Hello All,
I sent my I-129F application with all supporting documents (suggested by VJ) on 4th Aug 2011 via Fedex, and was delivered next day on the 5th.

Today, Aug 9 , i got an email from USCIS , stating the following:

Your USCIS application/petition has been received and routed to the Vermont Service Center for processing. Within 7-10 days by standard mail you will receive your official Receipt Notice (Form I-797) with your Receipt Number EACxxxxxx(i hid the numbers). With the official Receipt Notice (Form I-797) you may visit www.uscis.gov where you can check the status of your application using My Case Status. We suggest you wait until you have received your Form I-797 before checking My Case Status. This confirmation provides notification of the date USCIS received your application/petition. This notice does NOT grant any immigration status or benefit. You MAY NOT present this notice as evidence that you have been granted any immigration status or benefit. Further, this notice does NOT constitute evidence that your application remains pending with USCIS. The current status of your application/petition must be verified with USCIS.

So does this mean that they will send me the NOA1 , not sure what NOA1 means, but i guess that the first that usually people recieve??
Now how long will Vermont Service Center take for my docs to review and the my application is sent to the respective embassy where my fiance resides... please help me , all new to this stuff ...


Next, you will get a hard copy of the NOA1. The NOA1 is a receipt verifying that your petition package has been received and is being processed. It will have a receipt number on it that you can use to track the status of your approval online at the USCIS website. Now, it's just more waiting. Different consulates process them at different times, but it will be at least 2-4 months before your petition is approved and moves onto the next step. I submitted my I-129F package on April 29th and got the NOA1 about a week later. It was approved on July 18th. If anything else is needed, you will get an RFE (Request for Evidence) in the meantime. Otherwise, you wait to get notification that your petition package has been approved followed by the hard copy of the NOA2 (approval).

My fiance and I are currently trying for a K-1 visa. Prior to filing we had attempted twice to get a visitors visa for him to come visit me in the US and both were denied. For the first visitor visa I went with him and we were upfront and honest about our relationship. The second time his company was asking for him to come to the US for training but due to his previous interview with me and him confirming that we had an ongoing relationship it was denied again. Now as we are waiting for an interview date I am becoming more and more worried that these previous visa tries could affect the decision on the K-1 visa. Am I being silly for worrying?


Previous visa denials can impact the decision in the sense that it looks like he is doing whatever it takes to get to the US. Like, "Ok, I didn't get my visitor visa so now I'm going to try and marry someone and see if that works." He was denied the visitor visa because one can't obtain a visitor visa for any other reason than to visit the other country and leave. As soon as they know you are involved with each other, the intent of simply being a tourist is gone and it's apparent that his intent was not to be a tourist, but to stay permanently. You have a legitimate reason to worry, but if you've done a good job with gathering evidence and are honest with everything from here on out, you should be OK. Good luck to you and don't lose hope! There are many others with this same question and there is no set standard for whether you will be approved or denied. I've read a lot of stories on here and heard of people with past criminal records, illegal entry, drug problems, etc. getting approved with no problem. They also have waivers for people that might have something sketchy in their past, but they might qualify to have that event waived.

ok im going to dig up some more hotel receipts, some movie stubs, bank tickets and what not.

we are both 21 (but will both be 22 by the time we get approval and he actually can come - assuming the 5-8 month processing time)
is this age an issue at all, in your opinion. does it matter that im in school, do they care or look at money at all right now ( i know affidavit of support isnt sent until later).

he does not speak english (very well) we speak spanish, and although he is learning and will learn better when he is here, obviously i wrote the letter of intent and filled in the g-325a form. they will be able to tell that later (interview when they see that he does not speak english and could not have written letter of intent)- will that be a concern at all, or a reason for them to deny/question. should we have this in spanish, too???

The age is not a factor for you since there is not really an age gap. Age comes into play when one person is like 10 years older than the other. You're OK there. They do look at money. Maybe not right now, but soon. You will likely need a co-sponsor. I'm not sure about the letter of intent question...

