Someone can correct me if I'm wrong, but if the fiancée has to answer whether she intends to marry a US citizen during her trip, I don't think it means "ever." Assuming the OP isn't planning to marry her during her trip, I don't see that question as an issue at all. The answer would be "no." I don't see that as fraud. Visiting a fiancé before you get married isn't a crime. If it was, I wouldn't be in Michigan as I type this!

I dont get it. I thought the US embassy will give you the date for your interview appointment and the request for medical exams and even request for police clearance. I never thought that you can schedule for interview date yourself. I prefer to wait for the letter from the embassy. We survive waiting for almost 5 months for NOA2 so 2-4 weeks waiting for the embassy letter is nothing. My fiance just received the hardcopy of NOA2 yesterday.


I'm not sure if you'll be going through Montreal or Vancouver, but Montreal people definitely schedule their own interview.

It all works totally different than what's on the guides now. Montreal sends you packet 3 and tells you you can schedule an interview. I don't even know if there is a packet 4 anymore. But we definitely schedule our own interviews. Has been that way since September.

The two apparent issues:

1) Job description

A previous person had a good idea - have your employer provide a written description of your job, and also include your resume. If it is a type of work which is rather full or jargon or is technical, then you may need to take the above and put it in lay terms - ie terms someone not in your field of work would understand.

2) Distance your state is from California

The internet or google is your friend. There isn't any reason you shouldn't be able to find out the distance with all the resources available on the internet. Find out the information and present it in your packet sent back to address the RFE. If it helps, print out a google map with point A and point B on it and the actual distance in between.


That's a good idea, but I think she needs to explain why her fiance didn't know this information and demonstrate how she has helped him learn.

I guess you need to explain the questions the interviewer asked, how your fiance answered the question, and then an explanation/justification for his answers and perhaps how you've addressed that with your fiance. Like, that you've helped him familiarize himself with where the states are, and you've explained your job in more detail. That's how I'd address the RFE.

I don't think anyone here has mentioned that if she finds out at the consular interview that you were married, they could theoretically deny her visa because of it. Generally, bonafied couples reveal this kind of information to each other. If I found out at the interview that my fiance had a previous marriage he had been hiding from me, I'd walk out the interview and refuse to marry him. That's just me, but you should definitely disclose your previous marriage to her.

Our petition was initially rejected too (my fiancé forgot to put the I-129F). We sent back all the same forms, we didn't print new ones even though they had the line on them. They accepted them back fine.

Yes and no...sometimes they're accurate, sometimes they aren't. Initially, the timelines predicted I'd have my NOA2 the week of September 12th. Then USCIS halted all processing of I-129Fs (as far as we could tell) for about a month. VisaJourney can't predict slowdowns like that.

Your best bet is to keep an eye on the forums, mainly people who have a similar NOA1 date as you. Check Igor's List regularly (you can get to it by clicking Immigration Timelines at the top of the page) and see who's been approved recently.

I'm currently on the wait for a K1 visa in Canada and have been waiting for 4 months with ZERO movement but I really think you'd be done before September. That's 10 months away. Just make sure you get it in very soon and you didn't overlook anything that may cause a Request for Further Evidence, which would delay you a bit. You can always post a thread listing what you're sending to USCIS and members here will look it over for you and suggest any additions or changes you may have overlooked.

I've been here longer and seen more. Yes, there would be an RFE if a short form BC was all that was sent as evidence of US Citizenship. Sound like this BC was just fine though.


A good question that was raised, and maybe you can help answer it is: if USCIS requires the "long" form, why don't the instructions say that? For everyone's benefit, this a direct paste from the instructions PDF on the USCIS site for the I-129F:

"A. If you were born in the United States, give USCIS a copy, front and back, of your birth certificate."

Nothing about what kind of birth certificate they're looking for.

Great! The certificate I sent them includes my parents name and their place of birth. Its signed by the city clerk with seal.


