K-1 Fiance(e) Visa Process & ProceduresDoes Fiances employability matter ?
I can't answer the first paragraph but the beneficiary's employability does not make any difference in the handling of the petition or visa application.

K-1 Fiance(e) Visa Process & ProceduresPregnant Fiance-K1 Filed

3. No. If you would rather her have the baby here, there is a simple way to insure that. DO NOT mix your sperm with her egg until she is here and you are married. If that sounds harsh...it is exactly USCIS opinion. They could not possibly care less that she is pregnant or where your child is born...that is your responsibility. Ever since the CAUSE of preganancy was discovered some 1 million years ago, governments have relied on responsible adults to decide such things. An uncontrolled moment of passion on your part, does not create an emergency on their part.

In all fairness, that IS a little harsh. We don't know the circumstances of why his fiancee got pregnant. Birth control isn't 100% and it's unreasonable to assume couples who are careful would abstain from sex just because of a 1% chance. However, like I said, we don't know the circumstances so it's best just not to judge at all.

K-1 Fiance(e) Visa Process & ProceduresNOA2 in 27 days?

Heck, one of the September 2009 filers got locked out of the USCIS case updater thingie for a while because she figured out a way to see if other September petitions besides the ones on VJ had been approved. No matter how fast or how slow, it'll always drive you crazy. :)

Really? That's interesting. A bunch of the June filers figured that out too and were even posting charts on our June filers thread to show these random people who had been approved. To my knowledge, no one got locked out, though. Interesting.

K-1 Fiance(e) Visa Process & ProceduresNOA2 in 27 days?

I was just going over the time lines and noticed that some of the NOA2s came rather quickly!!! I realize that this is user inputted data, and I also understand that the 5 month projection is a estimated maximum based on total user data which of course could end up being a lot more or a lot less.
However, 27 days is something I was not expecting. This makes the total Days from Initial Petition Sent to Interview only 156 days! :wow:

Example:

NOA1 2010-06-01
NOA2 2010-06-28
Interview 2010-10-25

Sometimes it's just a freak thing, no one knows why. In June, Vermont started pumping out NOA2s in under a month. It stopped very quickly but it sounds like that's where you pulled that above timeline from.

I just wanted to chime and add that previous marriages in itself is not a red flag. Multiple marriages that resulted in the spouse immigrating to the USA is. Assuming that isn't an issue for you and you are free to marry (as in, you are never married, divorced, widowed, or had an annulled marriage) you are fine. Being divorced/etc isn't a red flag as others have stated unless the other marriages resulted in the spouse immigrating to the USA.

Wound up a little too tight? Maybe the visa process is getting to you. RELAX a little and laugh.

Um, no. I'm actually in no rush for my visa, I see my fiance all the time and I'm actually trying to figure out how to delay my POE. So I'm not wound up, but thanks for asking. I take issue with Gary and Alla's rude comments and sarcastic tone which is totally uncalled for when someone is just asking for help. Not everybody's first language is English and sarcasm doesn't parlay well into text or to someone whose first language isn't English. It is easier just to be straight-forward and helpful instead of confusing people and possibly causing hurt feelings.

So far my answer is the most accurate. You give no answer. Or maybe I missed it?

The estimates are THAT, estimates. They are based on previous members experience as reported by members. They are in no way "accurate" nor are any other "estimates"

I consider it very helpful to advise people to ignore meaningless information which does nothing for them or their loved ones. I have posted numerous times, dozens and dozens of times of consturctive things people can do during the wait time. Checking estimated timelines is not one of them.

Wow, you could have just said all that initially. That's my entire point...and I agree you have given constructive information, but using sarcasm that others may not understand is just wasting time for everybody.

Oh and sheenaspapi actually answered the question as well, albeit in a more helpful manner.

The MODS are aware of him and his stupid sarcasm so they choose to not take action strict enough that he will stop or restrain himself. Hopefully others will chime in to get his type removed from here.

I used to visit another forum related to foriegn brides. There were a couple of guys that were very knowledgable butcompletely arrogant A holes. They run people away from the site, like me and the site is REALLY inactive.

It's a shame when 1 or 2 people wreck an otherwise great environment here. I've seen more than one person refuse to read replies or even come back to VisaJourney because of rude comments. To my knowledge there really isn't any other immigration website comparable to VisaJourney and if people are being turned off by certain members, something needs to be done about it.

