US Embassy and Consulate DiscussionIf I am the US citizen, do I need to have the interview like my wifey?!?
QUOTE (mrs @ Jul 11 2008, 12:46 AM) <{POST_SNAPBACK}>
blink.gif Silly Question! I would like to ask if I am the citizen in the US, do I need to attend an individual interview after filing the K1 form?!?! Thanks a lot!

Not only is it OK not to attend the interview, but some Consulates will not even allow you to attend the interview. I know the U. S. Consulate in Guangzhou China does not allow the U.S. citizen to attend the interview. The following is from the FAQ's link on the web site of the U.S. Consulate in Guangzhou. I'm not suggesting that this is true with all Consulates.

31. Can the petitioner attend the interview?
No. Due to space and time limitations, the Consulate cannot allow petitioners to participate in visa interviews.

US Embassy and Consulate DiscussionI-864--huh?
QUOTE (Cailyn10289 @ Feb 9 2009, 05:36 PM) <{POST_SNAPBACK}>
My fiance just got packet 3 and he gave me the link to the website listing all the documents he will need. When I read through the site I saw:
"An I-864 is not required when applying for a fiancé(e) visa. An I-864 will be required at the time the fiancé(e) visa holder applies to adjust his or her status from nonimmigrant to conditional resident with the United States Citizenship and Immigration Services(USCIS)."

Does this mean I won't need to fill one out for the interview? We'll only need one after he's in the states? Can someone who has gone through the London embassy please let me know if this is true?

US Embassy and Consulate Discussion125% poverty guideline or 125% above poverty guideline?

QUOTE (Kirsten UK @ Feb 9 2009, 03:55 PM) <{POST_SNAPBACK}>
Hi, I'm sorry if this has been asked before. For the I-134 income requirement, must you earn NO LESS than the 125% as per the guidelines on the USCIS website (for a family of three $22000 gross) or is it that you need to earn 125% above this threshold? blink.gif Thanks!

must you earn NO LESS than the 125%

Question. Does the 125% requirement apply to K1's? I always thought the 125% did apply to K1 visas but this information from the U.S. Dept of State seems to indicate otherwise . . .

Should K-1 fiancé(e) visa applicants use the I-864 or the I-134?

Since fiancé(e)s are nonimmigrant visa applicants, they should use the I-134. They will need to submit an I-864 to U.S. Citizenship and Immigration Services (USCIS) when they adjust status to conditional immigrant in the United States after they are married.

Do the same income requirements apply to all immigrant visa applicants even if they use the I-134?

No. The 125 percent minimum income requirement, the most recent year's tax return and other requirements only apply when an I-864 is needed. Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA.

The U.S. Dept. of State article is in reference to Fiance(e) Visa applications. Here's a link to the web page . . .

US Embassy and Consulate DiscussionInterview Questions - Can you request it in Chinese?
Yes, you can request that the interview be in Chinese. My wife says that when she had her interview the man began conducting the interview in English. She requested that the interview be conducted in Chinese. The interviewer then switched to Chinese, but my wife said his Chinese was no better than her English. She then requested that someone else be brought in to assist with the interview and a woman who was a native Chinese speaker came in to help.

US Embassy and Consulate DiscussionInterview - English/Chinese - China

So we have been going down the path of getting a K1 visa and we are close to getting the interview date set, assuming mid May 2011. My fiancé can communicate just fine with friends, my family, and myself just fine in English. However, we know that her vocabulary is limited so we know the correct word to use, or know how to re-phrase the question such that she knows what is going on. My concern is the interviewee will not do this. I have read on day 1 of the process in Guangzhou she is asked what langauge she should take the interview in. What it be a good idea to tell the consulate she will have no problem answering the questions in English but may have a hard time understanding the questions because of a limited vocabulary? This way the interviewee may rephrase or ask in Chinese.

Any advice would be great.

Rather than give advise or make a recommendation I will only explain what happened at my wife's interview. My wife says the interviewer was a younger American male (younger being relative as my wife was 54 at the time). He first went over the I-134 and asked her a few questions about that. My wife had a difficult time understanding him and asked him if he would please conduct the interview in Chinese. He then began speaking Chinese, but my wife said his Chinese was worse than her English (her opinion) so she asked for someone else to conduct the interview. A Chinese woman came in to help conduct the interview. When asked for evidence of an on going relationship my wife presented about 15 emails and 15 print outs from Yahoo Messenger chats that represented steps in our relationship. These were presented with a cover letter briefly explaining the content of each print out. All the email and chats were in English so it was obvious to him that we were able to communicate with each other in English. My wife brought print outs of the other 400 or so emails and Yahoo Messenger chats just to show how often we communicated but he did not ask for these. We had other information also, but he never asked for it. He was satisfied that the content of the print outs were proof an on going relationship and approved my fiancee.

