Removing Conditions on Residency General DiscussionI-751 May 2014 Filers

Hello Everyone,

I just wanted to share some wonderful news, around 615pm cst I got a text message that that there was a change in my case status and to check online.
So I did and I got this new message:

"On July 2, 2014, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283."

I had my bio waived and I got my Green Card approval in exactly 2 months from my NOA date May 02. Thank the Lord this part is over.
Now just waiting for the actual card/approval letter in the mail.

Hopefully there will be more approvals for May filers in the coming weeks.
Best of Luck to the rest of you that are waiting.

Yay, congratulations!!!

Just notice something. The date printed on my interview letter (Priority Date) is June 24. June 27 is when I received the letter. Could someone fix that for me, please? Thanks!

Defence of marriage act?

Yes. One of the contents in this act is the recognition of same sex marriage.

Hi Converts!!

First of all GOOD LUCK and could you please share us what documents did you send to CSC ? Was there any red Flag ? Any idea why you got the Interview letter.

Thanks

And Best of Luck.

These are the documents I sent to USCIS :

Tax return and W2 2011,2012,2013.
Joint bank statements quartely.
My name under my partner's healthcare, dental, and vision insurance.
401k
House lease with both of our names.
Car insurance with both our names.
Motorcycles titles with our names on both of them.
Photos. (12 altogether)
Letters and cards to both of us on same address.
Affidavits of Bona-fide Marriage.
Copy of our driver license showing same address.
Copy of our debit cards.
Copy of our health insurance cards.
Court order on name changed. (my partner has her name changed few years back)

That's all I can think of now. I might missed a thing or two. I don't know if there's anything that raises red flag. All I can think of is the fact that we bought our motorcycles last April because I'm going to college, and my partner is thinking of riding her motorcycle to go to work to save money on gas.

I adjusted my status here and our case was a bit different, to say the least. Basically because during that time, DOMA hadn't been struck down yet. I might need to call them about my biometric, to see if it's still current or not since I haven't receive any. I put a service request on the 19th but didn't get any response.

Now we need to gather the evidences again, the one that we sent, and also new ones we have now. The good thing that might come out of this is if our interview is approve, I might get my card sooner than the estimated 4 to 6 months, although I notice that some of us got it in less than two months.

I'm pretty nervous, lol. I don't know if it's a good thing to get and interview. I read some posts on the interviews and some of them had Stokes interview. Our marriage is legit, it's just hard not to feel anxious about the interview.

No biometric letter, so this means that my biometric is current, right?

It's not typically american, no. But I remember when I went for my AOS biometrics, they were rude too... Kinda like at the DMV to get a driver's license. It's more like an administrative workers thing! :P

Oh my gosh, they were rude to me, too! Lol, I thought they were just having a very bad day. XD

I tried calling USCIS to ask about my biometric today. It's automated and it informed me that their options have changed and I need to put my receipt number. The machine said my receipt numbers cannot be found. There's no option at all to talk to a real person. Any suggestions on how to talk to the real person?

Soooo, it's getting hotter here in Sacramento, California. This Sunday is going to be 99 F. I sure hope there's not going to be any problems with my application (and everyone) or I would turn into a green monster, lol. Hot temperature and me doesn't go together. We have a love-hate relationship. :D :D

Yes. :)

I'm okay if they didn't refund the biometric fee as long as they mail me a letter saying that my biometric is current.

What I'm not okay is when I need to call them to inquire about my biometric letter because they left me hanging, wondering what ever happened to my biometric letter.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsStuck in Administrative Processing
My husband had his interview in Islamabad, Pakistan on Dec 26, 2013.
He was told that he had all the necessary paperwork and that he would get his visa in 1-3 months, because they has to put him on necessary Administrative Processing.
He was given a green sheet, which means that he was refused under 221(g) but they didn't say that he needed any other paperwork.
I'm confused because almost one month has gone by and his case was last updated on Jan 7, 2014.
Should I get my Congressman involved? Any tips?
Thanks!!

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsEveryone going through Administrative Processing in ISLAMABAD

Hello vj members i just had my interview at ISl embassy. The CO lady was very nice and polite our interview( my 1 year old baby and me) went well, but CO said she cannot issue me visa rite now but after some time InshaAllah. When i inquired abt the time frame she said 1 to 3 months. I am really depressed now as nothing is in our hands although my case was fine and she demanded nothing at all. Please tell me how much time I have to wait for our visas??

