K-1 Fiance(e) Visa Process & ProceduresGetting married before fiance visa approved
We are in the same situation Lee - we have booked for October next year so we have time (RFE's excepted) but it's getting nearer every day (and to think my math teacher said I'd never amount to anything!).

Good luck to you both!!!

K-1 Fiance(e) Visa Process & ProceduresCo-Sponsor's Credit Rating Affected
Hi All,

We have to ask my fiancee's Mum to be our co-sponsor - as well as self-sponsor based on the positive equity on my house here in Northern Ireland.

Anyway, does anyone know (and Yes I did search) if her Mum's credit rating would suffer as a result of becoming our co-sponsor on the K-1 visa?

Just want to get armed with the info before we go cap in hand-ing!!!

Thanks,

Sh1te ...

Using a foreign based address had better not mean a return - we have no current USA address on our i-129-F and we got our NOA1 OK to the UK. We did put a USA address on the i-129F form 'Question 14. Address in the United States where your fiancé(e) intends to live.'

Doesn't it make sense that some people might be living together in other countries and not have a USA mailing address for whatever reason?

Worried now!!!

K-1 Fiance(e) Visa Process & ProceduresCan I get away with planning a real wedding now?
We booked 12 months in advance of applying for a wedding in Oregon ... yeah I know it's probably dumb but we figured since a lot of people can't fly on short notice from Ireland and we won't be able to book the place we want on short notice either we'd take the chance.

We paid a not too big deposit that we get back if we let them know we are shifting dates a month beforehand - also, people can book time off work now and then book plane tickets etc after we get the OK ... sorry, IF we get the OK.

If you have no criminal convictions, no visa overstays and enough money for your affidavit of support then even with a RFE most people are OK on 12 months.

I realise now I've typed this I've probably just put a jinx on our application which will probably be granted the day after we were supposed to get married but ....

So that's my two cents. Would I advise other people to do the same as us? Probably not ... just in case.

Hi All,

I've been offered a new contract in the UK up until November which is a great opportunity career wise and it's DOUBLE the pay I recieve now.

The problem is it's a contract until November and we get married in October (provided we get our visa).

Can I take the job, go to the USA for our wedding then come back to the UK and finish the contract and then depart for the US full time? I know there are rules about this but I'm not clear if they make an exceoption for things like work etc.

And no, I can't start the job and then leave in October - it's a project one would have to see out to the bitter end!!!

It's over to you guys.

The SSA does NOT grant work authorization, The Department of Homeland Security does. SO the SSN by itself is NOT work authorization, EAD, Green-Card or US Citizenship is what authorizes work.

You may want to read the requirements on form I-9.

Ta!!! I'm guessing that by asking for your SSN on the form it means it's out the window!!! Anyone else feel a bit of a slob lying around for months before you can work? We will get married about 2.5 months after we go there - I sincerely hope I can work before that!!!

Hi,

I'm sure this has been asked but I did a search and can't find the answer.

I already have a work authorised Social Security Number from a previous US Visa. It's obviously still valid and will be in place and I still have the card. Does it mean I can skip EAD once I arrive on a K-1 and start work - legally - the next day if I wish?

K-1 Fiance(e) Visa Process & ProceduresSpelling mistake on NOA2!
Hi there,

When we recieved our NOA1 our address was fine, as were the names and all that stuff.

My SO changed her address from Belfast to Oregon during the NOA2 waiting period and when she got the NOA2 the address was spelled wrong - Buren St was spelled Bueren St - and I just notived last night when she came back from spring break in the US.

Anyway, if it was on our NOA1 I'd call 'em up and change it right now but as our application is onit's way to the embassy it makes things trickier. And it's such a small error that it didn't stop the postman delivering the thing.

Should I fret and get it changed or just correct it on my DS-230 and point it out in the interview? Also, SO let her cell phone fall down a toilet and her cell number has changed since our i-129F. Again, just note the new number on DS-230?

The eldest is going to be 18 the day before we marry and being male he will b harder to get in ... but he likes the place to visit but hasn't expressed any desire to live there. My daughter is 15 so she's OK.

It's really about giving them options and needless to say I'd love them to be closer than the 8,000 miles that will be between us soon.

Thanks for the heads up about the different processes.

I notice from the official USCIS figures that a US Citizen filing an i-130 to bring an unmarried child under 21 to the USA are having to wait around 14 days longer than the present batch of fiance visas for their cases to clear CSC.

