You can wait to do the I-134 until closer to interview.

Note the I-134 has been updated recently bringing it in line with the I-864.

Treat it like the I-864 and provide similar evidence.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.
  • I-134 signed and notarized.
  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html
  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)
  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

If your income exceeds 125% of the povertyline when counting yourself, prospective immigrant and any dependents, then don't bother with assets (401K, Bank balance, Stocks etc..), it is just extra un-needed data to provide, the consular officer is most concerned with INCOME.

This is because they are handled by the IV unit, but again K-Visa is NON-Immigrant and uses things like DS-156 (NON-IMMIGRANT) Visa application, I-134 which is for NON-Immigrant, and later files an I-485 to adjust status from NON-Immigrant to Immigrant. Only Immigrants get a Green-card, NON-Immigrants need to adjust status to get green-card.

1) NO no0pb.gif USCIS, NVC, and Consulate are NOT concerned with foreign citizen's employment status, they are concerned with US Citizen's income status, hence the I-134 for the visa interview.

2) NO no0pb.gif USCIS does not need to be notified of either person's employment status.

3) NO no0pb.gif USCIS does not need to be informed. Later when it reaches NVC inform NVC or DOS or Consulate of address chnage so that they can send the packages to the correct address.

All spousal visas K-Visa or CR-1 take time to process through the system, The CR-1 is the least expensive overall, you marry first and then file an I-130 for a visa. CR-1 has the advantage of a green-card at entry to the USA, so can work, and travel, K-Visas have the added expence and paperwork of adjustment of status.

Since you are discussing marriage and immigration the intent exists, so a B-Visa is NOT an option, using one with the intent to immigrate is visa fraud.

J-Visas can also have a 2 year foreign residency catch that can cause you problems.

One note, the US consulate in Japan and USCIS will recognize the divorce from Japan, I don't believe the Phil Embassy needs to do anything.

All that will be needed later at the time of interview will pe a Phil Police cert, and Birth Cert.

Yep, when we were planning on filing the I-129F, when I visited my wife, I had her sign all 4 pages of her G-325A, sign a letter of intent, and she gave me some passport pictures.

Even IF USCIS some how accepts a reason for not meeting, the consulate can deny the visa on the grounds of "Non-Bona fide" Relationship, having NOT meet in person.

For the most part all a lawyer does is give you a questioner that you fill out, and the lawyer transfers your answers to the I-129F, G-325A forms.

Only other option that will save you problems with renewal of visitors status, and would allow your SO to at least be able to work while in the USA, would be to Marry and file for a spousal visa DCF, this would get a green-card issued on entry to the USA, the green-card will be a CR-Green-Card valid for 2 years.

Only wrinkle with this is your domicile status in the USA, if you did not maintain US domicile you will have problems getting the visa.

She could enter the USA on a visitor's visa, and in some cases you can get one that is valid longer than 6 months a valid reason for such a long stay may be needed. Keep in mind being a visitor she cannot work.

The stay can also be extended while in the USA.
