Well, thinking we might make a mistake in our filing we made an appt. with a lawyer, they emailed some forms to us and they are dif. then what I see here They are immigration lawyers but now I am wondering why the forms are dif. Bio forms, affidavit, and letter of intent are all dif. And does the lawyer fill in the I129? more confused then ever. thanks for any input you can give

You must have a certified copy of the court documents for all prior marriages showing proof of the divorce. It can be pricey depending upon the length of the document and the court it was filed in... call the clerk of the court in the county that the divorce was filed and have them send you a few certified copies.. note I say a few... better to get them now than to have to go through it again if they get lost.. they will be needed again later down the line. Does not make a difference about the name...

ok, what about the marriage certifs, i dont know how i will remember where to get these, i have this past one

I was married in the early 70's and divorced in the mid 70's, (3years) and did not marry again until 1998 and divorced in 2006 will I have to have copies of the marriage and divorce from the 70's or just for the last in 1998? my marriage certificate for the one in 1998 has my other married name on it not my maiden name as i never took back my maiden name, does this make a dif. or will it cause a problem?

Hello, I am posting in the wrong place please let me know.
After reading here on VJ we have decided NOT to use a lawyer. We feel we can file the application for far less money and much less time.
Gerhard visited me and my family in Sept from England and stayed a week, everything was absolutely wonderful. He has now gone back to England and I am beginning the I-129F application. I am sure we will have many questions and would appreciate any help from all of you here on VJ. We have read the guides but as all of you know sometimes we still have questions.

It depends. Some consulates ask for a new one, others don't. I wrote one just in case, but the consulate in Seoul never asked to see it. One particular instance where it's often required is if the interview is going to take place more than 4 months after NOA2. An approved I-129F has a validity of four months, so consulates generally require a new letter of intent from the US citizen fiance to revalidate the approval if the visa cannot be issued before four months have elapsed.

That said, if a new letter of intent is required, it's usually only for the US citizen. The visa applicant affirms his/her intent to marry the petitioner when he/she signs the DS-156K at the interview.

Only divorce decrees are required. Who cares about the marriage once you are divorced?


Often, women need to submit previous marriage certificates to document name changes. The I-129F instructions don't specifically mention this but the I-130 instructions DO. If the divorce decrees don't show the track of name changes, you should provide marriage certificates that do.

For the I-129f petition you need only divorce certificates (if any) to show each party is "free to marry" Some consulates (kiev for example) require copies of past marriage certificates to show name changes (if any) You will need your OWN marriage certificate for the AOS.

Thanks, yes your right of course, trying to compile all that is needed for initial application and trying to cover everything. My next question is can I get the certified copies of marriage certificate from the courthouse as I can the divorce certificate ?

The instructions for the K-1 state:

Give USCIS a passport-style color photograph of yourself and a passport-style color photograph of your fiancé(e), with both photos taken within 30 days of the date of filing this petition. The photos must have a white background, be glossy, un-retouched and not mounted. The dimension of the full frontal facial image of you and your fiancé(e) in separate photos should be about one inch from your chin to the top of your hair. Using a pencil or felt pen, lightly print the name (and Alien Registration Number, if known) on the back of each photograph. http://www.uscis.gov...i-129finstr.pdf

so, yes, they should be taken within the past month. I don't expect you will have a problem if they are a few days/week or two out of the range but they do want them to be up-to-date and recent.

Yes, list all children, even the ones who are off on their own and married, even if they are not included on the visa application. You will discover that USCIS is really, really nosy, and will ask a lot of intrusive questions and ask for a lot of personal documents and information over the next few years as you go through this process. The best thing to do is to answer them accurately, completely and honestly.

Hoping some of you can advise on my 2 questions. I am finally getting ready to send out our application, I-129F, Is it true that when sending the passport photos with the I-129F that they have to be no more then 30 days old?
My other question is on the I-129F part B question # 13 "List all children of your alien fiancé", is this for people that have young children or for ALL children he has even though they are in their 30's and married? Thanks in advace for any help

and yes some of us are still waiting for our decision

and have you tried keeping in contact with your loved one every day by IM and Webcam?
It will be alot easier to keep up the relationship over the waiting period.
She could even talk to you parents in that way if she so desire.

Also if you love her then give her a chance to start her live by supporting her and not convince her that she has to move to somewhere else to be together.
