Russia, Ukraine and BelarusMosocw Medical Exam Controversy

I don't believe those stories about harassment.

People, give me a break here. It is Moscow, a civilized city after all!

Where do you get those strange ideas about Russia?

I've been to Russian 5 times and Moscow 3 times, and i would not call it civilized. Crime is high and it is not safe at night. The mafia runs the taxis and airports and most everything else. The hotels and restaurants are all rip-offs, and recently the Mosocw traffic makes NYC look like a rural town.

Additionally, Russian men have a well-deserved reputation for mistreatment of women. Along those lines, the MOM exam clinic was notorious for making the women strip and then having a staring fest complete with verbal profanity much like one might expect at a Russian strip club.

Civilized?

Oh sure, how can we compete with the civilized America where there's no crime at all. I mean, no one can shoot you at a mall in the middle of the day whistling.gif If crime and mafia and high prices are what makes you label a country "uncivilized", then your motherland is at the top of the list.

Well, it's your opinion, you're entitled to it. I'm entitled to mine, and I think your opinion is wrong, and if my husband ever dared to say something like that about my country, he would now be divorced and thinking of what to do with his lonely life. I'm sure glad you happen to have a spouse with views similar to yours.

And you know s**t about Russian men.

Africa: Sub-SaharanToo Young For Marriage?

In my opinion, it is MATURITY that makes the difference in a relationship - NOT AGE. I know some people who are 22 who are way more mature than friends I have who are 30+.

I couldn't agree more!

GhanaLove, 22 is not too young :) To be honest, I expected to see a post from a 16-year old kid asking if it's okay to marry at 16 :)

K-3 Spouse Visa Process & Proceduresi want to claim my japanese wife a greencard

my 1st question is after we get married can she possibly file an i-130 to claim a greencard?

You can possibly file an I-130 and all the rest, but you may very well run into lots of problems, since what you are trying to do is immigration fraud.

US Embassy and Consulate Discussionmeeting from fiance's family member

Maybe since his mother is a LPR and has the ability to petition her son herself, this will help you? I am unsure of LPR can peition adult children or only USC?

LPR's can petition for children. Besides, his mother has been an LPR for 15 years - if she cared about bringing her children to the US faster (or at all), she would have applied for US citizenship. So, I really don't think that's what his mother wants.

To the Yaalisa - definitely don't lie. Tell the truth. If your fiance wanted to immigrate to the US, he would have asked his mother to file a petition. He didn't do it, so I think it proves that immigration is not his first priority.

Good luck! :)

US Embassy and Consulate DiscussionI-864A Confusing directions
QUOTE (Jerrod @ Aug 18 2007, 05:48 PM) <{POST_SNAPBACK}>
Hi folks, I am a bit confused on the directions for the I-864A. I have seen on this site, people quote some official document that states you must be a resident with the household member for at least 6 months. However, the official documents do not mention this 6 month issue. What is the truth?

The 6-month requirement no longer exists - I-864 was amended in late 2006, and this requirement was eliminated.

If you list an illegal source of income, say, for example; I earned 50% of my income from blackmailing, money laundering and extortion, and thats why you don't see it on my tax return; then I believe the consular official can discriminate.

Yes, child support can be used as income for the Affidavit of Support.

I don't understand why some of you think of jury duty as a negative thing. I would love to be on jury duty! :)

I will apply for citizenship eventually, main reason for me is that with an American passport I won't need a visa to travel to Europe. Moreover, after having spent a few years here, I'm really starting to think of this country as mine - I don't have many ties to the country where I was born. My parents are there, but we can visit each other once a year, and I think it's enough :)

US Citizenship General DiscussionCitizenship eligibility???

Hi All,

Okie, this question has probably been asked a couple of times.  ...but here is the context.

Married in 10/2005, wife USC.
Got Green Card in 10/2006.

I was interested in NAVY's careers and went to see a recruiter. Unfortunately, only US Citizens are eligible to apply for job in NAVY. I explained my case and the officer told me that I could apply for citizenship right now without waiting for the 3-year green card expiration ???
He said that if I had a statement saying that my citizenship application was in process, I could then apply for job in NAVY...

So, question : has anybody heard about such a thing???

Thx,

Groomit

Well, military recruiters don't know much about immigration :)

Permanent residents can join the military, Navy is not an exception. However, they cannot get positions that require security checks, because the military can only perfom security checks on US citizens, so the choice of jobs will be severly limited. Also - and that's important - if you are a green card holder, the expiration date on your card should be further away in time than the date that you expect to be discharged from the military. The standard commitment is 4 years, so conditional residents probably can't serve at all! But I would look into it some more, cause the rules are very unclear. I don't think the military has adressed the issue of conditional residency very well :(

You cannot apply for citizenship now. The recruiter was wrong. Sure, you can file an application, but it will be denied. The recruiter probably said that because to qualify for government jobs (police, fire department, 911 operator), you need to be a US citizen OR have a pending citizenship application. In your case, you can't have a pending application, because it will be denied right away.

