Hello, I note there was no more postings on this topic.
I do have some more information for same sex couples regarding the embassy interview but basically you are treated the same was as a hetero couple with one exception. In countries where gay marriage is illegal or hostile, the consular officer meets in a private room with your fiance. Reason being is people around could hear the interview Q and A. It is an American person doing the interview.
 
I am not sure what is on the confirmation page for the DS-160 Print out which is usually collected by a local secretary etc with the passport and maybe given a number. Anyone can help?
 
PS: If you are still applying, YES either New York/MA or the entire NorthEast (except NJ and PA) have marriage.





Actually, both NJ and PA have same-sex marriage now.

If you've been reading this forum, most denied petitions die a natural death. Most likely, you will need to file a new fiancé petition. But then there's still that matter with the possible misrepresentation involving the nanny visa.

You could try getting married in Brazil then refiling this time for a spousal visa. I say Brazil because out of all the countries with same-sex marriage, it does not require a visa for your Fiancé in the Philippines. She could easily enter Brazil visa-free as a tourist then get married with you. You, on the other hand, as the US citizen, will need to apply for a tourist visa to Brazil.

If there is any misrepresentation issue associated with the nanny visa, there might be a waiver available to your future spouse. Best for you to speak with a US immigration lawyer.

There must have been an issue regarding the previously denied B1/B2 visa. A statement or answer in that previous visa application that raised doubts or contradicted the information you now presented in the Fiancé visa application.

You might want to go over the answers you guys gave in the previous nanny visa application and the answers you now gave in the fiancé visa application and compare if there's any inconsistency. If some answers don't match up, that might be what led to the denial now. You might wish discussing with an immigration lawyer how to overcome this issue.

I feel for you and this makes me sad and irritated (at the inherent unfairness of the immigration system) at the same time. Good luck!

Were you unlawfully present for more than 1 year in the USA? In addition to being questioned for having a bonafide relationship, unlawful presence makes you inadmissible to the USA.

The immigration forms to immigrate as a spouse of a US citizen or LPR and the information forms required by the US Embassy for your visa interview will ask if you have ever overstayed a visa in the USA. Telling the truth will lead to a 10-year ban. Lying and getting caught (and they will catch you) will get you a permanent ban.

If he was a student, then he did not enter illegally. He would have entered on a visa then overstayed. Overstays of spouses of US citizens are forgiven if the alien spouse entered on a visa. Since you claim that an unlawful presence waiver is required, that means he entered without inspection and he was not a student on a student visa.

Someone who entered without inspection will have a very difficult time getting a green card, so hire a very good immigration lawyer.

My fiancee just went through the process of applying for the Japanese police clearance in Manila. You are correct that you have to obtain a request letter from the US embassy first. Once you have your Manila case number (NVC letter) take that and your NOA2 to the US embassy. Go to Window X and ask for a "request letter for a Japanese police clearance". It took about two hours before the letter was ready. Take that letter to the Japanese embassy. Once there they will send you to Camp Crame (not sure of spelling) to get fingerprints. Bring the form back to the Japanese embassy and that is all. They told my fiancee it will take approximately 45 days. It is an easy process but you cannot apply until you receive your NOA2 / NVC letter.

I know! We just finished scheduling our interview! The earliest available date we saw was for 6 January 2014 and multiple available slots and dates in January 2014 and February 2014. We chose a date in February 2014 because we still need some time to gather documents from both the Philippines and USA.

Yeah, I didn't bring my X-ray CD. None of the consular officers - Filipino nor American - asked for it. There is a concession stand in the large waiting area just outside the interview building where you can buy water and food.

Well, I was referring to a different kind of disappointment which is the kind you feel when you become a United States citizen.
 
For me, it has been a little disappointng so far since I had such high expectations. I was under the impression that life would open up once I gained US citizenship, but so far, it's been quite lame:
 
- my credit card balances are still the same and did not vanish as I had assumed;
-apparently, I'm still required to join the queue when checking out at the supermarket (I had incorrectly assumed that as a citizen, I could jump the line but I found out the hard way this afternoon that that's not the case)
- I still have to pay full price for airfares on American Airlines (which until this morning, I assumed was a state airline with subsidised fares for citizens...)
 
... and, oh, my boss is refusing to increase the number of my paid vacation days. I tried to make the point that I was a citizen now, but he was such a douche and was like "Under US labour law, we have to treat everyone the same regardless of their immigration status" or something like that. What's the good of being a citizen then?

My father died in the Philippines in 2011 due to natural causes. He was a naturalized U.S. Citizen. (IR-5 petition by my naturalized US citizen sister)

In my AOS biographic Information form (G-325A), I declared there that my father was deceased, although I did not indicate that he was a U.S. Citizen (it was not asked in the form).

Is my family required to inform the USCIS or some other government agency of his death because he was a U.S. Citizen?

My husband is upset that I left understandably. His family was also insisting on me staying and just doing the AOS route but I didn't want to risk being flagged for visa fraud and getting banned and separated for YEARS from my husband and kid. He hates that I made it 10x more complicated but I just can't take the risk. And I don't want to be looked at as one of those chicks that's green card hungry. Let's admit it, southeast asian women have that stereotype.
 
The latest delays in the CR-1 processing is disheartening though :'(

My USC fiancé was able to open a bank account in the Philippines without an ACR card. The ACR card 'requirement' is bank policy and not a legal requirement.

Try Unionbank. Just Google the various locations. Bring passport to the bank.

Yes, that is good enough. that's exactly what I had too, just the appointment confirmation email. when SLEC asked me how I got my MNL, I told them I called NVC and got it from them. SLEC person just nodded and said "Ok, no problem".

A)  SLEC wants two copies of the interview appointment confirmation letter/email.  This is the email (or letter) you received confirming your interview date.
 
B)   -same as above (don't need the instructions letter)
 
C)  This is copies of the pre-registration form that was completed online at the SLEC website.
 
 

 
A - don't hold your breath for anything that is sent through PhilPost.   Instructions letter is online anyway.










I have my interview appointment confirmation letter in front of me. I don't see my case number on it. Will this be good enough to take to St. Luke's for the medical? Or do I need to request NVC to email me the case number?

I only got my case number over the phone. I don't have any written communication yet from NVC or the USEM which specifies the case number.

I-134 Affidavit of Support.   You only need supporting evidence according to what is listed in the embassy instructions letter, don't go by the instructions for the I-134, this form is used for other types of visas and is a "make do" for the K-1 visa.
 
What is required by the embassy is a copy of your most recent tax return (or transcript) and W-2, currently you can still use your 2012 tax return.
 
If your income is adequate to meet the poverty guidelines of the I-864P you do not need to include bank statements or such to show other assets.  You do not need a letter from your employer, that is strictly optional as well.
 
The I-134 has to be original, everything else required can be copies.  It seems logical if you are going to send an employer letter to send the original with the I-134.







We have the 2012 tax transcript from the IRS but no W-2. Would this be acceptable to the US embassy? Thanks for any information!

I called up the Japan embassy using the number you gave. It worked! Thanks! Unfortunately, my police clearance is still not there. The lady on the other end of the phone line was very nice and helpful though.

I've been calling the English direct line number of the Japan Embassy in Manila but no one picks up the phone or someone picks up but doesn't say anything and all I hear is background office noise!
