Hello fellow March 2010 CSC filers!

CVC received my I129F package on 3/08/10, check cashed on 3/09/10. I have not yet received any NOA1 notification. USCIC website says status is "initial review"

My K-1 should be a relatively simple case - no kids, no previous marriages, no problem with any of the paperwork (unless some unforseen glitch comes up!), no problem meeting any of the requirements. Interview would be at the Manila Embassy.

I seems like CVC has really been moving really fast lately.

Do you think getting her here by late July/early August is possible?

We sent out our I129F pckg on 03/09 and still waiting for NOA1. At this moment, CVC is working on I129F's with NOA1 issued 69 days ago. If it goes on like this I really hope I could be in USA by the end of July.
Therefore, I think that getting your fiance there by the end of July is possible as well. Hope you won't have any RFEs nor any other problems.

Yeah, he forgot the most important thing, I think it happened just because it was in front of his eyes all the time. Things like that happen to people all the time.
Anyway we were lucky- we got back our package two days ago (it took 13 days) saying that I-129F was the only missing document. He's mailing it to CSC today. I'm keeping my fingers crossed.

Hello everybody,

My fiance and I have got a bit of a problem. He sent our K1 application to CSC on March 9th, they received it on March 12th. Since we haven't heard from them for 10 days now I told him to check if he wrote his e-mail address properly on I-129F (he made three copies of all the documents). After a couple of minutes he told me that I-129F is the only document that he actually DID NOT INCLUDE in the package! He just got back from the trip and he was exhausted when he sent the package, so he just forgot about the most important thing.. He called his local office about the problem but they told him that USCIS will probably just send the whole package back.
Can anyone please tell me what will happen now? Did anyone of you guys have the similar problem? How long will it take to USCIS to send the package back to my fiance? We are both very anxious about this whole thing and we just want to start the process. Could we just make another package and send it to USCIS before they send this one back?
Please help me if you know anything about this..

Hello there..

I just wanted to remind you that these poverty guidelines you are talking about were officially in effect till March 31st. They change every year.
According to the Department of Health and Human Services website, Congress has taken action to keep the 2009 poverty guidelines in effect until at least March 31, 2010. The reason for the freeze is that for the first time since the poverty guidelines were issued in 1965, the annual average Consumer Price Index has decreased from the previous year. If the 2009 guidelines weren’t frozen, the HHS would have had to issue 2010 poverty guidelines that were lower than the 2009 poverty guidelines.
So if they do this any time soon (and I really don't have any info on whether they did that so far) maybe you won't have to worry that much.

K-1 Fiance(e) Visa Process & ProceduresSimple K-1 Question or two! (perhaps)

Hey guys, just joined; trying to bring my Canadian fiancee to the USA - Virginia - to marry me! We have explored both the K-1 and the K-3; Our thinking is to go the K-1 route because it would bring us together quicker in marriage - having the legal ceremony in due time (90 days) and then having something nicer in Canada a bit later - when we file the correct papers so that she can travel back home; while she deems this option somewhat 'anti-climactic,' it seems to be better than planning a wedding (mostly long-distance planning, mind you) for Canada, getting married, and then having to spend the additional months apart (additional meaning including the months we spent to planning the wedding) waiting for a K-3 visa;

Okay, so maybe my questions are simple, but let me go ahead anyway:

1.) If we did marry in Canada, would she be barred from visiting me in the US as my wife while waiting for a K-3? I'm assuming here that this option is even available - I just thought I'd ask!

2.) Once she receives the K-1 fiancee visa & enters the country and marries me, how long typically would she have to remain here in the U.S. before being allowed to travel abroad - abroad primarily referring to her home in Canada! I understand there is a paper to file for her to travel abroad, but I know very little about this part of the process.

First of all- WELCOME to VJ. I'm not an expert in this, but I'll try to answer your questions.

1) If you get marry in Canada, your wife won't be able to visit you in the US before K3 process is done unless she obtains tourist visa. (although I'm not sure if this info is valid for Canadians- you should check this with someone who's been in similar situation)
2) Once she recieves K-1, enters the US and marries you, she will have to file documents for AOS (Adjustment of Status). EAD (work permit) and AP (advanced parole- travel document) are included in AOS package. People usually get their EADs an APs in about 2 months after filing, while they all wait for AOS a little bit longer. So, if you go for K1, file for AOS as soon as you get your marriage certificate, and she should get her EAD and AP in about two months after filing.

