Almost mrs your husband was in AP for how many months? When did they ask him for new medical?

 

He is still in AP. Just completed 8 months at the end of August.

First we got an update on 8/28 (after not getting updates since 07/01) and then updated again 8/29 and that's when they called him and asked him to bring new medical. He asked if he needed to bring anything else but they said no.

And his interview was on 12/26/2013.

Contact the medical center for the appointment and then do your medical. When you get your medical report send it to the Embassy using their recommended courier.

For those of you whose visas have been issued, how long was the wait between sending the medical and visa being issued? Just so I can get an estimate :)

I am going to contact my congressman soon and see if there's anything they can do. I tried emailing the Embassy but it has been almost three weeks and no response.

He is still in AP!
His interview was December 26 2013, and they said he would get his visa approved in 1-3 months.

This rule does not apply to the cases where petitioner is US citizen... so i think you are still good, but we Green card holders are screwed and that little hope we had is gone...still Thanks to Allah for that he kept us better than millions "Alhamdulilah"

Wait I'm really confused by the June 2014 bulletin.
My husband's Priority Date was January 14 2013.

We applied for CR1 visa.

Does that mean that in June they are not issuing visas with PDs before May 2012?
That also means that in July they could change the current PD again, right?

Lots of updates in March and then nothing this month.
A lot of people tell me that sometimes things slow down and then all of a sudden, things start speeding up and you forget that there was ever a slow time. Don't lose hope! InshaAllah everything will work out soon!

Just called the NVC to get an update and this guy Mel basically just said that the case is still in Administrative Processing and the Embassy needs to determine whether my husband is eligible for a visa.

I don't understand though because all of the paperwork was there, his interview went smoothly, and he was told his visa would be issued within 1-3 months!

His eligibility has already been determined when we submitted the paperwork and had an interview!
It makes no sense.

Going into the fourth month of AP now. Praying for the best since that's all I can do.

I have been avoiding VisaJourney because some of the comments are really depressing :(
But I have to share this because I have nowhere else to vent!
I contacted my Senator about a month ago, and I just got a letter in the mail from her office today. The only thing it did was get my hopes up, but when I opened it, all it said was that my husband's case was in Administrative Processing.

I already knew that though! I contacted them to ask if there was anything they could do to speed up the process! 
So frustrating.
Now I contacted my Congressman, and I hope there's something he can do about it.

I am a U.S. citizen and our case is genuine. It's been more than three months since my husband's interview and still no visa.
Don't really know what else I'm supposed to do except wait and pray.

April has started, so let's make dua'a that this is a month of happiness and good news inshaAllah!

My husband's case was updated on February 24, after I sent an email to the Islamabad Embassy. Here is what they sent me:

 

Thank you for your email.

As per our available record, this visa case is part of an integral administrative processing, that can neither be waived nor expedited. Though, we certainly understand the importance of family reunion, and also aware about the frustration often caused by the delay.

However, ultimately the completion of such process, depends on the Department of State in U.S. Therefore, unfortunately, we are unable to predict the amount of time this process will require.

Consequently, It is imperative to mention that as soon as this process is concluded, we will move forwad regarding this case, and will make contact accordingly.

I am an I-130 August 2013 filer.  I am stiil waiting for my NOA 2.  But instead of an approval, I received this notice today.

 

*Request for Evidence*

 

On February 24, 2014, we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested. Meanwhile, processing of this case is on hold until we either receive the evidence or the opportunity to submit it expires. Once you submit the evidence requested and a decision is made, you will be notified by mail. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

 

Anyone have a clue as to the nature of what they might be seeking?  We've been waiting for 6 month and I don't this will delay the process anymore.  A lawyer checked our documentation before we submitted everything so I don't know what they could be after.  Has anyone else had this request?  What are they looking for?  I called the Customer Service number but they just said to wait for the notice to arrive in the mail.  She did however say that it could be as simple a birth certificate, affidavit, or even an   I-864 proof of income.  