US Embassy and Consulate DiscussionPassport????
As others have said, your fiancee will need a passport. Below is the Letter to K1/K2 Applicants from the Consulate in Guangzhou. Note that the letter says a visa must have a validity of at least 8 months beyond the Visa issuance date, not 6.

Attached File  K1K2 Appointment-Nov 10.pdf   214.61KB   3 downloads

Your fiancee will still need a Chinese passport when she comes to the United States because she will still be a Chinese citizen, not an American citizen. The passport will be her means of identification until she receives her green card. Even after she gets her green card she will not be able to become a U.S. citizen for 3 years and will still need her Chinese passport. As she will still be a Chinese citizen she will need a Chinese passport to travel outside of the country.

When my wife went back to China two years ago she tried to get her passport renewed while she was visiting. They would not allow her to renew her passport more than 6 months before it expired. She had to get it renewed at the Chinese Consulate in Chicago later that year when we passed through on vacation. It would be easier for her to get the passport while she is still in China anyway. The Chinese passport has a validity of 10 years.

ChinaI - 134 my income

Hello all,

We are just starting out here with our I - 129F package.
My check was cashed the other day and I'm waiting for the confirmation in the mail.
I am filling our the I-134 now.
I'm worried it will look like I don't make enough money to support my Yanyan when she comes here.
I don't own my own home and I have squat for savings.
How do they make their determination on enough support?
Am I up a creek here?

This is my number 1 worry about this whole thing.
I love her and want my Yanyan here with me.

Does anyone have an idea about this?

Thanks,
Paul

Your income will have to be 125% of the poverty guideline. The amount is the the same for the 48 Contiguous States and the District of Columbia and there are separate tables for Alaska and Hawaii. It varies with the size of the family unit. Here is a link to the latest information . . .

ChinaWhat does this mean ?
QUOTE (gregoh @ Aug 16 2007, 11:13 PM) <{POST_SNAPBACK}>
On June 21 st when I called the NVC. They told me my petition had been sent to Guangzhou China on that day. So I waited a couple of weeks to call the Embassy in Guangzhou. When I called they said it takes two to four months for them to receive the paperwork from the NVC. What does that mean? I know it doesn't take two to four months for the paperwork to get there. Does that mean that it takes them that long before they even log it in their computer system as being there. Or where or what is happening with my petition during that time? How can I find out if my petition has made it there safely and is not lost some where ? (My petition is for fiancé visa )

I know the frustration you're going through. My petition left the NVC around February 18, 2007. I was never able to confirm anything until May 8, 2007. Fortunately, things moved quickly after that. My fiancee's packet 3 arrived on May 15 and she replied within a few days. Packet 4 was received on June 16 and her interview was on July 10.

ChinaTime frame from the 2 to 4 month wait for interview for K 1 visa
QUOTE (Mace @ Apr 30 2008, 04:14 PM) <{POST_SNAPBACK}>
Hi every one. I'm new to this site so hope someone can provide some info. I have read some horror stories about the interviews at Guangzhou, and the long waits to get the #3 packet from them. Well I sent our I 129 to the Vermont Service Center in December 2007. We got the approval notice back in early Feburary 2008 and then the notice from the Department of State on Feburary 26 2008 saying they had forwarded our case to Guangzhou. From that point it was impossible to get any answers from USCIS or Department of State as to where our case was. We kept getting the automated answer your case can not be found or has not reached our office yet. Well on April 23rd my Fiancee got the #3 packet from Guangzhou. We were both very surprised at the very short length of time it took to get us to this point. We have completed the packet and sent it back to Guangzhou. Now the letter Guangzhou send with the packet states the interview will be scheduled within 2 to 4 months from the time they receive the #3 packet. Our question is based upon the speed of our paperwork being processed, how much time does Guangzhou give you to get to Guangzhou from the day you receive the #4 packet? We want to be sure we have all the paper work together for my finacee to bring to Guangzhou. So do they give you a week, a month to report for the interview once you get the #4 packet? We still must make arrangements for her to travel Chongqing to Guangzhou, get a hotel to stay for the week or so, so she can get her physical before the interview.
We just want to make sure we have sufficient time to take care of all the things necessary to be ready for the day of the interview.

Thanks for any help on this.
Mace

As you can see by my timeline, my fiancee received packet 4 on June 16 of last year and had her interview scheduled for July 10. That was sooner compared to others with similar timelines. Most had interviews scheduled from the 15th to the end of July. But it could happen that soon so you should be prepared.

