Click Messenger on the menu. From here click on Preferences. When the Preferences window opens up click on Archive from the list on the left. When this window opens up you have to make sure that the radio button "Yes, save all my messages" is selected or nothing will have been saved. Click on the box that says View Archive. All your saved messages will be displayed. You can select the messages you want to print by holding down the shift key and using the down arrow if you want to print an entire sequence or hold the Ctrl key down and click on individual messages to select more than one. Click on the print icon.

I imagine it's country dependent, but she may not be able to get it renewed that far in advance. I say this because my wife, who is a Chinese citizen, just came back from a trip to China. Her passport expires in November of 2009. I reminded her to have her passport renewed while she was there. She was told that she could not have it renewed more than 6 months before the expiration date. The government officials told her she could not renew it before May.

That is not the website of the USCIS -- refers only to visa and passport photos, not immigration documents. Better to be on the safe side...get them professionally made even at a CVS.

So my fiance and I are Christian and it's important to us that we have a church wedding before we consider ourselves married...ie. having sex. Since I really want to have my church wedding at my home in Canada, we are planning on having our legal wedding in the states, living at his parents together, not as a married couple, and then as soon as I get my green card we can go back up to Canada and have a church wedding, at which point we will actually consider ourselves married. I know this seems backwards, but its the only way we could come up with to have our wedding in Canada and still fullfill our Christian beliefs.

My question is, is this going to be a problem at the AOS interview? We will be living in the same household, will most likely open joint bank accounts and credit cards, have a legal wedding certificate, and will already have committed to being with each other forever. We just wont be sleeping in the same bed and will be having a second wedding after I get my greencard.

I plan on being completely honest, providing plans for our wedding in Canada, if asked, and probably letters from our pastor explaining the importance of a church wedding, etc.

Thoughts/advice?



There's no reason why your legal wedding in the U.S. can't be a Christian wedding. Depending on your state, there's usually a waiting period of 3 to 5 days after you apply for your license before you can get it. I actually applied for our license while my fiancee was still in China. You can no longer do that in Minnesota as both people must now be present to get the license. I had the option of having them mail me the license or go down to the Court House and pick it up if I wanted it sooner. As my fiancee was still in China I had them mail it to me. You don't have to a judge or justice of the peace perform the ceremony. Just take the marriage license to your local church, bring a couple of witnesses, and have the minister do the wedding. Once you get your green card go back to Canada and renew your vows with a formal ceremony.

No. Pictures are only required for those who live overseas. Others will have their picture taken at their biometrics appointment.

Saw this post today. We mailed my wife's I-751 on September 5 just before we went on vacation for two weeks. The NOA and appointment for biometrics came while we were on vacation. It was dated September 16. Biometrics appointment was for October 13. USCIS sent an email on October 26 with approval and said card was in production. The actual notice arrived in the mail on October 29. It took 8 days to get green card after the approval date the first time. We'll see how long it takes this time. Not too concerned though as the old card doesn't expire until 12-4-09.

By the way, the CTRL - works pretty good for seeing the tables.

First of all, I need the help to organise because I admit I'm a nervous wreak and I feel a lawyer will prevent the little mistakes that turn into disasters. My question to those who have "recently" used a lawyer can you give me a round figure of what you paid, please? I know it's a very personal question but it would help me tremendously when I go on Monday to see this lawyer and he asks for an amount. I would like to know if it falls in with what others are paying.

I know exactly how you feel. I hired a lawyer myself. I started out by searching the internet. There are plenty of lawyers offering their services. You pretty much get what you pay for. Some are not lawyers at all, but just services who will fill out the forms for you. I found the average price for a lawyer to be about $1000. The idea of doing it over the internet or through the mail didn't appeal to me so I did an internet search on Immigration Lawyers in the local online yellow pages. Most described their services. Some had people who could translate documents and some didn't. If you went the $2000+ route you could find a lawyer who would even hire someone in the country of the beneficiary to assist with the interview process. I wound up picking the lawyer closest to me. My finacee is from China and they had someone in their office who was Chinese and could help with the translations. Their price was $750 so I went with them. They sent blank forms to my fiancee via DHL for signature and had them back and filled out within a week. I'm very happy with their service. At that time I didn't know about visajourney.com. I guess I could have done it myself but I estimate it would have added 4 to 6 weeks to the process.

