Did you send any joint bank account statemets, joint bills, joint health insurance, etc.? USCIS seem to like that kinda stuff the best. Pictures of trips are cool, but people normaly use them as secondary evidence.

Now my references may also be in trouble as well, since my wife told the immigration officer that she doesn't know about the references."

The I-751 was denied in July, My divorce has gone through (Set) and I have hired a very experienced immigration lawyer (July). (I have been sent the NTA,after my 2nd marriage) I had to move on with my life since my ex-wife had already been showing some symptoms of craziness. However I have gone ahead and married (Oct) my gf of almost 2yrs, who is also a student here and she is 4 months pregnant with my child. We hope to go to the immigration court early next year. We have applied for a new AOS and the lawyer is very experienced. I'm glad I don't have any criminal history. My major fear is that one of my previous references wanted to get with me after she sent in the affidavit and I refused. I'm still going to school and I'm in the middle of my phd program. It has been quite tough for me, emotionally but I'm glad I'm able to put all the nightmares of my former wife before me and I can move forward.

Do I still have a chance of remaining in the country and keeping up with my life?

You DO NOT have to be married to remove conditions, all you need to do is prove the marriage was in good faith and not solely for immigration purposes. There is no requirement to have a viable marriage at the removal of conditions stage. You don't even need to read statutes and cases to figure that one out - it's enough to read the I-751 instructions.


Once you divorce your wife who is the original petitioner, you will be automatically denied and your status will be terminated as of the day of your 2nd anniversary of receiving conditional permanent residency. My case is similar to yours and I'm presently in removal proceedings now. My crazy ex-spouse went ahead and withdrew the I-751 I spent time and money filing. Now I'm getting letters from immigration. I'm still worried even though I have remarried and I am expecting a baby soon. Its hard now since I don't have a status, so I cant work. They need to change that rule. Its not the best.

The OP filed a waiver. Until the decision is made on her case, she will still be an LPR. In your case you filed a joint I-751, got divorced, and your spouse withdrew the joint petition and overall was being difficult. Hence the removal proceedings. The OP's spouse has nothing to do with her I-751 cause it was a waiver in the first place, so her status won't be terminated until the USCIS makes a decision on her case. It can take a while, but she won't be out of status.

Yes, they can deny you. If they deny you, the case would go before the Immigration Judge, and then the USCIS would have to prove you entered your marriage solely for the purposes of obtaining a green card. If your spouse has letters from you where you confess you never loved him and only wanted to marry for a green card or if he has your letters/emails to your friends and relatives where you talk about the same thing, or any other solid evidence of fraud, USCIS will definitely succeed. Otherwise, if you have some good evidence of the opposite - that you entered the marriage in good faith, the USCIS might have a hard time proving fraud.

You will have a hard time staying if you have a criminal record, even if your marriage was bona fide.

Also, keep in mind - USCIS can process your case for as long as they wish just to drag it out or for whatever reason. It's also good to have a lawyer even with a straightforward waiver case, I hope you have one. Good luck smile.gif

Not true, As I wrote I was reading a LOT of posts in the Removing Condition forums and you can see that for everybody the case number in the NOA1 was different from the Biometrics notice (and the number in the NOA1 didn't work online to check the status just the number in the biometrics)

I did not show up to the interview because I did not receive any letter in my mail. My lawyer receives all the letters regarding my case, but did not inform me about any interview. Sorry you're going through this. I know this is very hard...

My personal opinion is that lawyers just waste your time and money and don't help. A few immigration lawyers I talked to were plain incompetent and had no clue what they were doing. I-751 is a simple form, it's the evidence you need to put together that makes it hard. A lawyer won't create or gather evidence for you - you'll still have to do the work. The lawyer will put the package together and mail it out, and then, if you get an interview, the lawyer would be sitting next to you, making sure the USCIS officer is doing his or her job. That might be helpful. My personal issue is that I'd rather take the risk but save my money. You can try to get legal help from a local charity (battered women shelters often have an immigration program), but since they refer you to pro bono lawyers, it takes months before your case can be filed with USCIS.

You can file your waiver now without a lawyer.

Police report narratives that I had and restrainig order declarations were very helpful as far as dates and events, but the rest I had to try to remember. It's not too late for you to start writing about it.

I wouldn't expect to get any "touches" - they seem to be meaningless anyways. Just wait for things to show up in the mail. My case was approved 2 months after I did the biometrics, but I still think it was exceptionally fast, and I was prepared to wait at least a year for a decision.

Hi, fellow vj-ers!

I haven't posted in a while, but now that my immigration saga is over I felt like sharing a thing or two with you - I'm sure there are people here who can benefit from what I have learned.