Yes. Or VJ will give you your next estimate for FREE

You are really on a roll with the sarcastic comments lately. Why do you bother wasting your own time when you could just as easily close the window and let someone else answer? People post here because they're confused. It's great that you understand the process so well but not everybody gets this stuff as easily as you do. If you don't want to use your knowledge of the process (which I know you know a lot about) to be helpful, why even bother?

thanks, I'm not really familiar about the different sections of visajourney.com. Could you write out the full link for k1k3aos? thanks! I just got internet connection in our place after arriving in the U.S.

You should be able to just click on it. I don't think there's any way I can post a link and the forum won't shorten it. If you click Guides at the top of the page the AOS guide is the first link on the right-hand column.

visajourney.com/forums/index.php?autocom=custom&page=k1k3aos

Add "www." in front of it and paste that into your browser (or type it).

Should have everything you need to know. I don't believe there is any form you need to fill out upon her arrival other than what's in the AOS package.

Unless she needed an interpreter, you wouldn't need a signature.

It will make a difference, unfortunately a negative one. The only result will be a longer delay, possibly because someone is talking on the phone about a complaint when they could have finished an application with those 15 minutes.

The phone jockeys are not immigration officers, hence why they give blatantly incorrect information repeatedly.

K1 applicants do not need to send documents to NVC, so don't worry about that.

I'm not sure how the embassy in Honduras works, I recommend reading the info about it that you can find on here (click on Embassy Info at the top of the window). Usually they'll send you a package explaining in detail what exactly you need to do.

You can call the Department of State at 202-663-1225 to find out information about where your case currently is.

K-1 Fiance(e) Visa Process & ProceduresJust Looking for Advice

A slight update:

After much deliberation (& exhaustion of options), we've semi-decided to go forward with the K-1 process! (inside I'm jumping & yelling happily) :)

I'm (we're) looking now for any words of encouragement, or further advice, to help us push that "semi" off the semi-decided quoted above!

We've been together for 2 years almost, traveled to each other, talked every day; been through a lot. The perspective that with long-distance relationships, you have to move faster, or slower than you would normally do or wish, couldn't be more true. We both have acknowledged that given the circumstances, normally we would wait a few years after our exclusive relationship developed & living together, before deciding to get married; but feeling as sure as we do about each other & the possibility of being together permanently, we don't feel like we're being too risky, as a whole.

That being said, any little push of motivation from any angle would be gladly appreciated...staying positive!

Is it the entire end of the world of we cancel the K-1 or nullify things within a few years? Again, we wouldn't do it if we weren't sure about each other, but the comfort of a safety net that the world isn't going to end for each of us, if we for whatever reason go sour, can sometimes be a huge motivator in moving forward.

Any encouragement about the aftermath, the process & waiting (for the K-1), visiting while waiting for the K-1, or positive thoughts in general would be a huge boost. (our journey truly is unfolding on VJ) :P

Thank you all

Good luck on filing!

I can definitely agree with what you said about how long distance relationships run at different paces than you'd prefer. My fiance and I were both really not interested in getting married and aren't the type of people to rush into anything. But we knew if we wanted to live together, we had no choice but to get married. It can be frustrating and cause bumps in an otherwise healthy relationship, so be prepared to experience some not-so-pleasant feelings along the way.

Other than that, the K1 process really isn't that complicated. Just read the instructions and the guides. Make sure you understand everything and if something isn't in the guides, don't assume it's a problem or requirement. The process is only as complicated as you make it. You seem like an intelligent guy so I don't think you'll have much trouble with this.

The best thing about the K1 process is that eventually it's over! Keep your eyes on the prize and remember to be patient.

If you need any advice, feel free to PM me!

K-1 Fiance(e) Visa Process & ProceduresJust Looking for Advice
It sounds like you are trying to get together long-term before you start the K1, but what about shorter-term trips? Could she come visit you for a month or 2? Could you go visit her that long?

If you started the K1 process now or maybe in the new year, it would still be mid to late 2011 that she would be moving to the USA (and she has 6 months to use the visa, further delaying it if you wanted). Of course with all important things in life, especially something as important as marriage, it is advisable to take things slow, but considering she wouldn't necessarily have to be there until 2012, why not just start it now?