It sounds like you sent them what they need then. In my 11 months on VisaJourney, I've never seen anyone say they were RFE'd for their birth certificate so you should be just fine. :thumbs:

Personally I don't know why it doesn't say the exact requirements.

Read my post above and if you don't have the "long form" or a certificate that shows your parents' names, just photocopy every (even blank) page in your passport and send it in. Problem solved.

Basically I think USCIS wants to see your parents' names on the birth certificate. Some states (and in Canada, provinces) have small birth certificates and long ones, the long one obviously containing more information. If the certificate you have on hand has your parents' name on it, it should suffice. If not, you will need to obtain the long form.

You don't need the copy of her passport AND the birth certificate to prove citizenship. The only parts of her passport you need are the relevant stamps from visiting you. :)

Otherwise sounds good...make sure your cheque is written to the Department of Homeland Security, that's a common mistake!

Also I think you have enough evidence of relationship. It's not even really necessary at this point unless you're from a high-fraud country and you're not. Evidence of meeting and some photos will suffice. That's all we did and no RFE yet.

I don't know why anyone is continuing to give the OP advice about AOS without a prior visa. They've expressed intent to immigrate illegally and the AOS is no longer a legal option.

Bottom line daddySEAL: start reading the guides at the top of the page, specifically CR-1 or K1. If you try to go ahead with your original plan to go to the USA, marry, and stay, you are committing fraud.

You don't NEED ties per se but it's strongly advised. I visit my fiancé all the time and have never been asked, but I keep an envelope full of documents in my glove compartment just in case.

Also, no one answered the question you had about a time limit to file. There is none, you can marry without ever immigrating to the USA if you wanted. So don't worry about that.

After NVC completes the processing on your case and forwards it to the embassy, the petitioner will receive a letter in the mail saying such.. You can call and ask if the file is there if you want, though. Just give them the EAC or WAC number USCIS assigned to the petition.

I don't kknow where you guys get the idea of five months...I have been reading a whole lot of the posts where these couples get their visas mostly after 6 or 7 months. It does not matter when you get NOA1 or NOA2, if you get your visa after 8 months, then 8 months is your timeline. In my understanding the I 129f (to be more specific) is not serving it's purpose. By the way is there any one out there who can tell us why they came with the I 129 petition? I am asking because its no difference now between the I 129 and the I 130. Infact, If I had to do it all over I would go for the I 130... It is less expensive with your partner getting their green card much sooner, and more. Think about it and do the math before reply. Again the uscis or whoever is responsible are not using the I 129 K 1 visa for it's original purpose. It's that simple.


They're not talking about the whole visa taking 5 months, they're taking about the time between the NOA1 and NOA2, which USCIS advises can take 5 months.

The I-129F and I-130 are not visas, they are forms. There are many reasons why someone would prefer to do the K1 instead of the CR-1. There was a thread about it awhile ago and most people agreed it was because they didn't want to be separated for their first year of marriage. And the visas and their processing are a bit different, it is not "exactly the same."

Colin&Lori, it sounds like you kind of take it personal when people diss USCIS because you also work in an office. The fact is, no one will ever be happy no matter how long or short the wait is. For anything. Our society wants things done yesterday and are willing to throw money at it if they think it'll make it faster.

Last week for fun I checked out the very oldest K1 page on this forum, I think it was from 2006. Back then, it only took 30-45 days for the petition to be approved. People who were at 20-odd days were complaining it was taking too long. :wacko:

You can't beat 'em and if you don't want to join 'em, just ignore 'em.

Baron555, I think you generally give good advice but I notice you've given this fact a few times. What happened with your friends isn't really the norm and while it's entirely possible it could happen to the OP, I don't think it's worth pointing out to people who are perfectly justified in being impatient after 4 months of waiting. USCIS says it takes 5 months, not 10.

Oh okay, that makes sense now. I'm sorry, I don't have much advice but the money in your bank accounts (yours and your fiancee's) does not make much difference unless it is a very handsome sum and her consulate allows either self-sponsoring or for you to use cash as support evidence. Have you explored the idea of getting a co-sponsor?
