I am fairly late on the update but I might as well give one rolleyes.gif

 

I sent in the letter for a USCIS expedite request and on January 14th it was approved. It was then sent onto the NVC where we waited nearly 3 weeks for receival. I then sent in an expedite request through them and they denied the request at the NVC. We have the DS 261 completed, AOS fee and documents sent in, the IV processing fee paid and supporting documents shall be received today in their office via FedEx. Next will be the DS 260 from my understanding and then waiting for an interview appointment smile.png

 

I read the the Egyptian embassy is currently taking 4-5 months for an interview date. I hope this is truly not the case. I was hoping to have him home before that to assist me plus celebrate our 1 year anniversary.

Thanks to all! Currently we are awaiting for a response for our request for expedited service.

 

I wouldn't mind doing the tourist visa, but the risk of losing that additional money when it could be turned down is not worth the risk at this time. And my mother's health is too far down the tube to be riding in a car for 2+ hours by car. To get to Mexico, it'd take 8-10 hours minimum and to Canada would take 14-16 hours. More so, I will need my husband's help to transport my mother between doctor appointments/dialysis.

 

And my mother has to go to the restroom every 2 hours of the day/night due to an accident we were involved in 17 years ago (she sustained most injuries, I ended up with bruises). Her bladder has also slipped out of body and MANY precautions are taken on a daily basis on top of that particular issue. Kidney failure, shingles, heart problems, high blood pressure, scoliosis, epilepsy, short term and long term memory problems (cause of accident) are the things my mother endures on a daily basis and I need the additional help at this time.

 

I am not trying to clog the system, just trying to maintain a home for when my husband comes but also tend to my mother.

Does he have a Tourist Visa? If not has he applied for one?


He has his Egyptian passport but does NOT have any visas at all yet. When he comes here, this will be the first time he will go out of his home country.

The tourist visa would be denied if we already filed for an I-130 correct?

There's not another immigrant visa path that's faster, if that's what you're enquiring about.  He could attempt to get a tourist visa in order to visit, if he doesn't already have one, but it's very hard for folks to get a tourist visa with an immigration petition in progress because of the need to show non-immigrant intent for the tourist visit.

Hello,

I really to hate this question but I must face the truth in this tough situation. Last year my mother had special tests done on her kidneys and a total of 7% was working for her kidney functions. After an emergency visit to the hospital last night for complications, they ran another test on my mother's kidneys and now she only has a total of 3% kidney functions. She's currently on dialysis 4 hours per day on the average of 3 to 4 times per week. Both my husband and my mother have a desire to meet in person. Now with the news of my mother's health, is there a way that my husband can immigrate quicker without jeopardizing our I-130 application?

Please help and any advice is greatly appreciated. Thank you!

I just paid my IV fees 2 days ago and I sent in the supporting documents via FedEx 2 days ago as well. It does take 3-5 BUSINESS days for things to process for the fee to change from "in progress" to "paid". Don't fret! This way they have all the supporting documents and the fee will be paid, then we can both go online and complete the DS 260 then.

 

After the DS 260 is completed, they will send it to the embassy where your spouse is.

Now it will take an average of about 3 weeks to reach the National Visa Center. From there it will take an additional one to three weeks to enter the information into the system of theirs. Your husband will need to complete the DS261 form (choice of agent), whether that will continue to be you or himself. Then you will start to go ahead and pay the affidavit of support (AOS) fee for $88 and that will take 3 to 5 days to reflect that the affidavit support fee is paid. During that time of the three to five days, send in your supporting documents of your salary/income to the National Visa Center. Once they receive it, they will process it which takes another 3 to 5 days then they will open up the processing fee for $230 and that will take another 3 to 5 days to reflect that is fully paid as well. Send those other supporting documents in the meantime as well. Once everything is setup and complete and you will log back into the DS 260 form to the National Visa Center and then the process will begin where it will be transferred from the Visa Center to the embassy wherever your husband lives.

I've heard that a expedite with NVC is very difficult to get and sometimes may even slow your case down.

Have you tried calling them to see what grounds they denied you on then you can provide stronger evidence for that?

 

No, I have not called them regarding the grounds for a denial. That is a good idea. I will look into it. Currently through others what I have heard, the Egyptian embassy has a 6 month appointment waiting period. If my 2nd request for an expedite is denied, I will request a visitor's visa because even if its temporary, the medical side of things my husband can help with. Without a doubt,  he'd be on a plane back home a few weeks later due to work and therefore.

Hello all,

 

I am seeking the advice of my fellow members. I am a little confused here. In late December 2013 I sent in a request for an expedite through USCIS. After two weeks, we had an approval and 2 days later our case was complete at the USCIS level and moved onto the NVC. Our case arrived to the NVC on February 10 th, but was not officially in their system until February 26th. At that point I had placed an expedite request with the NVC and they had written me back one time requesting 2 international phone numbers for my husband. One more week had passed and that is when I received the denial email from the NVC.

