K-1 Fiance(e) Visa Process & Proceduresand Photos...

Hi Bruce,

I asked this same question when we were organizing our package. What was recommended to me was this ... though this would make sense to you and me and most other people here, you have to assume that the person examining your petition needs to be spoon fed, and as such, will not see multiple pictures printed on letter size paper as fitting their criteria. Wanting to play it safe as much as possible, I simply got prints made from K-mart (honestly though - they would have looked better had I printed them at home ). Part of the 'evidence' portion of our petition was a list of every photo included. The list was numbered, dated and included brief descriptions which tied in to our answer for Q.18. Then we numbered, dated and titled the back of each photo, put all the photos into a labelled ziplock bag and, of course, attached the bag to a blank page. It was the last page of the entire packet.

Just walk the person /reader through your packet and evidence, and as Andy said, make sure to include some primary evidence which ideally, should tie in to your photos.

Good luck!

Mo

Hi Mo,
Yeah I agree about thinking through their eyes, grrr. So after printing all - I also have a backup of CVS printed prints for individual pictures. Now how did you list them, where? Oh, a separate sheet listing them out? I like the numbering idea!

Mine were digital also, I had them reprinted at Longs for 19 cents a print and just wrote on the back who where when. You should look at the USCIS website under "general guide to assembling package" I believe they address how they like things labeled and assembled. Good luck.

Thanks, but they don't mention photos on that page.

I have exclusively digital photos with no dates (can't stand them messing up a picture) - in various recommendations I've seen most mention of having the photos printed and putting the info on the back. Sure I've done that. However, what's wrong with color laser printing them, say 2 to a sheet, captioning each photo with who, when and where? On my color laser it looks like a color copy you get at the local office supply store. That way the pics are not loose, but organized and part of the package fastened together.

thoughts?

Sadly, I agree. I also agree that you may well need a lawyer. But that can be expensive. Before you do that, find someone you know and respect. Someone who is intelligent, and is the most detail oriented person you know. Someone like a dentist, and engineer, an accountant. Ask them to go over your entire file - application, letters to and from USCIS. See what they have to say. It seems that you do not have a knack for detail, completeness and clear communication. That's OK. Many good people are like that. But if it your weakness, it puts you at a severe disadvantage in this process. Find someone who has it as a strength, and get their help.

Good luck in sorting out this mess.

Tom

Gee, thanks for the compliment, being a dentist

This thread is very puzzling and vague and questionable about the seriousness, and not to offend anyone could be just looking for reaction. my 2 cents

K-1 Fiance(e) Visa Process & ProceduresURGENT ADVICE PLEASE!
Funny, I posed this question last Sunday, as I was wrapping up my package to send out. I had made copies of half a dozen credit card statements, having blacked out account numbers and balance amounts, and putting post its over the bulk of my charges before copying.

I woke up that morning looked at these copies and began to wonder if it was too much of a red flag "hiding" all this stuff. During the day I downloaded my online account statements for most of the months and reprinted them.

After talking to my fiance I went with sending the non-blanked out statements - my viewpoint: who cares what they see. My account numbers were x'd out on the online statements anyhow. Besides, thay have my SSN!

brucejg,

It has nothing to do with when you filed. It has everything to do with having filled out the IMBRA questions. As has been revealed, there is no available option for "no or N/A".

Poorly designed form? Absolutely.

Gee, can't get a more unequivocal answer than that!

I think the two who answered leave it blank are recently filers, while the two who said not to leave it blank filed long ago. I too had the same question after mailing my package away a week ago. I've been wondering the past few days. But there is no place to answer in the negative, or if it does NA - it's just a check box if one applies. my 2 cents!

William - I guess we agree- when I said it had to do when you filed, I implied using a form that was pre IMBRA and thus those posters wouldn't know what the current IMBRA form questions look like. Definitely a poorly designed form from the standpoint of answering questions.

correct!!!

If you read the instructions, I think that you will find that every questin requires a respose, even if that response is N/A or NONE. Leave it blank and you will most likely receive an RFE.

