I'm still stoked about getting my NOA2 today, but something occured to me. My fiance' is here with me in America right now, his return ticket is for January 7th, 2007. Does he have to go home right away or can he stay? I searched the forums but can't find a related question. Anyone know? [Man, I hope he can stay for Christmas & New Year but I suppose if it would endanger the rest of the process, we could take the momentary disappointment] Any help appreciated :) Thanks loads! [still doing the happy dance!!!]



You'll probably be ok. You still have to get everything to NVC and that seems to take 1-4 weeks, and then it has to go from NVC to the consulate.

When you guys filled in your timelines did you put the actual date of the NOA1/NOA2 or the date you recieved it in the mail? The actual date of my NOA1 is 11/24 but I got it in the mail on 11/30, so I put 11/30 in but I'm wondering if I should put the actual date in instead.

This seems to be about the worst week for approvals since I've been here - or perhaps it's just my expectation of being close to an approval!

I haven't posted before but I could not keep this news to myself....I received an
e-mail today saying that we were approved!!! I am sooooo excited!!! Happy New Year!

I know that the next step is the NVC and then on to the embassy. My question is what exactly is in the packets 3 and 4? I want to start gathering stuff now and I can't seem to find this information. I know that I have to get the AOS ready and send that to my fiance, is there anything else? Thanks in advance for your help. And to anyone else out there waiting for their NOA 2....I am praying for you, its a WONDERFUL feeling to see that in your in box!


The AOS isn't gotten ready yet, maybe you're thinking of the I-134.

my situation is this, i recieved my NOA2 on dec. 21st 2006. i have been calling the NVC all week and they tell me they have not recieved my petition yet. Today i called the USCIS california service center and the late (rude) told me that it is still in there building and i should allow them about 3-5 more weeks before they send it out to the NVC. Its due to the holidays. Is anybody else experienceing this same situation because they recieved a NOA2 right before the holidays.

Last night my fiancee and I were discussing her upcoming medical appointment (Tues, 6 Feb) - and when to send the checklist back in - and of course we were second guessing when the interview might be. Knowing her consulate isn't very backlogged she was hoping for Feb 27 or 28, and I said, NO, Feb 21 when I meant Feb 20.....

But, this morning the consulate called her, asked her if she had an appointment yet, to which she responded her medical was on Tuesday, and the consulate's reply was to schedule the interview for Tues 20 Feb !!!!! Almost there !!!! :dance: :dance: :dance: :dance: :dance:

At this point it hardly seems the wait was that long, been 5 months since I dropped the petition in the mail box -

Hi and again, welcome to VJ - you're shedding much light on this "dark" process many of us have undertaken.

I do have a quick question: I was ill advised by a mutual acquaintance claiming to know the K1 process very well, to file an I824 - APPLICATION FOR ACTION ON AN APPROVED APPLICATION OR PETITION with my I129F for the K1 visa, with the notation to Cable Notify the consulate. Well that never happened. Of course my $200 was gratiously accepted.

Now what? I'm curious to ask for my money back. Nothing was ever done on the I824. Currently the online status of the I824 is the same showing the Sep 29th day received, but the update date has changed a few times, once on Jan 31, then on Feb 20 - the day the visa was approved at the interview, and again on Feb 21.

A bit of background info regarding the money/check cashing issue.

All petitions come into a centralized mail room at the NSC. Any monies attached to the petitions is immediately separated and locked away into the vault or repository where they keep the funds until a Brinks truck arrives at some point during the day. The mail room is a “secure” area and not accessible unless you work there (badge in and out etc..).

So, in case you are wondering, the adjudicator (or other staff) never handles any money. Once the application arrives in the mail room and the funds are removed, it goes to a central receiving/processing area where it is keyed/entered into the CIS system by contractor staff, placed into an A-File, assigned an A-number and corresponding bar code and placed on the shelf in the centralized storage area to await further processing. That’s why similar dates stay together because they are in-processed at the same time. Boxes of applications are withdrawn from storage on a first in first out basis, always working from oldest to newest.

The reason why it seems the checks are cashed before the petition is touched is because CIS deposits the checks and monies before a application is ever ready to be worked.

I hope that help to explain that.

While I get the point of what you posted - I still see that the so-called fraud route is not quite blatantly refused or penalized. What I mean is you can deceptively get in the US, apply for adjustment of status, stay here, and potentially get approved, thereby forego the arduous waiting that those of us do who are correctly following procedures of the K1 visa. Yes, you can potentially get denied and deported, but is it that risky? I don't know. And I'm not advocating that. It's just frustrating to see us wait and petition and follow the rules while others can shortcut that route another way.

What your acquaintance did could be found to be "wrong". She entered the US on a non-immigrant status with the intent to immigrate. Whether that is fraud, illegal or a material misrepresentation I can't say. What happens next, or inthe future for them depends very much on what exactly happened at the border/inspection, and IF it will be brought up in their AOS interview. Sometime, it doesn't work out.
A very high percentage of AOS cases are adjustments from other than a K visa.

Coming to the US to get married is not illegal. People do it every day. The issue is always about the intent to stay and adjust status.
You will sleep well at night for the rest of your lives. Their case is their case.


I certainly agree it's better to do the right thing. And I have no dispute with it being deceptive coming here with the intent to marry and stay -

but what's the law say? I'm not questioning all the responses on VJ about the fraud issue, I'm just curious what the INA says in writing on it.

It is not illegal, nor fraud to enter the US with intent to marry.



So I hear this both ways, it's fraud, it's not fraud - what does the law say?

I'm really curious because I know of another couple, an acquaintance of my fiancee, where the non-USC came here on a visitor's visa fully with the intent to stay and get married, and did, and is now merrily getting her work permit, advance parole, and interview for green card while we're waiting patiently for the K1 - so much for doing it the right way. What's the legal on all this?

Nope, doesn't say notarized here on the I-134 instructions. Why make it more complicated? Ya think sending a notarized copy when they don't ask for one could raise a red flag? Who knows, why bother?
