There are no additional charges. You pay the regualr adjustment fees just like everyone else on here.

Isn't working without work authorization a crime?

Working without authorization can be considered from two aspects.
1. As an immigration violation it is a civil wrong. It too is forgiven upon adjustment of status through marriage to a USC. Since all immigration violations are civil it by definition is not criminal in nature.
2. Working without authorization can go hand in hand with not paying taxes. Now that can carry criminal consequences. For example tax evasion is a Crime of Moral Turpitude in terms of moral character for naturalization, bond hearing or cancellation of of removal.

Overstays, no matter how long, are forgiven when adjustment of status is based on marriage to a USC INA§245(c ). If that is your only outstanding issue a lawyer is going to be a waste of money.

so if my father was naturalized before i was born, and was living in canada when i was born, then i have absolutely no way to use my father's citizenship as a way to help me get my dual citizenship, correct?

If you want an exact answer provide the following:
Year you were Born
USC's father marital status to your mother at time of birth.
Mom's citizenship status.
How long did father reside in the US
How long did father reside in the US after he turned 14.
If you were born out of wedlock to a non-USC mother there are additional requirements including confirming paternity and offering statement of support, all before you turned 18.

I don't think anything happens when a parent naturalizes, I just researched a bit on this and didn't find anything useful. I believe they will have to file when they turn 18.

Derivation of US Citizenship as a Minor through Naturalization of One or Both Parents
Derivation means that the minor automatically becomes a citizen when the parent or parents naturalize. There is no requirement for the minor to apply to the USCIS for citizenship, instead the minor can apply directly for a US passport.
After February 27, 2001:
The child must be unmarried;
The child must be under 18;
The child must have at least one US citizen parent (by birth or naturalization);
The child must be currently residing permanently in the US in the legal and physical custody of the US citizen parent
The child must be a lawful permanent resident of the US; and
If adopted, the child must satisfy the requirements applicable to adopted children under US immigration law.
The child can still do an N-600 to get his or her certificate if they please.

I never heard about the CR-1, she doesn't have an AP to return. So, the CR-1 is almost like the K-3? why study the I-130? where can i find out more information about it. I am very greatful for everyone that respond. Thank you so much.

K3 or CR1. Begin by filing an I-130. Study the Guides for details.

I would recomend doing the CR-1, for most consulates it is about as fast as K-3.

Do the CR-1 visa you will be much more happy for it because of the INSTANT GREEN-CARD.

For the most part CR-1 tends to take a bit longer than K-3 to get if you prepare for NVC when they request I-864 fee, and Visa fee, as well as documents requested by NVC. In many cases the CR-1 petition reaches the consulate just before K-3 interview, which causes K-3 to get dropped and the interview becomes a CR-1 visa interview.

K-3:

I see many posts from K-3 holders stating, "Wow this sucks, I am stuck at home because I don't have EAD, DL, etc, or I am having hard time getting added to bank accounts because of NO SSN." K-3 has a 90 day or longer period of limbo while waiting for EAD or Green-card.

K-3 was developed at a time when CR-1 was taking much longer that today, NVC has greatly streamlined the CR-1 process to the point where K-3 becomes irrelevant.

I've started studying for the civics test, but have a question.

When there are questions, like for example, 'what does the consitution do' there are three answers for it. This is not a question where it says 'give ONE' etc.

Is it sufficient to answer one of these answers? (i.e. are they simply alternatives) or must you answer all three listed?

I've noticed in other questions that they are definitely alternatives (i.e. it says Joe Biden, or Biden) but with these three-pronged answers I'm not completely sure.

Possibly- my appointment time was 1.30 and everyone around me had been told the Wednesday at 12pm.

I'm sure that if our date for travel had been more urgent (i.e. the next day or whatever) that we probably could have picked it up the same day, but it wasn't an emergency as compared to what others may have dealt with :)

Hi there,

Just thought I'd let everyone know about my experience with getting a passport using the passport agency emergency walk in (San Francisco office).

I made an appointment for April 1. We went in at the allotted time, passed through security and waited about 20 minutes. I went up to the counter where the woman took the filled out application, passport photo, my naturalization certificate and checked our tickets that were for booked for April 13.

She verified my application, checking everything matched. My second ID (military ID) name didn't match my naturalization certificate as I chose to change to my married name at the oath. That was fine - she made a note on my paperwork and everything was fine. She then took the payment and said that it would be ready for pick up on April 3 at 12pm.

