Hello all,

I have a question for all of you. Are you all citizens or legal residents? Did you mark that there was an immigration proceeding with your spouse or family member? I ask cause I wonder if there is a trend here for a reason why our cases could be on hold or set to the side. I filed in mid April and my spouse was actually denied entry to the US cause DHS said that my husband seemed he intended to stay even though he wasnt and had his roundtrip ticket on hand, under the Visa Waiver Program. But any how. My case was received by a Semegi through USPS receipt, so Im sure that pretty much everyone that has filed in CSC knows who this person is. So obviously some people's cases were set to the side. I have only gotten one f ing touch since April on my I-130.

Is the whole purpose of the California Service Center to do background checks or screening on the sponsors (US citizens and Legal Residents)? I think I have read that somewhere. Then the Embassy does the background checks on the spouse or family member. Any one know?

Im in the military, so I know that that does not mean much to USCIS. Not that Im any different from yall but I would figure they wouldnt think twice with me especially since I have been in for a couple of years. There has got to be a trend here some how. Cause I noticed people that filed after me have received approvals already. I should just have my husband fly to Mexico and walk over. That would be alot easier and quicker than this #######.

I am going to send a message to some news station about this #######. USCIS needs to work on their customer service. :angry:

Instead of using a calling card, why dont you use skype or yahoo messenger through the internet where calls are free. My husband is in Germany and we both dont pay for our phone calls since its through the internet. We both can see each other and speak and hear each other through the internet. Thank GOD for the internet cause God knows how much our bill would be. I know I would be charged 40cents per minute through Sprint, but its free through Yahoo :) Thank God for yahoo and Skype. Buy a web cam and earpiece and use the internet. You just have to download the Yahoo messenger or Skype and enter your profile. Your significant other would have to do the same thing and then you both invite each other and you will be able to speak to each other. I do every day with my husband. That is what keeps our relationship alive and free

I have 2 questions:

1) Is anyone here still waiting for their NOA1 (specifically from the California SC - printer problems and whatnot)? According to the USCIS site, our NOA1 should have been mailed on the 04/27. We chased it a month later and were told to wait a further month. Today is the day we chase again. I'd just like to know we're not alone in this.

2) Is it unusual for an I130 with an NOA1 date of 04/27 not to have been touched by now?
I'm getting slightly worried that we have already have our I129F NOA1 and that has already been transferred from Chicago to California and is currently pending. It's going from one extreme to the other, no movement on one and lots of movement on the other.

I sent my I-130 on the 13th of April, which they received on the 16th of April, but in the CSC system, they state that they sent a receipt on the 24th of April, which to this day, I have not yet received anything for that petition. But on the press room from the USCIS sight for 11July07, it states that by the 20th of July, everyone should receive receipts from CSC. Im numb to this long process. I am also pending a receipt for the I-129F from CSC since it was transferred there from Chicago. Hopefully, everyone receives a response soon from CSC. :whistle:

Hey Everyone,

I received a message from Chicago for the I-129F petition for my husband that the case was fowarded to CSC. To this date I have not received any notice for my I-130. But I hope that when they receive the I-129F, they get on their toes and start working on my case. I am going to call them and send an email to USCIS on the 24th of June since it will be over 60 days since I have not received anything for the I-130. I know :unsure: the receipt for the I-129F states that it will take 60 to 180 days from 4June07 to process it.

Does anyone know why Chicago would send the I-129F to California? Is it because my I-130 is in California (to be filed with maybe)? Thank you.

I filed my I-130 around the same time you did. And to this date I did not receive anything for it. But I filed my I-129F with proof (copy of check, case status online, USPS signature receipt and copy of I-130) and received the I-797 from Chicago within a week. I think that they would not send me the I-797 without verifying the I-130 in the CSC system. As long as Chicago is at least doing their job, Im happy, and hopefully they might somehow get Californ I A to speed up the process in order to get my pookie in soon. I know that people are afraid to take risks when it comes to immigration, but nowhere in the I-129F did I read about submitting the I-797 for the I-130 when you submit the I-129F. As long as you submitt proof, you should be good to go. And Chicago is really doing their job :thumbs:

What I mean by check too, is that you should (Im suggesting, but do this at your own will) provide a copy of your cashed check (which you can get through your bank) front and back (the back should have a stamp from USCIS with your case number on it, starts with 3 letters). I have online banking so like I was able to print it. I guessed my case number by registering online in the USCIS site. I could not make the last 2 numbers, but I guessed and saw one for the I-130 which I assumed was mine, and then confirmed it throught an infopass in Sacramento. They had my name and my husbands name in the system. So I printed that online form to and mailed that and sent a statement that it was confirmed through the field office in Sac Town.

