I've spent a bit of time trying to figure out the boards here, so please excuse me in advance if I'm asking redundant questions. It could just be that I'm a bit slow, but it is a myriad of terms I'm not used to. 

My situation is my husband is USC and lives with me in Australia. We've been married for 5 years.

I presently have a B1 visa for temporary visits.

Filed our I-130 application in late January to Chicago Lockbox. Have received the notification that they received it, and they cashed the check. Assume that's NOA1?

It's been sitting in "initial review" stage ever since - over 4 months now. 

I can't tell what happens next? Is it the NOA2 where they request more details, more money, we send that to them, and then it gets transferred to a Service Center (Texas, California or Vermont)?

If my assumption above is correct - and from wherever it is now (presumably Chicago) it gets sent to another center, how long likely before that happens, and then once it is transferred to the next center is it another lengthy wait before our local Consular/Embassy interview for approval?

 

Again my loose understanding is/was that send to Chicago, Chicago check all the details and send to one of the 3 centers who verify next set of information, who then send back to Australia for in-person interview for final approval. My understanding is last stage back in Australia will be swift, and upon interview - Visa should be within days of that - but I have no idea if I'm likely to be waiting for days, weeks, months or perish the thought - years.

 

Lastly - I've read elswhere that my hubby could have sent the application locally to Australia so wonder if we screwed up and should have done that in the first place?

Good luck with the expedite process - ours went really smoothly, so I hope for your sake that it will be the case for you too! If the K1 got approved without an issue, then I'm sure the CR-1 will be just the same. We were really shocked we didn't have an RFE!

No offense guys, but the judgement to rush to marry while K-1 petition is pending seems like misjudgement in my opinion. You should have wait and finish your k-1 petitioning and get marry when your fiancee finally arrived in the U.S. Both of you would have to start all over again in the petitioning process, and will be expecting a lot of delay, time consuming, fiancial hassle, and a lot grilling during the interview. USCIS will take a lot of time to review your paper work this time, due to short timing of your marry while K-1 petitioning is pending.

I haven't read the rest of this thread- but read your post and thought I should reply.

She has said up there that her husband will be requesting an expedite due to military reasons.

As a new military spouse, I can totally see why they'd rush it on those grounds, as he could have many reasons to need to hurry up the process. They will have a much quicker route this way (look at my timeline through a military expedite!).

Don't make assumptions on other peoples journeys- no point unless you know the facts of their personal situations.

My fiance put in a service request to have our case expedited and we received an e-mail the same evening saying that our request had been approved. They also said we would hear about their decision (NOA2, RFE, etc.) within 7 to 10 days.

My fiance got a call yesterday from USCIS tier 2 lady because he had an option either wait 2 hours on the phone or get a call back after 3-4 days. And she said she knows they are slow and we should expect to hear news within a month or more.. She said it's because of many K1 applications.

Now .. I don't hope anything because everytime I see approvals here or they say the same bull** about "you should hear something within 3 weeks" since December I'm like YAY!!! And then I'm so depressed and back to reality. This whole stress gave me a nice stomach problem. So I decided that I will be approved in 3-4 months and that's it.


So they actualy called back? I remember your last post about it and I thought there is no way they would call back considering their "fantastic" customer service. It is nice to see them showing at least some respect to their clients. Do you think it will take that long? I thought 8,5 months is the max but now I see posts about taking it a year from noa1 to noa2. Can't imagine that....

I think it has happened before. Last year when we filed our petition, it was Vermont that was way behind and I was happy mine was at California. If you look on Igor's list at the petitions approved for each month for the I-130's you will see that CSC is streets ahead of vermont. Looking at the USCIS charts, there are high's and low's but where there is a low for I-129's there seems to be a high for I-130's. They obviously receive far more of these petitions than K1's which is why it takes so long to catch up on them when they have been left to fall behind.

I don't know why but I actually feel confident that this is a temporary situation and things are about to change. I would like to say I think we will see an improvement within the next two to three weeks, just past the middle of the month probably. I would love to be right for a change! lol

I was looking at cases on UCIS and Igor's list and from what I can see California seems to have I-130's prioritized right now. It seems that they go through phases of having different ones as a priority. I think that when they get I-130's back within the 5 month goal they will turn their attention to us. I think we may still have about a nine month wait though.


