I received my letter on October 2 and my Oath Ceremony is coming up October 16th, its almost over!

I sent it more evidences, a whole whole bunch of them a couple of weeks ago and got a letter that my case was under review last week.

 

Finally, today, I got a text.....On September 19, 2013, we placed your application in the oath scheduling que. We will send a notice when the ceremony is scheduled. If you move prior to the scheduled ceremony, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

I went for my interview today, it was good, the lady was nice, I was called in 30mins after I got there, I passed the test and she said congratulations, you passed! We went through all the paper work she already got and that was good too and after I signed the passport photos and all the papers she asked me to sign, she took my ID, Passport and Green Card and gave them back to me, I was thinking we were done, lol, we chatted about family issue, brother in-laws, sister in-laws and church pastors generally  and her sister is a pastor, we chatted for about 10min and all of a sudden from nowhere, she said Ok, lets finish up, can I see your taxes for the last 3yrs, supporting documents showing you have relationship with your wife, lol, I said Ok, I gave her lease agreement with both names on it, gave her our business account which shows both name on it, she said no, I want the one  that shows your home address, really? we have the business together..helloooooo? ok, she said photos, i gave her photos a stack of family photos about 200pics, she said, there are more of church photos here, I need more photos of you and your wife on vacation and more evidence, I said Ok....Finally she said, dont worry about it, just send me more evidence showing you and your wife live together and have a relationship in the mail, you dont have to come back here anymore, I will approve and send your oath letter after I get those evidence from you, Congratulations! lol.....

I got my Biometrics letter yesterday and it was scheduled for 06/19 but I got it done today, it too less than 10mins

IF1 is Alien whose record of admission is created upon the conclusion of a valid marriage contract after entering as a fiancé or fiancée of a US citizen.

Doesn't matter what visa category you are, you still cannot file for Citizenship now. But hey, ultimately the decision is in your hand. You can go ahead and apply, and tell us how it goes.

Ummm...yes, you don't know what you're talking about. You can apply for SSN with your Green Card and yes, you can work legally if you have your green card. Who told you that you will get US birth certificate once you become a citizen? You will not get one and you will never get one. Read more.

e.g Name 3 original states - think of states that have the word New in front of them.
Name one US territory - For Spanish speakers, it's easy for them to pronounce Puerto Rico,

Exactly why it is best to not set a date in stone until you at least have the interview date (even better the visa in hand), though either way it shouldn't be set in stone since AP can still happen!  We were hoping for December 20th for a date, just cause that was when he had his Christmas break from school.  Just hoping though, never booked anything.  So unfortunately we will have to aim for the end of February instead.  

Just keep checking.. you could get one for February still and it will give you more time to get your passport back!  

Yes... I of course realize this but am a little heart broken regardless at the moment and there's nothing I can really change now. But we're hopeful and praying lots ha!

I never called DOS to confirm whether or not they received my petition (I just watched CEAC like a hawk!)  But I'm, pretty sure they would be able to tell you if your petition has arrived at the Consulate.

 

They can - 100% - tell you whether or not Packet 3 has been sent out.  I would call back and enquire again.

 

I would say you're in the safe zone to send you Packet 3 contents.  Just make sure you have copies in case for some reason there's a hold up on your case (for what reason, I have no clue at this stage).

Now the stuff was sent to the embassy back in August so I'm assuming it has to be by now I just wanted to be safe. The lady on the phone told me that she couldn't help me with that info though!! I see your point. All major airlines fly only through the US to the Bahamas. Have your wife check with a local travel agent in Belize about any other way of getting to the Bahamas. Perhaps by sea. Also there might be local flights that are not mentioned on official websites. This sounds like a big research project, perhaps it is easier to just change vacation plans?

The VJ ers have advised, wait the 2 extra weeks and do the CR-1/IR-1, but it is ultimately up to you if you want to spend all the extra money and time doing the AOS.

Do you actually have to tell the visa which interview you are going to? What happens if you just don't show to the K3? Is your IR1 interview still good to go? They don't just treat not showing to the K3 as an abandonment by the beneficiary on all cases? Just curious.

What I've heard is that you can only use only the income shown on your tax forms as "income" in terms of the I-134. Granted you could file a tax a return showing your graduate student loans as income and pay taxes on it to satisfy immigration. But that is a huge waste of your much needed loan and probably illegal or wrong in terms of tax filing. Once the money is in savings you can still use it, but it goes into to assets category requiring you to have 5 times the amount of money you are short to satisfy the I-134 / poverty guideliness.

If the embassy requires the I-134, and Moscow does in most cases, you will need to do one even if your income is $0. But they will need a co-sponsor who does meet the requirements. Otherwise it's an uphill battle meeting the public charge requirement of the INA.

A K1 or any visa for that matter can be denied for a number of reasons. Too many to even list at once.
For example grounds of inadmissibility (i.e. prior convinctions, drug use, prior overstays, medical issues, etc).
Or fraud and misrepresentations.
Not being eligible for the visa, i.e. already married, under age, same sex marriage, close family member marriage, etc.
Procedurial reasons. Didn't pay the visa fee, medical fee, didn't schedule an appointment, etc.
I am sure others will add many more reasons to be denied.

Well, options 1, 2 & 3 are rare enough to stumble across on the internet these days. And #4 is still covered because it's not Adjusting, it's going outside for CP.

I forgot that recently there is a 5th Option.
Join the military and serve in active combat and get discharged honorably. As I understand it you can go from EWI to Citizen during the time of your military contract. Which pretty much beats out any other method in terms of speed.

