The RFE was for a legible copy of the Divorce Decree for my US fiancé. We had already sent a legible one but we sent another one as required. I hope they will not come back with more RFEs as this first one was really weird. I start to get paranoid about the whole process now even though we did everything by the book.

Hello,

I know this question has been asked many times but when do you think I should consider calling USCIS to inquire on our RFE Response? We sent our response almost 3 weeks ago so I start to worry that something is wrong.

Also my US fiancé is 25y older than me and I am wondering whether this is a red flag for them and they want to make it difficult for us. Could they deny us on that basis (would be quite discriminatory though)?

I don't think you can generalise when it comes to lawyers. As everyone said it depends on your personal case, your need for a second pair of eyes to (hopefully) correct any mistakes, your financial situation (it is not cheap indeed).

 

In my case we hired an immigration lawyer that was supposedly one of the best in Utah; she mainly deals with hard deportation cases so our fiancé visa was probably not her priority and I got frustrated with her at times.

 

In our case my fiancé is 25y older than me and was married 3 times before so this was likely to be a red flag and we actually did get an RFE (still waiting for the letter). At the same time we got the RFE quite quickly (40 days after NOA1) so hopefully once we reply, it should not take too long.

 

For me she is more an "insurance policy" in case the sh** hits the fan (for whatever reason). I know she is used to difficult cases and the fiancé visa is just the first step, you then have AOS/Green Card application so it reassures me to have someone to rely on or beat up ;-).

 

This forum is really great with a lot of good advice and very supportive and human members (we are all in the same boat!) but I stilll believe that in some cases you need to know a bit more about how the system works and that's where good lawyers add value.

 

Also we do receive all the communications from the USCIS in my fiancé's name and address so this is probably something to check with your lawyer beforehand.

We also had a lawyer preparing our petition. The NOA1 and NOA2 notifications will be sent to both the lawyer and the US petitioner but in case of an RFE usually only the lawyer receives the notification (this was the case for us).

Our lawyer was good; with hindsight we could have probably prepared the petition on our own but it was reassuring to have someone supervising the paperwork.

We have decided not to use our lawyer for the consular processing (when the petition arrives at the embassy and the visa is issued) as it is quite straightforward at this stage. She quoted separate fees for the different stages so it was fine.

If the petition has not yet been sent to the USCIS (and you have not yet paid the lawyer's fees) then you can try to get your file back. Otherwise just get to the NOA2 stage and then you can take back control on your application.

Hello all,

 

I read a lot on this topic as I had initially planned to visit my fiancé in Utah after my NOA1 and it seemed to be ok-ish from various personal experiences (as long as you can show ties to your homeland). After discussing with my lawyer she insisted on NOT visiting under a VWP while the K1 visa process was ongoing. Her approach was perhaps very conservative but she told us that in a worst case scenario where I would be refused entry to the US, this would stain my immigration file all along (from K1 to Green Card). Indeed you frequently have to answer to the typical question "Have you ever be denied entry to the US?". I eventually decided to make a last trip to the US before filing the K1 petition and my fiancé is now visiting me while we wait for the visa.

At the end of the day it is up to you to assess the risk; it may be remote but it is not null and can lead to painful consequences down the line.

I used the one that is on their website...so I would think it was the right one.

 

 

It could be that you used an older I 864 form.

Call and confirm what the issue was with the NVC. They should be able to tell

There is nothing after that. The PDF ends there. There is a line with our case number below it, then brackets with the date. That's all I have to go on at this point. Other examples of checklists I have seen are specific as to what needs to be fixed.

 

There should be a list of changes below the text you copied in--is that missing from their PDF?

Got an email with a PDF that included a checklist from the NVC. It seems to be relating to the I-864A that was done by my dad as a joint sponsor, but I am not sure. It is so vague on what they need from us. With the I-864A I had 9 months worth of my dad's pays tubs and sent the three most recent tax returns. 
 

"______F - FINANCIAL EVIDENCE:______________________________________

A review of the I-864, I-864EZ, I-864W or I-864A (if applicable) Affidavit of Support form and

supporting documents that you submitted has revealed that you have provided incomplete information in

your response or you have not responded to some questions.

Please pay specific attention to the questions marked in the attached I-864/A checklist. You will need to

complete and submit a new form with the changes noted on the attached checklist.

You will need to follow the instructions for the Affidavit of Support (I-864) that are posted on the

Department of State website at the following address:

www.ImmigrantVisas.state.gov. From there, you can fill out a new form online, print the new

completed form and mail it to NVC. If you are the Petitioner, please read all instructions and complete

the correct form to submit to NVC. An Affidavit of Support form is required to be submitted from the

Petitioner on each case regardless of his/her income level.

NVC will hold this case until you send us these needed items. When you return the documents to NVC,

please make sure that the documents submitted are in the correct order and stapled together, as stated in

the I-864 Important Notice instructions.

 

Checklist for I-864A (filed by _______________ )

NVC has reviewed the financial evidence submitted. However, additional information is

required to complete the financial evidence review. Please provide all requested documents and

refer to page two for mailing instructions.
