Well I called NVC today and they still don't have case. I had a NOA2 from CSC dated 1/18/2007 and of course the notice said that it was being sent to NVC and this is 2 weeks later. The person at NVC said it could take up to 90 days, but usually no longer than 30, and to just keep calling back! So that's what I'll do.

So I got an email from NVC today saying that they had my petition/case and now finished processing it and forwarded it to the embassy. Which means that it was in fact sent to NVC regardless of what NOA2 said.. which doesn't matter, since they finished processing it very quickly, YAY!!!!!!!!! :)

So I called USCIS today to inquire about my petition not being at NVC yet after NOA2 and to ask about "and was forwarded to the consular office listed" on NOA2 and they told me that for I-129F they send not to the NVC but directly to the embassy. She didn't really give a normal answer as to whether this was previously the case.

Any thoughts? Was this true for anyone here recently? Do their support folks just not know what's going on?

Though, the NVC still doesn't have my petition and the Moscow embassy hasn't responded yet.

Read the rules before you let your little fingers loose on the keyboard. I could interject my Catholic beliefs on this matter but then I'd be here all day...HOWEVER...the USCIS added moral character as a requirement for a reason. The reason the OP cant find archives on the subject is because its not allowed. Let her find a lawyer...unless that lawyer is willing to lose his or her license she's out of luck. If there were no standards then CIMT wouldnt exist. The difference here is that the OP continues her lifestyle. It IS up to the USCIS to investigate on how a couple chooses to live their lives..why else are we pouring every ounce of evidence into these petitions we send in? Google it...an immigration officer will ask whether the OP practices polygamy at the interview...should she leave the boyfriend out then? Oh...lie to an immigration officer? That goes against everything this board stands for.

Please don't interject your Catholic beliefs on this matter as they are irrelevant. The purpose of K-1 is to be with the person you love. People in a polygamous relationship are not allowed to get K-1. No conflicts here, because OP does want to bring her loved one here, and she isn't in a polygamous relationship.

As you seem to be in a tiny minority with your opinion on this topic, this (topic) doesn't go against everything this board stands for.

Yea, Vermont is very fast. For us - 92 days from filing 129F to the actual interview (which we successfully passed today!!)

I think he stayed longer than 1 year. He was able to return without any problems back then, he only had issues when he tried to come back to visit me.

I just became a citizen and I want to fill a petition I-130 so I can bring my dad to the US, the only problem is that he was here in 2001 with a Visa and he stayed longer than he should have. On 2007 he came to the country but he was returned back to his country at the airport I think he signed a voluntary return instead of deportation (due him being longer than permitted back in '01). I want to fill the petition but I don't know if this will cause any problems or if it's going to be rejected. Can someone advise me in the matter? I will appreciate it.

INA §212(a)(9)(B)(i)(II) provides that any alien who has been unlawfully present in the United States (presence in the United States after the expiration of lawful status or presence in the United States without being admitted or paroled) for 12 months or more is excludable for 10 years.

Under INA §212(a)(6)C(i), an alien who, by fraud or willfully misrepresenting a material fact, seeks to procure (or has sought to procure or has procured) a visa, other documentation, or entry into the United States or other benefit provided under the INA is excludable. The determination of materiality is a fact which would make an alien excludable or shut off a line of inquiry which may have resulted in exclusion.

Waiver eligibility hinges on the existence of a "qualifying relative".

I think for these two issues, the spouse or parent is the qualifying relative for this waiver. Since you are neither his spouse nor his parent, there is no one who can apply for this waiver for you dad unless his wife or his parents are US Citizens or LPR's and will experience extreme hardship due to his not being able to enter US AND not being able to go live in his country.

I'm a US citizen and I want to fill a petition to bring my dad to US. but here is the thing, he used to have a visa and stayed longer than he was supposed to(about a year or so), he went back to his country and after several years (8 years) he try to return using his tourist visa but he was stopped at the airport and they put the following on his passport 212(a)(9)(A)(ii) and 212(a)(6)©(i), he was returned on the next flight. My question is what do I need to do to bring him over? is he admissible for a waiver? will he never be able to make it to US? what should I do? Any help will be appreciate it

I am sorry for being this ignorant but where can I get the Expedite Letter you talk about, or is that a letter that I have to do it myself, if so what should she put on the letter? Another question is that the package will be send to VSC (vermont service center) for the expedite process, do we have to pay extra for the expedite? and thanks for answering my other questions F@rsc@p3

I want some advise, I have to submit the I-751 to remove my conditional resident status witch is due in April this year but my wife is on active duty with the army serving in Afghanistan and she will not return until September; How can I fill out this form if she is not here, do I need to send her the I-751 so she can sign it and return it back to me?
Does been in the army is considered to be employed with the U.S government or not? (question 10 on the form)

I will appreciate any help and assistance that anyone can provide.
