K-1 Fiance(e) Visa Process & ProceduresK-2 visa deadline before 21st birthday
The date when green-card is approved, needs to enter USA, spouse marry, and file to adjust status BEFORE turning 21.

It happens often for a K-2 to "Age-out" when adjusting status that close to age 21.

K-1 Fiance(e) Visa Process & ProceduresEXPEDITE FOR MEDICAL CONDITION
HIV tends to be a medical condition that makes a person in-admisable to get an immigrant visa. Who has it? And no, to qualify for an expedite on medical grounds the condition would need to be urgent, as in life/death.

Section 212(a) of the Immigration and Nationality Act reads:

(a) Classes of Aliens Ineligible for Visas or Admission.-Except as otherwise provided in this Act, aliens who are inadmissible under the following paragraphs are ineligible to receive visas and ineligible to be admitted to the United States:

(1) Health-related grounds.-

(A) In general.-Any alien-

(i) who is determined (in accordance with regulations prescribed by the Secretary of Health and Human Services) to have a communicable disease of public health significance, which shall include infection with the etiologic agent for acquired immune deficiency syndrome,

You are fine, I cannot tell you how many times I see people post about that here on VJ. That is standard boiler plate from the post office, it WILL be delivered fine.

K-1 Fiance(e) Visa Process & ProceduresDid I screw up?
Common post, when people use tracking to confirm delivery to a PO box, USPS will show that error when it is delivered to the PO Box.

K-1 Fiance(e) Visa Process & ProceduresMeeting my Girl soon! questions?
Get a couple 2"x2" passport photos.

Get plenty of pictures together, especially with family. Document the trip, keep receipts, itinerary, etc...

Foreign Birth cert and passport needed when interviewing for the visa, not needed when filing petition.

K-1 Fiance(e) Visa Process & ProceduresDoes credit score affect K1?
NO  could even have had a recent bankruptcy, all they are concerned is if income is sufficient to support an immigrant, and this does not com up until interview time.
YuAndDanMaleChina2011-04-05 18:03:00
K-1 Fiance(e) Visa Process & ProceduresRFE - should I get a certified copy or will the one I have do?
What USCIS says:

USCIS no longer routinely requires submission of original documents or "certified copies." Instead, ordinary legible photocopies of such documents (including naturalization certificates and alien registration cards) will be acceptable for initial filing and approval of petitions and applications.

http://www.uscis.gov...00045f3d6a1RCRD

Send an ordinary photo copy of it unless the RFE specifies a certified copy.

K-1 Fiance(e) Visa Process & ProceduresWaiver I-129F
If USCIS issued an approval notice "NOA2" then it was approved, you simply closed it shortly after it was approved.

So yes you need to request a waiver.

K-1 Fiance(e) Visa Process & ProceduresDo we need wedding cards at the POE?
Nothing is needed at the POE other than Passport, and immigrations packet. You will be asked a few questions, fingerprint, photo taken, and I-94 card stamped.

K-1 Fiance(e) Visa Process & ProceduresFiling fiancee petition

NOT that good of an idea to mail from PI as mail does get lost. Probably almost as fast to take with you if you're not staying to long. Definitely saver.

Can always use FED-EX, UPS, or other Currier service, and use the physical address of the service center as spelled out in the form's directions.

K-1 Fiance(e) Visa Process & ProceduresFiling fiancee petition
Not talking about removing conditions from a 2 year green-card.

Moving to the K-1 forum.

Yes US citizen can mail the petition to the USA to the center that has jurisdiction over where the US Citizen has domicile in the USA.

OR can simply marry over there and file for a spouse visa which would be much less expensive, if citizen has residency over seas, and has been resident more than 6 months overseas, can simply file for a CR-1 spouse visa at the US consulate where they are resident.

K-1 Fiance(e) Visa Process & ProceduresI-129f Question 19 - International Marriage Broker
Back in my day I asked them about this, no they are NOT an IMB they are a dating service that is based out of Hawaii.

Here is what Blossoms had to say:

While we do not consider our company a marriage agency because we do not charge the women nor do we charge couples that end up marrying that meet on our web site. But our government has written a very broad definition of Marriage Broker so we will leave it up to you what to fill in.

Not sure if it hinders your petition to state that you used a marriage broker or not.

Sorry for the ambiguity but this law is an odd item. If you say you did not use a marriage broker you should let your Fiancée know so that at her interview she does not mention Cherry Blossoms.

Would suggest you call the USCIS and ask for clarification: 800-375-5283, at the voice prompts push, 1, 3, 4, & 9 to get to the correct department.

Over 200 of our clients called the USCIS and spoken to agents (it can be a long hold on the phone – hour or more) and all but two have reported that they were told Cherry Blossoms is not a Marriage Broker. You may want to call to confirm.

YuAndDanMaleChina2011-04-07 18:35:00
K-1 Fiance(e) Visa Process & ProceduresI-129F RFE?
I-129F only needs a copy of US Citizen's passport for two reasons, First to show traveling to foreign country proving meeting within past two years, and second to prove citizenship, if not using a US Birth Cert.

I-129F doe not need a copy of foreign passport, unless using it to show visiting the USA or a third country where meeting US Citizen.
YuAndDanMaleChina2011-04-08 09:58:00
K-1 Fiance(e) Visa Process & Proceduresaffidavit of support - required before interview?
It is not USCIS that needs it, it is needed for the visa interview.

