Hi Steph!!!

K-1 Fiance(e) Visa Process & ProceduresPolice certificate

In the Embassy of Brasil there's a request form written to the Federal Police here in Brasil, I thought I had to use this form to make the request.

Hey Laura!!!

You dont need that letter from the consulate at all... I got my certificates without them...
You NEED to go in person to get the police records... I dont know how it works the State records in your state, but im sure you can find the info googling it...
The form to request the federal is here. You just need to fill out and delivery in person at the DPF closest to you...

Hope I helped...

Carol ;)

PS (You need one police state record for EACH state you have lived in for more than 6 months after the age 16!!!)
PS2 (Both of certificates are freeof fees)

K-1 Fiance(e) Visa Process & ProceduresSo, I did it..I mailed my I-129F....

Hi guys! Well, I finally got everything ready, double-checked, and mailed off(I-129 original submission). So, I went to UPS and i asked him if he could overnight my application and get me a return-receipt thing...Well, he said we dont mail to PO Boxes...he said that I would have to go through the Post Office but that he could do it from the UPS store...So, I asked him if he had express + return receipt...he said yes but the Post Office is not guaranteeing any express items...SOO...that means I paid $31 for my package to arrive there on Friday (today is Tuesday)...how did you guys mail yours to arrive the next day???? cuz it didn't work for me.
Sidenote: thanks to everyone who has posted questions/answers on VisaJourney...you don't know it but you have been a huge support system for me. I read and take your advice. Well, we sent more of what they asked for and never got an RFE. I understand its a waste of time for the officer, but not for me, just because there was everything they asked plus some more evidence. No reasons to get an RFE at all. Why would hurt any application just sending in the BC from beneficiary???

To the OP: we sent in with the initial application (I-129f), my birth cert and translation copies. Never got any RFE.

Good luck!

CAM,

Yes, the US government has said what makes a marriage 'legal' - if the marriage is recognized by the government of the place where it was performed, it is recognized by the USA for immigraton purposes.

Yodrak
Hi im the op..... Like I said the U.S. state department defines a spouse as someone who is legally married to another. however the state department does not say what makes a MARRIAGE legal...atleast not that I can find. ......
EXCEPT homosexual marriages. The US is under NO obligations to recognize gay marriages from the Netherlands or Canada which both offer legalized gay marriages.

Well quite a few long time VJ members (me included) and a former immigration officer says don't do it.

"Fools go where wise men fear to tread."

Well thanks again for all who have put their 2 cents in on this matter. we made a decision & decided to postpone the wedding in Brazil until we can go back there with no problems. Ofcourse we're gonna have a legal & religious wedding here in the states first. Unfortunately my mom can't go to Brazil with us so she informed me my wedding wouldn't count unless she could be there for one of them. We figured there are too many possibilities the aos process could go wrong even though this would be a rather trivial issue in my opinion. mdyoung...I really like your quote about fools, it certainly could be applied here in this case...however in other circumstances remember...heroes also go where wise men fear to tread. as well as gamblers. And by the way...Newcastle is going to shred Man U when they play again this year...well probably not but I hope so...Alan Shearer...the toon army misses you!! & appareantly we have a jinx on us because we can't keep our star players healthy (Shay Given, Michael Owen, Keiron Dyer, & the list will just go on I'm sure!)

very good!

This is the reality of the issue, Carol was questioned quite vigourously, she in no means is perfect in english, along with the nevousness that comes with the intimidating attitude of the POE officers at entry! I could not imagine her starting to quote law to them,Its totally unrealistic! The POE officers carry GODLIKE POWERS when it comes to ENTRY if you start an ARGUEMENT with them its just going to make it worse! why dont people understand that.

Your post illustrates just one of the reasons that people are told to make up their own minds about the proper course of action for them. Should problems arise, confident, well informed, charismatic, articulate people who speak English fluently will generally be in a better position to explain their reasoning to the CBP without offending anybody or seeming confrontational. On the other hand, people who are easily intimidated by government officials, don't speak English well, tend to get loud, confrontational, offensive and obnoxious are much more likely to encounter significant problems at the border. Knowing that you are legally entitled to something is not the same as nicely explaining it to a government official who is questioning you and getting that official to side with you.

This forum is not in the position to assess each person's individual situation and personality and to tell people what to do. All we can do is provide objectively accurate and factual information and then have people make up their own minds about the best course of action for them.

Very good articulation! wish I would have said it!

In a perfect world everyone would do their job acording to the law and would follow procedure exactly.... but we do not live in a perfect world... everyone including CBP officers and USCIS staff have their own interpitation of the law and how they do their job.... we as the users of their services are very much subject to how they are feeling (bad day) how they see themselves within their jobs and all outside influences that make them who they are....

Us as immigrants are not in a position to tell them that we know the law and their interpitation is not correct... we turn up at the POE or USCIS meeting and hope to get out the otherside with as little hassle as we can... If they are having a bad day or they take a dislike to you there is very little we can do... this is especially true at POE because if this happens you can find yourself denied entry and on the first flight back from where you came.... you at that point are in no position to argue the law or the procedure...

I think what people here have been trying to say is why have something you feel the need to hide or not mention at POE or AOS interview when there is other ways to achieve the same result....