What I know for sure - permanent residents can join the military, and they qualify for citizenship after one year of service (active duty, not reserve).

There are people who are incapable of learning a language, no matter how young or old they are. But even those who are good at it will probably need a lot more time to learn after the age of 70.

I remember volunteering at a place where they prepare people for citizenship interviews. I had to act as an interviewer, and most of these folks didn't even understand English beyond "Hi, how are you?". I stopped volunteering after a couple of days - it was too much for me... :)

Once I read that there was a difference between being a US citizen and being a citizen of the United States.

Is there any? Even if so, you're neither one of those. You're an LPR.

Grrrr! Permanent residence is permanent residence, regardless of whether it has conditions imposed upon it. I feel like a broken record wink.gif. I'm impressing upon folks to read the FAQs and guides around here

Why would anyone even want a conditional green card if it didn't give you any rights or priviliges?

US Citizenship General DiscussionNaturalization deny & petition

okay..i need help..i applied for naturalization..after several months of the process..i just got mail today saying that my application for naturalization has been denied because i have a drug/marijuana on my criminal record..yes i do have a record of possession of marijuana less than 1 oz..that was my first crime and the only crime i have on my record..now they telling me that i can petition it..like where would i get the money to hire an immigration lawyer..i thought having such simple crime won't be a big issue..i need some idea..i can't afford an immigration lawyer because i am a student and don't make enough money to hire one..i am worried about student loan not some lawyer.

Did you have an interview, or did they deny you by mail?

IMHO you have nothing to worry. A refusal would have been given to you right there and then, most likely.

Mazel Tov!

Not necessarily, but they don't just deny people cause they think giving someone U.S. citizenship isn't a good idea. They gotta have some good reason for denial.

In a lot of cases it's the matter of getting an approval from the IO's supervisor, cause the IO doesn't have that kind of authority. Princess, you will be fine.

From what I have heard you need to wait 5 years after a conviction to apply for a citizenship. If you are trying to petition your case NOW it will not make a difference if you do it with or without a lawyer.

Thanx! Prince and Princess and little princess!
I went for my interview (9:45am)this morning and i passed! ^_^ Im down to the last step now. They said they will notify me within 30 days reagrding sched of the oath taking ceremony.
Here's my detailed experience.
I arrived @ 630 Sansome st, SF at 9am and found City Park Garage (475 Sansome St)walking distance from the Fed building. They will ask for a Photo ID card and appointment letter before they let you in.They'll ask if you have a camera phone (i left mine in the car, less hassle). You have to go through security then proceed to 2nd floor Reception Area. They will take your appointment letter @ the reception desk and will ask you to sit and wait for your name to be called. You have to atleast be there 30 minutes before your sched appointment so u get to familliarize with your surroundings. They called my name @ 9:30am and was ask to sworn in to tell the truth. The interviewer asked me to present needed docs (green card, State ID card, passports~old and new~)She asked me to sign the pictures i sent in and then She asked about all the info i wrote on my application. She asked me 10 questions.
What is the US National Anthem?
What does 13 stripes represent?
How old do u have to be to vote?
What is the rule of law?
Who vetoes bills?
Name one branch of government.
What ocean is on the west side of US?
What is the capital of US?
How many voting members does the House of Rep have?
Name 1 original Colony
I answered them all correctly.:)and then she asked me to read "How many Senators do we have?", and i answered 100.& she goes u dont even have to answer that, then she smiled.(lol) :bonk: and then she asked me to write down "We have one hundred senators."and i did.And then she handed me a piece of paper and said we're all done , do you have any questions?i said none and thank her.^_^ I read the paper she gave me and the sentence where in it says "You passed the english , US history and government test" was checked. And also "Congratulations! your application has been sent for approval. If Final approval is granted you will be sent a notification where to appear for Oath Ceremony " was checked.
* Since Sf has the most number of Citizenship applicants they dont do same day oath, and FYI future Oath Ceremonies from March till Aug 2010 will be conducted at Paramount Theatre (2025 Broadway, Oakland CA).I hope my detailed experience helps.Good luck everyone!Phew, now i can change my audio cd reviewer that ive been playing in the car for a month. :D

US Citizenship General DiscussionCan i do private Oath Taking done by Magistrate Judge?