 

Stressing a little, but I know that we're is legit, so whatever they are requesting I know I would be able to provide. But I hate speculating.. this sucks..

So I finally got the RFE in the mail on Saturday 3/1/14.  It had a mailing date of 2/21/14.  It said that they were requesting more evidence of a bona fide marriage such as:

 

Documentation showing joint ownership or property;

A lease showing joint tenancy of a common residence;

Documentation showing co-mingling of financial resources;

Birth Certificate(s) of child(ren) born to you and the benificiary;

Affidavit's sworn to affirm by third parties having personal knowledge of the bona fide of the marrital relationship...

Any other relevant documentation to establish that there is an ongoing marital relationship

 

You must submit the requested information within 84 days of the date of this letter.

 

However I initially sent in a certified marriage certificate, 5 sworn affidavit's, and western union receipts showing my support of my spouse through out our relationship.  But I guess they want more???  We just got married and don't have many assets together.  Just another setback..

 

Any ideas??

My opinion is that the law allows me to marry a foreign woman of my choosing, period.

That is correct. You can marry this foreign woman in the US or abroad. However, as the law is currently written you can only assert a privilege in terms of asking the US government for permission to sponsor your spouse to either come into the US (K3 / CR1) or come into the US to marry you (K1).

There is a legal process in place, I'm following it. How is that not my right?

You have every right to seek an immigration benefit if you and your sponsored alien spouse / fiance, etc. qualify for it. However, if IMBRA disqualifies either you from sponsoring the alien or the alien from coming here, then at best you have a right to appeal as designated by congress. Keep in mind, that allowing your appeal is completely in the hands of congess, because on such issues as immigration, congress has gone as far jurisdiction stripping of the courts to prevent the courts from hearing certain issues.

If that legal process were to fail and she were to be denied entrance, I'm free to leave and move somewhere else to be with her.

Yes, as far as I am aware, the US government does not prevent its citizens from leaving the US.

So your saying my relationship (or all of the relationships on this site) is a challenge to US sovereignty is not valid.

Absolutely not. All I was saying, that in general, if the US government chooses to prevent a foreign alien from entering the US, the USC cannot exert his right to marry as basis for overturning that decision. He can argue that of course, but based on current precedent, the USC is not likely to succeed on that argument. And one of the strongest reasons given against allowing the USC to assert his right to marry, is that in some situations US sovereignty will trump this right.

I am undecided as to whether that is right or wrong, I am simply explaining what the law currently says. I am not a lawyer, just a law student with an opinion :P

Out of interest, what is the cost for the immunity test?

I had the MMR vaccination only a couple years back, had chicken pox as a kid, but will need to get tetanus and influenza I guess.

I'd rather have a blood test to show my immunity to MMR and chicken pox then have them again as I remember being unwell for a few days after it!

(I live in Australia by the way, despite by NZ flag :))

Hi kiwis,

Just a question - we filed our I-130 while I have been living in Australia, however Auckland will be the consulate as I am moving back to NZ to wait the end of the visa process out.

I will be visiting my husband for Christmas for awhile and am wondering whether I should go ahead and get the medical done on a stopover in NZ on my way through to the USA, or should I wait until I fly back to NZ in February? (We will be requesting an expedite due to a military situation - so I'm relatively confident it shoudn't be long after I return that I get an embassy interview).

So, my question really is, can you do the medical stage in NZ PRIOR to it being at NVC? Secondly, how much should we be budgeting for this medical?

Guys I've never had a print out of my record from a doctor of test results.

I went to the doctor about something unrelated and got a test slip for clinipath to check my immunity for MMR and varicella.

When that comes back as being immune (which I know it will) - what do I need to ask the doctor for? What will the physician need?

Did you get the check directly through the AFP or did you do it through the state police? People living in Australia get it through their state police, and processing times vary between states. Usuall only those outside Australia go through AFP.


