Hi everyone,

I have a very complicated problem. and i am very anxious about this. I want to know if will it be an issue if you came here on a tourist visa remarried a USC after 2 years of being divorced. A divorce decree was granted yet NO final annulmet yet in the philippines.


My ex husband and i got married in the phillippines. We were both filipino citizen at that time. Yet when he filed the DIVORCE DECREE he was already an american citizen , I remain filipino citizen up to date. DIVORCE was GRANTED here in the USA. My ex-husband shortly after 3 months DIVORCE was granted, petitioned another filipina girl through fiance visa. And they are currently together and married here in the US now with kids.



I filed my annulment case in the Philippines and still in progress. I came here on a tourist visa and got married last june 7, 2009 and now living with my USC husband as we are waiting for the AOS approval. As we file for the AOS,we put the evidence----- AUTHENTICATED DIVORCE DECREE by the consulate General of the Philippines in Hawaii .



My question is:

Since the annulment case is still in progress in the philippines BUT the divorce decree proves the legality of marriage, WILL IT AFFECT OUR AOS PETITION?

Since your ex-husband was the one who filed for divorce, the divorce decree obtained by him legally allows you to remarry without having to file for an annulment in the Philippines on your part. As long as you have the divorce decree, it won't be a problem with the AOS.

Yep, keep it simple. Tell her to answer what is being asked. Consul asked the "What does he do" thing and I told him that he is self employed blah, blah blah. He didn't ask where he lives anyway. But just in case, she doesn't need to recite your exact address. laughing.gif

i dont think visitors visa is possible.. we tried that before when i was still in PI and we were just trying to decide whether to stay in manila or just settle down here in the states but the US embassy said they really dont give tourist visa to american citizen's spouse. :-(.. so sorry bout that.


I agree. Since you are married to an American, there is a presumption that you're gonna stay in the United States and not returning to the Philippines. Little or no chance at all that the US Embassy will give you a visitor's visa unless you can show strong ties to the Philippines.

Mr. Bill and I talked 3 or 4 times a day and sometimes at work he would send email and I would send reply right away. And on wekends like 2 or 3 hours because I don't work on those days. He was very patient waiting for me to go on line on the MSN messanger as if he's been waiting for me all his life. laughing.gif

I hope everything will turn out the way you expect them to be. The name in my green card doesn't match the one in my passport. But it's already taken care of now. I hope I won't have problems going to the Philippines and going back next year. Crossing my fingers.

The pre-screener choose only some letters and photos for the Consul, i was told that if the Consul will ask more proofs of our relationship, ill hand to him what i brought. When done with the pre-screener there were butterflies in my stomach right away but not much. I was a little nervous. Knowing that my co-applicant ahead of me were approved i dont worry much. They said that when all ur papers were complete then there will be no problem and its true, you dont have to worry if u have everything they asked. I waited, at the blue chair, then i saw my number flashed on screen again then i said to myself that THIS IS IT!, I was interviewed by Room 32 as i came in i found an american man seated and waited for me behind the glass. He greeted me Good Morning then i greeted back. He looked at all my documents first then was asked to raise my right hand to swear. Interview begins.

Questions from the Consul:

1. what is ur name?
2. who is ur petitioner?
3. how old are you?
4. how old is ur fiance?
5. how many times did he visits you?
6. how many days he stayed here?
7. when did he arrived in the Phil?
8. what he do for living?
9. what is his work?
10. have u been traveling abroad?

After the Consular interview i heard him say. CONGRATULATIONS! YOUR VISA HAS BEEN APPROVED! WELCOME TO THE UNITEd STATES!. i am sOooo happy that i am approved. I said THANK YOU SIR!. then i left the room. i got PINK SLIP from Window 37 and paying for Air 21. i can't hide my happiness from then on and until now i am still in cloud nine. YahOoooo. Lets Party

Bill and I have only 1 credit card. We're using that one to pay for the gas bills. It's a good thing you managed to cut down your credit cards to 2. You don't need that much anyway. Use cash for your purchases if you can. Hubby bought a used car for me and a used truck for him because we cannot afford a brand new one.

I had become totally at peace with being single, was very happy with my little life here in Mississippi and then all of a sudden, love came knocking at my door. Why would I want to fall in love with someone that lives on the other side of the earth, on purpose?? A long-distance relationship is one of the hardest things I have ever done, totally worth it, but really, really hard. And, I didn't "choose" him because of where he was from, LOVE CHOSE US. It just happened.

And, I'm not really looking for someone for my ex-husband, I love ya'll too much for that! Thanks for making the weekend go by faster, this was fun and entertaining!

It is curious that this thread generates so much "international" scrutiny. Frankly, I have no interest in the other regional specific topics, and spend more of my focus on the off topics, K-1 filers, and the Philippines.

The question becomes, why we can't have a discussion among ourselves, without hurting the feelings of those that really have nothing to contribute to the discussion? Do the other regional areas attract the same bomb throwers? It is a public forum, yes, but why not keep it "regional"?