Long story short - my marriage is over. It almost cost me my life, so the fact that it's over is a good thing.

For those of you who don't know me, here's the background:

Came to the US in 2005 as a student (F-1 status). Met the ex the same year. Married Jan 06, filed AOS in Sep 06, interviewed Jan 07, conditional GC approved 1/4/07. Separated March 08, divorced Nov 08. Divorce took forever - I had to do it myself without a lawyer and I had a hard time getting the paperwork right. I filed my I-751 waiver in October 08, when I wasn't yet divorced, and I checked box "e" - battered and subject to extreme cruelty. This kind of waiver you can file if you are still married and living together, separated or divorced - it doesn't matter. Here's my timeline:

10/14/08 - mailed I-751 abuse waiver to CSC
10/16/08 - package received at CSC
10/17/08 - check cashed
10/23/08 - extension letter in the mail (NOA date - 10/16/08)
11/22/08 - biometrics (I got a bio notice about a week before, can't recall the date)
11/24/08 - touched
11/25/08 - touched
1/29/09 - approved. Card production ordered.

That was it. No interview. If someone's interested in my evidence list, I can post it if I find it on my computer. I had about 700 pages - bona fide marriage and abuse, all over a 2.5 year period. I had things like restraining orders, police reports, shelter records, ex's numerous emails with threats and name calling, letters from 3 therapists that I saw during this nightmare of a marriage etc.

One thing you should remember - do not stay in an abusive relationship. Your life will be a lot better once you get out and start anew.

NVC will contact you via mail once your PD is about to go current.They will also notify your petitioner and then send u a letter via mail regarding choice of agent.Instructions will be sent to your choice of agent and then IV and AOS fee needs to be paid in order to process your case.Your DS230 will come later (usually after all fees are paid )when they'll ask you to submit required docs (police clearance, nbi clearance, bc, etc)

As soon as we received the letter from the NVC with the case number I count a week for the US embasssy to got the case, and after a wk I called them for the schedule of appointment. They asked me the case number from the NVC letter and they told me that they already have the case. At first call they turned me down, because they are looking for the letter of instructions from their office, but VJ members advised me to call again and tell them that I already got the letter, which I did, and they allow me to schedule my interview. Goodluck to you!

Well.....last week I tracked the batch that left last Wed and it arrived in Manila on Monday.....actually it arrived Sat..but was delivered on Mon. The batch that was scheduled to leave on Mar 16, actually left on Mar 17. DHL list only that shipping info was received on Mar 16....but the 30 lb package was picked up on Mar 17....it's now in DHL central in Ohio. Chazzie, how did you find out that your petition had been sent to Manila from NVC? I received an Approval Notice saying Valid from 11/18/2010 to 03/17/2011.

Hi!I called NVC and asked when they forwarded the packet to USEM manila consulate, then after that, i called USEM manila almost everyday to check if actual packet has arrived.Some Vjers told me to wait about 2 weeks but i kept on calling everyday until it was received on the 12th day after NVC forwarded it.my advice, keep calling everyday.:thumbs:
Its Dex interview today as we speak.:) Hes already inside manila embassy accdg to my mom n dad (inlaws) so I'll keep u guys updated.:thumbs:

HI!:dance: Did ur fiance ever received notification from USEM manila that he's now eligible to sched?My fiance hasnt received it yet but i called and confirmed for the arrival of actual packet.Make sure they have the actual physical packet of your case prior your fiance's appointment.Good luck!My fiance is sched on the Dec 1st!yay :blush:

Thank you!When i called and sched yesterday only Dec 1st until Dec 9 are open.No available slots yet after that.Usually they'll open it up a week before your target date.Good luck!:blush:

Do you need the USEM Notification Letter to be admitted into the Embassy to go toyour interview ?


I dont think so.You are only bringing required documents and thats not one of them.But lets ask other people here what they think.:unsure:

thanks Tahoma, Chazzie and BB. if it wasn't for the fact that i want my son's school to give him an early finals (either end of January or Early February), i'd have them here in time for christmas. but of course, with the whole process...i kinda went through my savings and will need a little bit more time to save up for the $2K for their tickets. so i'll have to settle for mid February. but it's ok...it'll be in time for my youngest son's 5th bday in March!

Chaz...wag ka ma-discourage. you'll get your interview soon rin! i'll cross my fingers for you and BB to get your interview scheduled soon.

i know waiting is sheer hell. but you're already in the last few steps of the process. at least your file is already at the embassy. unlike the rest of us with the same visa types and waiting for NVC to schedule our interview, you can actually keep calling them and have a chance of getting an interview scheduled as opposed to us waiting for an agency to schedule it for us.