If you read somewhere needed in middle of process yes for some visa types (CR-1 IR-1 SPOUSE visas) it is requested by NVC around the middle of process.

K-1 has no processing an NVC, so the I-134 is brought to the interview.
YuAndDanMaleChina2011-04-08 09:24:00
K-1 Fiance(e) Visa Process & ProceduresPriority date *blank*
Essentially K-1 has no priority because there is no limitation on how many are issued every year.

K-1 NOA 2 will have an expiration date, however the consulate can and will extend this if they cannot interview prior to that date.

Example one has not pri-date either.

K-1 Fiance(e) Visa Process & ProceduresPossible to wait this process out living in fiance's country?
Yes, many do.

Note K-1 is a tough nut for the Guangzhou consulate, they tend to deny them way more than CR-1, if you are thinking living over there while processing, why not marry first and then file the I-130 for spouse visa while you are living over there. The resulting visa gets green-card the moment they arrive, the consulate looks at people who are married as seriously committed vs just be engaged.

K-1 Fiance(e) Visa Process & ProceduresHelp! Getting Married Just before leaving on K1 visa
K1 is for unmarried couples, not people who are married to enter the USA.

If an overseas marriage is a priority then marry first then file an I-130 for a CR-1 spouse visa and forget the K1. Then wait 8-9 months at interview for the spouse visa before coming to USA.

K-1 Fiance(e) Visa Process & ProceduresG-325A for fiancee?
Package needs two G-325A forms included, one from petitioner (US Citizen) and one from benificiary (Foreign Citizen). Each form needs to be an originally signed form, it cannot be a scan or a photo-copy. So beneficiary will need to download one fill it out and then mail it to you.

Or you can always fill one out for beneficiary, scan it and email to beneficiary, where they will sign it and return it to you by snail mail.

K-1 Fiance(e) Visa Process & ProceduresCo-sponsor question..please advise
Depends on income, needs to count any people currently responsible for. For example they co-sponsored a K-1 visa, the K-1 then entered the USA and adjusted status, however they did NOT joint sponsor the green-card and did not provide an I-864, so are no longer responsible for that immigrant, so don't need to count them.

K-1 Fiance(e) Visa Process & ProceduresFiling for a K1 Visa when she is pregnant

thanks YuAndDan for this info. - i am thinking then, if the child is born there, and my fiancee has the K1 Visa in hand, can the child come here then after filing CRBA? I am guessing that the child will need a passport as well.

many thanks for answering my questions, you guys are great! ~~ sorry, if i have not updated my personal info., but will soon :)

UPDATE: I have just re-read it on the thread above and I guess a CRBA/Passport is what is needed.

Can register the birth at the embassy or consulate, and order a US passport, the child then can come to the USA as a US Citizen. Some countries do need to do additioal documentation like issuing an exit visa to the US citizen child born over there.

K-1 Fiance(e) Visa Process & ProceduresFiling for a K1 Visa when she is pregnant

YES!, I thank you for your kind replies and options. The scenario above is quite likely the scenario that I will embark in since I can not go there to marry her. What is a CRBA? How would I go by applying for it if it came to that case? (there is no guide here for it).

Thanks.

I think means Citizen Registered Birth Abroad.

More: http://travel.state..../birth_593.html

Since you did not fill in profile details with country that will be immigrating from, I cannot give you a link to the US consulate in the foreign country that details what to do about registering the birth for citizenship.

K-1 Fiance(e) Visa Process & ProceduresFiling for a K1 Visa when she is pregnant
Another option is to make a trip and get married now and then file an I-130 for a spouse visa (CR-1) If child is born prior to visa issuance, the child will not then be born outside of wedlock, making it easier to get child citizenship registered.

CR-1 is also less expensive overall, and does not take much longer than K-1 to get, also CR-1 gets a green-card upon arrival, K-1 does not.

Note The K-1 can start them overseas, but they are not a requirement of the visa and in most countries not needed for the visa medical, they are a requirement of immigrations, so need to be done for adjustment of status..

K-1 Fiance(e) Visa Process & ProceduresBringing my child
A child in common should be a US citizen by birth and registered at the US consulate getting a US passport, no need for a visa. Unless perhaps birth was before petitioner became a US citizen, as in naturalized after child born, and then filing petition for fiancee.

K-1 Fiance(e) Visa Process & ProceduresI-134 invalid when you file for I-184?
Note: Interstate 184 (I-184) is a short Interstate Highway spur route of Interstate 84 located in Idaho. I-184 connects I-84 travelers to downtown Boise.

We are talking about I-864 which is an Affidavit of support for an immigrant Green-Card holder, this form is used when adjusting status, or for Immigrant visas like CR-1, or IR-1 spouse visas.

But yes, once a person adjusts status from NON-Immigrant K-Visa to immigrant, the I-864 takes over.

You'll need to establish that you have legal residence in the UK before the London embassy will agree to take your case. Just because NVC forwarded it there and you have a visa doesnt mean it will be possible to continue in the London embassy.

Read this thread, not exactly the same situation but similar...

K-1 Fiance(e) Visa Process & ProceduresCivilly registered Long-form certificate (birth certificate)
Moving this to the K-1 forum, it sounds like you are dealing with an RFE for the I-129F petition.

A US citizen can use, Birth Cert, or Complete copy of US passport as proof of citizenship. Beneficiary's birth cert is need at the time of visa interview. Also beneficiary's passport should not be needed for filing an I-129F petition, they are probably asking for a full copy of petitioner's passport as alternate proof of US Citizenship.
