may be but u.s embassy islamabad told me that they denied and sending case back to U.S.

They may only know about the first denial, and not that USCIS re-affirmed case and it is on it's way back to them. it may be at NVC waiting to be sent back to the consulate.

Contact NVC about status, and if it has not been sent overseas, you can ask them to pull it, or ask DOS Visa services.

I) It shows to the consulate that you will be filing a I-864 later in the states when adjusting status. Just shows that you are committed to not allowing the person you are bringing to USA to become a charge of the state.

2) I-134 covers time from entry to the USA until Approval of adjustment of status (Green-Card) ate which time the I-864 that you must provide goes into effect.

My only thought is that perhaps there is some state-specific law that the adjudicator is concerned about applying to a particular case.
Something like age of majority, which is different in different states?
(There might be other examples/possiblities - this is just a guess/my first thought.)

As far as I'm aware, this isn't something you're required to state as part of the petition.

My thoughts too, some states do not allow marriage under a set age, if consulate sees younger than that age they may ask where will get married.

No. Not required to indicate where you will marry, only that you intend to marry sometime within the 90 days after entry to the USA.

We married in our home state, however could have easily married in any other state if we wanted to after arriving on the K-1.

You can always note it on the letter of intent, however that can always change after filing the petition.

This is not required for the I-129F. The only thing required is proof you have met in person and your letters of intent to marry.

Length of relationship prior to filing the petition does factor into the interviewing officer's decision process when considering the bonafides of a relationship, short relationship will get more attention than one that built up over a year or so.

However yes this is normal, NVC trips off some name checking "AP" and then sends on to consulate, typically 2-3 weeks at NVC.

I hope you provided a lot of bonafide relationship evidence in the initial I-129F petition filing, from your signature, from meeting online for first time to petition filing in just over 1.5 month probably will set off some possible red-flags at the embassy in Manila.

Best to use Priority mail. And no First class is not the same as Express, first class is standard mail using a normal postage stamp.

Priority mail tends to get it there in 2 days or less, Express is overnight service and you get to pay extra. Either method will not make the processing go any faster.

Priority with tracking is fine.

I have seen a few say they have sent additional evidence with a cover letter explaining what is being sent and why, and copy of petition NOA1 letter and getting it added, and other posts stating don't bother, additional stuff may get lost and never matched up with the petition.

If you do send stuff, sent it to the center handling the petition, not the TX PO box.

Yep, you need to be residing in a counselor district for at least 6 months.

Again visit the site I linked you, there you will find out how to avoid pitfalls with the Guangzhou consulate, they like handing out denials to K-1 like candy.

Your GF is mainland Chinese so should be dealing with Guangzhou, not HK.

Here is my take, you have been over there for some time, why not marry, and then file an I-130 petition to the Embassy or consulate over there, and then be able immigrate to the USA? This is the common approach for many who are over there studying and find something, this approach will save you time, and a lot of $$$$ as in over $900 in fees. Your GF/Wife would get a green-card upon entry to the USA.

DCF Spouse has a much higher success rate at the Guangzhou consulate than K-1.

Yes needs to be paid by check or MO drawn on a US Bank account, cannot be paid to a consulate overseas.

Also one red flag you brought up, you have been living overseas, and may be considered to have given up US domicile, this needs to be reestablished if you plan on using an I-134 to sponsor the visa later at the time of visa interview, an affidavit of support needs the sponsor to have US domicile.

A valid point, if still in the USA can always visit the police in the area where lived, and get a report of no criminal record.

I have read of others getting reports like that in cases where beneficiary was a student in the USA, not a resident as in former green-card holder.

Thanks everyone, I was having a "panic" attack there, and I just returned from the Post Office, so our Journey has started. I thought April Fools day would be a good day to start this process. I have been on the Candleforlove site, and have seen the horror stories (Although I have not seen the front loading forum you spoke of. I'm hoping we are somewhat safe in this process, both in late forties, both professionals, no money issues, no kids to consider, etc. Plus, unlike many here, we are fortunate to get to see each other quite often with my work. Actually had to "time" the submittal with her retirement, etc. (Didn't want the interview before the end of 2011). So thanks again, I'm sure this will not be the last question I have. Thanks. Darryl

No you do not need to remain overseas while paperwork is being processed.

Get green-card upon entry to the USA, so yes less paperwork after arrival to the USA, there will be additional paperwork prior to getting visa though. Costs are less.

CR-1 spouse visa gets green-card the moment arrive in the USA, the visa will be stamped temp green-card, and actual care arrives a few weeks later.

K-1 is essentially an option for cases where someting may prevent getting married overseas, as in an age limit, or added complications that prevent or restrict a US Citizen from getting married overseas, that is not an issue in the USA. Many would do K-1 because for a long time it was a quicker option, but for the most part the time savings is no longer there due to improvements at USCIS and the NVC.

K-1 may give you a visa is a slightly shorter time, perhaps a month or so, when factoring in the paperwork at NVC.

Compare:

K-1 (FEES ~$1800)
K-1 cannot take a job until getting EAD or Green-card, this can take MONTHS after arrival
K-1 cannot get a DL until they have EAD or Green-card, can use foreign DL in most states though.
K-1 becomes land locked and cannot travel out of the USA until having green-card or AP doc, which can take MONTHS to get.

CR-1 (FEES ~$900)
CR-1 gets green-card the moment they arrive in the USA so can take a job immediately
CR-1 gets green-card so can apply for a DL
CR-1 gets green-card so can immediately travel, conceivable the next day, passport is stamped I-551 which allows work and travel

Essentially K-1 visa holder will be unable to work for at least 4-6 months after arrival.

IF work shortly after arrival is desired, then the better visa is CR-1, (marry first, then apply for visa) CR-1 spouse visa costs less and gets green-card upon arrival to the USA, also with much improved processing, for most consulates CR-1 tends to take perhaps 1 - 1.5 months longer to get than a K-1.

CR-1 does not take much longer to get than a K-1