K-1 Fiance(e) Visa Process & ProceduresK-1 Denied
I'm in the same situation, driving into the USA to visit my fiancé. One of the pieces of evidence I used was credit card statements I printed that showed purchases made in my fiance's town (the purchases on the statement showed the location). The statement only showed my visa number, not my name. So I photocopied my credit card (which shows my name) and attached it to the statement. I blacked out the middle digits of my card but left the first and last set so they could see the first and last 4 numbers were the same.

Hope that gives you another idea.

Would you mind explaining more about your RFE? It sounds like you got RFE'd for something I'm worried about getting, too. I'm divorced but still use my married last name, and so some of my documents are in my maiden name (my divorce certificate and previous marriage certificate) but I go by my married name.

Actually, the expiry date is shown on the approval notice AKA the NOA2. Not sure if you just made a typo but I didn't want the OP to be even more confused.

K-1 Fiance(e) Visa Process & ProceduresProof of Meeting

True, but you are misreading what I intended. I didn't mean to imply that the only evidence they needed were pictures, but that only a few pictures were needed, not boatloads. Someone else said they included 32, which I think is too many for a case in western Europe. I also think that taking a photo with a newspaper is silly. What I meant was that a few photos would be just fine for the photo requirement, not that photos were the only evidence they needed. That's why I also said a copy of the lease, passport stamps or boarding passes would be good evidence to send along.

Oh okay, gotcha. I did misunderstand what you were saying, sorry. I agree with you...some people send way more stuff than actually is required.
JlovesAFemaleCanada2010-09-01 13:30:00
K-1 Fiance(e) Visa Process & ProceduresProof of Meeting

All you really need are some pictures.

That isn't true, actually. Photographs are considered secondary evidence as they can be man-made. People on this board have been given RFE's for only including photos as proof of meeting.

K-1 Fiance(e) Visa Process & ProceduresLiving in Canda--not a citizen

He may find, calling around to various RCMP detachments, that rural or semi-rural ones are a lot less busy and have much quicker turnaround times. I had mine done in Steinbach, Manitoba [About 30 miles outside Winnipeg. I was working there as a teacher, commuting in from Winnipeg] and there were able to do mine on the spot, with no turnaround time at all. Biggest inconvenience was that they wouldn't take cash or plastic - only a cheque or a money order, which seemed weird.

My detachments did CR checks for free but I think cheques and money orders make it easier for them to deposit the money into the federal account (Receiver General of Canada). :)

As a former RCMP employee who processed criminal record checks, I would advise your friend to call a few different police stations (RCMP, provincial and municipal, everything nearby) and ask how long it'd take. The detachments I worked in had a turn around time of only 4-5 business days but if it was an urgent matter, I would just do the check on the spot. So if your friend is leaving very soon, I really recommend calling a few places and seeing what they can do for him. Be aware the record check does NOT have to be from the RCMP, as long as it is a federal record search.

In general, the K1 is faster than a CR/IR-1 but there is no hard and fast answer.

You are asking questions that don't have definite answers. My advice is to look through the timelines (found at the top of the page) and compare the processing times for visas in the Dominican Republic.

I also recommend reading the embassy reviews for the DR as well as Latin America/Mexico/Caribbean forum on here.

Hmmm weird comparison!!

How so? A 200k debt (which I originally thought was $200 000 USD) is a 200k debt. The only thing that's different is how you're paying it off and what it bought you in the first place.

No, the consulate does not take into consideration the petitioner's (or the beneficiary's) credit history or debt. Owing $200 000 on a credit card isn't much different than having a mortgage, and many petitioners here have mortgages. As long as the petitioner makes 125% of the poverty level for their household size, you should be fine.

K-1 Fiance(e) Visa Process & ProceduresNo, you CANNOT file a I-129F and marry while waiting.

I am a canadian citizen who has been dating a us citizen for over 5 years and we are looking to get married in September 2011. I was told by the us customs at the detroit border that we are to apply for K1 fiancee visa and get married within 90 days after getting the K1. Approximately how long does it take to process the K1 and get the actual visa.
I also saw posts about applying for an I 130, is this before or after the k1?

If anyone knows about other steps I might have to take before that. I have over a year to get this done right and would like to have all my ducks in a row ...
Any help would be greatly appreciated