I attempted to change my address at the uscis stage as well when My i130 was already approved there but was instructed by an operator that I had to wait until they received my case and entered it into their system at the nvc. My uscis status went back to initial review as well but the operator told us we were approved and they did have our case at nvc so not to worry, so you can call and ask them about this and have them put your mind at ease, that's what we did. But the same exact thing happened to us.

when in doubt call the immigration 800 number. I do all the time. When they don't answer my question clearly, I hang up dial again and get someone else. Usually that solves my problem. They are very vague answering questions, but once in a while they can help and suggest things.

Speaking of denials I sent application I-129F last Friday, along with it I sent 13 pictures. however, I neglected to label all of them with exact dates, our complete names, and detail of the places. I did label like 5 or 6 this way but the rest are actually old pictures and I did not label them (can't recall dates because they are from 1998). My fiance and I go way back since I was 14 and he was 15, so lots of old pictures.
Can anyone tell me if this would be a reason for them to return my package asking me to label all pictures fully. I figure since at least some of them are, that they wont' bother.

If it will make you feel more comfortable, I only enclosed one photo copy of one picture with no date on it when I sent in my I-129F. I had no problems or RFE. I think it's important to send at least one picture of the two of you together and any it would have been obvious to any idiot that the picture I sent in was taken in China. The important "must have" documents are photocopies of your passport showing the days you entered and left the country, airline boarding passes, hotel receipts, etc.

Yes, "can be" means at your discretion. However, most people probably file an Affidavit of Support based on employment so if yours deviates from the norm I would think it's best to attach an explanation. In my case I had quit my job and was unemployed at the time I filled out the I-134 so I filed the Affidavit of support based on assets. Rather than just send in all the statements, I typed a short letter and inserted a table listing the names and value of each account and the assessed value of my house. From this I subtracted the balance of my mortgage and came up with a total amount for assets. This way they could see at a glance how I came up with my figures. Copies of all the latest financial statements and property tax statement were attached to the letter. At the bottom of the letter I wrote, "I swear the the above table is a true and accurate representation of my assets and liabilities," signed it, and had it notarized.

What are they asking for? If I am planning to marry somebody I am planning to support him
(if necessery) for as long as he or I shall live. Does "forever" count as a valid duration
of the contribution? :) Or do they mean just the period prior to the marriage?



The I-134 is used for any situation where a person may be supplying support for another, not just a K1 visa. No, you don't have to be employed to file a I-134. If your not employed put "None" in the first line of 7. above Type of business. Where it says "I derive an annual income of" put the annual amount you receive from V.A. Compensation and SSI. They're looking for amounts here, not explanations. Explanations can be in an attached letter with other supporting documents. Paragraph 11 does not apply to you as you are applying for a K1 visa. Put "N/A (K1 visa process for permanent residence)".

First off, I am John :) I just joined the forum. Very happy to be here. I have been visiting this site ever since I first filed for my wife. Now the I-130 is approved NVC has taken over the case.

After reading several threads on financial affidavit, I am very confused.

Is there a difference between "Income" (Question 24 on Form I-864) and "Asset"(Question 26 on Form I-864)? In otherwords, say if i do not have a savings (Asset) of over $16500*, can I use my income as a backup to qualify?

Ok, may be I should give an example; say I have an income of $70,000 and a savings of just $5,000, can I still qualify? Or should I have an "Asset" (Savings) of over $16500* (House hold size = 2), as per the 125% rule, to qualify?

Several threads implied that I should have an "Asset" (Not income) of over $16500 (House hold size = 2) to qualify. Other threads are giving me the impression that my salary (Income) should be above $16500 (Holly and Brett thread for example).

There are two ways you can qualify for an Affidavit of Support. Most people file an Affidavit of Support based on income. To qualify you must make 125% above the poverty level. The $16,500 figure you have is wrong. For the year 2007 the amount must be $17,113. Here is the latest government link where you can get that information.

The second way you can qualify for an Affidavit of Support is based on assets rather than income. In my case I had to use this instead of income because I was unemployed at the time I prepared my Affidavit of Support. With no income, I needed to file an Affidavit of Support based on assets with a value 5 times above the $17,113 level or a minimum of $85,565. In my case the equity in my house alone was well above the minimum level. Here is the latest government link to that information.