We went in on April 3 at 3pm (the second phase available for pick up). There was a line waiting, but we managed to avoid it as the security guard recognised us from Monday. We took the lift up and waited in line for about 10 minutes. The man checked my ID and gave me my passport, which was all accurate and in my married name.

Nothing to worry about and all went smoothly, apart from the fact we had to go into the city twice and parking there was ridiculous! We ended up going with the parking two buildings down from Hawthorne Street, which was $2.50 every 15 minutes.

My husband's interview letter arrived today. His interview is scheduled on Monday May 6th at 9:27 AM at the San Diego Federal Office. That 9:27 is a bit odd, not sure why it isn't 9:30 or 9:25, but we won't question anything. :lol:

The only issue is that I may not be able to accompany him to the interview, as I am a teacher and that is the week we begin the state and federal mandated testing, so it may be difficult for me to take time off. I have to check with my principal next week and see what she thinks. I don't want my possible absence at my husband's interview create an obstacle for his citizenship.

Your husband will be fine going alone.

All he has to do is explain the above and they will understand. It really isn't practical that everyone can go along with their spouse. I went without my husband, explained he was in training that he couldn't get out of and it wasn't questioned.

I'm A United States Citizen

Thank you all for your support after my news yesterday!

I had my interview this morning in the Sacramento, CA office. My experience was very smooth and painless. I waited for about an hour as I'd been slotted in between people who had had appointments scheduled for weeks, so I didn't mind waiting at all. I people watched and saw a lot of people go in and out of that office! You didn't need an appointment letter to get through security as the building was used for a lot of government organizations.

I was asked how I met my husband, and we talked about the military a little. He did the English test oral & writing which I thought was funny since I am a native English speaker, so that was painless. I was asked 6 of the questions which I got all right, so he didn't bother asking me any more than that. I don't remember all of the questions I was asked, but I remember I was asked 'who vetoes bills?' 'who wrote the Declaration of Independence' 'who is the Commander in Chief of the military'. I can't remember the other 3. I had managed to get 100% in the practice tests late last night though so I was feeling confident about those!

He then went through my file with me, asked if I wanted my maiden or married name on my naturalization certificate, and I went with my married name. I also had to write a statement saying that after my husband's tour is over in Germany that I will return to the USA to live. He said I was approved and printed off a letter saying such, and asked me to wait out in the foyer.

About half an hour later, I was called into a filing room with a tiny US flag and a man read the oath to me, to which I was to respond with 'I do' and he handed me my certificate and 'Welcome to the USA' pack. They don't usually do same-day oaths in the Sacramento office, so it was all pretty casual and unofficial.

I'm now about to make an appointment to get my passport rushed. I'm so glad that it all went smoothly after the finger print issues!!

Good luck for everyone else!! I saw A LOT of people with big archive boxes going into the interviews, lawyers, interpreters, all sorts. In the end he didn't even look at my packet of evidence!

Hello all,

Received notification today that my interview would be 1 May, then got a call from the Sacramento office saying that I would need to have my interview tomorrow as it's expedited and they had one available space for me.

Wish me luck- I'm now sitting down cramming all the questions & answers- definitely didn't think I'd have only half a day to study! Definitely better than the alternative however of having to fly back from Germany!

We are moving to Ramstein Air Force base, which is about 1 1/2 hours south of Frankfurt and an hour from Mannheim. Conveniently, we can cross the borders to France and Luxembourg within an hour too! I'm super excited to see that part of the world.

My husband actually really wants to visit Finland while we are there (we both have a 'to do' list in the 3-4 years that he has orders there, and we have each picked a country that we want to visit that isn't as tourist-laden as other places in Europe and his choice was Finland). Any tips? Feel free to PM :)

Fingerprint appointment round 2 was today.

The woman doing my finger prints said they were too weak due to my 'soft skin' and that they would be rejected by FBI (2 of the fingerprints couldn't get a clear reading at all, let alone the others that 'passed' but the two were rejected).

She said I'd get a letter requiring me to get police clearances from any place I'd lived in since arriving in the USA.

We're thinking of abandoning it now, we don't need this stress before we move to Germany with the military, and no way will it be through before we leave now despite being expedited. We might just take the normal course of ROC and citizenship while in Germany, which would mean I can do it all over there and not have to fly back to the USA for the oath etc.

Pretty disappointing, but such is life and trying to realise that it must mean something.

That really sucks! do you know why they weren't readable? The machine usually says accepted or not for the fingers, if they were accepted and then they said unreadable that would be odd!


I'm not sure, she didn't say! Just that they came back from the FBI as unreadable and that they'd need to be done again.

