Does anyone know if this is the case for Latin based alphabets?

I understand that chinese characters are very different. But the Croatian alphabet is very close to the Roman alphabet. I'm just wondering because names such as Jose vs. José or Francois vs. François or Joao vs. João.

I could've sworn I've seen a friend's whose driver license says João instead of Joao. But I'm not entirely sure. I should find their email lol. His would simply be Sr?an vs Srdan/Srdjan.

Seems like a trivial question, but it's important to him...so I'm trying to find him a correct answer.

Driver's licenses are issued by the individual states, so one state may, and another state may not do this.

A little bit more of an inquiry on his part. He's somewhat adamant of keeping his native spelling for official documents (future GC, driver's license, etc). It would be two letters out of his whole name that are not found in the Roman alphabet. Is he going to be able to do that? Or does he have to settle for the Americanized name?

My wife's green card does not have ?? on it, and even in cases of Chinese married to Chinese they use Romain-zed spelling, in the case of Chinese is called "pin-yin", nope, I don't think USCIS has character support for anything on the card other than the standard 26 character alphabet.

I dont know where you heard that a PO box was not a good place to receive correspondence from the USCIS?? That is where I had our stuff going. I am in the military too and was deployed during the time I applied for my wife. You can use any mailing address that will be checked. Are you going to be deployed soon or deployed now? If so, you can expedite the case by calling the military helpline. If you need any help with it, let me know. I can tell you what I did for my wife's petition.

I used the G-1145 and got SMS updates while I was in kuwait. Helped me let my buddy know when to check the mail for letters.

As far as physical address where you guys would be living....you can put your parents and just do a change of address once your fiancee is in the US and you have a good physical address where you guys will live.

I think the confusion is between Petition (I-129F or I-130), and Affidavit of support (I-134 or I-864). The petition can have PO BOX, however later the Affidavit of Support needs residence address, to show US Domicile.

I-134 used for K-Visas has "Residing at", this is where sponsor lives, not a mailing address.

I-864 used for CR-1,IR-1 and later for K-Visas adjusting status, has 2 addresses for sponsor, Mailing address, and Residence address.

Depends on where and what the cause of denial.

If for example, the consulate officer denies the visa for "Non Bonafide Relationship" and sends back to USCIS, many simply get married and file an I-130 for a spouse visa.

In the case of K-1 Visa denial at consulate, USCIS will do one of three things with the denied case.
  • They Expire the K-1 petition, and send letter to petitioner to try again.
  • They Re-affirm the petition and send it back to consulate for another interview, they did not believe the consulate's findings.
  • They REVOKE the petition usually placing a mark of MISREPRESENTATION on the case. (This can be serious and can affect any future petitions, it needs to be addressed when petitioner gets the notice of revocation even if they have an I-130 in process for spouse visa.)

Back in 2006 I had to mail our petition to Vermont.

From time to time USCIS can and does change procedures, now ALL I-129F fiancee petitions get sent to Texas no matter where you live, who knows perhaps next year all petitions get sent to the Chicago address. Texas will then send the case to the center that handles your petition for where you live, or they may send to a center that is not as back-logged for work-load shifting.

This is why you confirm the most up to date info at the source.

Why not marry your fiance(e) and go down the I130 route. You will still have to return home, but it will reduce your cost and time and when all is approved you will have a Green card and be able to work from day one.

This has to do with IMBRA law, has to do with excessive petitions.

I am not fully versed, but I believe has to do with going all the way with the K-1, as in approved, and then used, only to have failure after used. Then again if USCIS has issue with a second petition within to years, they can require a waiver.

In essence could file an I-129F tomorrow for another K-1, the first petition did not result in a marriage and green-card... Especially if you get the first one revoked.

Approved as in I-129F approved by USCIS, or as in interviewed by consulate?

If not interviewed yet but petition was approved, I would call DOS Visa services and get it withdrawn.

If was approved and has visa, again I would contact DOS visa services and ask about it, they may revoke it. The Visa is essentially useless for the visa holder, it cannot be used to enter the USA and marry someone else.

Applicant means the person getting the visa, you are a US citizen and not getting a visa only non-us citizen is the "Applicant", when they say "each" they mean the K-1, and then any K-2 child also getting a visa. It says "Each applicant" not "Each K-1 Applicant"

Third option is to marry now, file an I-130 for a CR1 spouse visa and don't overstay the visa, and simply return home then interview for the CR-1 when the time comes. In this economy it is the least expensive route, (~$900) vs (~$1800, $1900) To adjust status from current visa or from a K-1.

If dont overstay current visa and if the visa is a multi entry one, can always visit while the I-130 is processing.

Lastly The I-130 (CR-1) will get work authorization upon entry to the USA, K-1 and adjustment of status tends to wait MONTHS for either EAD or Green-card in order to take a job.

Sure you CAN! However, you will no longer be fiancee's, the K-1 is a FIANCEE visa, not a SPOUSE visa. You WILL be starting over bu filing an I-130 for a spousal visa.

Here is what many do, they visit during the process, and through a nice "Engagement Party" and don't get married until after arriving on the K-1, we did.

Avoid doing any type of ceremony, in some countries even having a "religious" ceremony constitutes a "LEGAL" marriage, and the USA recognizes any legal marriage.

Here is an example of a couple that married prior to coming to the USA on visas that were for UN-Married people.

Keep in mind by they time of interview the I-134 may be a bit stale. If you did not attach a copy of 2010 IRS return to it, the consulate may ask for a newer I-134 with newer tax return attached.

Good question - thanks for posting. I was considering sending a letter of intent, pictures, and more info on the relationship (maybe even the affidavit of support I-134) as we didn't include anything except the I-129f and G325a forms. I'm hoping by adding this info to our petition it would help bypass an RFE and take us straight to NOA2 - but don't want to screw things up by adding any confusion and difficulty for VSC. Fingers crossed and wishful thinking.

I'm looking forward to reading the responses.

K-1 cannot take a job until getting EAD or Green-card, this can take MONTHS after arrival
K-1 cannot get a DL until they have EAD or Green-card, can use foreign DL in most states though.
K-1 becomes land locked and cannot travel out of the USA until having green-card or AP doc, which can take MONTHS to get.

CR-1 (FEES ~$900)
CR-1 gets green-card the moment they arrive in the USA so can take a job immediately
CR-1 gets green-card so can apply for a DL
CR-1 gets green-card so can immediately travel, conceivable the next day, passport is stamped I-551 which allows work and travel

CR-1 does not take much longer to get than a K-1

The security markings actual are there to show you have the original in your possession, if it were some sort of forgery then then markings would not be on the forgery, USCIS would probably question the validity of your copy if the "VOID" markings were not in the copy.

Fine, mine did too, not a problem with USCIS. B&W copy, same happened with marriage cert later.

They understand security markings.
