Same here... Everybody thinks that if it takes so long to get that visa, we won't get it at all LOL If they just knew that we are still at the initial stage after so much time of waiting...

Has anyone else had someone tell them about a person THEY knew and how that person got THEIR family member to the states REALLY fast? I hate that. I say to myself, "and you're telling me this to make me feel more crappy then usual?..."

I am going to make copies of my two 4 I-797c notices ( I have two petitions in for wife and stepson) and the SR letter and a long letter explaining everything in detail to the top guy. I will also mention all of you guys also, but sometimes you just have to go to the top to get a fire lit under mid-level mamagement butts. But the big joke is that we are all just waiting for our petition to be approved, which actually only allowes us to get into line to apply for a visa where the real decisions are made. This part of the process should actually be the easiest as long as we or spouce are not in govt databases as being bad people. they should only be looking to see if we paid monies needed, all paperwork required, and dont show up on some database search if all those are in good standing stamp it approved attach next steps paperwork and ship on to NVC.

Yes! This was supposed to be the "easiest" part of the whole process! Today someone asked me about my husband and when he was going to get here and I told them that we're still waiting for the papers to be processed and they were like, "it takes THAT long?" I was like "APPARENTLY FOR ME IT DOES." And then I ate a donut.

Here's the address for the top dog at the uscis!

A copy of your letters sent elsewhere, and info to him, wouldnt go amiss, Id say.

Hmmm, I am tempted to write to him. Might as well, I guess.

Ive forgotten, so forgive me for asking, without looking back but now Im wonder4ing if they reset the clock once the cases were transferred?

I think TSC is trying to make it that way. That's what they told Val's senator & that's pretty much what it says on the automated customer service line (please wait 180 days from the date of transfer to inquire about your case...).

I think you'll find over the next week or two she will investigate this. The more info you can give her the better, and obviously the more people that pose the questions that are similar will have a positive effect on the action she may or may not be able to take.

I hope so, thanks for posting it!

I agree. We should absolutely write to the media. I have written to the President, but they just forward the letter to the State Department. I think it's important that people know what we're going through. Maybe then the people that represent us and create these situations will feel pressured to do something to help us. I will write to my local paper in Annapolis, MD as well as to the Washington Post. Who else is willing to write?

I can write to my local newspapers, as well. Can someone give me kind of a template to follow? Sorry, I'm just horrible at writing.

This is the answer we have from the congressman forward from TSC on 01.04.2011 :
"Both of the I-129F, WACxxxxx and I-130, WACxxxxx have been received into our office. Please allow 60-90 days for processing before the individual will received a decision or other Notice of Action regarding the cases."

I got the same kind of info, except it said 45 to 60 days. But who knows.

Hey, guys,
So I received another letter from my congressman and it reads as follows:

"According to the Texas Service Center, the Western Service Center transferred 36,000 I-130 petitions to their office and they are all falling in that same time frame and they are processing these as fast as they can which involves a 5 month turn around to complete all of these applications.

The Texas Service Center's Congressional Unit has ordered your file to be sent to the EXAMS Unit in which it will be then assigned to an examiner. You should receive a decision or other Notice of Action within 45 to 60 days."

So, yeah.

Thoughts?

Has anyone heard of the website zzi.net?

They've published an article on the TSC that begins with the following:

The American Immigration Legal Association (AILA) recently distributed to its members an update of various issues after a meeting with USCIS officers at the Texas Service Center (TSC) in November 2009. The meeting covered multiple areas of concern including TSC processing times, EB-1 adjudication standards, denial without RFEs, separated derivative applicants, among other issues.

Thanks for posting this. I've read the article but I'm not sure what to think. It didn't say anything about I130s, did it? I might have missed it.

Just received two pieces of mail regarding my case. One is a response to my service request made on 12/27. Looks like it was sent from TSC and says what the other people's letters have said. Nothing new there.

Other letter is from my congressman. He wrote, "In an effort to try and be of some assistance to you, I have written to the Texas Service Center on your behalf. Just as soon as I hear any further word from the Texas Service Center concerning the I130 petition you filed on behalf of your husband, I will be in touch with you immediately."

We'll see where this goes.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 COVER SHEET WITH BARCODE

the cover sheet with barcode = the envelope that we receive from the NVC?

thanks before

No, you print out the bar-coded sheet yourself after you pay the AOS bill. The only papers you will get from the NVC is the DS-3032 with bar-code (which you don't even need because you can email the DS-3032).
So after you pay that bill, print the receipt page and you stick that in front of all your I-864 documents.
You'll do the same thing with the DS-230.