The same thing happened to my husband, who had his interview just one day after yours! The lady at the Embassy was very nice and satisfied with all of his paperwork but said it would take 1-3 months for his visa. She said it could be longer but that is the general timeline. Let's hope and pray that what she said is true. InshaAllah.

But how long did it take from the approval on your interview date to actually getting the visa in your hands?

Removing Conditions on Residency General DiscussionPost I-751

I traveled with NOA and expired GC.

Although you are correct I can see a potential problem when you travel to nations where their citizens need visas to the US. For example, in Russia you won't be allowed to board an airplane unless you can prove that you will be allowed into the country of destination. USA in our case. But try explaining your situation when you are holding an expired greencard and an extension letter to an airline employee who has been taught 10 - 20 basic words in English to facilitate his or her position. I imagine the greencard, visa, and I-551 stamp is by far more common than the NOA extension letter.

Removing Conditions on Residency General DiscussionDoes 10 yr PR have to change address?

Will it ever end?

Not until he naturalizes... :P

Not necessarily, if you happen to have lied on your original application either for a visa to the US or the I-485. For example an ex-nazi guard who failed to disclose his situation got his naturalized citizneship revoked.

Removing Conditions on Residency General DiscussionHas somebody sent pictures as a proof of relationship?

Pictures don't really prove anything, and they aren't listed on the I-751 application. Best evidence of a real marriage is "financial entanglement." Joint bank accounts, investment accounts, car titles, mortgages, title to the home or a joint lease, credit card statements, insurance, etc.

Would you agree that a very poor couple, who has no credit cards, no cars, no investment, no insurance, and no property / leases would be at disadvantage in establishing a "real" relationship?

Removing Conditions on Residency General DiscussionDo Affidavits Need (Legal) Notarization
Based on VJ FAQ the letters do NOT have to be notarized:
"7.8.1) ..So what does USCIS (INS) want to see in the affidavit from people we know??
A..(newsgroup)..I did the I-751 in 1997, and it was approved without an interview. I asked the USCIS (INS) the very same question. I did exactly what they told me to do for the affidavits.

- Choose 2 friends who know you well *as a married couple*
- Have EACH friend write a letter
- Letter format:
- Must include the person's name, date of birth, SSN, address, and phone.
- Must be dated.
- Must state how the person came to know you [and list each of you by name).
- When and for how long they have known you.
- Must state that they have seen you a certain amount of time ['frequently' works] since you have been married and that you appear to be a married couple.
- Must be signed, but does not have to be notarized."

But now we're worried (like everyone else) about what happens if the interview letter (if there is one) or NOA-2 or green card get sent to the old address.

Have you heard about USPS mail forwarding?

I wouldn't worry about it even if they didn't get your address change the first time around.

No real effect for lifting conditions. Bigger effect for citizenship, because he has to mark that he was charged with a crime. Not sure if a DUI is a crime of moral turpitude, it depends on how the immigration folks interpret the local statute he was charged under.

US Citizenship General DiscussionCitizenship Question

I will be applying for my citizenship three months before 5th year mark, which is Sept 28, 2014. However, this year, I was out of the country for four months. And then next year, I will be out again for three months, as I will be getting married overseas. Do you think that this will affect my citizenship application?

Btw, I am getting married before my citizenship. Would it affect my citizenship? I'm also planning to apply for I-130 for my future spouse.

A response will be greatly appreciated. Thank you.

US Citizenship General DiscussionWill marriage affect my naturalization?
My father petitioned me here and I have a 10 yr green card.

Yes, I am planning to upgrade my application immediately once I get my citizenship. Im just worried that me getting married in the Philippines will affect my naturalization.

Thank you for your input.

US Citizenship General DiscussionWill marriage affect my naturalization?

I am getting married on April.. and I will also hit my 5th year on September, I am hoping to apply 3 months before this.

I will stay in the Philippines for 3months.. so April-July. Will my marriage affect my naturalization at all? I'm planning to apply for I-130 after I got my marriage certificate, and then apply for a citizenship. I'm worried that this might affect my naturalization, and then affect my I-130 application :/

I just got married in the Philippines 3 months ago, and I am eligible to apply for my citizenship on July 28th this year. What should be my first step? Do I need to change my marital status first? Thanks
