K-1 Fiance(e) Visa Process & Proceduresready to file

As was said, some of the stuff you don't need to include in your petition. It won't hurt to include extra, but it will have no bearing on your petition case. The extra fluff will be just going to the embassy for them to review it after your petition is approved. At the same time, you want to send a fairly compact petition that won't take ages to go through because it could prolong the approval process.

As far as how to assemble your petition: use paper clips. Keep like items together with smaller clips, and use a big one to hold everything together. I did this with my petition, and then I went to the post office and slid all my paperwork into a priority mailer and mailed it. It's that simple.

Ah I see. Thank you soo much. I'll apply for my petition today!! Finally got the Journey started.

How about Certificate of Naturalization with all pages of passport?

My answers in bold:

Don't use a folder, staples, or binders. Paper clip it all together.

K-1 Fiance(e) Visa Process & ProceduresI-134 Question
Does the I-134 (mine and my father is co-signing) go in my packet for I-129F or do I send it to my fiance when he does his interview? I'm just trying to get my packet ready to finally go out and want to make sure I have everything in the right places.

K-1 Fiance(e) Visa Process & ProceduresDo I even need a K1 as a Canadian?
am1996,

I have read through this thread and caution you on the road which I think you are planning to take. Regardless of what the law says, perception is often more important and if you are PERCEIVED to be acting in a certain way, then CBPs are well within their rights to pull you aside and yes, even deny entry. I came in for a visit last week and was "this close" to being denied. I think think someone must have been on my side at the very last second. My own scenario - no mortgage, no children, no business to call my own - business cards, pay stubs, loan documents, driver's license just did not cut it - hell not even my charm and wit got me by the first CBP!

I'm not sure how often you have crossed recently, but bear in mind that every little news happening can affect life on the border.

Like in every walk of life, if you start telling someone how to do their job, whether that someone be a baker, banker, customer service rep, doctor, lawyer OR CBP you will be met with resistance. Do not think that these people do not have the power to send you home to Canada or worse - put a big fat ban on you which could complicate things even more.

The fact is - you have a realitively simple case - you are already in the US legally - don't have to worry about being separated like most of us do, and yet are still (to my understanding) trying to jeopardize this - for what - a wedding on a beach? Postpone the beach!!! Trust me, it will be there in 6 months! If you file now, you may even be able to be there by March Break! You will also be jeopardizing your internship.

Also, (and here is where I take out my own soapbox) the people on this site (not including myself yet) are VERY KNOWLEDGEABLE. As you probably have realized, amongst them you have CBP officers, lawyers and people who have gone through the process and yet still stay to give advice. If seeking an expensive laywer makes you feel comfortable then that is exactly the route to take, but I'll bet you dollars to donuts that you learn nothing that you would not already have learned here.

I do wish you all the best - as a fellow Canadian, I too thought that this process would be easier for us and definately looked for the quickest route - but learned that the honest, safest route was also the one where you filled out all the paperwork, dotted all the i's crossed all the t's, waited, waited and waited some more and yes .... will probably cut the number of ulcers that I will suffer as a result of this at least in half!

K-1 Fiance(e) Visa Process & ProceduresWhen to file
We are filing from inside the US and I can sympathize; bringing the paperwork across was worrying to me. How about mailing everything to yourself, or better yet, courier it to someone who will be available to receive it.

K-1 Fiance(e) Visa Process & Proceduresanother I-129F quick question

Click on "example forms" and open the I-129F. There you'll see that, in that line, they wrote "(ONLY complete for Naturalization Certificate)". So no, if you choose birth certificate you just check the box and leave that line blank. If you choose naturalization certificate, then fill that line out.

It's oddly worded on the form though. They should really specify "Give number of naturalization certificate" instead of just "give number of certificate." But then again, the USCIS doesn't seem to like logic too much.