Hi everyone! One quick question, i hope I can get some answers. My husband already sent my IV Packet, and on Fed-Ex tracking it states that NVC receives it last May 04. Now I've been calling NVC's AVR to check on our status. It still says that some document is missing or incomplete. Is it possible that they haven't updated our status yet, How long do they usually update their system?

It can take up to two weeks for documents to get entered into the system and the AVR to update. Call and speak to an operator to see if they can give you more details.

If everything is done correctly and you don't receive any RFEs then you can be out of NVC in 4 - 6 weeks. They process forms quickly if it's done right the first time.

wow that's odd. i didn't know they gave RFEs for savings and checking accounts. i didn't even thing they were needed

I think they only need that evidence if you fill out Part 7, Use of assets to supplement income, on the I-864 form. That part is optional but I've seen a lot of people get RFEs for filling out that part when it wasn't necessary.

IR-1 / CR-1 Spouse Visa Process & ProceduresHow much detail does USCIS need for affidavit of supporti864?

I am compiling a list of my and my husbands assets for the i864. For our incomes, I will be providing employment letters, IRS transcripts and copies of W2s. However, for other assets like cars, property, 401Ks, IRAs, investments, savings accounts etc., I was wondering what, if anything, I have to provide copies of (like the deeds for the property and titles to the cars, as well as may be last months statements for the investments, savings and retirement plans or Notarized memos on Letterhead from the institutions stating the fact that we have those accounts and the current balances in them ) OR do i just write down the balances of those on the form and not worry about it.
I don't want to have to go through the trouble of doing all of that if our incomes are more than enough to cover the 125% of the poverty line.
Any advice is appreciated! Thank you :}

I would say do NOT fill out the optional part of the I-864, because if you do, you will have to show evidence of those assets. If your incomes are above the poverty line then you don't need to submit any additional evidence.

I read somewhere that there's less turn-around time if both packets are mailed together; however, I mailed mine separately and they were processed pretty quickly. The only thing is that if you do send them separately you will most likely get a false RFE for it.

IR-1 / CR-1 Spouse Visa Process & ProceduresI'm now in NVC I-864 hell

Thanks for the replies folks.

OK, I called the NVC just to confirm and yes, the Household size must match between the tax form and the I-864...i.e., according to the NVC, it is impossible for a CR-1 to get a tax return accepted for financial evidence if you filed that return as single (assuming you were married during that tax year). So, an ITIN is a must have. Now I have to see if I can get an ITIN while filing an amended return.

I filed single on my 2010 tax return and NVC gave me no problems. If you take a look at your W-4 form, which everyone has to fill out, you will see that it states the following: Note. If married, but legally separated, or spouse is a nonresident alien, check the “Single” box.
Yes, you can do the ITIN thing if you choose to do so, but it is not necessarily the only option. Also, I wouldn't take anyone's tax advice on this forum. Each person's situation is different, so I would suggest you speak to a tax professional.

Sorry about the grilling part. I'm just glad he made it. What did they ask and how bad was it?

For my husband they asked him for details about how he kept our long-distance relationship going, and he told him, you know, through the internet and Skype and all that jazz. But for the most part he said they seemed pretty laid-back. He just went back to the embassy today to pick up his passport and sealed envelope!

Luckily for me, my father will be traveling back with him so he can tell him where to go and what to fill out! That makes me a little less stressed about his journey lol...

Ohhhh, I see- it just takes a couple of days for them to match up the form to the case, that's all. Give it a few more days and then call to see if they've reviewed it. Remember, neither the I-864 nor the DS-230 actually shows up in the system for the operator to see until it's been reviewed.

The NVC has received the requested Immigrant Visa Application (DS-230). However, we are still
waiting for the Affidavit of Support form. Please submit the Affidavit of Support form according to the
instructions on the Department of State website at the following address:www.ImmigrantVisas.state.gov.
From there, you can fill out an Affidavit of Support form online, then print the completed form and mail

why they're asking me to submit AOS form? my HUSBAND should be the one to fill up that form, right?

That's probably a false RFE (I got the same thing). It just means that they processed the DS-230 before the AOS. For me, they processed my AOS before the visa app and sent me the same kind of email.