I live in WA, which has no 'state' police check so to speak that the US will accept. It says on the US embassy website to apply for a full police check through the AFP and bring it with to the interview.

Also, my case number with NVC will be an Auckland number - so for all purposes, I'll have needed an AFP certificate anyway.

How did you guys find dealing with AFP generally?

I've lived in Australia for <18 months. It's been 2 weeks now since they received my application. I emailed explaining that we urgently needed the police check as it's the only thing that will hold up the NVC process, and offered to pay an extra fee if required for urgent processing to no avail. They said it was first-come-first-serve and that my circumstances (the USCIS even recognised the urgency of my husband's military situation and approved the I-130 in 2 weeks!) would not help to prioritise it. I wasn't pushy at all, maybe that's my downfall.

So, do they generally stick to 20-25 working days? I leave Australia 30 November for NZ to wait out this whole visa process with my family, but I'm paranoid that then I'll be waiting on my flat mate to send it to me! :(

I looked online and I booked in with City med in Auckland - despite living in Christchurch, I was precious and want a female doctor!

It's $333 for the doctor, nurse, x-ray and blood tests.

Good to know about the embassy saying it's ok to have on the same day. I'm hoping that I can get it done the same trip to Auckland that I've booked the medical for early next month. Fingers crossed!

FYI - not every doctor gets you to strip. my doctor in Sydney just got me to take off my shoes and sweatshirt, and he sent me to a female doctor for the breast exam.

I was about to ask you where in NZ, I'm in Auckland at the moment and met one of the Auckland doctors that do the visa medicals, and she was lovely.

Where are you PCS'ing to? I'm in a similar situation to you, except we are going K1, I've been living in Australia and have just popped over to NZ for work for 4 months, NZ born and raised though, however i chose to do my interview in Sydney, at the time of filing, I didn't know I'd be in NZ, it would have been easier though!

my fiance is Army and we are PCSing to Sth Korea in May, provided I get command sponsorship of course, so we need to expedite AOS after we get married.


Good to know - I'll be in Christchurch and the two doctors are male. I know it's a bit silly, but after reading this I'm a bit concerned about the evasiveness of the medical! I'm still in Perth for now, but will be back in NZ 1 December. I have quite a few airpoints due to all the long distance travel I've been doing - and I see all 4 Auckland approved doctors are female - so maybe I'll fly up there for my medical. Seems a bit extreme I know, but I won't be working and Auckland is a great place!

We are PCSing to Ramstein, Germany in April. FYI- you will also be able to expedite citizenship! My husband and I have done a whole lot of research on this and if your husband has PCS orders, you can apply under a special section of the naturalisation act - s 319b I believe, where if you are currently PCS'd or PCS'ing you can apply for citizenship with ZERO residency years!

We're definitely going to start the process as soon as I'm in the USA, as it will give many more job options on the base!

I'm glad it was of some help to some people. I myself wondered as to what they do that costs so dang much!

I made small chat with the doctor, as you do when you're doing awkward medical things, and the requirements they had to meet in order to be able to do the medical was pretty stringent hence, why he could charge so much ($456)

Well, now, I'm just waiting for some documents from the fiance and the results of the medical. Once I receive these final documents, I'm able to send off my packet 3 and be advised of my interview dates (fingers crossed start of December).

How is your journey coming along?


Definitely going to diet if I have to stand in front of a guy naked! I'm in Perth now but since I have an Auckland NVC number, I'm quitting my job at Ernst & Young and heading back to NZ the end of this month. I looked up the approved doctors in Christchurch and there's only men.

I'm still waiting on my police certificate, and my husband sent me back my birth certificate that I'd left over there by mistake. We've requested an expedite at NVC since we're PCSing next year and if that happens, then things are going to happen incredibly fast. I'm pretty nervous about not having everything, but I think that the only thing that will take awhile now will be the AFP certificate. Always feels as though I'm waiting on something!
