Probably - H1-Bs are employment visas, which tend to get processed faster - businesses tend to get better service than citizens from the US Government. Not sure where they are processed, but you can be sure that anything thats in the news on a regular basis gets a lot more attention than we do, such as Bill Gates saying we need more H1-B workers, or anything on illegal immigration. Our fiances are at the bottom of the priority list, seems to me.

This happened to me, too, though I'm a CSC filer. I mailed the I129F May 18th, it was received by the CSC the 19th but the check cleared in Texas and the NOA1 was dated 5/25. The notice does say it was received 5/19, though, which made me feel better for some reason. :) Our file was "touched" yesterday--maybe that means it's back at the CSC again but of course there's no way to know that. Wishful thinking on my part, I guess. These changes must be why the CSC was so quiet the week of May 18th.

We received the NOA2 in the mail but we never received electronic notification (as requested) and our status was never updated beyond initial review on the USCIS website (and we now have the package 3 from the embassy) Electronic updates from the USCIS are completely inconsistent, so no worries if you don't get any.

September 17th @ 9am!!!!!!!!!!

That'll mean 3 1/2 months from the time it got to Vermont till interview. We are so lucky!! :dance: :dance:

That's probably the most frequently asked question on these boards. I've read that anyone in the military is expedited, but I have no idea if that's true. Seems like it's just luck. Check out Igor's list... My link

If it makes you feel any better at all, CSC mostly hasn't gotten to the June filers yet. Or you may be approved and not even know it yet. We were approved but the USCIS website was never updated...I got the hardcopy NOA2 in the mail 4 days later.

Waiting for the NOA2 seems like the hardest part (so far). Things have moved pretty quickly after that. Best of luck!

Hi there everyone! Ok, here's the scenario -

We filed to the CSC on June 1 and received the certified mail receipt stamped June 3. 30 days passed and still no NOA1 receipt, so I called and they said the receipt was sent June 8 and was returned. Apparently when I moved and had my mail forwarded (I used the new and correct address when I filed) the postman forgot to put my name on the inside of the box, so it was marked return to sender. I got it straightened out and they said a new receipt would be mailed. I was also assured by the representative that the application was still in process, and that this would not affect processing time.

I received the 2nd receipt around the 2nd week of July (case was touched July 9) but I have not heard a peep since then. No touches, nothing...and when I check online it still gives me the message saying 'on June xx 2010 your receipt was returned to us, etc, etc, you have 180 days to call this number, blah blah.' Since I can't call and complain because it hasn't been an exorbitant amount of time passed since the original date of filing, I'm just left to wonder. It's been 76 days since they received the paperwork...

Should I be concerned or is this fairly normal? I just keep seeing so many people getting approvals within a month or so and mine just seems to be going so long...

Thanks in advance for any help/advice/comfort/support! :)


Hang in there...CSC seems to be taking a little longer lately. Your experience is well within normal and if you haven't received an RFE there's no reason to worry yet.

By the time we had our interview we were married for almost a year - we didn't file for AOS right after marriage, cause I was in status, and I actually wanted to wait with AOS until our second wedding anniversary to avoid the lifting of conditions. However, I got tired of being a non-immigrant after a while, and we filed AOS after all. We had a ton of joint financial stuff - joint accounts, joint car insurance and car titles, joint lease, phone bills, life insurance, dental insurance, renters insurance etc. Our pics were kinda sucky, and our wedding pics were even worse, because our financial situation at that time was, to put it mildly, destitute - we couldn't afford to have a nice wedding laughing.gif

Sure, luck comes into play when you're dealing with USCIS, but it is true when you adjust status from other types of visas too, including K-visas. I'd go as far as saying that, if the adjustment of status is based on marriage, the immigration officer will put more importance on the bona fide nature of your relationship, rather than intent upon entry - regardless of the type of visa you're adjusting from.

There is a number of people on this board who are in process or have successfully adjusted from F-1 visas. Most of them don't even read the K-visa forums, you can find them in the Adjustment of Status part of this board. A lot of them weren't married for a long time before their AOS interviews, and didn't have that much proof of relationship, but they were fine nevertheless. You can get more responses if you post your questions in the AOS forum.

Nope, it doesn't indicate dual intent. Working on-campus of for a recognized international organization is allowed to F-1 holders.

The best proof of not intending to use a student visa for immigration purposes is the fact that your boyfriend actually went to school. Had he entered with an F-1, never showed up at school, got married and applied for AOS right away - that would have been fraud. He didn't do it.

Immigration officers are not lawyers, and I suppose, most of them are not too sophisticated. They would never try to interpret the immigration law the way some members on this site do. So, don't worry about it too much.