 

I do not understand the denial for the expedite request at the NVC stage, but yet USCIS gave an approval. My circumstances have not changed from the time I requested it at USCIS to the NVC stage. Though yesterday I did write a second request for an expedite even though the first one was denied because my circumstances have changed over the past 2 weeks since the denial. Not only does my mother have the kidney failure down to 3% total function, but now financially I must spend part of my money on her as well just to help her keep her alive medically since she has been cut off from all government programs for her dialysis and other medical conditions.

 

Any advice from anyone?

My best advice I can offer you that I started doing right away is telling my husband to gather all his supporting documents (police records, military records, birth certificates, passport photos, copy of passports, etc.) back in late January/early February. Once he gathered them together, I had him send them to me via FedEx.

 

The first step at the NVC is to have your spouse complete the DS 261 form online through the NVC once you receive a case number from the NVC. It's best and typical for the foreign spouse to have the citizen here be the choice of agent. Then the AOS form will need to be completed by either you or your spouse ($88 fee). Send in supporting documents for the support (proof of salary, tax return, bank statements). Wait 3-5 BUSINESS days for "paid" to show online. Then pay $230 IV fee (send in supporting documents...documents I listed first), wait 3-5 more days. Complete DS 260 online and then the NVC will do the rest of the work for you until the interview date.

 

*Reference: Just paid the IV fee 2 days ago and documents sent via FedEx as well. Next week I will check with them for the opening of the DS 260.

Yes that is correct. DS 261 (5-10 days), AOS fee (3-5 days), send in supporting AOS documents during this time (3-4 days to process documents), IV fee (3-5 days), send in supporting documents (military records, birth certificates, police records, etc. - 2-4 days to process documents) then DS 260 will be opened up to be completed.

Thanks Darnell.   4 authorized places in China!  Ridiculous.  Our interview is on a Tuesday and she already bought tickets for Monday (anxious).   Can't take the chance that they'll get it done in GZ on short notice (less than a day) so another trip to Beijing for her!  Pain in the butt but she gets one extra visiting time with her family before we get the hell out of this country!

Hi everyone, I just recently ordered a new birth certificate for myself in long-form for my interview and I was born in Nova Scotia.
My issue is that I have a 3 year old daughter born in British Columbia and when I went to try and get a long-form birth certificate for her, there is no such thing.

The options I am given are as follows :

Birth Certificate with Parental Information ($27 each)
Birth Certificate with Individual Information Only ($27 each)
Certified Photocopy of a Birth Registration ($50 each)

I have already ordered and have in hand, the birth certificate with Parental Information, which Packet 3 clearly states that there needs to be parental information on the birth certificate. I read an interview experience from someone and they needed a long-form of their birth certificate, not wallet sized ones.. So I'm panicking a bit.
The birth registration is really only a copy of the form I filled out with just registering my daughter's birth, it's not official and it won't bear a seal once it's printed and sent off to me, what should I do?

Yes actually my father's tax transcript because I am still dependent on him.

It was required during the NVC stage but they asked for it again. Not sure if they actually checked it though.

I would advise getting it just in case. You don't want to take any chances.

I scanned it and sent it to my husband, who then printed it out.

To answer your questions:
He took all of the documents that they requested (they sent him a checklist with things like tax statements from the petitioner (me), wedding pictures, evidence of communication (Facebook messages, texts, call records), and a few other forms) but they really only asked a few questions like where we met, what my occupation is, what his occupation is, our birthdays and places of birth, and then that's it. They didn't even check all of the paperwork they had requested!
In my case, my husband was asked to bring in phone logs (which were 260 pages long!!) and just a few pictures. The Embassy lady checked the pictures but she didn't even look at the phone logs.
Police certificate is always a good idea to take, I think that's one of the things that the Embassy lady asked to look at. It just verifies that you are cleared in the system.
We basically only met once (during my Nikkah). I was introduced to my husband in Summer 2012, had Nikkah in December 2012, and haven't seen him since. We communicate very frequently, which was clear in our proof of communication. We just had to scan our tickets and itinerary as part of the proof of marriage.

Hubby and I had our Nikkah in Pakistan in December 2012. I am from the U.S. and he is from Pakistan.

We are currently in "Administrative Processing" after his interview, which was on Dec 26, 2013. The lady at the Islamabad embassy said he did not need any other paperwork and that his visa would be issued in 1-3 months inshaAllah.

Is anybody else in the same boat?
I don't understand why we are in Administrative Processing if no additional paperwork is required.

I am the US citizen. The I-129F was approved 20 August ''til 19 December. The package arrived in HKG in October. One police certificate is taking a LONG time. It is apparent that more time is needed. I read that the time can be extended by a consular officer.

It is not obvious: Who calls which person how??? Does my fiancé have to try to contact the consulate? Or do I have to make the request? The dated period is on MY I-797. What Case numbers, confirmation numbers, USCIS rec. numbers, etc have to be referenced. I have looked thru FAQ's etc and cannot find any explicit instructions on what to do or who to contact exactly. Does anyone with experience with the HKG consulate have any definite info about how to extend this period?

