English is so ambiguous. The word "met" in English might meet the very first time you were introduced and became acquainted, or it might mean any time you were face to face. I can say "I met my older sister last weekend for dinner", even though I've known my sister all my life, and we first met when I was brought home from the hospital. When you read the word "met", you have to look at context to tell which is meant.

The statuatory requirement written into the law is that your most recent face-to-face meeting must have been during the two years prior to filing the petition (with a very few exceptions that are hard to get). The law doesn't say anything about how long ago your very first initial acquaintance may have been.

In Q18, it says "Has your fiancé(e) met and seen you within the two-year period immediately receding the filing of this petition?". That's clearly asking if there has been any face-to-face meeting, not necessarily the initial one. Then it goes on to ask "Describe the circumstances under which you met." In context, this sentence's "met" is referring to the same meeting as the previous sentence's "met". It's all getting at whether you have fulfilled the statuatory requirement. It goes on to ask if you don't believe the statuatory requirement applies to you.

If you feel you must describe the circumstances of your intitial meeting there, go ahead, but that's not what they're really interested in here. Whatever you put there, make it clear so that anyone can understand that you have been together in the same place in each other's presence at some time within the two year time period before sending the petition in. And provide documentary evidence of this in-person meeting within the two year time period before sending the petition. If you describe an in-person meeting that happened many years ago, it doesn't help demonstrate fulfilling this requirement. Failure to demonstrate this is one of the most common reasons for RFEs and denials of K-1 I-129F petitions.

The subject comes up here periodically. At the petition stage for a K-1, you absolutely are required to provide evidence that the two of you have met in person sometime during the two year period before you filed the petition. Beyond that, not much is required. Plenty have reported success with just boarding passes and passport stamps to establish travel to the other's country within the required dates, together with one photograph of the couple together in person.

At the interview stage, you are required to satisfy the officer that the relationship is not a sham solely for the purpose of getting an immigration benefit. The amount and type of evidence required to prove this will vary greatly from one case to another.

It's important to know and understand exactly what you are trying to prove. Submitting lots of call logs at the petition stage doesn't prove you've met in person. Proving you've met in person without establishing the date when the meeting took place doesn't show you've met the statuatory requirement. Submitting evidence at the interview that shows you've been in contact doesn't solidly demonstrate that the motive for the relationship wasn't to get a visa. I've seen lots of sad postings from couples who initially overlooked these points.

FWIW, we went through the K-3/CR-1 process, where the requirements are a teeny bit different from the K-1, but the only relationship evidence we produced during the entire visa process was our marriage certificate. We also went to the interview together, and stood in front of the officer, communicating to one another, which might be taken as a form of evidence. We had many pictures and other things available at the interview, but they weren't asked for, so we didn't show them.

I don't think it's a good idea to bury them in unsolicited evidence. I've seen people report RFE's to the effect of "We submitted 300 pages of evidence and they still gave us an RFE!" -- "Well, where was your dated proof of being together in person during the required time period?" -- "It was right there, plain as day, on the bottom half of the 285th page of evidence!"

I'd recommend submitting just a little bit more than what's needed to clearly and incontrovertibly establish the point you're trying to establish. Think about how easy it would be for a fraudulent couple to fake the evidence. A small amount of difficult-to-fake evidence that clearly establishes the point is ideal.

Yes, that's common, and it's one reason why it's not always wise to bury them in evidence.

For example, sending a love letter in a non-English language without a certified translation is one sure path to an RFE requesting the translation, even though the love letter wasn't required. The rules say that all non-English documents must be accompanied by a certified translation.

They're supposed to read all of the evidence you provide, and they should resolve to their satisfaction any discrepancies or inconsistencies in what they read. So anything that raises a question in their minds may generate an RFE.

Be aware that the timelines do change rapidly and constantly. When we faced that decision, looking at the timelines available, the K-3 definitely looked faster than the K-1. So we married first and filed for the visa. While our paperwork was in the system, the K-3 ground to a dead stop, with no petitions approved for many months. In hindsight, if we had gone the K-1 route, we would have been reunited about four months earlier than it actually took us. We don't regret the decision we made; it was the best one we could have made at the time, but still...

It's unlikely that those events will repeat to that extreme, but it's definitely possible for things to speed up, slow down, and flip-flop while your paperwork is in the system. So if there's a strong concern about where you want to be married, or whether you want to go through the separation as a married couple or as fiancees, and if the timelines don't seem too widely different, then choose the manner in which you want to do this, and let the timeline fall where it will.