We all know that if you read the law for immigration it tells you one thing but in practice that is not always what happens in real life.... yes that is wrong and yes it should not happen and yes you should be able to do something about it.... but for most of us there is nothing we can do but just try to get through this journey as quickly as poss with as little hassle as we can... so that we can get on with our new lives...

All the legal statements and processes are not going to help you if you are stood at the POE and they are about to deny you entry.... maybe after the fact you can do something about it but would you really want your SO to have to go through that? I know I would not...

Kezzie

K-1 Fiance(e) Visa Process & Procedureslegally married?

I find the proposition that people are advising against non-legal wedding ceremonies before the K-1 because they're jealous to be pretty ridiculous. Because, you know, this place is just full of chock-full people telling people bad advice so their NOA2 takes longer, 'cause they're jealous.

Advising people not to have a ceremony because of envy, jeolousy is so ridiculous! I cant beleive that was even brought into the mix!

Having a non-binding wedding ceremony could increase the chances that a) someone slips up at the PoE or adjustment of status interviews or B) the couple gets accidentally married because they didn't check the laws for their area. Yes, it could probably all be sorted out in the end if something happens, after thousands of dollars of legal fees, and more likely than not, there will be no problem at all. But it's not just as easy as 'do whatever you want because everyone else is jealous of your wedding party'; make sure you check up on your locale's laws.

I agree totally! Like Yodrak said, If your going to do it BE VERY CAREFUL!

I guess I just don't understand....why do some of y'all want to do this anyway. I mean, the K1 is a fiancé(e) visa, if you want to get married first, then do so and file the K3. Why in god's name would anyone want to take a chance of being denied??? This journey is stressful enough without having to bring this component into it.

*sigh* not being judgmental...just wondering is all.

My sentiments exactly,go through all this and then "ROLL THE DICE" at the finish line! I just don't get it!

If its OKAY!......................................................Then why should They "" BE CAREFUL ""

If I understand correctly, because the officer at the POE has the power to send you back home on the next plane if he suspects fraud. Or that your ceremony MIGHT have been a legal one.

And because it is way harder to prove that you're NOT legally married than THAT you are legally married. :)

You might want to read the whole thread, then you might have a better idea of what is being discussed.

I didnt do it = You shouldnt do it because I say so.

This is what is bothering me! Just because you didnt (and I didnt either!) does not mean that others cannot!! They just have to be aware of the risks, and be careful when going thru POE or AOS.

If its OKAY!......................................................Then why should They "" BE CAREFUL ""

Because, as Yodrak and other people here have mentioned, the CBP at POE or AOS might not understand the situation and it might create problems for the immigrant.

K-1 Fiance(e) Visa Process & Procedureslegally married?

Granted, this just in from the 'misinformation line' but I called them about my RFE, got transferred to CSC and the person I spoke to said that having a cerimony only in the country of your fiance is very normal. She said she's been there for years and to pay no attention to what people post on message boards regarding this matter. I spelled it out quite clearly in my petition and my RFE that we already had wedding photos made, had a cerimony and even a date tentatively planned, and that I had checked and in Thailand, its quite an ordeal for a Thia to marry a foreigner - I even have to get approval from the US Embassy. She told me not to worry one bit, that wat I was doing was quite normal, and if there are any problems with my petition, it won't have anything to do with our planned ceremony in Thailand or our wedding photos. Again, I think my NOA2 is just around the corner, (hopefully) - and we'll see. I was 'assured' what I am planning to do is normal, it happens all the time, and I should have zero worries about it.

Bill

PS I might add that the RFE I received said nothing about any problem with having a religious ceremony in Thailand. I even marked on my credit card statement the place where I purchased 'wedding photos' and explained in the RFE that this was customary to do before the cerimony in Thailand. I expained it would be a ceremonly ONLY and that the legal marriage was planned for when we got to the USA.

The person you talked to on the info line won't be the one greeting you at the POE, ReREAD Yodraks Post! Wait months to be together and take a chance not me! but its your life!

K-1 Fiance(e) Visa Process & Procedureswill USC using public benefits hurt our case?
What about to have emergency health assistance during the K-1 period??? Im the beneficiary and had to go to the ER. Could I have the medicaid take care of it or should I pay it anyway???
On the I-485, part 3, question 2, says:

Have you received public assistance in the United States from any source, including the United States government or anystate, county, city or municipality (other than emergency medical treatment), or are you likely to receive public assistance in the future?

But, at the I-134 that we filled for the interview says:

4. That this affidavit is made by me for the purpose of assuring the United States Government that the person(s) named in
item 3 will not become a public charge in the United States.

5. That I am willing and able to receive, maintain and support the person(s) named in item 3. That I am ready and willing to
deposit a bond, if necessary, to guarantee that such person(s) will not become a public charge during his or her stay in the
United States, or to guarantee that the above named person(s) will maintain his or her nonimmigrant status, if admitted
temporarily and will depart prior to the expiration of his or her authorized stay in the United States.

Im just curious because I heard of a case that the Non-USC used the Medicaid and didnt have problems with the AOS. It was an Emergency case also...

Any other cases about it???

Carol

PS (Im going to pay anyway, I dont want any problems in the future...)