K-1 Fiance(e) Visa Process & ProceduresA Tricky Question... I need some 'exert' advice

(4) INTERNATIONAL MARRIAGE BROKER.—
(A) IN GENERAL.—The term ‘‘international marriage broker’’ means a corporation, partnership, business, individual, or other legal entity, whether or not organized under any law of the United States, that charges fees for providing dating, matrimonial, matchmaking services, or social referrals between United States citizens or nationals or aliens lawfully admitted to the United States as permanent residents and foreign national clients by providing personal contact information or otherwise facilitating communication between individuals.
[B] EXCEPTIONS.—Such term does not include—
(i) a traditional matchmaking organization of a cultural or religious nature that operates on a nonprofit
basis and otherwise operates in compliance with the laws of the countries in which it operates, including
the laws of the United States; or
(ii) an entity that provides dating services if its principal business is not to provide international dating
services between United States citizens or United States residents and foreign nationals and it charges
comparable rates and offers comparable services to all individuals it serves regardless of the individual’s
gender or country of citizenship

Bill - I had the same questions that I'm sure everyone has had on this. But until I found the legal wording above, I wasn'tn sure. Part B (ii) answered it for me. It specifically is excluding from IMB all freely accessible dating services. The target of IMB is those entities that solely target US residents and foreign nationals and charge based upon that target, ie the US male pays to find a foreign female and she paid nothing. There's a lopsided arrangement, not a free and open one. So your meeting place is covered by the exception.

We've been waiting and wondering since I couldn't track a check as I paid by cashier's check. On Weds my fiancee and I decided it should arrive on Friday - and today, there it was in my mailbox, the NOA1 from CSC.

What's the consensus for the timeline purposes: I submitted to TSC but it went to CSC as expected, so should I use CSC in the timeline? I've already changed it since it makes more sense that way.

K-1 Fiance(e) Visa Process & ProceduresProcessing Times...

How come the average processing time for CSC is moving up so much so quickly? It went from 104 to 118 in only a few days. I'm getting ready to send my petition on fri., but watching the processing time go up the way it is, is making me SICK...

Matt

Unfortunately those times are probably just good guidelines since the randomness of the approvals varies so much. And, correct updating of timelines would help a lot. I just noticed that one of today's NOA2 posters has a discrepancy between their signature NOA1 date and their timeline NOA1 date - it's off by 7 days - that doesn't help with the accuracy of the statistics.
Bruce n JenMale02006-10-19 20:10:00
K-1 Fiance(e) Visa Process & ProceduresTSC via CSC statistical significance?
As a frequent visitor to the K1 forum I couldn't help but wonder about something after seeing the recent NOA2's. It seems TSC filers are statistically seeing quicker approvals than CSC - obviously, as borne out by the VJ timeline statistics.

Currently it shows TSC taking 89 days to NOA2 vs 120 days for CSC. But why is that? CSC handles both. It would seem that the TSC petitions are handled differently/separately at CSC. Or are they? Who knows.

And lets not forget the inherently added time going via TSC. My own NOA1 date is almost 2 weeks after the petition went in the mail. Thoughts? (PS. NSC is similar to TSC although slower)

K-1 Fiance(e) Visa Process & ProceduresI-129F processing statistics
I've been looking at Gary's stats last few weeks, and wondered what "current" processing times might look like if analyzed differently. Specifically I was curious about the Jul and Aug processing times on their own, not added into others. And this is what it looks like...when just considering the approved Jul and Aug NOA1's. This information only includes the approved petitions and using Gary's numbers for the days between NOA1 and NOA2. It certainly looks like on average petitions are being approved faster. I realize this is a crude assessment as there are many outstanding Jul and Aug petitions which can skew this data. But I noticed that most of the outstanding Aug petitions were filed later than the to date approved ones. Therefore, I still think there is some hope that approvals are speeding up on average.