Hey all that want to file an I-129F for K-3 with no receipt for I-130 (797)

I just received my I-797 for the I-129F. It said that it will take 60-180 days for them to process it. I filed it without the I-797 from my I-130 since I did not have it yet. I sent a copy of my check (received from my bank) front and back (shows date cashed and case number of I-130) with the online status form. Im so :innocent: I was having a rough day at work and loosing hope yesterday. I didnt even check the mail, like I did daily cause I was so sad cause I am tired of people asking me about my husband. It is hard to maintain a relationship afar. But I know that all this time and effort and of course money will be worth it when he is here with me :). Dont loose hope yall, you will make it through with your partner :innocent:

But I thought for the I-129F, you just need to provide proof that your case is pending, so I sent a copy of my check that was cashed, front and back along with the online form with my case number. I to this day have not received anything from USCIS either. But I mailed my I-129F to Chicago. They can send me a notice if they want that they need the I-797, but as long as they do not cash the other check I sent to them, I guess I will have to wait. Supposedly by June 15 CSC will be compliant. I will be the first person to call if I dont have anything before then.

I was wondering, when you filed your I-130, did you also file the affidavit of support? I forgot to do that but am not sure which form to submit. I just sent the I-130, the Bio data and my pay stub. What other forms or documentation should i have filed? Any advice is deeply appreciated. :whistle:

Yeah, its up to you how you want your last name to be, but keep in mind you will have to change it too with the social security office, bank, passport, bills and etc. I did a name change in March to my husband's last name with my social security number and passport.

I think from what I have seen is that some members dont even receive the NOA2 when they are suppose to. But you will know your case is at the NVC when you receive something from them. I think people have mentioned to allow the NVC like 2 weeks I think until you receive a case number. Congrats on that approval. Im still waiting on mine.

Dont give up. She might be saying things out of desperation and anger. I do it with my husband too. I have my days where I think maybe his life will be better if I ended instead of it being on hold. He quit his job thinking this will be a smooth process, gave up his personal space, car, pretty much his life and is currently living with his dad until hopefully he is here with me. Im in the service so its not like I can just get out or get stationed there with him. God knows when we will get approved by CSC, or even if we get approved. At least you both are halfway there. Maybe in three months you both will actually live together here in the US. Give her time to vent, reflect and express her thoughts. But even if she is negative about things you will have to be the positive one in the relationship. Some truths may come out of this for you both, but at this point you will know where each others hearts stand. rose.gif

I dont think your husbands knowledge would be held against him even though that stereotype exitsts. I know of Pakistani and Iranian people in the US. Maybe he can take the Employment route to get into the US with his type of knowledge if for some reason this does not work. But USCIS or the NVC will have to give you a valid reason to why he is denied entry if it comes down to that. Dont worry. Either way you love him, right? You cant live with him, you cant live without him blush.gif

Yeah the immigration officer told me to allow the additional 30 days of what they had on the site as far processing date to allow the letter to come in the mail. Which is a dumb reason because per the website, at this time or sometime before (within) they should have started processing my case or anyone before me. He told me that since CSC is processing Texas and Vermont I-130s along with people sending their forms before July 31, they are doing catch up so I should not go based on the date on the website. But any how, I hope to see the date that USCIS dares to put on their website so I can confront them again. Im tired of all this #######. Im not a criminal and have rights, my husband is not a criminal. I would figure that they would just be content knowing that everyone's spouse or family member will contribute in paying federal taxes, and the economy. wacko.gif

Yeah I contacted USCIS in vain. The immigration officer told me that I am on the 6 month mark but I have to wait an additional 30 days to call them so they can put in an inquiry to the CSC. The customer service representative told me that right now in the system they can view that they are currently processing March 13 cases. So I guess I will have to wait until next month. Oh yeah and Texas Senators along with Congressman are pointless. I sent them a letter for assistance and they have not responded. Its been about three weeks now. I just want to let yall know that tomorrow I will call USCIS to let them know that my case has reached 180 days tomorrow on the 12th of October and if they refuse to help me I will raise hell since their website does state "within 6 months". Since really 6 months is 182 days I am not counting Saturday and Sunday. I hope to not hear the same old bs about my case because I have not received any response from them other than the late NOA1 I received in August even though my case was sent in April. Any how I will let you all know how it goes. Hopefully the Department of Homeland Security does not let me down since I have not let them down by doing my part in the military in "defending our country". tongue_ss.gif

Can you or your husband submitt a letter to your state congressman or senator? I think your situation would stand out more than mine due that there is a life and death situation. I am stressed and impatient with my situation, but with your situation, this is not what I know our founding fathers or even the Department of Homeland Security would want for a family. I think you can apply for the immediate processing. Have you and your husband thought of that? Im sure that there are financial programs out there either in Canada or the US that will help. I think from what I understood the expedite process is like 1000 dollars. You should check it out in the USCIS site. Your situation sounds like it meets the requirements. I can not imagine you handling everything on your own with your child. The child needs her father too. I hope that your family will be reunited soon and your daughter to feel better. I cant wait to one day have children. Hopefully soon.

