We had no problems with our K-1 process, but our good friends did. He married a Baguio City girl, and fully expected to bring his wife back without any problem. It took him two years, and he enlisted the help of Lynn Woolsey's office, (D) California, at the end. They said she was most helpful in directing them to the proper agencies, and helped with the filling out of the forms.

What I noticed when I was there for my interview last Friday, Jan 9, 2009 was that fiances/husband are allowed to be with the beneficiary within the premises if they show a valid ID so that they could get inside. Since they really don't have any appointment there but just to be with the beneficiary on her big day. They could be with the beneficiary upon the pre-screening but on the CO interview, they are not allowed to get inside. Only the beneficiaries are allowed to get in the room. I met someone there who brought her fiance with her but he wasn't allowed to get inside during the CO interview.

I have heard both ways, either the fiance is allowed on the CO interview, or not. I think it depends on the CO, etc. My wife's friend from work is going to Manila next week to be with his fiancee, and he hopes to be by her side the whole time.

I would contact the Saudi Embassy in Metro Manilla, and the Philippine Embassy in Saudi Arabia. Keep copies of all correspondence to show your attempts to get your police clearance. Some countries do not have reciprocity agreements, and will not issue a police clearance without a letter of introduction, and only while you are a resident of their country. The US Embassy should aware of those countries.

Others should have personal experiences similar to yours, and may give you some advise.

The applicant may bring it but the officer may not necessarily examine it. The interviewing officer is less concerned with why the applicant is going to the United States than with whether s/he has ties that will bring him/her back.

We live in Northern California and it's not as cold as some of the places you all live. But the winter here is always wet and some mornings there is frost on the ground and frozen puddles everywhere. The first few days and weeks when I got here, I was always complaining of the cold temperature and it was not even winter yet. Finally, my husband bought a flannel night gown and an electric blanket and I think I spent my first six months living underneath that blanket plus I've got my slipper socks, fuzzy slipper and pajamas. How cold it is? Freaking cold for me. You need to dress in layers. My good friend from Texas that I knew from the Philippines sent me a care package when I first got here and it contained slipper socks, sweaters and gloves. My sister in-law also gave me some sweaters, jackets, scarf and a pair of gloves. Oh yeah, my husband got me a wool cap. If you keep your head warm, your body stays warm. That's important too.

The only thing i can guess is there was something in the packet or said in the interview that sent up a red flag, that caused them to contact the visa fraud unit and do extra interviews, I imagine they are going to do some more background checks and what ever else is protcol in these matters.

It is better for you to tell the truth because if you are just making up some stories they might eventually find out and that might put you in a bigger trouble. In the Phils, it is more acceptable if you tell people that you meet your fiance or bf/gfs through friends or relatives but apparently that is not the case in the USEM due to some cases of fixed marriages. It does not necessarily follow that if you meet your fiance through a relative/friend then you will be sent to the Fraud Unit. I think the CO also consider the circumstances of your meeting among others. I have read several cases here in VJ who met their loved ones through relatives but did not have any problem in the interview. I don't know if they changed their rules now.


Well said. I would ask your fiancee to be completely honest with you, and make sure there is nothing else here. This is not to say things are not exactly as you said, but sometimes we "forget" things that happenned before, that might cause concern later, and love is blind, at times.

If it is a temporary lay off, your fiance can still get an employer letter stating his prospect for employment with the firm, the particulars of the lay off, and his expected salary for 2009.

Does he have any assets, investments, real estate? Do you have letters from any bank accounts showing his current balance and deposit history? That is all I can think of. The proof of child support, does that show the amounts he pays and how often?

I'm always confused as to why come to the US if the petitioner is not in country. It is a lot less expensive to support a beneficiary in the RP than it is in the US so best stay in the RP for now.

Isn't there some way to keep the K1 active while waiting? I know the visa, once issued, is good for a year, but I'm not aware of any hold/pause period that can be applied.

If you aren't worried that your fiance might change his mind, if you are secure emotionally, unless he has family that is willing to take good care of you and the other dependents, you are likely better off in the RP for now. There is the problem. The consul is saying that with his child support payments, he is effectively only making $15,000 a year and that is not enough to support another person.

On the same train of thought, I wonder how much, if any of the expenses involved could be deducted as moving expenses. I did not try, but has anyone found a way to recover some of the cost, other than the obvious tax savings of being able to file a joint return, that first year?

You will not receive copies of anything already submitted from the USEM. They probably won't show the forms, or evidence, unless the Consular thinks you could clarify the information your husband provided. If possible, have your husband make copies of what he sent so that you can see what information the Consular already has. Many of the questions the Consular will ask will be based on the information already submitted, i.e., "What is his father's first name? Does he have any brothers and sisters? Who does he work for?"

An original BC and his naturalization papers are necessary to get a passport, and those are returned.

It is not necessary to send originals when he files your petition, unless specifically requested by instructions, or RFE. All documents sent to the USCIS not specifically requested will not be returned. You can request new documents from the authority that issues his birth certifacate, and new proof of naturalization from the USCIS. The documents he submitted with stay with your packet. Perhaps one of the adjuditing officers along the way could hand back his documents, but I doubt it.

Employer letters work too, showing his prospects for continued employment, and expected salary. Our friend just had her interview. The sponsor just took a new position, and the employer letter clenched it for her. She sailed right through.