"Section 329, INA
This section applies to members of the U.S. Armed Forces who currently serve or have served in active-duty status during authorized periods of conflict as outlined in the INA (WWI; September 1, 1939-December 31, 1946; June 25, 1950-July1, 1955; and February 28, 1961-October 5, 1978) or any additional period designated by the President in an Executive Order.*

* Recently, the President signed an Executive Order identifying September 11, 2001 and after as an authorized period of conflict.

Have you served honorably in the U.S. Armed Forces during an authorized period of conflict?

Even if they went off and got married... if he is a citizen.. she is still not elegible for adjustment due to being here illegally.

That is not true. Illegal aliens who entered without inspection are not eligible to adjust status, but illegal aliens who had an initial legal entry but whose status lapsed ARE eligible to adjust status.

There are forms of relief for people who are EWI in this country. And they can adjust status. I will list a few below.

1. INA 240(a)(b ), someone who is EWI (entered without inspection), been continuously present for 10 years, has good moral character, and have a qualifying relative who will experience “exceptional and extremely unusual hardship" if they are removed. This of course is a form of relief once you are in removal proceedings (caught) and very discretionary.

2. The other form of relief is INA 245i. If this girl had a pending I-130 (regardless of which relative filed for her) before April 2001 and was physically present in the US in December of 2000 she will also be able to adjust if she marries this person USC right now and he files a new I-130. 245i is the gift that keeps giving because she would have been grandfathered in.

3. Another long shot form of relief is that if she has been here illegal before January 1, 1972 she can adjust status via registry. (current statute of limitations on immigration violations).

4. Finally if she doesn't meet any of the above they can still get married and then do counselor processing. She will need a waiver (I-601) for unauthorized work and authorized stay if she has been doing either for longer than 90 days.

I don't understand how someone can say she will be banned for life and never adjust based on the facts given!

I am sorry if you feel that this advise is nonsense... but I would not try to offer advice on this topic as it would be best for the OP to advise his friend to have someone go over the whole situation in detail and give advice based on that.... not what some people might think might or might not happen....

You misunderstood me. I was only upset about your suggestion that VJ should be limited to certain kinds of questions and cases. Just because a lot of members might only be familiar with a straight foreword G325A, I-130, etc... doesn't mean other questions should be precluded. Seeing an immigration attorney is good advice no matter what the question is. Why if you didn't know how to answer question #9 on the I-129F you could go see an immigration attorney, right?

This is correct, except that, as I mentioned in my prior post, his naturalization will allow him to upgrade his petition to immediate relative which takes just a few months to process.

So, he is just concerned that he may not be able to complete his citizenship oath because of her immigration status.

That is something worth asking an immigration attorney, but I don't think her or she will know. Besides experience or inside connections it is generally difficult to figure out the exact internal procedure followed by the USCIS. There are occasional public memos, regulations, and cables sent out, but I don't think they would touch on this detailed of a question.

Don't really worry about ICE. They usually don't do personal raids of the sort you are describing. They are more interested in people who are evading removal proceedings or have been picked up by local law enforcement.

And, even if she was picked up by ICE, you will have a chance at a bond hearing to get her out. Has your friend filed an I-130 for his out of status wife? He should do so as soon as possible. Once he becomes a USC he can contact the service center to upgrade his petition. There is case law on point which states that immigration judges (assuming the wife gets picked up now), will stall the proceedings until the I-130 is approved. And ironically, if she was to get picked up, the immigration judges would have jurisdiction over the case and actually adjudicate an I-485 a whole lot faster than USCIS.
He might want to contact an immigration attorney about his own N-400. I have not heard of stalling petitions to check the spouse's status.

As long as his wife doesn't have other issues like a criminal record or other grounds of inadmissibility / deportability, simply being out of status or working illegally will be forgiven upon marriage to a USC, which her husband will probably be in December.

Not all immigrants. Refugees for example can receive welfare. I think all non I-864 immigrants should be able to? Correct me if I am wrong here. Just taking a guess based on old experience.

So some of these will apply to you. This does not bar you from applying for naturalization. But it will have a bearing on your good moral character analysis. It is totally discretionary. A petty theft is considered a CMT in the eyes of immigration. CMT's are no longer taken into consideration 5 years after they occurred. But your count will be dropped so talk to an immigration attorney about what effect that will have if any.

One thing that was not mentioned in the other thread is that you can file for your I-539 extension of B1 status. Even if you get denied, while they are looking over the application your wife has legal status. So you can buy yourself time by not filing for an extension until the the day before your wife's status expires.
An I-589 application for asylum will also buy your wife time in status assuming she has "some" colorable claim. These take close to a year to review. If you get an interview before she is out of status, then you aren't harboring any "illegal" aliens as others have suggested.

To grant or deny you citizenship based on your wife's status is completely in the discretion of the USCIS officer doing your interview and reviewing your application. I don't know if an attorney can give you an answer either way. If you want an opinion, then I think this will have no bearing on your application.

If you get naturalized in the normal processing time then it really won't matter what status your wife is in. Her overstay will be forgiven when you file for her adjustment. Also in the worst case scenario if she is picked up by ICE when she is out of status, deportation hearings drag out quite a while too. Depending on the local court's calendar, you could be looking at 6 to 12 months before an individual hearing assuming you ask for a form of relief. One example would be an asylum application. That will certainly buy you time.

But the call is yours to make.