I hope this helped you at least a little bit.

Wow, your the first person I can recollect explaining in such detail the measurement of the photograph! My gut tells me that they are fine. Most people look at the background and that the photo meets the general criteria of the "standard".

Something tells me that you are particularly attentive to fine detail and may loose xcessive sleep over this. You, for your own peace of mind may want to get new photos taken.

However, if in the next set, your head is to small and your eyes are to high, you will be in the same predicament and at risk of a nervous breakdown!

As for me, I think I would send the photos you have and forget about it.

My head also measured more than 35 mm, it measured 40 mm actually. Everything was ok, no RFE. Don't worry about few mm's. I really don't think it will be a problem. At least I didn't have one.

My fiance has a work-only SSN from when he studied here in 2007, should he put that on the form?


Yes, he should. He might have to change it later, but he should definitely include that one on the form.
My SS Card says ''valid for work only with DHS authorization'' so I will have to change it once I get married (change my last name) and get my GC (the quoted restriction will be removed and my SS Card will be replaced with the new one, but the number will be the same).
Every fiance(e) who has SSN should provide it on all forms, in that way USCIS can check certain things about you and in most cases that is a plus.

Hi..

I have also been to US as an AuPair and I didn't list my US addresses in G-325A. I changed three addresses while I was there.

As for question 12- just ignore it. She is in her home country now so you don't need to fill it out.

Also, if she has her SSN (and I believe she must have it) don't forget to put it in form I-129F.

AuPairs usually get one-year visa in their passports and if they want to stay more they can get extension for 3, 6, 9 or 12 months. I came back home before my one-year visa expired. I hope she hasn't overstayed or something 'cause that might be the problem.

I read another thread about the same issue the other day. Some girl (K1 visa petitioner) asked if the co-sponsor should file I-864 or I-134. The co-sponsor for K1 holders should file I-134 as well (but provide as many proofs as he/she can in order to show that he/she is willing and able to sponsor you once you are married and file for AOS). I-864 comes later, when you file for AOS.

Someone correct me if I'm wrong, but I'm 99% sure about what I'm saying.

It's not my intention to argue, I have more important things to do. AND I certainly don't have to justify my opinion to anyone.
These are all just opinions and different experiences (99% of posts)- definitely not rules of any kind. Only people who know the actual rules are people working with USCIS, NVC or embassies. So, just leave people who are posting alone and no offending, please. I really think that we are all much or less the same.

You do not need to hire a lawyer because you can find out about anything you want here, on VJ. So far, I have seen three cases (out of 4) where lawyers have done things wrongly. Their goal is not to help you with this process but to rip you off and earn money- that is why they exist, so in most cases they make mistakes (simply because they don't care about your process as much as you do). You can finish this process by yourself and if you have any questions or uncertainties you can always ask someone here (I'd suggest older members).

Hello...

You DON'T HAVE TO translate chat logs or e-mails. We didn't do that and our e-mails were in Bosnian. I bet that there's no one in USCIS speaking that language yet there certainly is someone speaking Spanish. Do not worry about e-mails and chat logs- those aren't official documents so there's no need for translating them. If you are in the process of preparing your I-129F packet I really don't think you need your fiancee's Birth certificate, all you need from the person you are petitioning for is her G-325A biographic form (signed), Letter of Intent to Marry (signed) and visa type picture taken within one month (30 days) of filing for K1. If you aren't sure about what to send :guides: , they will help a lot.

So.. I'll share my experience with you, but you have to keep in mind that it is only MY experience, it doesn't have to mean that you'll have the same one. My boyfriend had his oath ceremony last September. First thing he did after he got his Naturalization Certificate was that he got his American passport. So, when he filed our I-129F package he just copied his Naturalization Certificate without having it certified by notary. He also copied and included all of the pages of his new American passport (nothing from the Bosnian one). In his cover letter for I-129F he made a remark in the last line, it was something like this: ''Copies of the documents submitted are exact photocopies of unaltered documents and I understand that I may be required to submit original documents to an Immigration or Consular officer at a later date.'' We never got RFE (maybe we were just lucky). I think you'll be just fine.. If you have any questions post them in our forum, I will be very happy to help you with anything I can (maybe I wasn't paying much attention lately- it's only because of my medical and interview).