ChinaWhere to find American Cookbook in Mandarin Chinese language?
QUOTE (Gumby @ Dec 28 2008, 12:58 PM) <{POST_SNAPBACK}>
Is there something like this available?

Thanks,
Alan

I know what you mean. When my wife lived in China she never had an oven and cooked everything on top of the stove. Now that she has an oven she's fascinated with baking cakes, breads, and cookies. She makes them for all her Chinese friends as they've never cooked any of these things either. I've found a site that sells books in Chinese, but none of it is in English. Most of the cookbooks are probably about Chinese cooking, but by looking at the covers I see some with pictures of breads, cakes, donuts, and cookies so I'm guessing the some of them might cover cooking that relates more to American food than Chinese food. Attached is the link to the cookbook section.

Beings my fiancee does not know english hardly at all will they have a translator there to help her with interview?

My wife's English wasn't nearly as good as it is now when she had her interview. The interviewer was a man and he started the interview in English. My wife (fiancee at that time) asked if she could please have the interview in Chinese. The man started conducting the interview in Chinese, but my wife said his Chinese wasn't any better than her English. She apologized that she could not understand his Chinese and asked if someone else could help with the interview. They brought in a woman who spoke fluent Chinese to assist with the interview. Everything went smoothly after that. Make sure your fiancee isn't afraid to ask for someone else to assist if she has trouble with someone who isn't a native speaker.

QUOTE (silverfox5859 @ Aug 2 2009, 08:34 AM) <{POST_SNAPBACK}>
Hi gang, I am new at all of this but have been told by people this is where to find out the best answers.
#1, I have a fiance from Anshan China she is 45 and I am 59, does age difference make a difference, as we are so much in love?
#2, I have been trying to teach her as much english as possible, and she goes to english classes every Thursday after work and on Saturdays and Sundays. She still has a hard time understaing. At the interview, i am sure they want them to communicate in english, but if they don't understand something, will they explain in chinese or is that a red flag?
#3, I have been talking threw the computer for over 1 year to my fiance and seeing her on the webcam and writing and learning on the computer while we see each other, this is every morning and every night for over 1 year. I am not good at the computers, just on and off and a few other things. I just found out how to save our conversation on line, is this a problem with the time gap between now and when we started talking on the computer, as I don't have copys of those talks. I have all phone records also
#4, I have been to China to see my fiance 4 times in the last 10 months with the last trip for 2 weeks on april 13 and coming home on april the 30th. I have copys of all airline tickets etc. We have many pictures with us and her family, our engagement dinner at her brothers home, pictures in 10 different citys, pictures of her son with us at times, will I need more then 1 picture of each?
#5 I filed for a K2 for her son that is 20, he turned 20 on April 13, will they interview him too?
#6, is there anyone who is out there that can tell me what I am missing and should have and bring to her interview.
#7, Is there any chinese lady out there that has been threw GZ that is willing to email and talk to my fiance, as many things I just can't get threw to her, her english is still poor, even after 15 months of being together.

When my wife had her interview the man started to conduct it in English. My wife (finacee at the time) asked if she could please have the interview have the interview in Chinese. The interviewer then switched to Chinese but he was not a native speaker. My wife told me that his Chinese was not that good so she asked for someone else. After her second request a Chinese woman was brought in to help with the interview. My suggestion is that you have your finacee do the same.

ChinaYou know you've married a Chinese when.....
You know you are married to a Chinese when you take your lunch to work and you have chop sticks instead of a fork. I did introduce my wife to the American food of pie and she likes it. That's about the only time we ever use forks.

CaribbeanGetting to the interview in Kingston

Hey guys how is everyone? Does anyone have any experience driving from Negril to Kingston? I'm worried because my husband is insisting that we leave at 3 in the morning to get to the the embassy for an 8 am appointment. I keep insisting that we stay overnight in Kingston the night before but he refuses. Is this going to give us enough time? The driver doesn't know where the embassy is either. Its a friend of his. Should we leave a lot earlier?

Oh and good luck to everyone on upcoming interviews. I am nervous as heck!!!

BethAnn

I would suggest you stay in Kingston overnight, I've had to go to the Embassy a couple times from Ochi Rios and I had to leave at like 4:00 am. You don't want to drive from Negril and then have to sit and wait several more hours for an interview that's gonna make you crabby think about it, it makes way more sense to just stay in Kingston overnight, especially if the driver doesn't know his way plus consider traffic. that's what I've done the last three times i had to go. Good luck at the embassy.