I don't think that will work, but if it does, let me know.

I personally would love to take my oath in the courthouse of the city I live in, instead of having to sit with a bunch of weird people in a big hall, waiting perhaps all day. Call it the Cadillac Plan of citizenship oaths, and I'd love to sign up for it.

(Even better would be if I could sign a form, have it notarized at the courthouse here in town and mail it in.)

USCIS only allows an approved US citizen applicant to be sworn in with a presence of a Judge and a USCIS officer.I already received my oath sched which is 26th of this month so i wont bother.(it's a wednesday, so i dont have to switch sched w/ my coworker)I'll just save the judge the hassle and just ask her to marry me and my fiance when he comes here within that 90 day period.Posted Image

no offense Sand, its just that its so hard for me to get off of work during weekdays, plus the fact that its now held in Oakland.(it used to be held in SF before)and also, if it will save me time to get it done ASAP i would do it, coz it would mean less time for me to wait so i can file my I129f for my fiance. If it cannot be done, i would gladly join all my fellow new U.S. citizens during the ceremony. ;)

US Citizenship General DiscussionCan i do private Oath Taking done by Magistrate Judge?

I would call USCIS and ask. We tried to have a federal judge do it (as my husband was changing his name and thus needed to go before a judge), but USCIS told me that the judge cannot actually administer the oath. The judge is there to change the name and a USCIS representative has to administer the oath. So, we had to wait for a scheduled naturalization ceremony. But, cases may vary and it is worth asking.

Thanks so much for the insight!^_^

K-3 Spouse Visa Process & ProceduresConsummated Marriage
Thank you! I just read the definitions and it is very clear. It only applies if I wasn't physically present at the civil marriage. Thank you all for your advices and information. I believe we will go with our original plans and don't need to meet with the INS officer to ask this questions just like some of you think I shouldn't do. I don't see a need.

I will start the process in December after I get married in Venezuela. After she gets her I-130 Application approved and has her interview, we will set a date for our church wedding =)...

Once again, thank you all. I am glad I joined this forum. I am sure it will be useful during my process.

K-3 Spouse Visa Process & ProceduresConsummated Marriage
QUOTE (INA 101(35))
(35) The term "spouse", "wife", or "husband" does not include a spouse, wife, or husband by reason of any marriage ceremony where the contracting parties thereto are not physically present in the presence of each other, unless the marriage shall have been consummated./quote]

If you were both present at the ceremony, you're considered married for immigration purposes, regardless of whether the marriage has been consummated.

Thank You! I hope you are right. You do make a strong statement (convincing). All doubts will be cleared on August 4 when I meet an INS oficer.

Can someone send me a link to INS norms/laws (Section for marriage purposes). That would really help me too. I know you listed the INA 101(35)...Where can I find this information?

K-3 Spouse Visa Process & ProceduresConsummated Marriage
Thank you for the different responses. I have been getting both in other places too.

Here is my situation:

I am here in the States and she is in Venezuela. We "WERE" planning in having two weedings in Venezuela.

The first for LEGAL purposes for her to process her I-130 and K-3 Visa. We would have NO sex after this ceremony. I will be returning to the United States after the ceremony.

Once approved and granted, we would have had our second wedding ceremony by CHURCH. This time we will be seing each other as husband and wife. In other words, the marriage will consummated after the second ceremony.

And I am confused by the sentence stating that I SHOULD NOT APPLY IF "you and your spouse were not both physically present at the marriage ceremony, AND the marriage was not consummated."

Does it mean that both of us must be present AND consummated the marriage before applying? Or by being present at our first wedding is enough? In other words, will INS accept our first wedding ceremony even if don't have sex?

WE ARE NOT WILLING TO LIE. So lying is not an option for us. Does this mean we have to get married in the States (K-1 Visa) or wait apart from each other after we get married until her K-3 Visa is approved?

I have an appointment at my local INS office in August. I will be asking them this question because the phone representatives have not being able to answer this for me. I appreciate your responces and replies.

K-3 Spouse Visa Process & ProceduresConsummated Marriage
Who May not file this Form I-130?
4. A husband or wife, if you and your spouse were not both physically present at the marriage ceremony, and the marriage was not consummated.

I plan to go through civil marriage in December 2008 and then have the church wedding after my Spouse receives the approval of I-130. We will not have sexual relations before the church wedding.

Will INS accept the application? Will INS recognized our marriage legal if we don't have sexual relations, or consummate the marriage?

I will be physically present at the civil marriage. Will that be enough? Or does INS require us to consummate the marriage (have sex) too?

I would appreciate your answers.