Oh, and if DCF is available to you, it probably is the fastest route. It's not available in all countries, and usually, where it's available, it's only available to US Citizens who have some sort of permanent residence or status with the foreign country; a simple tourist stay normally won't qualify you for DCF. But check with the consulate.

There are two meanings to the English word "met". One is "initially encountered", and the other is "encountered". They're concentrating on the latter meaning.

You might have known each other for a few months or for your entire lives, it doesn't matter. The law says that, in order to get a K-1 visa, you must have been together in person face-to-face on at least one occasion sometime within two years immediately before filing the petition. Make it clear to them that you've met this requirement (or if you haven't met this requirement, don't bother filing the I-129F until you schedule a visit to meet the requirement).

Don't worry if your first meeting was a long time ago. It's your most recent meeting that has to be less than two years ago.

This is an offense that should not require a I-601 waiver... Basically this is the portion of the INA that states that you have immigrant intent and therefore they can't let you enter without an immigrant visa.

But your trips to the US are done until you get the K-1 or Immigrant Visa...


Yep, exactly correct. You can look up the relevant paragraph of the INA in the "laws and regulations" section of the uscis.gov site. I've extracted some text here:

Immigrants.-

(i) In general.-Except as otherwise specifically provided in this Act, any immigrant at the time of application for admission-


(I) who is not in possession of a valid unexpired immigrant visa, reentry permit, border crossing identification card, or other valid entry document required by this Act, and a valid unexpired passport, or other suitable travel document, or document of identity and nationality if such document is required under the regulations issued by the Attorney General under section 211(a) , or


They called you an immigrant because you didn't prove yourself to be a non-immigrant. And being an immigrant, you were supposed to have an immigrant visa, but you didn't.

This is a very common situation, and it's a non-event as far as getting and using a K-1 visa. You must not conceal it, hide it, or lie about it when asked, but as long as you're up front about it, it won't cause a problem, and no waiver or other extra paperwork will be required.

If no photocopy of the birth certificate was sent with the original petition, then there's no need to have it at the interview either. The USC's birth certificate is not a required piece of evidence, but if it IS used as evidence of citizenship for the petition, then they might request to verify the source at the interview.

The only reason they want to see source documents at the interview is so they can verify the original raised seal.

It depends on what you sent with the original petition. They may ask for the source of any photocopied document you submitted with the original petition. The USC's birth certificate is not explicitly required, but a birth certificate is one common way of establishing citizenship of the petitioner, so it's often submitted with the petition. (In our case, I know nobody in the entire visa process ever saw the USC's birth certificate, since we used the passport as proof of citizenship).

If you submitted the birth certificate with the petition, it would be safest to have it at the interview. But I don't believe they always ask for it, so if it's too late to send anything, it's too late. Its absence may not be an issue at all, and if it is an issue, it will only be a minor delay, not a catastrophic end to the process. The worst thing that will happen is that they'll delay issuing the visa until they see the birth certificate.

Note that the item you've quoted only says the passport has to have been issued with a validity of at least five years, that is, its expiration date must be at least five years after its issue date. It doesn't say the passport validity must extend five years beyond the current date. Note that the I-129F instructions say that the passport must be unexpired, and must have been issued with a validity of five years. There wouldn't be much point in insisting that it be unexpired if the phrase "issued with validity of at least five years" meant that the passport expiration date must be at least five years into the future.

Most passports issued to adult US citizens have a validity of ten years. Passports issued to minor US citizens typically have a validity of five years.

The legal requirement isn't to show that the relationship is ongoing, but to show that the relationship is not for the purpose of evading immigration law. Thus, lots of evidence that shows you communicate isn't necessarily helpful. Evidence should show there's a reason other than the visa for your engagement and marriage-to-be.

They won't approve or deny you based on whether you were a student or unemployed. This isn't a professional or work visa, nor is it a resume for a potential employer. You don't have to demonstrate a good work history, and you don't gain any extra points by putting a spin on it to make it look better than it actually is. Be accurate and not misleading about your work history, because presenting something that is lying, misleading, fraudulent, or omission of a relevant fact is the big thing that could get you in trouble in ANY immigration form you fill out. As long as you avoid getting in trouble for being misleading, you should be fine.