I really hope you are right. It is hard to estimate though. I could imagine CSC either start working on our petitions really soon or delay it by a few more months, even up to a year. After getting disappointed so many times throughout the last two months I am holding to only one idea that's certain - they WILL eventually start approving our petitions! I am just curious whether such a long waiting period has happened ever before in the previous years or is it unprecedenced. If it had happened before than it's worth checking how long people had been waiting for back then.

I just don't understand how managment at uscis can function on a daily basis knowing that they put on hold lives of thousands of people. I wouldn't be able to sleep at night knowing that my work from July and August LAST YEAR is still not done! We are not just some projects or case numbers, we are living people who want to have a feeling of control of their lives, have children that they need to plan for, houses to buy and sell, illnesses we need to deal with. Everybody understood the situation we will be in when upon filing fiancee petition, everybody was prepared to wait but what csc is doing with us is just happily taking the advantage of their position. My kid keeps asking - when, and I have no answer for him. So sad...

Hello All,

We received our approval today. 10 days ago I emailed my US Senator's office. I included all of the information that I could about the process. I included the Visa Journey site so that they could understand how I was coming up with my information. I included excuses given to other congressional offices, as found on VJ. I talked about the fact that CSC has been working on July 18, 2012 for the last four months. I preemptively agreed with the whole first come first serve basis of approval. What I pointed out was that there were 11 million applications that seem to have cut in line. That, I was not above the law but, I did not feel it fair that many people who are following the law, now seem to be affected by those who have not. I basically thanked them, informed them of what they could expect as an answer from CSC.

I received an email today from the Senator's office stating that the info I had given allowed for an informed argument and dismissal of the excuses given by CSC. I was told to expect to hear from them soon as the USCIS representative was confounded with the informed person on the other end of the line. The Senator's aide also told me that she had no idea of the things going on and could only take what she was told by USCIS at face value in the past. Well, I received an email from the USCIS 3 hours after hearing from my Senator's office, our approval.

My suggestion to all who are still waiting. If, you have been waiting longer than 6 months, email your US SENATOR'S office. Be very polite letting them know you do not seek preferential treatment but, to be treated fairly. Give them the VJ site for their research. Our Senator's office said that they found out a huge amount of information about the process and current state of affairs from VJ that they had never been privy to in the past. Take your time to document all of the inconsistencies from the USCIS i.e. the plumbing problem that was expected to cause no delay, only to be used as an excuse for 48,000 applications. Give the people you are asking help from the tools they need to help you. My letter to my Senator was a couple of pages of clear, concise information as it pertained to my case.

Hang in there, it can't be too much longer. I understand your sorrow, but try not to concentrate that much on what you are missing, think about what future holds for you and your baby boy - all the wonderful family moments, father and son bonding time is awaiting them. I know you suffer seing your family apart, I have 7 yo son myself, but there will be times when none of you will even remember those dark times of not being together.

Why did I get approved and many from July and August are still waiting? I contacted my congressman and they were willing to keep contacting them over the past few weeks including talking to supervisors there. Without their help I'm sure I'd still be waiting. So, go do whatever you can to get the process moving for you, it CAN help.


Congrats! We must be from the same area because Mr McClintock is our congressman as well. We contacted him yesterday, hoping for the best.

It should go: met in person in the ladt 2 years, free to marry, able to go insane without negatively influencing your relationship while waiting for noa2. And once the foreign fiance/e moves to the US they should offer free sessions with a shrink. Please csc, have mercy on us!

USCIS contacted my congressman's office and let them know what the rfe was about. Yes, he just put NONE in question 9, scanned and emailed the corrected form back to the congressman's office and I guess then they sent it to USCIS.

That was extremely quick response review! My fiance got a phone call on Wednesday from the congressman's office about a rfe, the same evening we knew what the rfe was about - leaving a blank space in question 9 - have you been married before - instead of putting NONE! Such a minor thing, so cheer up folks, your rfe's might really trivial as well. Anyway, he corrected it and emailed it back to the congrssman's office same evening and my status changed from request for evidence to request for evidence response review. Two days later he got a text message saying your petition has been approved and the blue circle moved again to post decision activity! The congressman's office has been fenomenal!
I am so happy to see so many July, August folks approved! Our lives will finally move on! Good luck everyone and hopefully see you in AOS forum :dance: :star:

Do people call nvc in order to obtain the number only because it speeds things up for them or it's mandatory part of a process? Also, do you guys know whether my son has to go with me to the inteview at the embassy? He was born in the US, has dual citizenship, US passport and was listed on the petition but not as a beneficiary. Thanks.
