Full disclosure, I'm all for frontloading. You can include the evidence you mention with the DS-230. Realize that including more at this stage could slow things down at the NVC; however, by including it with the DS-230, it becomes part of the file the CO will see prior to the interview. If you hold on to it and bring it to the interview, there is no guarantee a CO will ask for it.


No, don't include anything that the NVC doesn't ask for in your DS-230. Any photos and other evidence you should take with you to your interview. If you try to include that kind of stuff with your visa app the NVC will not be happy.

Green cards are prepared twice a year and if your POE date is just after the last cut-off date, you will get it after 6 - 7 months of your POE date, so don't worry. Did you get your Social Security Number! If not yet, then go to one of the closest SS Office and get one.

Calling USCIS is pretty much a waste of time, I think. It says that 5 months is the average wait on the site but I think 6 months is really how long it takes for a petition to be approved. So you might have a wait a few more weeks.
Have you contacted senators/congressmen? That might be a good idea.

Anyway, when you email/snail mail the DS-3032 Choice of Agent, do both the petitioner and beneficiary fill that DS-3032?

I understand the beneficiary needs to fill the DS-3032 and appoint someone (preferably the petitioner in the US) as the agent--But do I, as the petitioner currently residing in the US, need to fill that DS-3032 and appoint myself as the agent?

No, it's the beneficiary that is appointing you as the agent. He/she should email the Ds-3032 using the available template telling NVC that all correspondence regarding your case should be sent to you.

It is not necessary but helps. I feel that Consulates/ Embassies make a decision of the cases before the interview itself in about 80 - 90% of the cases, so I think it is good to add any evidence available with DS-230.

What you submitted with I-130 may os may not go to the Consulate but DS-230 certainly does, so include it again with DS-230. Add a copy of the money remittence - it is a great proof of continuing relationship.


I disagree- I don't think you should send anything that the NVC does not explicitly ask for. Proof of a "continuing relationship" should be sent with the I-130.

There is no NVC rule that requires signatures to be in blue ink. It's not even a "preferred" color, so not sure where people are getting their information.

I have been working on my taxes this weekend. If you take time to read the instruction book, it explains very clearly that if you are married to a non-resident alien (your spouse lives outside of the US) then you need to file as single (or head or househols if you have a dependant living with you.)

I don't know why anyone would want to wait to amend the return in the future. If you are going to do married filing joint in the amendment you should do it now so you get your money back faster.

If you aren't going to get more money back filing married filing joint then you should do married filing separately.

I would not file single if I am married, as that is the whole purpose of doing married filing separately.

By the way i am not an expert. it is just what i have read.

When I filed taxes last year, I was in fact married, however since my spouse was not in the States and did not have a Social Security number, my accountant advised that I would file Single. Upon her entering the country and obtaining a SS# and filing 2010 taxes, my accountant will amend last years filing to show I was married and the adjustment will be made. I am expecting a nice return this year although it took an extra year to get it. Nothing at all illegal by doing it this way!

If I had my husband sign the DS 230 form today and mail it to me it would arrive here in about 30 days. So let's say that my I-130 is approved around the end of December and his mailed form arrives here at the same time. Would it look weird if the date he signed it was Nov 22, 2010, but the form is submitted to NVC in January 2011?

Rather, what is latest date that the form can be signed and still be valid?