If you go the expedite route I would include doctors notes and results to USCIS so they understand the severity. rose.gif

Thank you Jundibasam for the advice, but that only applies if you are currently stationed overseas. I understand that I am no different from everyone else on this forum that wants to build a family. But I am frustrated just like everyone else with the long distance and seperation from my loved one. Hopefully with supposedly all the increase fees in July USCIS comes up with a plan to make this a smooth process and work on their customer service. I have been given the run around twice which is giving me a bad perception of their employees and program.

I sent messages to the Texas senator and congressman and to this day I have not received a response. Im currently stationed in California. I was reading this CNN healine about this Navy guy whose wife is going to be deported in June of next year I think if she does not get her papers or legal residency squared away. She came with her mom from Guatemala when she was little and then her mother became a resident but unfortunately was not able to obtain it due that she married her Navy Husband. The court gave her a year to adjust her status or go back to her country. Her husband is about to deploy for the 4th time. This sucks for her because its not like her petition will get squared away within a year. Im a US citizen and I am still waiting for a ^&%&*() damn approval from CSC. Its already day 176 since I sent it and to this day nothing. I know at this time they are doing a background check to verify information on me, but Im in the frickin military for almost 6 years, I have paid my taxes, I do not have a criminal history and of all I am a US citizen. I dont understand why it is taking forever. This should have been a quick one in my eyes. Ive seen that they touched my case a couple of times. I wish they would just tell me you are approved or you are not or we need additional information rather than not inform me at all. They dissappoint me and there customer service is a joke. I have sent messages to a couple of news stations but I dont think they will do a dang thing.

I feel the same way. Im so disappointed with USCIS. I want my husband here to give me the support and energy I need to brush off all the daily stress at work. I know Im just a number in the military and the president could care less if I died, but Im a human being. sad.gif I have feelings too and cant help to feel alone. Ive been trying to see what my options are in getting out cause I just feel like I cant take the heat anymore. I feel so alone, my parents moved back to Texas recently, my brother and sister have children and their significant other where with me Im just alone with my cat. No children yet. It seems like I signed my soul away and I wish now that I hadnt. Its hard for me to get out now. Everyone is giving me the runaround with options and resources. There is no direct point of contact for me to call, its taking a bit to schedule an appointment with mental health and the work is just adding up. Well really all the bullcrap and time. Today was my hubbys birthday, and Im sad that I could not spend it with him. For the past three years we both could not spend our birthdays with each other. Not even christmas or any other holiday. Its not like I can take leave any time for whenever I want to. My congressman responded with a message like subscribe to his site and blog. He is anti illegal immigration, which I understand but what about those that are really trying to do it the right way? He didnt really respond to my concern so there goes that. I dont feel like the US is my home. Its nice to have all the benefits and opportunities but it has no point if you cant share it with the one you love and want to share it. I find myself with extra money everypaycheck, but I dont even have a desire to buy anything like I use to. For what purpose? crying.gif

You have to create your profile in the USCIS site under "case status online" which will be on the left of the screen and then click on "register". Its your choice if you are the customer or if you want your representative to be able to obtain information but you will enter all your information and email adress and select your case number and clikc on "email on" so you can receive information. But its not really accurate because I have received a couple of touches recently and I have not received any email messages, but when I look in my "portfolio" I noticed the date changes. Good luck with your case.

wacko.gif Is your spouse american or from a different country? When I got married I changed my last name through the social security office and then changed the passaport to match my name. Even though my previous passport with my maiden name was like a year old. I dont think timing matters unless she is from a different country and they have laws and regulations. I would say you should speak to them to clarify the reason behind why she is not able to change her passport with her current name. I did mine right after I changed it in the Social Security Administration. Im kind of worried to cause my last name in german is Schäfer but in the US I have Schaefer since it is pronounced that way and then I had my maiden last name. So three different last names. But I included that in my I-130 for my husband. Hopefully that is not the reason for the hold up in CSC.

