Two things, I-134 is NEVER filed with I-129F when initially filing for a K-Visa, it is always brought to visa interview.


Secondly, Casablanca does not use or require the I-134, but is a good idea to have one handy at the interview just in case.

I think it will depend on who evaluates the packet on if it will be an issue or not... The intent letter was scanned and printed also...
In hindsight I should have asked her to fedex the docs instead of filling them out and signing and scanning and emailing them.
That was our case also, letter of intent was photographed by my wife and emailed to me, I then printed the photo. This too was not an issue.

I suspect you wont get an RFE for that either.

Bring the originals to visa interview if you dont get and RFE for them.

K-1 tends to be Quick, however if she wants to be able to work shortly after entry, your fiancee needs to first MARRY, and then file for EAD AND adjustment of status, it can take months to get EAD and/or green-card.

CR-1 is an IMMIGRANT visa and gets green-card upon entry to the USA, this allows the ability to take a job soon after arrival.

K-3 is a NON-immigrant visa which is not work authorized, getting work authorization requires filing for EAD and/or adjustment of status, EAD and/or green-card can take months to get.

K-3 is an OPTIONAL visa type developed when USCIS was taking a very long time to approve I-130 for spousal visas, the K-3 allowed the foreign spouse to enter the USA and WAIT for I-130 approval. Since USCIS has been approving both I-129F for K-Visa and I-130 for CR-1 visa on the same date lately, this has defeated the reason the K-3 exists, (WAITING for I-130 approval).

You can get a CR-1 in just about the same time it takes to get K-3, CR-1 is also $800 less expensive than K-3.

the Citizenship Clause of the Fourteenth Amendment to the United States Constitution provides that birth "in the United States" and subjection to U.S. jurisdiction at the time of birth, entitles one to citizenship.

The courts have never ruled on this but it has been said that in Mcain's situation was that he was born subject to US jurisdiction when he was born in the Canal zone while his parents were on military deployment. Had it been different there would have been challenges to his eligibility.

One note about K-3

If considering K-3 think carefully about it. CR-1 and K-3 tend to take about the same time, K-3 may save you about a month, however the K-3 has the added pain of adjustment of status, and it NOT a work authorized visa, so also has the added period of limbo waiting for EAD to be able to do things like take a job, get SSN, etc...

For the most part CR-1 tends to take a bit longer than K-3 to get if you prepare for NVC when they request I-864 fee, and Visa fee, as well as documents requested by NVC. In many cases the CR-1 petition reaches the consulate just before K-3 interview, which causes K-3 to get dropped and the interview becomes a CR-1 visa interview.

K-3:

K-3 was developed at a time when CR-1 was taking much longer that today, NVC has greatly streamlined the CR-1 process to the point where K-3 becomes irrelevant.

Also you will be forfeiting the $455 already paid for K-1.

The directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.
  • I-134 signed and notarized.
  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html
  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)
  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

If your income exceeds 125% of the povertyline when counting yourself, prospective immigrant and any dependents, then don't bother with assets (401K, Bank balance, Stocks etc..), it is just extra un-needed data to provide, the consular officer is most concerned with INCOME.

You need to provide proof NOW at the time of filing the I-129F that you are free to marry, so need to provide a copy of divorce decree with the I-129F.

But I've already received Package 3, I'm just waiting for my canada police report. so you meant even the I-129F approval expires, however, our K1 case is not expired yet?! as long as the General Consulate in Guangzhou mailed me the package 3, so they already have our status in the immigration status??

Do I still need to apply extension of the I-129F approval from both General COnsulate in Guangzhou and Immigration service in Vermont?

The consulate will extend the validity of the I-129F approval for however long it takes for them to assign an interview.

Simply wait on returning DS-230PT1 and OF-169 until you have the CA police cert in hand.

When Guangzhou posts the P-3 packet, you have up to 1 year to respond to this packet that you have the required documents for interview (The police report from Canada) once you have the required docs in hand you can then send P-3 back to the consulate (OF-169 and DS-230 PT1), they will then schedule an interview.

I would work on getting the CA police report while waiting for I-129F to process through the system, and perhaps you will have that report before GUZ mails the P-3 packet out.

Mostly in line, however #6 can be an issue, a green-card is for permanent residency in the USA, it is not for the convenience of living in two places, they (DHS) can and do catch on to this and can revoke green-card if the suspect this. Any period of absence from the USA can be considered to be abandonment of LPR status, even ones less than 6 months.

I have question - how did they stop her BEFORE she boarded the plane? I've flown internationally many times, and I've never had a customs agent go through my bags before I boarded a plane. I'm just curious how they found these documents....

US POE has their customs agents located in the airports in Canada, is called "pre-clearance", this is done also in Ireland.
