Your packet needs to remain sealed. If you opened it, you need to go back to the embassy to get it resealed. They know you don't have that Immigrant Data Summary, becasue your K-1 Visa is a "non-immigrant visa." If you have any questions, just call the CFO.

Use the form explicit in the instructions your wife will receive from the embassy. If you are applying directly to the NVC, use I-864. The I-134 contains a sworn and notorized affidavit. That is the primary difference in the forms.

Yes, things will get better. We are thankful that we are still making it what with the economic problems that the country is facing now. We are indeed lucky to have a very wonderful, caring and loving husband by our side. Somehow it helps us forget about being homesick for a while especially Christmas just around the corner. I had a great career in the Philippines, I have my family and friends and maids, for crying out loud. I was very useful there. I was very good there and never felt alone or miserable. I could eat what I want without cooking or craving for it. I could drive wherever I want to go. And never did I feel helpless and dependent on anyone (except with my maids and staff, of course). It is during these days that I think my husband wanted more of me despite of him not saying anything to that effect. It is during these miserable days that I feel stupid and cannot laugh about it.

It is very difficult to be in and out of the better and bad days. But I need to cope with it, in and out of these days.



Hi Nick of time. I also went through being sad, bored and homesick. I always miss my family during the first few days, weeks after I arrived in California. I even had bad dreams about my family and I always tell my husband I want to go home and that my family needs me. He would always say, "Baby, this is your home now. I am now your family. You can send emails or call your family." I had a stable job in the Philippines, I even took the bar examinations before I flew to California. Unlike you, we didn't have maids. no0pb.gif I didn't have a car and I didn't know how to drive one. But I am enjoying my life like any other single and independent Filipina woman. I can go anywhere I want and I can go home anytime I want. But now, it's really different being married and everything. But the sad part is, I'm a lousy cook. I don't even know how to cook for my husband back then. I felt worthless. But it really takes time. Now, I am still learning how to cook, how to drive my car and eventually getting my driver's license and how to adjust myself to the winter. When my husband leaves for work, I just stay home and watch TV, sit in front of the computer and I would get bored. Now I got a job at a major retail store here just to keep me busy for the mean time. What I want is to go back to school and take paralegal classes. I'm saving money right now because it cost too much going to school here in California. But it takes time. I am not in a hurry. I've been only here for more than a year anyway. Always remember home is where the heart is. As long as you are happy with the love of your life, it makes no difference at all whether you feel bad or bored or whether it's bad or better days. yes.gif

I am assuming you are using a PC.

When you get the screen you want, press the "Print Scrn" key.

Click on "Start", then "All Programs", then "Accessories".

Find "Paint", and click on that.

When Paint opens, click on "Edit", then "Paste".

Click on File, then "Save As".

Select a file name, and scroll down on file type, to say "JPEG", or whatever format you want, then "Save".

So, that is their story. I am thinking myself about doing the same, just not yet. For the man, it is an adventure, no doubt. For the wife? I guess it might seem a little less glamorous, having already "lived" the adventure. Maybe even a step backwards. But she will go, no doubt, hoping the man in her life will get bored and return to his senses.

Have you been watching TFC and TV Patrol for the Fil-Am news? Filipinos are returning in droves, and worker contracts are not being renewed, especially with the Obama adminstartion expected to begin a new era of protectionism.

That is my rant. Now for my suggestion: Provide copies of the last three years of income tax returns to show that you are making at least 125% of the expected poverty income guidelines that they will not publish for two months yet! It is pretty hard to plan for a requirement that no one knows about yet.

To the Philippines, there is restriction and heavy duty tax on some electronic devices other than for personal use. If you check them with your baggage, they use such a strong x-ray that it would probably destroy electronic devices. I know because it destroyed my satellite clock. So you have to bring them in your carry on luggage if you want to take a chance.

Don't ever stop looking for that visa packet while you are still there. Report the loss to any US Consulate as soon as possible. That packet contains all your files including your petition, your medical papers, all the papers filled out at the embassy. Everything that they took from you and your husband to add to your file. All that stuff gonna have to be regenerated again. Don't hesitate to ask for help from US Consulate to find out what your next steps will be.

The only issue you might run into is if your name is not on the credit card used to buy the ticket, and your husband does not join you. PAL requires a photocopy of your husband's Passport/Identification and either the credit card used to buy the ticket, or a photocopy of the credit card to board the airplane.

When my wife flew on an electronic ticket, I had blacked out some of the numbers on the photocopy, and they did not like that, so I had to fax a copy of my statement to her at the airport, before they would let her board the airplane.

I met 2 ladies during medical and interview and all of us got approved, we became friends and up to now we still have communication. She got her TD shot when she went to Kaiser for her first check-up. We took the receipt, along with the shot record she received at St. Lukes, to the AOS interview. That seemed to satisfy the interviewer, and he approved our AOS right then and there, no issues.

After reading my wife's and other posts here, I have something to contribute to the subject. We also have a gap in age, she being 34, and I was 50 at the time we first stated coresponding via email. Are Asians more mature as some have stated? I would disagree. They tend to be much more niave in my experience, somewhat childlike at times, but that is refreshing to a jaded ex-long-haired-redneck-hippy type like me. When someone asks if she is my daughter, I just say, "Yes."