Fiance Visa - September 19th 2007
Unmarried Child Under 21 - September 5th 2007

As they are going to be going to college and getting degrees we are talking at least 5 years before they come the USA - if they decide to do that at that stage. If they want to study in the USA then presumably we get them student visas.

Maybe my simple happy outlook on life will bite me in the ### one of these days though!!!

You haven't mentioned the ages of your children. Since you said "after school" I interpreted that as arriving "after age 21" and most likely reaching age 18 before your marriage to a USC.

To qualify as an umarried step-child of a US Citizen, the marriage establishing that relationship must have occured before the child's 18th birthday. If they are over 21 when you file a petition, it is you, the LPR, not the USC that petitions, so you look at a different timeline.

Obviously it's going to be easier and faster to get them here before age 21, provided they qualify as step-children of USC and under 21.

Whoa! The names of the K1 beneficiary's children should have been on the petition. This gives them derivitive status for K2 visas. If they follow to join as K2, they must do so within a year. They'll do their medical and interviews later in that case.

Hey pushbrk,

Obviously I put the names of my children on my i-129F - in the section where it ask about Names of Your Children or words to that affect. We didn't fill in G-325As for them because they won't be joining us in less than a year as they are at school and plan to go to college after that (though they might know that yet - lol).

So, for now, on Question 21B of form DS-230 part 1 should we write None and then bring them over when they are older (if they wish) by filing separate form I-130, Petition for Alien Relative at a later date?

And thanks for sharing your experience Amalitta.

Hi Everyone,

Trying to gauge if anyone else has had a similar situation.

My kids are both at school so won't be joining me and my fiance when we move back to the USA.

I'd like of course for them to join us some day so now I'm looking at Question 21B of form DS-230 part 1; namely, Person(s) named in 14 and 19 who will follow you to the United States at a later date.

How much later is later? If I put them down now how long does that stand for? Do they need to come for medicals and interviews with me or do that themselves later?

Thanks.

K-1 Fiance(e) Visa Process & ProceduresTime from being assigned to an adjucator to NOA2
Hi there,

We were assigned an officer on February 20th. We got a NOA2 on March 17th. The person who has yours may be full-time, part-time or have 50 other applications that aren't registered with Visa Journey.

I think it's almost harder once you know it's on someone's desk but once you get the NOA2 - which won't be long now - you'll feel a lot more relaxed.

Personally, I don't believe the "RFE trick" works to do anything other than reassure you that your petition isn't lost and I have yet to be convincd otherwise. But that's just me.

K-1 Fiance(e) Visa Process & ProceduresDaughter MIGHT move now ... but might not ...
Thanks everyone for your input ...

Well, she's no nearer to deciding and can't make up her mind. Worse still, there's no UK equivalent of a US High School diploma (5 Grade C GCSE's is the nearest thing - but not exact) and she isn't that academic, despite our gently prodding her in that direction.

Well, we've got a few days 'til the Packet 3, she can come over now if she likes and if not as pushbrk says there's always other options.

And Roselinda, I know the feeling. Not want to include kids in case it complicates the case but not wanting to leave them behind either. At lest she's young and the door doesn't close on her for a few years yet!!!

We have joint custody legally, so I have to change that to sole custody and god knows how long that takes, my solicitor is looking into it now but as her Mum is fine with that it's cool. She lives with her Mum and comes and stays with me and my SO.

I'm thinking of calling the embassy to see if there are any implications. It's a great outlay to fly to England to get a medical and visa interview etc for her not to come right now as we are really on a shoestring budget here.

She is coming with us initially - either on K1 if she is staying or on a holiday visa if she isn't. As for going home when she wants, the problem is we are going to be on the West Coast and at 15 she's too young and small to travel that distance alone.

It's a wonder i sleep at night!!!

K-1 Fiance(e) Visa Process & ProceduresDaughter MIGHT move now ... but might not ...
Well she's just 15 and in an attempt to get her to act like an adult we let her make her own choices about some things. And I know this is a real biggie.

She wants to go but has been told the pros and cons. Being 15 American guys, Jobs and Music are all pros to her right now. I've told her she has to say Goodbye to her mum, her boyfriend, her school friends, her cat, etc and that put the fear of God in her.

She's also been told that while she can leave 'school' here this June and study hairdressing (her choice again, not mine) if she comes with us then she has to stay in school until she's 18. No ifs or buts.

i just don't want to put her name down and she backs out and then we turn up for interview and/or entry and there's no sign of her and it will create problems. If she decides to come a year later then she won't mess things up for herself or us. Life, eh?