yes.gif This is the happiest day this year. Its my moms birthday and I received approvals for both the I-130 and I-129F. I cant beleive it. I called the customer service line and the guy upseted me by saying that I had to wait until December 13 to inquire about my case. I was angry. But he told me that the touches I received recently could be that I have been approved but the case worker probably did not update the system. And long behold I check my mail after school today and I just started crying. I just started taking Zoloft for depression. So I guess I dont need the stuff any more. Or do I? Yeah, it is hard to manage a long distance relationship, but showing patience really show how devoted the couple is. Yeah I might not have my husband physically here and dont have as much sex as I would love to, but I think about him everyday and yahoo messenger him everyday. I think Yahoo and Skype have helped alot in our relationship since we can see each other even though we are not around each other. We both have been and still are managing our love for 2 years and 7 months. Just got married in March. I have my days where I just want to say ###### the US and hello Deutschland. I know that me and my pookie will make it somehow anywhere in the damned world. Trust is what keeps me holding on. I trust him very much. I read about a post sometime back where a US citizen who was trying to bring there fiancee from the philipines, was put on administrative hold I guess cause when it came time to the medical exam, they saw that the fiancee in the philipines had suicidal scars on her wrists. Im not sure if they were approved yet or what happend, but as long as you dont have scars you should be good to go I think.

But I agree with the comment before, dont mention about the drugs. But I would figure even if you were honest and did mention to them that you did use drugs when you were young, that they would not judge based on that, since if they were to do a drug test on you, you would not test positive. I wouldnt mention it, but I would be honest about how you and your hubby met. There is nothing to be ashamed about meeting through a chat room community. I have read other posts where couples met online and they were approved and able to come to the US. Im sure that they would not question your relationship as much do that your husband has served in the military and would understand how stressful military life is. But one thing that you might want to ask your hubby and think about, is he claiming through the Veterans Affairs for medical benefits for his PSTD or does he have some type of disability claim for it? They might look into that when they are looking into your hubbys income and stuff. Not that I know, but from what I have researched is that they want to make sure that you will not be a public charge.

I wouldnt worry to much about or stress over it. I feel depressed too since it is the holiday season and it sucks not to have my hubby. But we are getting close to finally living a life together. Hopefully. I wish you luck and hope that all goes well for your family. blush.gif

You know, I think for the name question, I would put down, only if it applies to you, the name changes you have made since you have been married. I think that is a reason why my I-130 is taking for freaken ever because I just changed my last name through the social security office. I had my maiden name, then I have my german name and the american version of the german name. The american alphabet does not contain ä with the two dots above it so in the US you would pronounce this letter as ae. I think that is what the hold up is. My social security, passport and work information has my current last name. But some of my bank and bills statements have my maident. Germany only has the marriage certificate with the German last name.

My husband is kind of in the same situation as yourself. He was coming in December last year to be here for my graduation for trainning to become a supervisor and for my promotion. We actually did intend to marry also in Vegas but intended to file all the legal paperwork required for him to live here. He was in the Visa Waiver Program. When he attempted to come through the POE in Dallas, he was questioned about his intentions in the US since they also saw that he was bringing his two cats. Of course we both did not know at the time or read about immigration laws and assumed that he is able to come visit whenever since he has a couple of times before December 2006 to visit me, as long as he does not stay here for over 90 days. He even had a roundtrip ticket and intended to return due that his brother passed away last summer and he wanted to check up on his family while we would process his paperwork! They stamped on his passport:

VISA WAIVER PROGRAM REFUSAL pursuant to 8 CFR 217.4

My husband bought his own ticket back home and was detained at the Dallas county jail until his flight left since they had no space to detain him in.

I called back the immigration officer, who called me earlier that day to question if I knew my then fiancee and his purpose in the US, to see if he is able to come to the US after being denied. The immigration officer told me that as long as I file a K-3 Visa he should be able to come into the US to marry me. Screw that. I went to Germany, got married and filed the I-130 and I-129F. I am nervous about his inteview because I am sure that they will question him about that incident, but Im sure that they will understand that we did not know. No one explained to him the Visa Waiver Program regulations and limitations. Any how.

Does anyone know if we would have to file a waiver to for this? wacko.gif

This whole immigration process sucks. I imagined that maybe I would have some type of control with my life and my husband's but for the past 5 months and a half our future pretty much rests with the California Service Center. I know at this time in the process they are just doing the background checks but why in the world is it taking this long to do mine? Everyone else close to my timeframe and after have received an approval. I pay my taxes, I have no criminal history, Im military for almost six years and a US citizen. Im feeling let down by my own government. I just want them to tell me now yes you are approved and move on or no you are not approved so I can just get out of the Air Force due to Family Hardship and move on with my life with my husband. I dont care if I have to give up my US citizenship to be with my pookie. Im tired of just dealing with a bunch of stupid nonsense from power triping abusive airman and deadlines and stress. Life would be less stressful if my pookie were here. I just feel like a damn robot. Work, eat, sleep, hope, work, eat, sleep, hope, work... I just want to crying.gif
