I got approved lightning fast because I applied through VSC - really that's the only reason. I filed at the right time in the right place.

As for a my disclaimer... lol.. Tamzyn ... I mean my little disclaimer in my signature below saying that this is only my opinion :lol:

I did not submit any special note with the petition in regards to my divorce. It stood alone.

We were in the same boat too and got approved, don't worry too much. (Separated longer than we were married, but just did not file for divorce until this year with it being finalized in June - then the K1 was submitted in August).

This is fairly common apparently - made me realized I was not the only lazy ####### out there.

You definitely need a translation and yes, I would submit both. Only a copy of the original is actually the divorce decree and only the translation will let anyone else know what it is, lol.

If it makes you feel better you can write a note saying that you had been separated for 5 years, but really, your grounds for divorce states that and all USCIS really cares about in this case is that you are legally able to marry.

My thoughts are to follow your instincts and keep a couple of aces in your pockets. Not only will you have another 2 people to 'sick on em' next week or so, but how happy will these people be if they find out that you have asked all 4 of them to do the same exact job from the get go. Remember, if one of these people feel that they can swoop down and save the day (i.e. be a big hero) then they are more likely to push the envelope for you.

I was confused about the contents of Packet 3 and 4 too when I started out. Basically, the Embassy will send you packet 3 after they get your case from NVC and it will tell you to do 'this and that' (forms, police checks etc.) You send the checklist back to them and then they send you packet 4 which tells you when your interview is and perhaps some other forms.

Now this is very vague. But when you visit the site above, it will give you more information, specific to your embassy.

Wow.. lots of very definitive answers to this question and many of them totally conflicting!

To the OP.. I can tell you what we are doing:
I (the beneficiary) came to the US on the VWP and then we sent in the paperwork.
I will be going back to Canada for the medical and the interview (which to the best of my understanding cannot be done here in the US).
If the interview is assigned outside of my allotted time to stay here, then I will go back to Canada earlier.

We did it this way because we did not want to risk having to be apart for months and months on end. But this was a personal choice.

Regardless it is legal to visit the US while the process is ongoing. It is always up to the discretion of the CBP whether or not to let you in.

Just to add one more point - if you send too much information, then it is very likely that the information that you really want them to see will simply be lost in the piles and piles and PILES of paper. I'm sure they go through each case thoroughly, but anything past the first few pages (just like a resume) is probably not going to be read with as much interest as the first two.

How are they going to see your little passport stamp (I take it we all agree that this is crucial primary evidence?) if it has been buried under emails, skype logs, movie tickets, pressed flowers, the kitchen sink and whatever elss you have tossed in the poor envelope?

(ok .. so I got a LITTLE carried away with the flowers and sink).

Read the guides, take the advice of HUNDREDS of others that have gone before you. (That's why we are on VJ, not so?) Send what is needed and asked for - put it together it in a clear, concise, organized way that will not have the adjudicator flipping back and forth. Try not to overwhelm anybody - NOBODY likes that. Mail it off - have a glass of wine and then wait. That's all we can do.

I agree that you can definitely send TOO MUCH evidence. If you have really good primary evidence, and you do, then there is no need to fluff it. For sure I would send proof of all 4 trips, but all the info you have does not have to be sent. The passport stamps, boarding passes and photos should be fine. If you want to send 1 or 2 of the hotel receipts that should be great too - as it puts you in the same region as your fiancee, not just the same country and the photos also back this up.

I have to say that I LOVE jezebelseven's idea of using different coloured highlighters to highlight the dates and names etc for each trip! I know, I know... not necessary but love the clarity all the same!

It took NVC only days to recieve our case, however, we were coming out of Vermont. Apparently, CSC sends all approved cases out in batches, so it can take 2, sometimes even 4 weeks for them. Were you in the group that was transferred to CSC?

I THINK that on the books, the service centers say between 2 - 4 weeks for cases to be sent to NVC after approval.

Welcome to VJ and just make sure that one of you (if not both of you) is eager to do lots of research. The more you know the easier you sleep (and honestly, once you send the initial petition off - a huge weight is lifted.)

Best advice - don't get swallowed up in the process (advice passed on to me by another member). This process is a drop in the bucket. Your relationship is still what needs the most attention.