K-1 Fiance(e) Visa Process & ProceduresNew Timelines for CSC/NSC/TSC

Has anyone else put this data into Excel and noticed the recent trends?

From what I can see, over the last 3 months the average number of days has gone down considerably (compared to being over 100...)

Specifically, if you look at NOA1's from July 1 on that have been approved, the average is falling to 70 days and below. I realize this is based only on data from this site and not reflexctive of all applications, but it is still nice to see something improve.

I've attached an image so you can see what I am talking about.

The second thing I have noticed, which goes along with the first is that applications approved are moving faster from week to week. meaning the number of days they "seem" to be approving each week. Over the last few weeks it is as though they are getting through more days (not applications). I read somewhere that maybe they move through some of the easier ones first, and try to get many of those done first. From what I can see they are already starting to look a the first week of September (for easy ones I assume) as I can see approvals from that week happening.

So... I personally hope mine is an easy one, and that the trend is true. I will keep you informed, as if the theory hold we should see this again over the next few weeks (and maybe in 3 weeks I will have an NOA2).

Comments anyone?

I did exactly this last week and posted my findings but no one seemed to notice my post. I found that the Aug filings were significantly faster than Jul by almost 2 weeks.

K-1 Fiance(e) Visa Process & ProceduresCSC/NSC/TSC Timelines are now posted

Here are this weeks timelines. We are almost done with April, May, June, July and Aug. By my count there are 6 left for April, 6 left for May, 5 left for June, 10 left for July and 15 left for Aug.
I really hope that this week sees those left behind getting their NOA2's.

http://garyandluz.com/timeline.html

Enjoy!

Thanks Gary! great work.

I keep noticing the relatively same numbers left for Apr, May, Jun - and it just seems a bit odd to me. Logically I would think there would be less Apr than say Jun - as there is with July vs Aug. So is there some hidden arbitrary thing going on with a few filings each month? Are they pulling aside a few and doing whatever with them, hmm?

K-1 Fiance(e) Visa Process & ProceduresBest Type of Visa

Coming to the U.S. with a tourist visa with the intention of marrying a US citizen, is visa fraud. If a person comes to the U.S. with a tourist visa, then meets and marries a U.S. citizen without any prior intent, that is a different matter.

It is not illegal, nor visa fraud to come to the US to marry on a tourist visa. The issue is only the immigrant intent.

K-1 Fiance(e) Visa Process & ProceduresK-1 Visa - Self Vs. Lawyer assistance

Do I need to use an attorney for filing/processing the K-1 visa for my daughter? I have interviewed couple of immigration lawyers and asked them to explain about their service during this process. All of them had mentioned that they have lot of experience with K-1 visa and they will guide us through the whole process. Is $750 - $2000 is justifiable for this process?

I am new to this web site/group. It seems like this web site has all the detail steps needed for the K-1 visa process. What extra help that a lawyer will provide? Has anyone self filed and then used a lawyer later because they found the process was too tedious? I would like to know your experience and the guidance.

Please give me your firm opinion with some explanation and please don’t tell me that it is up to me to use a lawyer or not.

Thanks,
Kabilan.

Do it yourself. All the info you need is in the guides and tips. Unless you have a complicated situation an attorney is going to do no more or less than fill out the forms, and you can do that yourself.

K-1 Fiance(e) Visa Process & ProceduresTSC, how can I find out....

As you can see from my timeline the Texas Service Center received my I-129 application on November 11. I understand that TSC sends the K1 packet to California Service Center. My check has not cleared, I haven't received my first NOA and it's already been 2 weeks! I've noticed others send theirs to the TSC and it's transfered to CSC and they recieve their NOA1 about a week later. I've also read in other posts that some people mailed in their packets and somehow some Service Centers never recieve them, im just worried that my packet is floating around somewhere and that the CSC never received it. My nerves will rest once I know that the CSC has recieved my packet but until then how can I find out if it's been transfered to the CSC?

Look at my timeline too - my NOA1 date was 2 weeks from mailing and received the receipt a few days later.
