K-1 Fiance(e) Visa Process & Proceduresinquiries
Not much can be done other than create a tracking account on USCIS.GOV and monitor the status checking every day or so and when you see a date change you know that they are at least touching the case.

Ref: http://www.visajourn...p?showtopic=300

Patience is required, USCIS can take up to 6 months or more to process a petition.

Thanks for everyones input! It's extremely helpful.

For the I-129F, I have two questions:

1) Is it typical to just send the documents on your own, or should I schedule an appointment at the local USCIS field office?

2) 5B: How do I provide a statement of intent to marry, each of us just write a letter saying that we are engaged and intend to marry? Is there a special format for this?

1) You CANNOT turn them in at the field office, you must mail them to the service center that has jurisdiction over where you live, either CSC or VSC.

http://www.uscis.gov...00045f3d6a1RCRD

2) You may want to look through the Example forms, there is a sample letter of intent, can be one signed by both, or separate ones from each.

This is a common topic, many when sending package to USCIS via post office will get bad tracking info, usually the package arrives at the PO box AFTER USCIS has picked up for the day, check the tracking info in another day or so.

Well I looked up what the 2008 Poverty level was, it says for a single person its $10,400 and for a couple its $14,000, so 3X that would either be $31.200 or $43,000. So if I maintain a least $43k in liquid assets then my employment wont be an issue? Do I need some kind of letter from my bank or will just a bank statement work?
She currently lives and works in Singapore so I am hoping she can do her interview there and avoid using the Manila embassy since I'v read they can be a bit difficult.
14000 is 100% poverty line this is for military persons, for persons NOT in the military it is 125% and 17,500 3x is 52,500.

The consulates hold people to the 125% considering that it will be the requirement when adjusting status.

K-1 Fiance(e) Visa Process & ProceduresAOS and employment
If your un-employed, you will need to rely on your savings as an asset, this will need to equal 3 times (125% Povertyline) a little over 52,500 in liquid assets.

OR You can try using a CO-Sponsor, but sometimes this is not accepted in PI.

hi good day!
im a newbie here..
i just sent my package yesterday..we are very excited.i cant wait for my fiance to be here with me..

i met my fiance through my employer who happens to be her uncle.they have been talking online and saw her at webcamera last march, and i askes my employer/friend to introduced me to her, we were introduced online but we started talking regularly few months later..from then on we strted to talk regularly and fallen in love..i came to visit her in her country and we had a good time,,i love her so much.im going to see her again in march.. now my question is this.. i was reading a lot on this website and bumped into this red flag..

i]Petitioner is employed by or has a business relationship with a relative of beneficiary[/i];

will it be a problem because i am working as a healthcare with his uncle's nursing home..been working there since june 2007.

please help me with this question, worried.do i need to resign from my present job??/
You should have posted about this BEFORE sending off the package.

The best way to deal with red-flags, is to "front load" the petition, detail exactly how you met your fiancee in your Fiancee letter of intent.

The reasoning behind front loading is if USCIS sees the red-flag and approves the petition anyway, the consulate cannot use it to deny.

USCIS
California Service Center
24000 Avila Road
2nd floor Room 2312
Laguna Niguel CA 92677

Please advice if this address is correct or if there is anything else that I need to add. I am leaving in abt 20 minutes. Thanks.

Tomorrow being Saturday, is there any concern for sending it by FedEx. Will the delivery happen on Monday?

Seriously - best advice is USPS Priority. Just as fast if not faster and will save a bundle. good.gif
Yep, I remembered a few posts last year when USCIS bumped the rates up July, 30, 2007, several used FEDEX or UPS and sent package July 28 or 29, and got rejected because USCIS received the package after the rate hike. If they had used USPS, USCIS would have not rejected becaues they use POST MARK as date item sent.

Only USPS can deliver to a PO BOX, and also give a post mark if needed.

As long as the translation has a notation by the translator that it is a true translation and is signed and dates by the translator then you should be fine, if not, if you know someone who is conversant in both languages and can read and compare translation and origional and can confirm that the translation is acurate then that person could sign the translation.

QUOTE
Please submit certified translations for all foreign language documents. The translator must certify that s/he is competent to translate and that the translation is accurate.

The certification format should include the certifier's name, signature, address, and date of certification. A suggested format is:

I [typed name], certify that I am fluent (conversant) in the English and ________ languages, and that the above/attached document is an accurate translation of the document attached entitled ______________________________.

I'm filling out the I-129F and I noticed somewhere that it said I had to also fill out a G-325A for both myself and my fiance. Now they're saying we don't send it in with the I-129F. So I'm not sure what to do. Can any of you shed some light on this? Thanks =)

Who gave you THAT advice? USCIS needs both forms as specified, with multiple copies of the G-325-A, each copy signed.

Someone from the 800 number for help filling out a form did =( i keep getting different answers everytime I call. Lol my fiance is on the phone with them now and someone is telling him about the color of the ink? lol. But thank you all for your help.

Unless you can show liquid assets exceeding 3 times 125% poverty line, you wont be able to sponsor the prosepective immigrant without a co-sponsor, and manila is know to sometimes not accept a co-sponsor.

AFAIK, as a K-2 she can adjust as long as she has not attained the age of 21. If adjustment has not occured by 21 then you could not petition an I-130 for her but her mother would because the step child relationship did not occur in time.
Correct, a K-2 can and will be issued up to age 20 or so.

What you are thinking is step-parent filing an I-130 for a step son or daughter, this is not the case for K-1/K-2 K-2 can adjust status directly from their K-2 without requiring I-130.

K-1 Fiance(e) Visa Process & Procedures1-864 cosponsor duration of sponsorship
In the case of the I-134 used for the visa, the sponsorship ends when status changes, that is when the NON-Immigrant becomes an immigrant and gets green-card.

The Co-sponsor is not obligated to also be Joint sponsor when filing I-485 after marriage and adjusting status.

The visa pititioner (Fiancee) US Citizen Spouse MUST sponsor, and if financial situation changes they can adjust status WITHOUT the joint sponsor.

NOTE I-864 is NOT used for the visa. I-134 is used for K-Visas. I-864 is for sponsoring a GREEN-card, it is used for adjustment of status.
