Greetings to all Spouse VISA-ERS OUT THERE: :unsure:

I hope that everyone's process is going well. I have three questions about filing the I-130 petition:

1. Name Change: My fiance and I got married on March 8th. I would like to change my name to take his last name--Cayasso. However, I am afraid that this is going to complicate our visa processing because I will have one name on the application and a different name on my passport etc. (my original name). Can anyone advise me on the pros and cons of that? Thank you!

2. Photographs: There is no way that the way that they complete "eye-balling" method used at the photo place we went to in Nicaragua is going to meet the specific requirements laid out in the 4-page description on the u.s.c.i.s website. I mean, to me it looks like a normal passport photo ...but do I really need to actually get out my ruler and see if it meets the specifications? Should I take a picture and try to post it for you to see?

3. Filling out I-130 Form/G-325A Biographical Form: Is it preferrable to fill it out on-line within the actual Adobe Acrobat software or is it ok for him to just sign the form, send it to me and I can fill it out with black pen (HE HAS TERRIBLE HANDWRITING)!

1. I would wait after the process is complete for a name change, it complicates or delays everything. I don´t see the need to do it now. My wife has told me she will change her first name (spelling, she keeps her last name).
2. I would really need to see the picture. All I can say is that most phto places in Nicaragua are familiar with passport type photos. But if it becomes an issue at the US Consulate or the NVC, they will let you know and probably ask for a new one.

3. Ask him to sing the form and send it to you. You then fill it out. That´s what I did.

I can strongly recommend you to wait with the name change after the process. It will be easier, plus you will have no chances to get under a prolonged FBI check.
I changed my name during the process and got to deal with a lot of difficulties. I am still afraid that this will cause some complication in the interview. Anyway, it is better to put the last name that you have right now in any petitions that you file.

Ok here is an update -

After 8 emails and 1 week between myself and the Sydney Consulate I have confirmation they made a mistake. However they didn't say it was exactly, just that it was overlooked. I found them to be stupid (no other better word to describe them) as they kept asking the same questions when I provided all the required info in my first email.

They suggested I contact USCIS and it change through them. Unfortunately my local office is LA, a 3-4 hour drive. I can no longer drive on my Aussie license so I have to wait for my husband to take day off so we can go to LA. Hopefully next week. I only received my green card in the mail today and was hoping the USCIS would pick up the mistake but they didn't so my green card says CR-1 and expires in 2 years. I can't get through to them on the phone so we will just make an infopass appointment.

I sent the Customs Border Patrol an email asking why they didn't change it when I went through immigration and why would the Consulate said they could change it as it can be changed. Still no reply.



Well, I am so mad at them. I hoped that USCIS would notice a mistake and change it to IR for you( and hopefully for me)
I did not get my card yet. but I know that there are two ways now^
1. File I-90( that is what immigration officer would most likely tell you to do) It can take a year for them to correct the mistake
2. Wait 1 yr and 9 months and get your condition removed. This is the way I am going to do it( most likely)

Another thing you can do or your Citizen spouse can do is to contact your Congressman in your district to correct US CIS and US state department's mistake.
Maybe you can go with I-90 form petition along with this option.
You can point out that the government made mistake or overlooking whatever, and nobody is responsible for correcting mistake.




Ok, the update.
I got y green card today. They did not just issued a card for 2 years, but hey even managed to make a mistake in my lat name. I am going to file I-90. I also made an appointment for the 3rd of AUG

If you haven't left for SFO yet, send an email to the Consulate and ask them if it was a mistake and what you need to do to fix it. If they say the same thing as Sydney about bringing your marriage certificate with you into SFO then show that email to the inspector. Hopefully, you will have better luck than me! We are still awaiting further advice from Sydney as to what to do now that we are in the US with a 2yr green card instead of a 10yr.[/quote]

I have been married to my husband for more than 2 years. However, when we started the papework, it was just a year. When I went to the interview, we have been married for 2 years and 3 months. I specifically asked the officer, what type of visa I would get, SHe said that I would get IR-1. I got my visa today and it says cr-1.
What to do now?

If i do end up going on CR-1, when should I start removing condition? Right after I arrive or only when I am in US for 1 year and 9 months.
Please help, I am sooo confused now!!! :help:

I think it has to be in english, but again, I remember reading somewhere about the names requiring the original language alphabet. :reading:

It means that if the I130 and the I129F are approved on the same day by USCIS (which they have been for years) and they arrive at the same time at NVC (which they also have been for years) NVC will stop the I129F forcing you on the Cr-1 visa path. Now, recently a tiny few I129Fs have made it to NVC before the I130 and thus leaving the K3 path open, but like I said...a tiny few.

PS - begin preparing the documents for the Cr-1 path, failing to do so could waste time if your I129F is closed at NVC


Thanks again! We will definitely start preparing everything for the CR-1. But on the uscis site they say that estimated time for processing of i-130 is like 5 months and u're absolutely right - it looks like the 2 petitions will be approved at the same time. If we go for CR-1, we have to wait for the approval of i-130 (for that NOA2, as i understand) which is not earlier than 5 months - and they will send us also additional instructions on when to file i-864, when to pay the fee for it etc. Right? And eventually they should contact me from the embassy about the interview for CR-1?

It is not up to you to prove that you can support yourself, your husband has to show that he can support you - although under certain circumstances you may use your savings or future US income on the forms, read the instructions that come with the forms to see if you qualify

If not, your husband will need a co-sponsor

Keep in mind, about 99% of I129F petitions will be closed at NVC. You're probably going to be on the Cr-1 path so you might want to review the I864 required for the cr1 visa

thanks for ur response! i didn't quite get it though - 99% of 129f will be closed at NVC...What does that mean? As for I864 - we've review it and we have a co-sponsor who is willing to file for me, so there should not be any problems with that. But still if they'll approve 129 before the i130 - is it possible to have a co-sponsor filing for you the AOS i134? That's the part that i really don't understand...Looks like i gonna need that i134 for the interview at the embassy - so i wonder if it's possible to show them that of my husband and of a co-sponsor, since my husband doesn't qualify for the financial requirement....