Having said that, if you were studying full-time, I'd probably say "student" more accurately describes your situation than "unemployed".

If submitting to the USCIS with an original petition, you're governed by the USCIS rules, which say that anyone can do the translation. Notarization is not required. The person doing the translation has to self-certify that he/she has the required language ability and that the translation is true and correct. See the USCIS general tips page, which can be found by going to their forms/fees page, clicking on the general directions link, and then clicking on the general tips page. If you're lucky and my html works, you may be able to get their by clicking this link (I personally translated a birth certificate for our own petition, and all went well.)

If submitting a translation to a consulate for an interview, different rules will apply. Most consulates won't require tranlations of documents in either English or the official language of the host country where the consulate is located. In those rare circumstances where a translation IS required, you'll have to contact the consulate for their rules, because they vary widely. Depending on the consulate, notarization may be needed, or they may want you to hire someone from an approved list, or someone with certain qualifications.

Has everyone received an email or online update after turning in an RFE?

We mailed our RFE from England and used International Signed For (big joke!). I believe it was delivered as we check USPS' site, but it said the 98677 Laguna Niguel Zip instead of 98607 where the PO Box is...Then on top of that, it as received on the 10th at around 3:30pm...it's been a couple days (I know, only a couple of days...but it seems they have done it no problem in the past!)....there mail room must not be aware of those Christmas bonuses or something...the rest of the departments caught up and were working but the mail room seems to be dragging....or they need more employees!

I just can't wait till our petition finally leaves California and we can deal with some more compitant people (even if only by a little....)

Sorry for my complaining, and yes I know there are probably other threads like this or maybe other people have been sitting longer waiting for ANY RFE response...which should just make everything more irritating as some people have been waiting what seems like forever! and still nothing has happened.....

The CSC is so mismanaged and random in their timing. My original I-129F sat for over three weeks before they opened the envelope and began the process. Others that arrived at the same time were opened within days. Same for the RFE. Most June petitioners received theirs in July/August. Mine was late September. And then the CSC received our RFE on September 26, just when others were being approved in a couple of days. I'm still waiting. I can't wait to get my NOA2 and then have a new aggravation to deal with! :lol:

I was going to agree with the OP that perhaps as CSC is now getting some approvals from August/September in under 90 days their focus may have been directed elsewhere. And that would be understandable - if there wasn't people still waiting from March, April, May and June. But they can't (shouldn't) just throw all the pending files in a box to work on something else.

We all pay our $170 which is supposed to cover all USCIS costs so they don't need additional funding (apart from backlogs). But any backlog initiative from 2001 would not have been targetting IMBRA backlogs.

As usual $$$ rule the world! I still think it's wrong that an employer can pay the premium processing fee but a fiance can't.

I know Kitkat and Kristen are well informed, but God I hope they're wrong! The thought of anymore delays is just too depressing.


We have received touches this week but no NOA2. I can easily believe the issue of fiscal year end and reduced funding - very typical of government. We were told in our RFE receipt email that preliminary processing was done so less time than usual will be needed to approval. Since then, four more touches over two weeks and still waiting. The unpredictable and unfair treatment is tough on the nerves. Managing a workoad in a first come first served situation is really not that hard.

I decided to call USCIS about my RFE they received over 2 weeks ago. The person on the phone, Officer Cluff said the computer shows my petition was approved on the 10th but it hasn't sent out the notification yet! She said she note it since I called to see if it doesn't send out the approval emails within the next couple of days, she will do an inquiry - something about a glitch in their notification system!

I still haven't received emails or online status change but looks like we're moving too. We are very, very happy now!!! :dance: :dance:

How come the average processing time for CSC is moving up so much so quickly? It went from 104 to 118 in only a few days. I'm getting ready to send my petition on fri., but watching the processing time go up the way it is, is making me SICK... Matt


Actually the spike does not affect you Matt. The reason for the spike is simple... IMBRA and RFE

For more than three months, from March into June, no processing of applications could occur as the USCIS required months and months to create a one page form asking three questions as required by the IMBRA law. As they sweated and struggled with this challenging problem, nothing happened. Once the new questions were finalized, the new I-129F form and RFE form were released and processing could resume.