I remember that we had similar timelines, we were in the same filers group i.e. CSC March 2010 filers. I am very sorry to hear that you two won't go further with you case. I suppose it must be very frustrating to go through all of this and then just break up or something. Everybody has a problem with the distance, lack of ''face to face'' communication and all those things that make relationship ''healthy''. I have so many problems myself. Some of them I try to keep for myself, but there are some that I just have to share with my fiance, and to him they maybe seem like they aren't really big, but to me they are, because every single day I have to find a new way to solve them, and I have to do it on my own.. Anyway, I am very sorry to hear about your break up.
I have been going through different posts lately and this is what I think: She doesn't have to do anything because she didn't apply for a visa. She can call embassy and tell them that if she wants to/ if she feels obliged.
I'm not sure about you though.. I THINK you maybe should write some kind of letter to USCIS and tell them about the case.
Many people here have more knowledge of these things more than I do, and I'm sure that they will help you out and tell you more. I just wanted to say that I'm sorry it didn't work out for you.

The important point is that you have to follow the consulate's specific instructions, and provide what they require with the I-134.


Well.. My consulate asked only for I-134, none of the specific requirements. And I believe that's most people's experience.

I just want to add that I received packet 3 yesterday. Instructions said that I will need to submit I-134 @ the interview. Sometimes even CO's don't know what is correct I-864 or I-134. I know for sure that I-864 needs more proofs and supporting documents than I-134. I advise you to prepare both forms and bring to the interview. When the CO asks for one he will probably be specific and you'll be able to provide him with which ever form he asks from you.

Yes, I know about that question.. When I saw it first I started investigating the matter and found out that if you are not in the process with USCIS you don't have to report change of address. You can do it later, once you start your AOS. So, no worries about that. :)

I have similar issue myself. My fiance lives with his parents. He bought a house last year and at this point he's preparing it for my arrival. When he sent our I-129F package he used his parents' address on all the forms. I'm waiting for my packet 3 to be sent by embassy (and they told us just an hour ago that they will do it tomorrow morning). So when I receive my letter and when I fill in the forms I will have to put my fiance's and my future home's address on the form, not the one he used when filing.

When you are in the middle of the process with USCIS and change your address you have to file ''Change of Addres'' form or just do it online @ USCIS page. At this point we are done with USCIS until we file for AOS, so there's no need to report change of address to anyone.

As for question number 3, I suggest that you just read and follow the guides here. Write a cover letter and list all the documents in your package. Then just order the documents according to the list and that's it. You can just use simple paperclips, there are really no special requirements that you MUST follow. They will not return your package to you if it's not in perfect order. Everybody has its own way of organizing documents and once again just read the guides and you'll be fine.
Remember that ''one picture is worth a thousand words''. A lot of people got an RFE for not providing sufficient proof that they actually met in last two years. Passport stamps ARE important, but when you think about it they don't really show that you two have seen each other in the past two years, they can also mean that you were on a business trip or something else. USCIS must have a proof that you two were at the same place and same time in the last two years. What's better than pictures than?

Thanks Zee Bee, I did call the NVC and they said the request must come from the Embasy itself. Good news though! The Embassy reported today that they have the file. Perhaps it was lost somewhere, and they scheduled her interview again for Nov 19th at 10 am. Praise God!

The NVC scheduled my wife's interview on Nov 4, 2008. My wife tried to schedule her medical, but the information online about the doctor was not valid, so after a couple weeks she calls the US Embassy in Harare, and they inform her that they make their own appointments. She had to complete the medical, then submit all evidence of our relationship. Later she was informed that her file never made it from the NVC when she went to turn in the evidence. Things are in limbo until the Embassy requests the file to be sent again from the NVC as they said they will not interview her without it.

This process is so frustrating, just wondering if anyone else has dealt with the Harare Embassy.

Thanks for the reply. The plan was to do a K3 visa with him in derivative status. Unfortunately, I did not send in the 1-129F before the I-130 was approved. This situation may work out better for him to finish the school year while my wife joins me in Japan for some training I am doing there for 7 months.

I am new to the forum. I was trying to file for a K3 visa for my spouse, but did not send the I-129F before her I-130 was approved. At this point she is on track for the IR1/CR1 immigrant visa. I received the request for IV payment but her son was not listed on the paperwork. Am guessing its because he does not have derivative status due to the IR1/CR1. How can I get him to the USA without having her come over first and then file for her son? That could take years, and I don't want to begin our lives together with her in distress.
