Just want to add my agreement that stand-alone emails are not really necessary at this point. While many choose to send them and to my knowledge, do not get penalized for this, just be sure not to rely on them to prove your case. Primary evidence (boarding passes, passport stamps, tickets, even credit card receipts) backed up with photographs is still your best option.

I don't know why the OP gave background info. I am not the OP; however, I believe I have already stated why I THINK he gave background info. I THINK that he gave background info so as to best enable us to help him with his specific case. That being said .. I am not the OP.. I could be wrong. Regardless, it is not up to us to criticize either of them. Nobody made us a collective judge, jury and executioner.

As for your question/comment on whether or not I am this 'bossy' with my fiance ...

Many questions arrise.

Can she request an extension of the K1?

If she returns to her home country, and we cancel the current K1, what is the likelyhood that another K1, or K3 spouse visa will be approved later on?

What is the likelyhood of her being approved for a tourist visa, so that we could see each other?

If she over stays and we marry a few months from now, I would think an application for adjustment of status would be shot down and she would be deported?


Sorry, but I see 4 questions and none of them asking for relationship advice. The OP was giving background info as many of us have asked for on numerous occasions when trying to respond to a request for help.

This woman is not chattle to just 'send back' and we have no way of knowing his fiancee's intent. The OP did not ask for our opinions, just help on his case.

I have not been through the interview stage yet. That being said, I know that if I received evidence of any kind that had areas that had been blacked out, then the first thing that would come to my mind is "what is this person trying to hide".

I agree with Mew - only send what does not need to be blacked out and definitely do not send all 4000 pages. Just pick a few over the period.

Though from a different country, a fellow Canadian was crossing and said that he was visiting his girlfriend and did not mention the pending K-1. (Canada also has the VWP btw.) The officer at the POE was none too pleased and came VERY close to not letting him in because they said that he was lying to them. They were concerned that if he was hiding the fiancee and K-1 portion then he must be hiding other things too.

Other members that have done the Canada-US crossing have reported that it is important to bring ties to your home country. One member also said that being far along in the K-1 process is also a good indicator that you are doing things the right way. They travelled with their correspondence from USCIS/NVC/Embassy to show that they had an interview set up.

Honesty is always the best policy, but you don't have to reveal all if you are not asked for it. They really don't want your life story, you know?

The fact is that nobody can tell you for sure if they wll let your fiance into the US. If you can't go to the UK, best bet is to buy either a refundable ticket or one that he can re-use at a later date. You never know until you try, but it is up to the discretion of every POE CO.

First off, a fiance/e visa is intended for fiances and though it might be used for the purposes you are proposing, nobody here will tell you to do so, as that will probably be construed as visa fraud. That will be a decision you will have to make on your own.

The other thing is that you should know is that the fiance visa is also a HUGE pain in the butt, lol.. and can often take much longer than a visitors visa. If you began the process now (and I say this WITHOUT knowing the Brazil stats) you probably would not be granted a visa before mid-late 2007 anyway.

I am unclear as to whether or not your questions are strictly for the fiance visa purposed however, I would really suggest that you read around the site some - in particular checking out the guides. When you send in the initial K1 petition, the USCIS is looking to get a sense that 1. you have met within the past 2 years and that 2. this is a bona fide relationship. Evidence you have to support that is what is needed. The I-134 and discussions with the consulate come much later.

Best of luck to you... keep doing your research here and feel free to post more questions. There is a point where it all becomes clear.

I'm sure that people from Brazil will chime in, but BE CAREFUL. If the embassy only suspects that you are already married, you can be denied. There have been people who have done this, but just be aware that in many cases, church ceremonies are considered legal ones. I would not take the word of one lawyer.. you will definitely have to do extensive research.

I know that a K1 visa approved in Thailand is good for 6 months. What I need to know is when the visa is granted do you need to leave right away (in our situation go directly to the USA to get married) or can you stay for a month or two in Thailand to get your fiancees affairs in order? I know she should probably get her affairs in order sooner but just in case things come up. Does anyone have an answer?


You have six months in which to enter the US. Upon arrival, you then have 90 days to get married. Her staying in Thailand for a month or two should be no problem at all.

Whether or not to seek outside assistance is really a choice you will have to make. It can seem like a daunting process at first, however, my experience has been that if you are thorough, are good at doing research and have time to do that research, and have a straight-forward case, then with the help of VJ, you should not have to hire a lawyer or any other such entity. VJ should be all the 'outside help' you need.

Now all of this rests on your own peace of mind and your own comfort level.

We filed when I was in the US too (I am the beneficiary) and though I listed my Canada address on the forms, we answered yes when they asked if I was here in the US and then we noted that it was as a Visitor (no I-94 and VWP).

I would definately list the Pennsylvania address as a former residence. However, what were the conditions under which you were in Canada for the six months? Did you still have utility bills and a rental agreement in Mass.? I'm not saying that either of these things should be the determining factor, but if you are visiting a place only, then in my opinion, it would be fair to say that that is not your place of residence.

Many petitioners have sent a copy of their passport and it has been fine. Just be sure to include copies of ALL pages - even if they are blank.
