K-1 Fiance(e) Visa Process & ProceduresAffidavit of Support
QUOTE (Jas_gold @ Oct 11 2008, 05:11 PM) <{POST_SNAPBACK}>
For year 2006, I didn't have much income so I wasn't required to file an income tax. So will it be ok if I just send the income tax return for year 2007. Will that be a problem? I am guessing it wouldn't as long as I have enough current income, rite?
Only past year's return (2007) tends to be a requirement. Other years are optional. You should be fine.

K-1 Fiance(e) Visa Process & ProceduresAffidavit of Support
Copies of bank statements showing deposits from that income.

If your income from your current employer is adequate without using the other income then don't bother including it if documenting it is tricky.

The directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.
  • I-134 signed and notarized.
  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html
  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)
  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

If your income exceeds 125% of the povertyline when counting yourself, prospective immigrant and any dependents, then don't bother with assets (401K, Bank balance, Stocks etc..), it is just extra un-needed data to provide, the consular officer is most concerned with INCOME.

even the I-129f i will do also 2 punched on it? as in everything?
Yes, USCIS uses the 2 holes to bind then in their case folders used at the service center.

This is also recomended by USCIS:

QUOTE
In preparing your packet, please take note of the following:
  • Do not use binders or folders that cannot be easily disassembled.
  • Use ACCO fasteners to hold together thick or bulky applications or petitions. Two-hole punching the top of the material for easy placement in the file is appreciated.
  • The use of tabs assist in locating items listed as attachments. The tabs should be placed on the bottom and not the side for ease in filing.
  • Avoid using heavy-duty staples; instead use ACCO fasteners or heavy clips.
  • Avoid submitting originals unless specifically required. Avoid submitting oversized documentation when possible.

K-1 Fiance(e) Visa Process & ProceduresAssembling the I-129F Petition, Help please
VJ and USCIS assembly instructions are what I used.

1) 2) Keep it simple, USCIS will simply re-order it the way that they need it in the file.

http://www.uscis.gov...00045f3d6a1RCRD

http://www.visajourn...p;page=assembly

I simply bound everything together with a single ACCO fastener coverletter on top, then I-129F, G-325A, passport pics, 2nd G-325A, then all required evidence after that.

3) Read USCIS directions above, simple photo copies are all they need or want, NO need for certified copies.

5) B/W fine.

Having been issued a K-1 is clear indication that there is immigrations intent, it will be hard to get a visitors visa with that intent there. PI is one of the places where they are very critical of visitors visas, and will want very strong evidence proving that the visitor will not attempt to remain in the USA they will want to see very strong ties to PI.

You are wrong, SSN is issued to a person for LIFE, it is always valid, if your fiancee has the number, then enter it on the forms where it asks for it.

This is one less step to do when your fiancee eventualy enters the USA on K-1, wont need to apply for SSN, if misplaced the card, can apply for a replacement card after entry on K-1

What forms should be send back to the Consulate?

As described in Form DSL-1076:

- a photocopy of each page of your passport
- one passport style picture (attached to Form DS 156)
- Form DSL-1076: visa instructions for fiance(e) nonimmigrant visa applicants (checklist)
- Form DS 230 part 1
- Form DS 156 (needs one passport photo attached)
- Form DS 157
- Form DS 156k (the checklist says to return this one as well – however it needs to be signed in front of a consular officer)

The checklist form is actually misleading – at the bottom of Form DSL – 1076 it says: “ You should bring all of the above pertinent documents and the application forms with you to the interview”; thus you should send back the checklist and DS 230 – as everything else is an application form or a document.

K-1 Fiance(e) Visa Process & ProceduresPolice certificate - canadian...
Typically no for persons living in Canada, and YES for persons NOT living in Canada.

QUOTE
Inside Canada: Applicants who are physically present in Canada should contact their local police service or Royal Canadian Mounted Police (RCMP) office regarding criminal record check procedures. Applicants may obtain a certificate of no conviction issued by any Canadian police service so long as it notes that Canadian Police Information Centre (CPIC) or the national criminal records repository was searched using the applicant’s name and date of birth. Applicants should ensure that the search includes all names that they have previously used, including maiden names, prior married names, or names used before Canadian naturalization. (Note: Because records checks based on name and date of birth only are sometimes less thorough than those based on fingerprints, U.S. diplomatic offices reserve the right to request that certain applicants obtain fingerprint-based searches from the RCMP.)

Outside Canada: Applicants who are not physically present in Canada must obtain a Certified Criminal Record Check by sending a duplicate set of fingerprints (taken by a local police force) to the RCMP. Fingerprint submissions must include the following:
  • rolled and flat impressions of all ten fingers taken with black ink (may use a standard FD-258 FBI fingerprint card)
  • full name, date of birth, and sex of the applicant
  • the name and address of the police agency taking the fingerprints
  • the signature of the official taking the fingerprints
  • the reason for the fingerprint submission (U.S. visa)
  • the processing fee of CAD 25.00 or USD 18.00, payable to the "Receiver General for Canada" by certified check or money order.

Fingerprint submissions should be sent to: RCMP, Civil Fingerprint Screening Services, P.O. Box 8885, Ottawa, ON, K1G 3M8. Additional information is available online.

K-1 Fiance(e) Visa Process & ProceduresFinancial Support After Diviorce
For the initial K-Visas you provide an affidavit of support I-134 that is brought to consulate when being interviewed for the visa, this doc indicates that you will provide support while they are in the USA as NON-Immigrants.

When you marry and then file to adjust status from NON-Immigrant to IMMIGRANT, US Citizen/ Spouse MUST sponsor the green-card by providing an I-864 Affidavit of support, this one is the BINDING one that has only 5 ways out of it.
  • Immigrant dies.
  • Sponsor dies.
  • Immigrant naturalizes and becomes a citizen.
  • Immigrant leaves the USA and gives up LPR status.
  • Immigrant works and is credited with 40 quarters of work (10 years) HOWEVER, if the immigrant does not work and instead goes on welfare, you are STUCK repaying the government whatever means tested benefits until one of the above 4 conditions happens, NOT 10 years, this can be a lifetime commitment.

A pre-nup wont protect you, this is a contract between you and the government.

K-1 Fiance(e) Visa Process & Proceduresaffidavit of support - property...
BIG Question why are you using an asset?? Is US citizen fiancee's income below 125% poverty line??

If income exceeds 125% of the poverty line, then don't bother with assets, it only gives the consular officer more questions to ask.

In our case this what the I-134 included.
  • I-134 signed and notarized.
  • Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS
  • Photo copy of IRS form 1040, and W2s for past 3 years
  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past 6 months pay stubs up to a few weeks before the interview.
If you list the asset things the consular officer then just has more to ask questions about and you will have to provide more financial evidence. I have bank accounts, 401k and other things but did not list them on the I-134.

Rule, N/A = Not applicable, means the question truly does not apply, as in further questions for a child when name is "NONE"

NONE means it can apply however the question is NONE, a person could have a middle name however this person does not.