When my now husband and I decided to get married, I seriously thought I would have to go back to my country and wait for a K-1 visa. I'm happy I did ore research and found out that it was perfectly legal for us to get married and file for AOS in the US - it saved us a lot of time and money (and we're not rich).

noa2 date is nov 17..... (141 days from noa1).....
nvc forwarded to usem my case via electronic file nov 23, 2010
have called usem many times (02-301-2000)....
and all i get is.....
"we have received your e-file but we need to have your physical file"
"please call us again after a week (same advise given last week)"
i asked if i can pay the visa fee
"yes, you can"
further asked if the bank will provide the UID
"we receive lots of complains about it, so we are trying to figure it out(?)"
i asked that since i have my mnl number, if ok for me to schedule my appointment
"no, you have to wait that your file be uploaded first"

geeee.... i thought we were done with the dilemna after waiting almost 5 months for noa2...
another test for all of us?????

do i really have to wait for the usem to tell me if i can already sched my interview?
the usem staff said that my file might be already there just waiting to be uploaded.....
i have not tried calling up the call center (02-982-5555)
but been calling usembassy (301-2000) almost everyday.....

and interview mid of january....

also, my noa2 (dated nov. 17) states it expires feb 16, 2011....

Hi! keep calling them everyday until they tell u physical packet is received.Its usually about 2 1/2 weeks after NVC forwarded it to manila consulate.If they tell u to call back in a week,just call again the next day.:blush:
This process is really a test of patience.Even after the interview and its been approved,theres another 2 weeks of waiting to get the actual visa.Im keeping myself sane here with a thought that me and my fiance will be together really soon.hang in there a lil bit more.Good Luck!:thumbs:

I just got back from the CFO website too. :lol: Looks like your fiancée won't need the bio page from her passport after all.

However, check out #3 on the first list where they say that they can ask you for any documents they want. I think they sometimes ask for a copy of the bio page. Maybe that's why it stuck in my mind.

When Chinook attended the CFO seminar at PRISM, she took along all of her papers...and I mean everything...just in case. Chinook said that there were atendees at the seminar who were asked to submit various documents, didn't have them, and were allowed to complete the seminar anyway. So, don't worry too much about the bio page.

Hiyee! CAn Dex attend the seminar and counseling without his passport?I figured they would need orig passport so they can put sticker on it after seminar and for verification purposes too.Posted Image

I'm sorry to hear that the Immigrant Section of the Embassy would not schedule you for an appointment. Did they give you any idea why the call center is not currently scheduling interview appointments for K-1 fiancée visa beneficiaries?

There sure seems to be a lack of information on the Embassy's part when it comes to all of the good people who are waiting on pins and needles to schedule their interview. :(

Chazzie, I was just posting my experience of the call (about the operator). My intention was never to portray you as a liar regarding the new Appointment System that will be implemented Dec. 1st. It does EXIST and IT WILL HAPPEN, just like you mentioned. Don't take it personal. I do understand that EVERY operator is different. Like I said, it was MY experience. On December 1, 2010, the U.S. State Department’s transition to a new contracting system for visa services, known as the Global Support Strategy (GSS), will take place at U.S. Embassy Manila. With only one payment (the current MRV fee), the following services will be provided:

  • MRV fee collection at any branch of the Bank of the Philippine Islands (BPI)
  • Scheduling of visa appointments
  • Providing information on general visa inquiries
  • Delivery of passports for approved visa applications
Following these changes, new nonimmigrant visa application procedures will be implemented very soon.

The Nonimmigrant Visa Unit of the US Embassy in Manila will transition to a new visa appointment service soon. Because of this, limited visa appointment slots are open until the second week of December only. If you have travel plans in December or later, we encourage you to check this website for new visa appointment procedures on or after the last week of November. Rest assured that we will try to accommodate your travel plans as appropriate.



Applicants who have booked their appointments will not be affected by the transition and will be interviewed at the Embassy as scheduled.

I think when we get into the visa process we tend to loose our minds. If you didn't have patience to begin you will learn patience in all of this. Welcome to the USA Immigration System. hello chazzie,

In my case we have been waiting for more than a week before he went to his vacation and we checked to his bank twice but still our check has not yet encash.

Now,its more than two weeks and I can't anymore check whether it was encashed and if NOA1 were delivered because my fiance is now on summer vacation with his parents and will return end of August. :-(

Im hoping that you will have good news and I hope CSC will process our papers fast and no delay due to backlog or anything. Goodluck to us!!



hiyee! even if your fiance is on vacation, cant he check online?If yours hasnt been encashed yet and its been more than 2 weeks now it only means i have to wait longer...oh well,nothing we can do for now but to just wait.Posted Image

Wait 5-10 more business days. Then get a roll of duct tape. Wrap it around your head. Use the entire roll. You are just starting and already getting nervous. By day 143 your head will explode...you will want to keep all the pieces.

Hi Chazzie--I was worried at first too because it seemed like everyone who filed in early May and before had their checks cashed and cleared in two days. It took mine a week. I think what happened is the change in processing; the I129F is now forwarded from the CSC to a centralized lockbox in Texas. That's where my check cleared. I'm sure it will be cashed soon. Hang in there!