So thats where I saw it!!! I thought it was a thread!!! Geez. :)

K-1 Fiance(e) Visa Process & Proceduresanother I-129F quick question
ok.. so I definately will put the state file number listed (it's the only number that would make any sense to put). since we are sending a copy anyway to prove citizenship then ity should be fine... and if we were not meant to put it, then I gues better too much than too little information.

thanks for all the help.

cheers

K-1 Fiance(e) Visa Process & Proceduresanother I-129F quick question
If the USC checks "Birth in the US" as an answer to Q.10, then does the question of giving the "number of certificate, date and place" apply? Or is this just for the 'naturalization' answer.

If it does apply (I'm looking at the birth certificate from NY state dept. of health now), is it the STATE FILE NO. given in the body of the document? or is it the looong 16-digit number that starts with a V that can be found in the bottom right hand corner of the front page of the document. There is also a number under the bar code at the back, but I am assuming that this is not it.

Thanks

K-1 Fiance(e) Visa Process & Proceduresusps or courier?
Thanks so much for all your input. I will definately be using USPS and asking for a signature - however, whether we go overnight or 2-3 days will depend on my level of cheapitude (yes - it truly is a real word! ok, not really) once we get to the post office.

I was a little concerned before because David's cheques don't get returned to him, however, we can see copies of cashed cheques online so will be easily able to look for the case number.

Thanks again,
Mo

K-1 Fiance(e) Visa Process & Proceduresusps or courier?
ok, just about ready to send everything off ... two quick questions:

1. I read somewhere that USPS was not reliable. Any thouughts on this? I know to pay extra to have them sign for receiving the petition, but just making sure we should not be using a courier service instead.

2. for the fee involved for the i-129F .. I take it you should use a personal cheque so that you can track it through the bank? Or .. should we get a money order?

I don't know why, but just sending this off makes me nervous!

thanks

K-1 Fiance(e) Visa Process & ProceduresSecond k-1 petition

Do you really think your fiance wants to come to the US ONLY because she loves you?

#######?!?!? Are you implying we want to marry our fiances because they are american?!?!!? I, for one, am only marrying him ´cus I love him, and am only accepting leaving my beloved Brasil ´cus I love him.

To the OP. We do not offer help to green card hunters here.

Notice I said ... ONLY .... :)

Yes, I'm sorry if I have read your post wrong but ... I am coming ONLY because I love my fiance. I can live in Canada, in the Caribbean AND in the UK legally.. yet I am jumping through hoops to come here... ONLY because I love him. Again, I apologize if I have misread you but I wanted to be very clear about my own intent.

K-1 Fiance(e) Visa Process & Proceduresk1 advise
Hi Ianjo,

You have heard from wiser than me, so I won't bother to add my two cents on your questions, but will say to go get yourself about 20 pots of coffee, and be prepared to not sleep for the next week while you do your research about this whole process. The guides here give you lots of info and just reading the posts of others teaches you so much as well. Yes, you may be tired after not sleeping for a week, but you'll feel better knowing what to do and what is to come. Preparation is key :)

Regardless though ... welcome to VJ and congratulations on the upcoming birth.

Hi and welcome to VJ!

About your hotel receipt ... if you did indeed throw it out during spring cleaning, you can try calling the hotel you stayed at to get a copy sent to you. I did this as well for our petition.

K-1 Fiance(e) Visa Process & ProceduresQuestion about visits while in processing...
Arazia,

I have the sense from reading the posts of others on this topic, that the farther along in the process you are the easier it seems. Showing customs your in-process K-1 SEEMS to be proof in itself that you are planning on returning and going through the proper, legal channels. Now to be clear, I have never done this, I am not giving you advice or firsthand experience, just passing on what I have read from other posts. However, this has mostly been my understanding from posters in the Canada forum ... driving back across the border is a lot less costly than eating the cost of a plane ticket.

Question ... someone inferred earlier (sorry I don't remember the name now) that if you get turned away you have to start the whole process over. Really?? This counts as a strike against you? Sorry if I read it wrong (unfortunately I can't find it if I scroll down now) but I just want to confirm that this is true.