Yeah, I'm really excited since I do have so much proof and I want to share it but thats what I'm afraid of, pissing them off somehow :x How much would too much be? I know about 15 pics, Receipts and iteneraries, and hotels, shared bank accounts, we have proof that we've been living together for a year and he's on my car insurance, we also have letters and packages from before we met and after, emails from a year before we met up until he came to America, etc. I'm not sure if I should add it all :x (Not to hijack the thread, just curious since I'm new to the whole process...) :innocent:


Listen, none of that additional stuff is required for the initial I-129F package. If you sent nothing else that what was required, you would be OK. There is no set number of things that you should send. It's always better to send more than less, but save some stuff for the interview. Don't send everything. I printed every phone bill that I've received since I've known my fiancee, but I only sent 3 from various time periods in order to show an ongoing relationship. I will give her all of them to take to the interview. Just pick out a few things (receipts, boarding passes, bills, etc.) and send them in. That's already more than what is required. Some people have an I-129F package that's 200 pages. Mine was about 50 & mainly because of my divorce documentation. Without that, it would have been about 20 pages.

hi yall... about to send the I-129F packet. Every time I check and re check i think of new questions, i stress a little bit more.. so I just want to ask about the packet to those who know-

1- with the I-129F packet and sending the "evidence of having met/ relationship"- I have photocopies of some pictures of me and my fiance - some pictures of just us together (wearing different things, different locations.) I also have pictures of us with his family in Mexico.. (some pictures of us with sisters, nieces, dad.. etc). The question is *should the pictures be in color?? * and do i have to have a description of the photo??-where it was taken, year, who is in the photo??-
2- how necessary is extra evidence and such.. i have some emails from my fiance to my parents :) discussing our relationship etc.. also phone bills and records, and some letters that i have sent him and him to me..

I am also going through the process with Mexico. I hired an immigration consultant to help me put the I-129F package together & can tell you what we did. Here is was was in my package:
1. I-129F Petition
2. G-325A For me
3. G-325A For her
4. Copy of my birth certificate
5. Two page letter explaining how we met, our visits with each other, places we went, and our intentions.
6. Copies of my passport pages
7. Pictures of us together. My consultant advised me to make a sort of "scrapbook" of no more than 15 pictures of us together. I bought some nice paper at a scrapbook store. I looked at all the photos of us together and picked out 15. They are ones of her with my parents, me with her parents, us together, etc. I took them to the pharmacy and made some color copies. I glued 3 to a page for a total of 5 pages. Next to each picture on the page, I typed a description. I put the date of the photo and a description of where it is and who is in it.

That's it!

I got the NOA1 about a week later. I then realized that I forgot to include copies of my divorce. I called the California Service Center number on the NOA1 and spoke with a representative. She said to send in the divorce documentation with a copy of the NOA1 and a letter explaining what happened. I went to the family court records office and got a couple of certified copies. I wrote a brief letter apologizing about not including it and asked if they could attach it to my original petition. Now, even though it's not required with the original I-129F package, I had read many posts on this site that says you should include emails, phone calls, bills, and other evidence with it. Some people call it "front-loading" the petition. In other words, giving them as much information as possible up front because all of that will be reviewed by the consulate before your fiance(e) has the interview. Anyway, I figured since I was sending in my divorce documentation, for my own piece of mind, I included a few of these items (copies of trip itineraries, phone bills, and credit card bills). I mailed this all back and just waited. I was pleasantly surprised that our petition was approved last month!

In short, all of that evidence is not required with the I-129F petition. The instructions included with the I-129F do not ask you to submit those things. I did it for my own piece of mind primarily because of what I read on this site. All you are required to submit is what it asks for in the instructions included with the form. I'm not saying everyone has to or should do it this way, but this is what we did. How you put yours together is up to you. Hope this helps!

Thank yall so much! I'm sending the packet tomorrow morning.. so right now im just going over and over everything. thank you to everyone who has helped out. i have been reading these forums/gathering information and evidence ever since Dec. to think that the day is finally here- it's pretty big. and yes, i know there is TONS more ahead. much much more waiting, other pages and pages, more plane rides, interview, more waiting.. and then hopefully ill be able to share the same that some of yall have experienced- when fiance finally has the visa, and we are finally together.
So, for now... no more questions. I'm 100% sure on all the information/evidence/pages that we have, and IM READY!

