantial] N-400 fee if you can't find an authoritative answer.

When you send the form, they require no proof at all other than the tax transcripts.

 

At the interview, they are within their rights to ask for more proof, both of the continued marital union and, as you say, of cohabitation. But it seems like they rarely do, unless something in your previous immigration file (which they have access to) prompts them to.

 

At my N-400 interview, the IO wasn't much interested in seeing anything I brought in, and that is apparently not uncommon.

For the N-400, your read of those "OR"s is correct. You can just send tax transcripts. That's all I did.

 

The interview notice will come with a checklist of documents to bring. One of the line items is relationship evidence, similar to that requested for RoC. For that I looked through the list of evidence I sent in for RoC, and took 2-3 items from each category that I sent in from RoC covering the period of the last year (since my RoC filing).

 

The IO had no interest in looking at any of it. smile.png