On the counseling/consent stuff, my friend, a little older than I, married a 30 year old from Baguio about 6 years ago, and they each had to attend two weeks of counseling before they could be married. They needed the approval of her parents, before the process could even begin. Maybe that was something provincial to Baguio. He was a little thick headed at times, trying to bribe his way through, but he still had to go through the program. He spent two years trying to bring his wife here, finally contacting his congresswoman, and was finally pointed to the proper forms and preceedures. Like I said, he was stubborn at times. He even tried to bribe his was through the CFO after being denied at the Airport: They took his bribe, and still made his wife attend the CFO seminar.

Was that just his experience, or did that happen to others? We went the K-1 route, and that generally went as expected.

I hope this will help with regards to parental consent. I got these from the Family Code of the Philippines.


Art. 14. In case either or both of the contracting parties, not having been emancipated by a previous marriage, are between the ages of eighteen and twenty-one, they shall, in addition to the requirements of the preceding articles, exhibit to the local civil registrar, the consent to their marriage of their father, mother, surviving parent or guardian, or persons having legal charge of them, in the order mentioned. Such consent shall be manifested in writing by the interested party, who personally appears before the proper local civil registrar, or in the form of an affidavit made in the presence of two witnesses and attested before any official authorized by law to administer oaths. The personal manifestation shall be recorded in both applications for marriage license, and the affidavit, if one is executed instead, shall be attached to said applications. (61a)

Art. 15. Any contracting party between the age of twenty-one and twenty-five shall be obliged to ask their parents or guardian for advice upon the intended marriage. If they do not obtain such advice, or if it be unfavorable, the marriage license shall not be issued till after three months following the completion of the publication of the application therefor. A sworn statement by the contracting parties to the effect that such advice has been sought, together with the written advice given, if any, shall be attached to the application for marriage license. Should the parents or guardian refuse to give any advice, this fact shall be stated in the sworn statement. (62a)

Art. 16. In the cases where parental consent or parental advice is needed, the party or parties concerned shall, in addition to the requirements of the preceding articles, attach a certificate issued by a priest, imam or minister authorized to solemnize marriage under Article 7 of this Code or a marriage counselor duly accredited by the proper government agency to the effect that the contracting parties have undergone marriage counseling. Failure to attach said certificates of marriage counseling shall suspend the issuance of the marriage license for a period of three months from the completion of the publication of the application. Issuance of the marriage license within the prohibited period shall subject the issuing officer to administrative sanctions but shall not affect the validity of the marriage.

Should only one of the contracting parties need parental consent or parental advice, the other party must be present at the counseling referred to in the preceding paragraph. (n)





Based from my experience, the age requirement in order for a person to contract marriage is 18.


OK...but hold on a second. This appears to be requirements for a marriage license issued in the Phils. The original poster is applying for a K-1 visa - which means he'll have a marriage license issued in the USA. Do these requirements apply if the marriage is to take place in the USA? I would think not.



You are right that the Filipino Family Code does not apply to the United States. However, they still have to hurdle of gettring approval from the CFO before she can leave the country, and the CFO may very well try to enforce some or all of these requirements before issuing a certificate and stamp. The requirements of the CFO seem to be arbitrary, varying from official to official and from office to office. Forewarned is forearmed.

I keep telling my husband we should just move back to manila where the house is in my name, and he won't have to work a day in his life, but syempre, it's no go..

Anyhow, because of the above-said situation, my relationship with my in-laws just took a nosedive. I know there's a culture difference, but there's also the fairness of it all. I might be being melodramatic, or overacting, but I guess that's the way I am. My husband understands my side of it though, so it hasn't affected our relationship at all. Maybe after some time has passed, we'll test the in-laws waters again..

I didn't have to go through the document verification after I had my interview. It seems that they are really giving you a hard time -- The NSO and the Delbros. Usually it takes three days only after your interview and your visa will be delivered by Delbros. Mine took 9 days because I had to repeat the finger scanning thing. That was the reason of the delay in my case. It's not fair that they have to make you wait 3 to 4 weeks. It's a waste of time and a waste of money when you just want to be with the one you love and they are making this harder for you. Don't you just hate it? I think it's only in the Philippines that you have to pay so that your documents will be verified by the NSO. My husband said it's a waste of time. -- Marie

At the CFO and at the airport it seems that many of the employees resent the fact that Filipinos are leaving the country and try to make things difficult for them. Jealousy perhaps or maybe they are just afraid of losing their jobs. It's good thing that you're gonna accompany your wife and son on their journey to America. That's the way it is. So just be prepared. Americans get a little respect, but sometimes also they get the big shaft. Goodluck!

Don't forget to save money for the airport tax and emmigration tax. My fiance gave me some money just in case I needed that to bribe my way onto the airplane. My then fiance told me that if your visa is denied by the embassy, they will let you know. Since you haven't heard from them, I guess your visa was just delayed. Darating din yun.