-what ive been thinking about is this.. RFE usually come within how many weeks?? if we are waiting about 3 months, does that mean that we just keep waiting, and now worry about the RFE.. or can they come after weeks/1month/5 months. basically i want to know if there is a time frame where i can just not worry about RFE, rest that everything is ok and just wait for the ok(or denial but why would THAT come:)

I think you should put your package together in manner that allows you not to worry about receiving an RFE. Be confident that you have done everything you can and done it properly. When I sent my package off April 29th, I got the NOA1 (acknowledging receipt) about a week later. I then realized I didn't include documentation of my divorce! That is a required document! At that point, I was worried about getting an RFE, but I tried to be proactive in preventing that from happening. I called the USCIS number on the NOA1 and the woman I spoke with told me to send in the divorce documentation with a copy of the NOA1 and a brief letter explaining what happened. I did that and sent it certified mail. I was pleasantly surprised when, last month, I was notified that our petition was approved and we can move on to the next step. Anyway, my point is, you should feel good about what you are submitting and not have any doubts. If you do forget something like I did, there is a possibility of correcting it without waiting for the RFE.

What you wrote looks good to me. My letter was a page and a half long so yours is far shorter. I think it's good that you mention each time you visit & what you did. It's also good to explain how you fell in love and what your hopes and intentions are. Good luck to you!

Contrary to the above post, don't bring your NOA1, you won't need it. It will just be another piece of paper that you will have to keep track of while you're there. I travel a lot and was in London in May. To the best of my recollection, when entering, they asked the purpose of my visit. I said vacation. They asked where I'm staying. I said a hotel - The Sumner - near Marble Arch. They stamped it and that was it. They may not ask you anything at all or just basic questions like that. Just don't respond with, "I'm a prospective terrorist and I'm coming to scout some locations for a bombing" and you will be fine. If it was recommended that people carry the NOA1 with them when they travel, they would tell us to do that. As it is, the NOA1 does not mean anything other than a receipt of your petition and is not going to get you out of any jams.

No need to tell them all your business. You're allowed to travel and visit anywhere you want. Just present your passport so they can stamp it as you would anyway.

My fiacee was in the U.S. on a tourist visa when we met in 2009. We started dating and throughout our time together here, she would go back to Mexico and come back to the US quite frequently. On one of her return trips to the U.S. (June 2010), she was stopped and questioned at the airport. I guess it was the frequency of the trips that raised suspicion. She explained everything and they ended up revoking her tourist visa. As she was honest and they did not believe her to be a threat, they did not apply any restrictions to the revocation (no 1 or 3 year bans). They actually released her to me for 24 hours so she could collect some things, but told me I had to bring her back to the airport and that she has to go back to Mexico. They said she could reapply for a visa right away once there. In short, my question is how serious is this?

Note that she never overstayed or was out of status or anything. I'm just wondering if when we check that box on the DS-156 that she has had a previous visa revoked, if that leads straight to denial for the K-1. We have no other concerns with approval other than this.

Funny, but in Brasil I went to the interview, in fact it is encouraged and looks as only positive if you are ther for the interview.
Why would they not want both partys.
I was asked as many questions an Neecee was, participated in the discussions in Portuguese.
Shows a true relationship for both partys to be there.
Do not know of any consulate that would not interview both people.


Mexico not only DOESN'T interview both people, but the US citizen fiance isn't even allowed in the consulate! They must go to a seperate waiting area.

If I were to visit again soon, is it safe to tell customs/immigration that I have a girlfriend in the USA? Would common repeated visits be ok? Or would they be suspicious about it?

Just be careful not to violate the intent of the visa. If you begin making repeated, frequent trips and they do find out that you are involved with someone here, they may determine that you have immigrant intent and revoke the visa that you have. A similar thing happened to my girlfriend (now fiancee). She came here on a B2 tourist visa. We met here and she was making frequent trips from Mexico to see me. She was stopped at the airport upon entry one time and questioned for a few hours. The frequency of the trips probably raised suspicion. They ended up revoking her tourist visa and she had to return to Mexico within 24 hours. Fortunately, because she was honest, they did not apply any penalties to the revocation, but that sort of thing can happen. I wouldn't offer the information, but if you are questioned about it, be honest.