From what I can see, the petitions that were sent in starting in July with the new form are moving faster than the average and the backlog of older petitions (March through June) is almost cleared. While there are no guarantees when dealing with the CSC, I would bet that your procesing time will be well below the spiked average you see today.

It is nice news. We have the same NOA-2 date, october 11 and USCIS online status still shows not approved too.

How did you get the information from NVC?


I called their hotline at 603-334-0700. Didn't have to wait long. The person asked me for the USCIS receipt number, my address, both our names and birthdates. Then she gave me the NVC tracking number and date sent to the embassy. The letter with that info should arrive in a few days.

I was also told you can email a request for status to nvcinquiry@state.gov.

Calling was very painless. Good luck!!

This is good news, I hope, for a lot of us.

Yesterday, the NOA2 letter arrived in the mail with Notice Date of October 11. Today the NVC confirmed that the application arrived and was forwarded to the Manila embassy on October 18. We now have a NVC Case Tracking number as well.

Strangely, the USCIS online status still shows not approved and their Customer Service supervisor told me that they don't have a procedure to contact CSC to correct this error. Oh what a relief to be finished with the CSC! :P

Perhaps the delays in forwarding petitions from CSC to NVC have been resolved for a while. Just sharing some good news with you all as this website has been the ONLY place we have ever been able to get helpful information on what is happening in the Visa process.

Calling the USCIS 800 line is a waste of time. You will talk to a live person who cannot tell you anything and who cannot communicate with CSC to check on a question.

The best way to check up on your own situation is to register on the USCIS website so you can see your petition online. USCIS Online

Once there, you can choose to receive email notifications on actions to your petitions. However, you cannot depend on their email system as it is unreliable. You need to log in at the end of each day and check the "last updated" date. Every time that date changes is a "touch". Many times you will be touched but not get an email. It is still helpful to see when they are working on your petition. Those touches get very exciting after you haven't been touched for a while! :lol:

And of course, be ready for a NOA2 in the mail because it can also arrive without warning at any time. So that gives you two things to check each day.

Their systems and procedures are so poor! But USCIS will tell you that a paper document is the most reliable source of information. You are definitely approved and should just save both letters. I assume the Approval Date you mentioned is based on the Notice Date on the I-797 form. Does the date range shown under the words Approval Notice begin the day before the Notice Date on both your Approval letters?

The main thing that matters at this point is the date in which your petition arrives at the embassy in Manila so you can get in line for the interview. If you try to find out what has actually happened to your petition or which is the actual approval date from USCIS, you will get no help from them. I spoke to an agent and a supervisor and got nowhere. They will just tell you to wait to hear from NVC and ask them.

Keep checking with NVC if they have seen it yet and maybe they can tell you which approval date is shown. It can get there fast so hopefully yours will arrive very soon.

We Get Touched yesterday Get Email From USCIS And I Attached Here Below The Contents of Email And On My Profilio And Today They Send Back The RFE Notice They Send From Last Month!!! We Got Update Yesterday And Send Us Email Saying:

It's helpful that you showed the contents of your email because it is clearly not a duplicate of their original RFE email notification. You are saying they sent you this one AND the RFE notification right? It MAY be that in your RFE response, they need something more from you. There may be a RFE letter on its way to you.

Just watch your mail and expect RFE or NOA2. If it is a RFE, read it several times. Don't rush and double check to make sure you have provided everything they ask for.

You never know for sure with CSC, but it seems very likely that this is just a system error and not a new RFE. In the past couple of weeks, their notification systems have been very unreliable and so your paper documents are your only solid information. Our petition was approved the week before last and we still haven't been notified by email, the online status is not approved either, BUT we received the NOA2 letter and a letter from NVC saying that they received our petition. Many others also didn't get emails. In your case, there's a repeat of an earlier email and this has also happened.

Those recent touches are a very good sign (they still SEEM to still mean something!) but you may need to wait a week and see if a NOA2 appears in the mail. As always, be patient and don't expect the USCIS to be able to help you when errors like this occur. Paper is everything so be happy that your RFE letter has FOR SURE been received and so your NOA2 will be coming. With some luck, coming soon!!

OMG!!! Its about G-D time!!

You guys have been the poster child of getting shafted in this unfair process. We're very very happy that you are finally getting free of the CSC black hole.

Call the NVC at 603-334-0700 first thing in the morning and choose option 5 to speak to a person. You MUST speak to a live human! Maybe you will be luckier in the next step!