When you ask who they should be addressed to I am assuming you mean a street address as you ask if it should be the same as the USCIS or the foreign embassy. The I-134 and supporting documents are sent directly to your fiance and are brought to the interview. I know they ask for a statement from your bank saying how long you have had an account there and what your average balance has been. My bank had a computer generated form that they were able to print out in seconds and the salutation was "To whom it my concern."

I'm wondering how many emails and photographs are required for the K-1 visa interview, because the packet-4 states >> "bring extensive documentation" as proof relationship. (Packet-4 received from Chennai consulate).

Also do we have to make sure that we submit for visa interview the emails/photographs that were already submitted with the I-129F petition ?

I had hired an Immigration Lawyer before I was even aware of Visajourney.com. The only proof of an on going relationship I had were email and Yahoo Messenger files. My fiancee had been printing out every email and every Yahoo Messenger file each day. The lawyer told me to have her select about 2 emails from each month and print out a listing of all email sent. My fiancee selected 20 emails and attached a list to them describing the content of each. We only had about 5 pictures. Two were taken when we first met and one of the pictures was with her family. The other 3 were pictures of my parents and my nieces. She had her interview 2 days ago and it only lasted about 10 minutes. Mostly, he just asked about a lot of questions about how we met. My fiancee only handed him what he asked for. He spent most of the time looking at my income tax records and asking her what I did for a living. He asked why I had made more one year and less the following year. I think it was a test her knowledge more than anything else as I easily met minimum income requirements. She correctly explained that I had quit my job in 2006 and had been unemployed. He quickly skimmed through the 20 emails and seemed satisfied, smiled at her, and said congratulations. He never asked to see the pictures or any other supporting evidence which consisted of emails and pictures to my fiancee from my parents and other relatives. Hope this information helps you.

It depends on the Embassy. The best thing to do is go to the Embassy's web site. You will find that the rules vary. Some Embassy's have very good web sites and allow you to download the entire K1 visa package and others don't. Here's a link from the U.S. Embassy in Tokyo, Japan. Their web site is not as easy to negotiate as others, but I think this link has the information you are looking for.

That should be sufficient. I was unemployed at the time I filed my Affidavit of Support and used assets as opposed to income. Below is a quote from the government web site.

What Cash Value of Assets is Needed?

Your Turbo Tax printout will work fine for your tax records. However, as beckypua mentioned, if you use a software program these records can be faked. You must attach a copy of your W-2 along with your tax return.

The I-134 is a multi-purpose form that is also used for things other than a K-1 visa. This section does not apply for a K-1 visa. For a K-1 visa you can put down what I did, N/A (K1 visa process for permanent residence).

Here is a quote from the U.S Department of State's web site. You assets have to make up 5 times the difference you are short, not 3 times. 3 times is only for spouses and immediate family members. If you are applying for a K1 visa you are not married.

For example, a petitioner/sponsor with a household size of four and an income of $18,000 would need assets equal to five times the difference between his/her income and the income required for a family of four at the current federal poverty guidelines level. Remember, the Immigration Timelines are only averages. Time varies greatly depending on which Consulate or Embassy you're going through. For example, we went through the Consulate in Guangzhou China and we waited 5 1/2 months from NOA2 to the interview. This was typical for China at that time. If you use the Immigration Timelines you should look on the left side of the screen and select K1 Visas - Advanced View under Visa Display Options. You can then sort by country and service center to find cases more similar to your own. Still, every case is different. Those who filed the same month as we did were getting their P3's 2 to 3 weeks earlier than we did. Yet, when my wife received her interview date, it was the earliest one for people who filed the same month as us.

Not only is it OK not to attend the interview, but some Consulates will not even allow you to attend the interview. I know the U. S. Consulate in Guangzhou China does not allow the U.S. citizen to attend the interview. The following is from the FAQ's link on the web site of the U.S. Consulate in Guangzhou. I'm not suggesting that this is true with all Consulates.

31. Can the petitioner attend the interview?
No. Due to space and time limitations, the Consulate cannot allow petitioners to participate in visa interviews.