The funny thing is that if you came here & got married after meeting someone, that is not illegal so long as that wasn't your intention. Now that you have filed the K-1, it's clear what your intentions were so you can no longer go back and say you never intended to get married. I would say it's best to continue on with the K-1.

Is it possible? Yes. Will it be approved? Probably not. Besides, you have to submit pictures of the two of you together with the petition package and you can't do that unless you've met in person.

All petitions go to the same address in Texas before they are forwarded to the service center that handles cases in your area. Send it to the address that it tells you to in the instructions.

It's not absolutely unrealistic. Assuming everything goes smoothly, you could very well be completed with the process by then. It's just a bit risky to make any plans at all. Things like RFEs and unexpected backlogs can slow the process down.

the visa fee wich is 350 you can do that online, throu the phone or online i wnt recomend trhou the phone thou. also medical exam wich is 184 dollars i paid in pesos wich was 2300. At the ASC you dont pay any fee :) and i think you pay a DHL fee 150 pesos but i dk ill find out that tomorrow :huh: .

I did the same thing with the scanner. I now have a big file that I'm putting together in preparation for the interview and every document in there has been scanned and is in a folder I made on my computer. I think it's better than a black and white copy. I had a few passport stamps that showed up much better with the color scan print. That is fine.

A week after I received the NOA1, I was researching what to do next and I realized that I did not include my divorce record with the petition package. I called the USCIS office on the NOA1 and asked what I can do. I didn't want to sit and wait for an RFE. They told me to send it to them along with a letter expaining what happened and a copy of the NOA1. I did that and I never got an RFE. Our petition was approved! Sounds like you have everything though.

Mugumogo, this happens all the time to a lot of people. It especially seems to happen to a lot of Canadians. Some even come back with strong proof of ties and are allowed to enter. At the interview she will be asked about this because it will be in their database. This isn't something to be worried about because it doesn't affect visa approval. You'll find lots of Canadians with the same story.


Well that's makes me feel better. I just don't understand why, when you look up common reasons that a K-1 visa can be denied, I always see that having been denied entry is one of them. It also asks about that on the DS-156 form and in the DS-260. The reason I posted the question again was because I had more detail and I learned that the immigration officers seemed primarily to be concerned with the fact that she might have been working on a tourist visa and I wasn't sure if that changed anything - even though they put that code in her passport that allowed her to withdrawal her application to enter. My fiancee was in the US in 2009 on a tourist visa. She did not know that you couldn't do certain things while in the country on a tourist visa and in order to help support her stay, she helped a relative with some things at the office that she (the relative) owns. This was not done regularly nor was my fiancee on any kind of payroll. In exchange for her help, the relative would give my fiancee money from time to time. My fiancee was stopped when trying to enter the US later that year. The officers went through her things and didn't find anything suspicious until they came across her calendar on her computer that had some appointments in it. They were business appointments that the relative was keeping and my fiancee was helping to keep track of them in an effort to help her be more organized. The relative explained that my fiancee was very helpful and expressed interest in filing paperwork to have my fiancee come work for her as a consultant. Anyway, before the paperwork could be filed, my fiancee's tourist visa was revoked at the airport. She was honest with the officers and they seemed to understand that my fiancee misunderstood what she was allowed to do with a tourist visa. They said that it appeared to them that she was working or at least the activity she was doing was not allowed and that they would have to cancel her visa. They did and wrote 22CFR41.122(h)(3) in her passport. They were going to send her back that night, but because they trusted her, they released her to me, took my information, and told me that she had to be back in 24 hours to return to Mexico. She returned the next day and has been in Mexico now for over a year. I have been to visit her many times. So... all this said, will this cause the K-1 visa that we are currently applying for to be denied? We intend to be honest about everything, but I just want to get some insight as to what impact this might have on approval.
