1) Nope, once the K-1 is affixed into your passport, the next entry to the USA WILL be as a K-1 Visa holder, and the visa gets used.

2) Simply DELAY returning the packet 3 (DS-2001) to the consulate, they will wait up to 1 year for you to declare yourself ready for interview. INTERVIEW for the visa AFTER the wedding and birthday.

Do not return this: http://www.usembassy...t_Readiness.pdf Until you are ready to interview for the K-1.

I've seen reports of success attempting this but there's no way to be certain in advance. I'd recommend following the above advice instead of trying to enter without using the visa in the passport.

Yep, and if you have a hard and fast plan for your wedding, I would do a religious wedding (NO MARRIAGE LICENSE or LEGAL) on VWP, then get the K-1 and return to USA and do the LEGAL marriage in front of a judge to satisfy the K-1.

That is a relief.

i was thinking of calling the embassy tomorrow to see if they have any info on the case, Do you think it would be a good idea to go ahead and do that?? or should i just wait??

Thanks again, you guys are awesome. <3
First check case status here: http://www.uscis.gov/portal/site/uscis (Enter petition number in the box in the right column)

If it has not been approved yet, then sit tight and wait.

The four month notation is standard wording, the consulates have the authority to extend the petitions validity. Contact DOS Visa services and check up on case status, you will need the DOS case number (Begins with DBL) if you dont have the case number, contact NVC and ask.

Hello

My girlfriend(Colombian) has been in the US for 3 months now on a tourist visa. I'm an American seeking advice what to do. We plan to live in the Bahamas ( I have a work permit) . We need to leave in 2 weeks

Should we get married in the Bahamas and apply for the K1 visa from there?

Can she travel to the US with her US tourist visa while the K1 is pending?

Any other options? I know I could get married in the US under her tourist visa, but it would take months until she has AP..

Thank you
Hard to do when married, K1 is for fiancees!

If you marry you will be filing for a CR-1 or K-3 visa, preferably the CR-1 because it costs less and results in a green-card upon entry to the USA.

Your second question is a FAQ: http://www.visajourn...cation.html#4.6

Moving to K-1 forum.

NOTHING, the consulates have the authority to extend the validity of the K-Visa NOA2 expiration, this is the case in many consulate, especially the slower consulates like China. China NEVER interviews before the expiration date of the NOA2 letter.

We just got approved on our I-129F, and my fiancee's interview will soon to come. At the same time we have a Consular Report of Birth Abroad appointment for our newborn baby in 2 months. This CRBA appointment will come before my fiancee's interview. If my child passes the CRBA appointment and gets his passport. Then When it comes to my fiancee's interview, reguarding the i-134 support form, the CO only ask for the income for 2 people right? 1 is me, the other one is my fiancee who i am sponsoring. Or, they will count it as 3 since we have a child?

ALL dependents count. Matters not their citizenship or immigration status. If you had 3 children by a previous marriage that were living with the ir mother and you are paying child support...they count.

Your family size (assuming this is the only child dependent on you or your fiancee) is 3

a co-sponsor is not an option for me, if my income is good enough for 2, then can i bring my child over later and have my fiancee come over first? Will the CO accept this?
Why not simply get a co sponsor who can co sponsor your fiancee (Count them self and your fiancee, the co sponsor wont count your child)

On your I-134 you will still count yourself, fiancee and your dependent child. 3

K-1 Fiance(e) Visa Process & ProceduresNon-Immigrant Visa- Why?
QUOTE (KimandRuss @ Mar 9 2009, 02:18 PM) <{POST_SNAPBACK}>
I should add that the Embassy will usually treat the K-1 as if it is an immigrant visa because the purpose, afterall, is to immigrate. wink.gif That's why the same forms are needed.

Correct, the embassy or consulate processes K-Visas through their immigrant visa unit, doing the more extensive name checks for an immigrant, and they apply the same level of inadmissibility standards to the K-Visa as they do to other immigrants. They also interview the K-Visa beneficiary as if they are immigrating. Because of this level of checks ate the consulate, many K-Visas when adjusting status get approved without an interview.

K-1 Fiance(e) Visa Process & Proceduresnewbie question...do I need a lawyer
You DO NOT need a lawyer. Being denied a visitors visa has no effect on processing of a K-Visa.

A lawyer cannot make the process go any faster, if one tells you that, "RUN AWAY!"

Simply follow the K-1 Guide here on VJ.
YuAndDanMaleChina2009-03-06 18:49:00
K-1 Fiance(e) Visa Process & Proceduressponsoring when you are receiving govt benefits
No it will NOT hinder the process, all they want to know is if the immigrant will be sponsored and supported, and the IMMIGRANT won't go on government assistance (Welfare)

So if your income is insufficient, you will need a joint sponsor who's income is sufficient to support the immigrant.

Moving this to the K-1 forum, since you say fiancee visa. CR-1/IR-1 visa forum is for persons petitioning for a spousal visa and are already married.

K-1 Fiance(e) Visa Process & ProceduresMilitary Expedited K1 Visa
Typically a military expedite has to do with getting the K-1 visa approved BEFORE the soldier is deployed overseas, not to get the K-1 approved before the soldier returns to the USA. In this case more than likely they will say there is no reason to expedite because in any case sooner or later the soldier will be in the USA BEFORE the K-1 visa is issued.

Pregnancy is not a reason to expedite.

Interview can take place where you are a RESIDENT, if you have a resident visa for Hong Kong, then you can interview in Hong Kong, if not then interview will be in Manila.

Note you will need police certs from both places if you have been resident in HK for more than 6 months.

Yes I agree with that advice. My wife lived in Macau and she took her interview in Hong Kong. Just tell your fiance to put down the Hong Kong consoulate. Also make sure they do it right, they sent all the paper work to Manila from the NVC so I had to have them transfer the paper work to Hong Kong.

I would attach a copy of passport showing a residency visa, or if you have a HK ID, attach a copy of that to the I-129F.

K-1 Fiance(e) Visa Process & ProceduresFilling out a green I-94 piece of paper (commonly thought of as the Visa Waiver form)
QUOTE (SDARCY13 @ Mar 20 2009, 08:47 AM) <{POST_SNAPBACK}>
So The days of filling out a green I-94 piece of paper (commonly thought of as the Visa Waiver form) on a plane for entry into the US have ended. We now need to fill in an online request to enter the States, at least three days before travelling otherwise you'll be turned away at US immigration.

The form is called the Electronic System for Travel Authorisation form or ESTA for short. And here is the website;

https://esta.cbp.dhs...A5-9D0721EFE754

My question is this, I will be travelling to the States in May on a K-1 visa to get married in June and was wondering do I need to fill this in, or will whatever is in my brown envelope I can't open contain sufficient information? My Concern is filling it in and not needing to and causing harm to my entrance to the states, or not filling it in and causing harm.

? You are a citizen or eligible national of a Visa Waiver Program country.
? You are currently not in possession of a visitor's visa.
? Your travel is for 90 days or less.
? You plan to travel to the United States for business or pleasure.

Can anyone please shed any light on this?

Cheers,
Shaun.
You WILL be using a VISA to enter the USA so wont be doing a VISA waiver. On the plane you fill out a WHITE I-94 card. And you will not be turned away for not filling out the online form.

If you're really concerned, 30 minutes with an immigration lawyer might be money well spent.
Mabey not a K-1, but he had to file an I-130 for a spousal visa along with I-485 to adjust status. The I-130 needs to be noted on the I-129F petition.
