I am only 3 weeks in from the NVC saying our case was complete (April 18). Sent in a request for an expedite due to my mother being in the hospital.

I did question the representative on the phone and that is 20 WORKING days, not Sunday through Saturday scheduling.
Praying for an expedite approval because I truly need the help at this point.

I will advise you that you do receive the original marriage contract and translation after a successful interview.  It takes 6-8 weeks to get the documents back, but you will.

Hey guys I am new to this and I wanted to know if anyone knew about how long it takes for the NVC to schedule an interview for El Salvador. In our final package we were missing a copy of my husband passport so we had to resend it again. I called the NVC and they have not received it but they said when they receive it they can schedule us a date for him to go for his interview. Once he gets his interview can he come or do we have to wait still? Please let me know if anyone has any idea I really miss my husband. :help:

Our Journey has been long and we had to have a lot of patients. I would love to be present and if God permits me i will be there. We filled for a K1 and for I130 and we got our I130 approved before the K1 so the K1 was dropped and we continued out journey with the I130. Once we got everything approved by USCIS and everything moved over to NVC everything started to move a little quicker. Now all we need to do is wait for the interview date inwhich its frustrating because we know its so close to the end but still nothing. From all my reading and research that i have done i have found out that El Salvador Consulte is very busy and they have a lot of cases everyday so its just patience and all this has tought both my husband and myself to have a lot of patience and when you lest expect it, it shows up. Have you already gotten your approval from USCIS and NVC or are you still waiting?

I'd love to know more about your journey. We're waiting to hear from the embassy in El Salvador for our K1 application as well. Are you planning to be present at the interview? Im not sure if I could make it and there is so little info about El Salvador consulate :(

Hey guys.. I called NVC this morning and they said that the case was closed yesterday and all we are waiting is for the El Salvador Embassy to schedule us an interview. Does anyone know how long that would take? How many interviews does it take? Would I have to go to El Salvador to interview? Basically how much longer does this take? If anyone has any idea or anything that would be great.

CR1 has been approved and the NVC closed our case on (7/2/2012), now they told me we have to wait for an interview to be scheduled with the US Embassy of San Salvador, does anyone know about how long it take to get scheduled in? I thought there was first priority for spouses of US Citizen? Please let help me out here its going to be a month since the case was closed and we haven't gotten an interview date, could there be something wrong with our case?

I am filling out the ds-230 for my filapina wife, she has 3 children all under 16 years of age. I have compleated the AOS fee payment and that covered the 3 children as well. I am ready to submit the I-864's and also I-864 from my joint sponsor along with supporting documentation.
my question is: do I need to fill out ds-230's for each child? or only coppies of the principle applicant (my wife)? also I understand the fee of the ds-230 is $230.00 usd, will the fee be times 4 because of the children?


Hi! With regards to your queries, yes for all. You need to prepare ds-230 for each person that you are petitioning. also you have to pay for each individual. That means 4 people including the principal applicant.

Just sent back the 3032 form back so guessing they'll be sending the 864 support papers????? but the question is will I have a problem showing support as I'm retired and until recently didn't have to file???? I will have to file for 2013 cuz of receiving SS.(bummer!) I do beat the 125% poverty level but my income is just SS and a pension. Any help is appreciated!!

Hi there!  Kinda tricky question regarding domicile and the 864.  USCIS says i must have a domicile to sponspor my wife for her visa and to show both a mailing AND a residence address.  I spend almost all my time here in china but my bank statements, drivers license info etc is in the states.  When I come back to the states for whatever reason I stay at this address, and no, water, gas, electricity bills are in another persons name.  So the question... is it enough to call this address my residential address????  .....  I don't want to make the wrong decision obviously but........

For those who are still following:  I called NVC and was told that sending in the docs that accompanied the 230 will not be needed to be sent with the new 260.  That's a relief but gov being gov wouldn't be surprised after waiting 30 business days that I was supposed to send them!!!  In regards to the 261, if you sent the 3032 and got your  case number then not necessary for the 261.  Also there isn't a   BID # just the case number that was issued,  GZO********** whatever.  Happy trails!!

I got the rfe on the 864 so maybe taken care of maybe not .  I resent the replacement 230 with the new 260 but without the docs that I sent with the 230.  I did the 260 online, and there was no asking about gzo or whatever, just being sent to NVC,  and yes I do or have been using a gzo #.  So do you think I should resend the docs again and now I'm wondering to who?  There is no CCP affiliation.