Sorry to hear that. :( Have you had issues with fingerprinting before or was this the first time they were "unreadable"?
I hope it all gets resolved soon.

And you are right, it is always a good idea to call and check on our cases, if we feel there is a need to do so.

I hadn't had fingerprints taken by a service center before, this was a first. I had them taken manually by police in Australia when I needed my police check run, and by the embassy in NZ, and also obviously at border control and there were never any issues.

Just was unlucky this time I guess!

Well, bad news for me.

My fingerprints were unreadable. I apparently had a letter sent to have my fingerprints retaken to my old address - which I never got.

Now I have to wait for another fingerprint notice to be sent out, doesn't look like it will be through before we leave the USA now.

The worst part is I would never have known had I not called to check up on my case because my online status is stuck on initial review!

So - lesson learned, call to check up if things aren't moving as they should!

Unfortunately not the case. We are filing under s 319(b) which you can't apply for until 90 days out of the date you are leaving the country under orders!

If it doesn't come through in time, then I go with my husband to Germany- period. I'm on his orders which means I have to go with him on the military plane we have been booked on!

We've planned for it not coming through in time- I'll fly back on my own for the oath & ceremony. Thankfully we've got savings set aside just incase!

I also forgot to mention that I am hoping to have my interview & oath in the Fairfax, VA office. I requested it in the memorandum that accompanied our expedited naturalization request, but when I'm assigned my interview I will see if the request was met. After we leave Travis AFB we will be heading east to take a rotator to our new base for four years in Germany, so hoping timing works out perfectly!

Why did you *need* early biometrics enough to have him use his uniform for unofficial duties? Is he being deployed soon and you need to join him?


1- It was after work, we went in together after he finished work (not that that relates to anything)
2- Yes, we *needed* to as we are both on orders to pcs to Germany on April 20 (as my signature states)
3- We had our biometrics scheduled for a date where we had already had to have left from Seattle because we have just moved to another base in California for six weeks so yes, we *needed* to do early biometrics.

If you can do your walk in thats awesome! I know we cant here at Nebraska - they do not accept walk-ins unless its after the date you were given lol. I'm not really in a rush tho I need more time to study this stuff.


We are going to try to do my walk in here in Seattle before we go down to Travis AFB. I read that military don't have to have appointments, so I'm going to go in with my husband and explain that we are pcsing and won't be in Seattle, and take a copy of our orders and see what happens!

If that doesn't work, we'll be in SF area next week and I've read a lot of people have had success walking in to San Francisco, so we'll try that if Seattle doesn't work. That's if we actually ever get the hard copies of these letters!

I called the military help line and he gave me the dates my NOA & biometrics appointment letter were sent out.

I'm going to have to do an early biometrics walk up, due to our move, so I'll have to see how that goes and whether we are successful.

So there you go- my embassy biometrics were done December 2012 and then 2 months later I'm getting them done again, so for sure, obviously the 15 month rule has changed!

Quick qn: I thought if you'd done your biometrics in the last 15 months you didn't need to do them again. Is this the case with N-400? It wasn't too bad for AOS and ROC because we didn't interview, but as there definitely WILL be an interview that means 2 trips to Des Moines (at 3 hours one way)... ugh. I think I need to plan for 2 trips. I should give my boss the heads up :S

Post only - I did include the sheet for electronic notification but have had NO notification from them at all !! other than the paper mail in the mail box. The check also doesn't show up on the banking online page so couldn't get case number from that either.

I was hoping my friend would go through citizenship at the same time as me but life events have prevented her from filing for now. There would have been 3 of us!


Ok I have been checking my inbox and text message inbox obsessively ever since I saw that the check was cleared!

Good to know that I should be checking my mailbox as diligently!

I really just hate all the waiting. I want my case number, and then I'll be happy. To make it worse, we're moving state next Friday due to some training my husband needs to do before we PCS, so I really don't want to miss anything in transit!

Wondering if I should call them, but not sure if it will really achieve anything.

I am about to apply for my citizenship three months prior to 5th year mark, which is Sept 29th. However, last year, I have been out of the country for five months, and then next year, on April, I will be going back to the Philippines to get married, and will stay there until July. So pretty much 8 months in total.. would this affect my citizenship application? I will appreciate a feedback. Thanks!

Thanks for your reply. I received my appointment letter and I am going to meet you at the Embassy since my appointment is on the 18th too! In fact my case has been expedited by USCIS and NVC (Filing on 03/03/10. NVC approval on the 06/11/10) and the Embassy did not take the expedite request into account so they have received the file from NVC on the 18 and took the usual two months processing time....