I suggest seeing I-130 through and NOT sending I-129f (I-129f actually slows down your petition as they pull I-130 out of its existing place in line to joing it with I-129f and then it goes to the bottom of the line).

Your husband will still have to do his I-864 as he is your principal sponsor but he is of course able to use the co-sponsor to make up the shortage of funds. The co-sponsor also fills out I-864 (I-864A if they live in the same household) and provides proof of their GC or US passport as well as last three years of tax returns, just like your husband.



Thanks a lot for quick responses!!! we do have a co-sponsor and there should be no problems with him filling out the i-864, he is a US citizen as well. But if we still go for k3 visa and send the i129f in - i can't figure out if it's possible to use a co-sponsor on this stage, i.e. so that both him and my husband could fill out the AOS i-134. They say that if you go for K3 visa - on this stage my husband is not required to send the i-864, but at the embassy they might ask me (or might not) to show them the i-134 form, which is also an AOS. But i've never seen anybody mentioning that a co-sponsor can fill it out....Is it possible? I mean, if a get the k3 visa - we are planning to finish the rest of the paperwork (including i-864) while i'm in the USA, and most likely will have to have a co-sponsor for i-864 - at least that's the way the things look right now...Would really appreciate some help with this i-134, cuz we really wish i could receive the k3 visa...Thank you!

Hey, everybody! I've just registered on this site, so i'm really new here. I've been reading a lot of topics and a lot of information here - first of all, thanks a lot to everybody - this site is really helpful! But I still have a couple of questions about my case - hope somebody could help me....
I'm married to an american citizen, we got married in 2008, after that i came back to Russia, he visited me plenty of times, met my family...Now we've started my paperwork for the k3 visa, mailed i-130, got NOA, ready to mail i-129 in the nearest couple of days. The part that i'm worried about is that my husband is unemployed right now - actually has been unemployed for over a year already, claimed unemployment benefits.. My question is - is this going to be a big problem for getting K3? Will my husband have to fill out the i-134 form, AOS (being unemployed)before my interview (of course in case everything goes well)? Can a joint-sponsor fill it out instead? I'm really worried about it...I can support myself financially - but is it ok for the embassy interview? What documents would i need to prove that i can support myself? Really hope to hear some comments. Thanks in advance!

My husband just filed i-130 too - in a couple of weeks we received the NOA. Now we are actually planning on filing i-129F for K3 visa (this is a 2-year non-immigrant visa for spouses of USC). So after your husband receives his NOA, you can file i-129F as well, i suppose. But probably it is really better to wait and go for an immigrant visa, cuz it looks like the time of waiting is almost the same and naturally it's better to go as an immigrant right away...

You got a certificate of naturalization, it's not the same as a certificate of citizenship! so check Naturalization, then give number, date n place. everything else leave blank.

How do you guys find things to talk to your wives and finances? It was a lot easier in the first couple of weeks after I got back in the states. We did a lot of things together that we could talk about. Now, it has been three months, I struggle to find topic to talk about.


Talk about everyday things. Don't wait till something 'interesting' happens to talk about it, this may ruin your relationship. This is not a debate contest or an analytical TV program. My best advice is to relax. I could suggest reading books or watching movies 'together', but I think that would make things stale, too made up.

Sorry to hear you've got to go through the wait, that really sucks. I think I would have just said f-it and moved to Russia if I had to wait 2 years.

Edit: Almost forgot to mention. I remember reading about people applying for the CR-1 right before the home stay requirement expires.
I'm not sure how familiar you are with the CR-1 process, but basically you have three stages:
USCIS
NVC
Embassy

The USCIS takes about 4 months to go through and they don't check home stay requirements. HHR's are checked at the NVC stage.
So ideally you can get the USCIS wait out of the way before your home stay requirement expires.

Yeah, that's what we are doing. We got our NOA1 in March and are now waiting for the second one. I'm not sure about the 2YHRR being more common now, mine is dragging from 1999. I just never got around to it, and didn't think it was going to be an issue at all, until my husband and I decided to file for adjustment of my status. That's when we found out what we were about to face. Since you brought up NVC and Embassy... I'm still not sure what will happen once they find out i'm still in the process of fulfilling that requirement. Are they just going to date my visa after the 2 year period runs out? Should I try to schedule the interview till after I'm done with the requirement? This is just one huge headache :(

We are filing for CR1/IR1 and I am a J-1-er with the stupid 2-year home stay requirement. I'm sitting it out- I have a little under 10 months left. Basically, when we considered applying for a waiver, we ran into a problem locating some documents. I just decided to come back and get this done and over with. It totally sucks, btw :(

Hey all. So Tanya and I were talking about things to bring, and she brought up her driver's license. She has a Russian driver's license, but she was asking about getting an international driver's license. She read somewhere that having an international license might make it easier to get a license here in the US. Anyone have any experience with this?


I shouldn't make any difference. As long as she has a proof of legal presence in US she's going to take the same 5 min. drive around the block and she's done. The test is a lot easier in US, it'll be a breeze.

Nope, in CR-1/IR-1 cases this is a requirement of the visa, so will be handled at the medical for the visa, and be included in the medical documentation. The board certified doctor overseas can handle documentation in the local language just fine.

K-1 is different than CR-1/IR-1