I got a dreaded RFE and called NVC--- why!  Got maybe an answer and then she reminded me to send the 260!  What I said, I sent the 230 in early august.  Needless to say I sent a 260 but now do I send all the other required info that accompanied the 230 again????  I'm seeing the light at the end of the tunnel but I could be seeing things!!!!

wow I have been on quite a journey with my visa thus far. Recently my lovely fiance got an earlier interview date for February 18th.. for awhile we thought it wouldn't be until March (we booked our wedding for March 16th). Here's the thing; should we still change our wedding date if possible? It's three and a half weeks after the interview and I do NOT want to have any more worries.

 

What's the wait time as of lately for the visa after the interview?? We are having the interview in Montreal.

Hi Everyone,

 

First of all, I would like to thank everyone that contributes to this great website.  The wealth of information available is an excellent resource for anyone with an immigration case.

 

I got an RFE for proof of personal meeting within the 2 year period preceding filing my I-129F.  Based on the info I have seen on VJ, this seems like a common reason for getting an RFE.  The one thing they requested was the passport admission/entry stamps.  I copied all pages of my passport, pointed out the relevant admission stamp, and sent that to USCIS, along with more date-stamped pictures (I had submitted a few at the time of the original filing), and a copy of my plane ticket (I had submitted the same at the time of the original filing).  I also made sure to use the envelope that was included with the RFE.  USCIS received this on June 5 and updated the case accordingly.

 

I have not heard anything since, and looking at timelines, it looks like USCIS is now processing applications that were filed after mine.  Even many applications that were filed around the same time as mine and got RFE's have also been processed.  

 

Additionally, I created a timeline with VJ and the system suggested that my application may be delayed past regular processing times.

 

All of this is making me concerned. 

 

According to USCIS, they do have 60 days from the date they receive the response to RFE before making a decision.  I called USCIS and they said nothing can be done until the 60 day period has passed, in which case they would issue an inquiry into the case. 

 

 

What do you guys think? Does anyone have any recommendations at this point?

I got a similar RFE on 5/30/2013.  I was missing the passport stamps, so I sent them that, and they got my response on 6/5/2013, but I have not heard anything yet.

 

My NOA1 date is 2/1/2013.

Hi Everyone, I'm a January filer as well.  I filed on 1/24, got an RFE on 5/30, which I responded to the next day, and I'm still waiting.  They technically have 60 days from the day they receive the RFE response to make a decision, so I've been told to wait every time I called USCIS.

We have a similar situation here. We filed in January, got our RFE at the end of May, they received our RFE response and updated status on 6/5, and still no response.

 

I was also told to wait for 60 days when I called them.

I don't believe my case was transferred to TSC.  From what I've seen, they only seem to be doing this with some delayed VSC cases.

What would be the explanation for the authorities to let you in? I mean, if you'd be currently married it'd be reuniting with your spouse. If no, why should you be let in? Just for being married to a citizen in the past?

 

That was the suggestion. I too question it.

 

What I have found so far is that I would be eligible to pursue a change of status to permanent residency if I held the fiance visa and was married in the time frame, even if divorced in the meantime. Going from student to married to divorced makes it more complicated.

It has been suggested to me that it is possible to apply for a "marriage" visa/residency after divorce. I'm a UK citizen and was living in CA (Student visa) a few years back and for a time married to a US citizen. When things fell through I came back to the UK and didn't pursue a marriage visa.

 

Has anyone ever heard of a visa being pursued after the fact?

I'm not filling a DCF. Although we'll marry in China, I will file the I-130 for a CR1 once I return to California. From your help, my understanding is that my past, now dead I-129F will not have any impact on this process.

Hello VJ Members,

I searched for an answer to this in your forums but was not able to find one specific to my situation.

Less than two years ago, I filed a I-129F for a fiance visa. However, we broke up before we had submitted Packet 3.

Fast forward to today. I have met a lady during my travels who may become my wife. My questions are, assuming we marry, do we need to wait two years after previously submitted I-129F before applying for a CR1 with a I-130, if we do NOT use a I-129? And if we do have to wait, do we wait from the submission date of the previous I-129F or the date it was cancelled or expired? If it is the latter, how do I go about learning this date?

Also, what are the negatives, if any, to doing a CR1 without a I-129?

Hello

I am from California and my fiancé is English. We live together in London and plan to get married this year. We need to get married by June, as I will need to have the marriage certificate when we apply for a different visa here in the UK, and we want to continue living here. However, we plan to move back to the Us in a couple of years, so we want to make sure we are in compliance with immigration.

We hoped to get married in California this May, but we've just found out that it could take 8-10 months to get a fiancé visa. From what we have read, it is frowned upon to get married on a tourist visa. However, most of the cases we have read about include people trying to stay in the US after, which we do not plan to do. Are we a different case? We just don't want to have trouble moving back later on in life.

We have also considered marrying here in the UK (court house type thing) and then having a bigger wedding in the US. Would there be any problems with this?