Hi everyone,

I am sending off our I-130 application tomorrow, and I'm reading a lot of conflicting advice about how many passport style photos to include.

The USCIS instructions state to include a passport style photo of both the beneficiary and petitioner with the I-130.

The guide on here states to attach a passport style photo for both the beneficiary and petitioner with the corresponding G-325a.

We are more than likely going to reduce the chance of them coming back for more photos by attaching two photos (one to each of the above) but it would be great to have clarification on that from someone who has been through the process.

I'll be starting my time line once this is in the post!

Hi everyone,

I just left my husband after 3 weeks together, during which we got married. We decided to 'ease' the pain of my going home, that we'd lodge the I-130 while there. So now I'm officially on my visa journey.

Question - I have CPA exams to sit in California - 1 or 2. I want to visit my husband at the same time as doing them. My concern is that they won't let me in to actually sit my exams! I'm in a visa waiver country so can't apply for a visa in advance. I know that I would have to return regardless to my home country for my embassy interview so surely that is proof enough that I'm not going to stay there, and if I was going to, I would have just been able to AOS while there on this trip?

Does anyone have experience with this? To add complication, I may have quit my job by this stage and be moving back to my home country (NZ) after having lived in Australia after over a year.

Hi everyone,

After reading another person's post, I realised that we made an error on the I-130 form that we submitted.

Under question 22, I believe we made a mistake. We put N/A to all parts of the question as it said 'If the beneficiary is eligible for adjustment of status...' so we moved onto question 23. I now realise after reading another post that we should have put the embassy we want to file at in the right hand boxes.

What do we do to amend this? Can we call USCIS? Or do we have to submit a new form? Will they ask for clarification on it anyway?

Thanks guys, ahh man - spend so much time on these things and then it is destroying to find out you make a small mistake due to interpretation!

My husband is PCSing to Ramstein, Germany.

For military purposes you can request an expedite if you receive orders or notification of a PCS.

We filed our I-130 while I was visiting my husband under the VWP.

As long as you intend to return to Australia, it's fine.

Good luck! It's very hard each time you part, but once you get things started with the visa processing, it does tend to make things a little easier as you feel as though you are getting things done! Get her to start applying for things like the documents you require at the NVC stage (police certificates etc.) and have all the original documents ready to go.

If your fiance visits you under the VWP after you are married, then it's easy to get her all enrolled in DEERs etc. while she visits, and get her her military ID.

  • Skype log showing our video/phone chat durations
  • Photos from 2 of my trips to the USA
  • My passport stamps from those trips
  • Joint bank account print off
  • No wedding photos (we didn't have a ceremony) so we only had our marriage certificate to 'prove' our wedding
  • My spouse military ID card

That was sufficient, no explanation of how we met etc. We thought the amount of time we spent chatting to each other (something equivalent to a whole month of chatting 24/7) was enough to prove we were legitimate in itself!

I received my NVC numbers a couple of days ago.

My husband and I were both able to log in to the payment portal and it said that there was no payment available for processing.

Yesterday it started having a sign on error. It would load but say that there was an error with the log on or whatever on a new page.

Today it now says:

You cannot make online payments for your case at this time. Please contact the NVC if you have questions or need further information.

I've read about sign in failures prior to an invoice becoming available, but is it possible this is related to our expedite request? Wishful thinking I know!

I read on the NVC page that this error message is normal, but I'm more confused as to why we got 2 DIFFERENT error messages over a period of 2 days after initially being able to access it.

How long will the system usually go down before you can pay it?

My husband called USCIS last night and they said they couldn't understand why ours was sent to NBC if we didn't file an i-485 at the same time.

Going off the September 2012 filers on here though, it seems to be that they're going to NBC and then getting sent to a local office for processing now. Do you have an 'MSC' code?

Being one of the August 2012 filers with csc I thought it would never happen. Waiting for noa2 (8months) was one of the most depressing times in my life. We did not know what is going on with csc, why they stopped approving us, weeks were going by, seasons were changing and there was absolutely no progress. Some people were saying to get all the docs prepared for when it arrives and it was the most annoying thing to hear, as I thought I had everything ready. And you know what? They were right! I did not think about it at that time but I could have had ds156 filled out months in advance instead of spending entire week trying to figure out exact dates of my multiple entries to the US, searching for old passport and digging inbox for old itineraries. All forms could have been filled out stress free weeks in advance.
The interview at the embassy was extremely plesant, the consul did not even look at the thick pile of docs I brought with me. It was maximum 10 min conversation about how we met, relationship between my fiance and my son. What was challenging though, was the entry to the embassy bulding with one small purse and one canvas shopping bag full of forms and papers. The security did not want to let me in with two bags, even after I took out documents, folded the shopping bag and put it inside my purse so it would count as one. I ended up leaving the empty shopping bag out on a street in front of the embassy. Such a nonsense! Oh well, the imigratin path to the US has never been easy :-) Flying off next Tuesday.
